Activity Operations Support

Description Licensees providing outsource services to Clients for office operations functions.

Objective Assist Clients in sourcing office operations support.

Requirements 1. Compliance with the Licensing Regulations 2003 and Licensing Categories Decision, as amended.

2. Compliance with the Employment Regulations 2004.

Permissible Permissible activities shall only and strictly include the following: Activities To provide services to Clients for office operations support not covered under existing activities of the Outsource segment.

Non-permissible Non-permissible activities shall include but shall not be limited to the following: activities 1. Providing the services outside the Creative Clusters.

2. Providing the services through any employee of the Licensee earning less than UAE Dirham Five Thousand (AED 5,000) per month.

3. Providing the services without submitting to the Authority a written agreement between the Licensee and the Client for the services.

4. Providing recruitment or training services.

Special Conditions 1. The Licensee must also be licensed to conduct Executive Search activities in the Dubai Creative Clusters. 2. All Licensees employees providing the services shall be considered as employees of the Licensee (including, without limitation, for purposes of responsibility for payment of remuneration). 3. The Licensee’s employees shall not enter into any type of service or employment agreement with the Client. 4. The Licensee shall maintain personal records for all its employees. 5. The Licensee shall submit an employment contract between the Licensee and each of its employees prior to obtaining the ID card issued by the Authority. 6. The Licensee shall not allow any employee with remuneration of less than UAE Dirham Five Thousand (AED 5,000) per month to provide the services. 7. The Licensee shall submit - proof of the electronic transfer of salary to the individual employees account each month by the 5th of the following month, OR Enrol for a custom-made Wage Protection System (WPS), with any Banks or Money Exchanges, who are authorized to conduct WPS for the licensee; 8. A Bank Guarantee covering one month’s salary

Violation of the 1. Any violation of these Guidelines will subject the Licensee or the Client to Guidelines penalties as shall be imposed by the Authority, including suspension and subsequent cancellation of their licenses as provided for in the Licensing Regulations 2003.

2. The Authority reserves the right to call on the bank guarantee amount in case of persistent breaches by the Licensee.

3. The Authority may impose a penalty of UAE Dirham Ten Thousand (AED 10,000) upon non-submission of the proof of payment for the concerned month by the 5th of the following month, in addition to other sanctions and penalties that the Authority may impose pursuant to the Licensing Regulations.

Definitions For the purposes of these Guidelines, the following defined terms shall have the meaning assigned to them below:

Authority: The Dubai Creative Clusters Authority (“DCCA”); For the avoidance of doubt, any reference to Dubai Technology & Media Free Zone Authority (“DTMFZA”) shall mean the Dubai Creative Clusters Authority (“DCCA”)

Licensee: A company having obtained a license under the activity that is the subject of these Guidelines, of the Licensing Categories Decision and pursuant to Licensing Regulations 2003;

Licensing The Dubai Technology and Media Free Zone Authority Decision Categories concerning Licensing Categories for Dubai Internet City, Dubai Media Decision: City, Dubai Knowledge Village, Dubai International Academic City, Dubai Outsource Zone, International Media Production Zone, , Dubai Biotechnology and Research Park & Energy and Environment Park as amended;

Licensing The Dubai Technology and Media Free Zone Licensing Regulations Regulations 2003, as amended; 2003:

Employment The Dubai Technology and Media Free Zone Employment Regulations Regulations 2004, as amended; 2004:

Client: Companies registered and licensed by the Dubai Creative Clusters Authority and operating in the Dubai Creative Clusters.

Dubai Creative The free zone created by the Law No. 1 of 2000 and the zones Clusters: annexed by the Decree No. 12 of 2011, the Decree No. 4 of 2013 and the Decree No. 22 of 2013 as repealed by Law No. 15 of 2014 creating the Dubai Creative Clusters Authority.
