The Hong Kong Policy Act of 1992 (P.L. 102-383) states, “Support for democratization is a fundamental principle of United States foreign policy. As such, it naturally applies to United States policy toward Hong Kong. This will remain equally true after June 30, 1997” (the date of Hong Kong’s reversion to China). The Omnibus Appropriations Act of 2009 (P.L. 111-8) provides at least $17 million for “the promotion of democracy in the People’s Republic of China, Hong Kong, and Taiwan …” The democratization of Hong Kong is also enshrined in the Basic Law, Hong Kong’s quasi- constitution that was passed by China’s National People’s Congress (NPC) prior to China’s resumption of sovereignty over the ex-British colony on July 1, 1997. The Basic Law stipulates that the “ultimate aim” is the selection of Hong Kong’s Chief Executive and the members of its Legislative Council (Legco) by “universal suffrage.” However, it does not designate a specific date by which this goal is to be achieved. On November 18, 2009, Hong Kong Chief Executive Donald Tsang Yam-kuen released the long- awaited “consultation document” on possible reforms for the city’s elections to be held in 2012. -

Commercial broadcaster, as a proprietary organization, is believed to emphasize on maximizing the profit while the public broadcaster, without commercial considerations, is usually expected to achieve some objectives or goals instead of making profits. Therefore, the contribution by public broadcaster to the society is usually expected to be different from those by commercial broadcaster. However, the public broadcasters are in crisis around the world because of their unclear role in actual practice. Many politicians claim that they cannot find any difference between the public broadcasters and the commercial broadcasters and thus they asserted to cut the budget of public broadcasters or even privatize all public broadcasters. Having this unstable situation of the public broadcasting, the role or performance of the public broadcasters in actual practice has drawn much attention from both policy-makers and scholars. Empirical studies are divergent on whether there is difference between public and commercial broadcaster in actual practice. -

THE BASIC LAW AND DEMOCRATIZATION IN HONG KONG Michael C. Davist I. Introduction Hong Kong's status as a Special Administrative Region of China has placed it on the foreign policy radar of most countries having relations with China and interests in Asia. This interest in Hong Kong has encouraged considerable inter- est in Hong Kong's founding documents and their interpretation. Hong Kong's constitution, the Hong Kong Basic Law ("Basic Law"), has sparked a number of debates over democratization and its pace. It is generally understood that greater democratization will mean greater autonomy and vice versa, less democracy means more control by Beijing. For this reason there is considerable interest in the politics of interpreting Hong Kong's Basic Law across the political spectrum in Hong Kong, in Beijing and in many foreign capitals. -

HONG KONG'S ENDGAME AND THE RULE OF LAW (II): THE BATTLE OVER "THE PEOPLE" AND THE BUSINESS COMMUNITY IN THE TRANSITION TO CHINESE RULE JACQUES DELISLE* & KEVIN P. LANE- 1. INTRODUCTION Transitional Hong Kong's endgame formally came to a close with the territory's reversion to Chinese rule on July 1, 1997. How- ever, a legal and institutional order and a "rule of law" for Chi- nese-ruled Hong Kong remain works in progress. They will surely bear the mark of the conflicts that dominated the final years pre- ceding Hong Kong's legal transition from British colony to Chinese Special Administrative Region ("S.A.R."). Those endgame conflicts reflected a struggle among adherents to rival conceptions of a rule of law and a set of laws and institutions that would be adequate and acceptable for Hong Kong. They unfolded in large part through battles over the attitudes and allegiance of "the Hong Kong people" and Hong Kong's business community. A concluding chapter suggests some possible means of resolving or minimising the difficulties which have been experienced. IN HONG KONG Ian Scott is Emeritus Professor of Government and Politics at Murdoch University in Perth, Australia and Adjunct Professor in the Department of Public and Social Administration at the City University of Hong Kong. He taught at the University of Hong Kong between 1976 and 1995 and was Chair Professor of Politics and Public Administration between 1990 and 1995. Between 1995 and 2002, he was Chair Professor of Government and Politics at Murdoch University. Jordan* Introduction Hong Kong's common law legal system will not survive the 1997 transfer of sovereignty to China intact. It will slowly be transformed into a capitalist common law/socialist civil law system, tempered by political realities rather than forged by a coherent set of legal principles. The formal source of the conflict is the Basic Law,' a Chinese state-level law written by main- land Chinese scholars and officials with input from Hong Kong officials. The Basic Law is the national expression of China's promises contained in the Joint Declaration,2 the 1984 agreement whereby Britain transfers sover- eignty over Hong Kong to China. -

WANG_2.9.21 2/10/2021 1:03 PM HONG KONG’S CIVIL DISOBEDIENCE UNDER CHINA’S AUTHORITARIANISM Shucheng Wang∗ ABSTRACT Acts of civil disobedience have significantly impacted Hong Kong’s liberal constitutional order, existing as it does under China’s authoritarian governance. Existing theories of civil disobedience have primarily paid attention to the situations of liberal democracies but find it difficult to explain the unique case of the semi-democracy of Hong Kong. Based on a descriptive analysis of the practice of civil disobedience in Hong Kong, taking the Occupy Central Movement (OCM) of 2014 and the Anti-Extradition Law Amendment Bill (Anti-ELAB) movement of 2019 as examples, this Article explores the extent to which and how civil disobedience can be justified in Hong Kong’s rule of law- based order under China’s authoritarian system, and further aims to develop a conditional theory of civil disobedience for Hong Kong that goes beyond traditional liberal accounts. -

CHAPTER 6 HONG KONG Key Findings • The Hong Kong government’s proposal of a bill that would allow for extraditions to mainland China sparked the territory’s worst political crisis since its 1997 handover to the Mainland from the United Kingdom. China’s encroachment on Hong Kong’s auton- omy and its suppression of prodemocracy voices in recent years have fueled opposition, with many protesters now seeing the current demonstrations as Hong Kong’s last stand to preserve its freedoms. Protesters voiced five demands: (1) formal with- drawal of the bill; (2) establishing an independent inquiry into police brutality; (3) removing the designation of the protests as “riots;” (4) releasing all those arrested during the movement; and (5) instituting universal suffrage. • After unprecedented protests against the extradition bill, Hong Kong Chief Executive Carrie Lam suspended the measure in June 2019, dealing a blow to Beijing which had backed the legislation and crippling her political agenda. Her promise in September to formally withdraw the bill came after months of protests and escalation by the Hong Kong police seeking to quell demonstrations. The Hong Kong police used increasingly aggressive tactics against protesters, resulting in calls for an independent inquiry into police abuses. • Despite millions of demonstrators—spanning ages, religions, and professions—taking to the streets in largely peaceful pro- test, the Lam Administration continues to align itself with Bei- jing and only conceded to one of the five protester demands. In an attempt to conflate the bolder actions of a few with the largely peaceful protests, Chinese officials have compared the movement to “terrorism” and a “color revolution,” and have im- plicitly threatened to deploy its security forces from outside Hong Kong to suppress the demonstrations. -
