It serves to provide an overview of the Proposed Desludging and Lining of Dam 02 within the Northern Wastewater Treatment Works (WwTW); 2. It provides an outline of the Basic Assessment (BA) and Water Use Licence Application (WULA) Processes that will be undertaken for the project; and 3. It grants the opportunity to be registered as an Interested and Affected Party (IAP) and allows for comments to be made on the proposed project (refer to attached Reply Form in (Annexure 1). 2 PROJECT OVERVIEW 2.1 Project Background A Record of Decision (RoD) was obtained in 2007 and amended in 2008 for the desludging of Dam 01 at Northern WwTW. The RoD for the desludging of Dam 01 included the following condition: “Recording and Reporting to the Department 1.24 Johannesburg Water must submit a future plan for dam 2 (two). The plan must indicate what Johannesburg Water intends to do with the dam in future.” In response to the above condition, Johannesburg Water (JW) intend to desludge and line Dam 02. The procedure of desludging Dam 02 envisaged at this stage, and to be confirmed during design stage, is as follows: 1. Remove and dewater the accumulated sewage sludge from Dam 02. The approximate volume of the dam itself is 120 000m3, while the volume of sludge is uncertain but is estimated to be about 70% of the dam i.e. 84 000m3 and place on a disposal area by the Contractor. It is assumed that the dewatered sludge will be transported from the disposal area to farmlands by JW contractor along with existing works sludge provided the sludge quality is of an acceptable quality; 2. Shape the edge and floor of the Dam and construct layer works. Install under-drainage pipes and pumps; and 3. Install liner to the Dam. Page 1 August 2019 Proposed Desludging and Lining of Dam 02 within the Northern WwTW Background Information Document 2.2 Project Location The proposed activity will take place within the boundary of the existing Northern WwTW within the City of Johannesburg, Gauteng Province (Figure 1). The Northern WwTW is accessible via School Road in Diepsloot. The residential area of Dainfern is located approximately 3km south of the Works, and the settlement of Diepsloot lies to the north-east of the site. The site is approximately 8km north of Fourways intersection and west of the R511 road. The Jukskei River flows along the southern boundary of the Northern WwTW towards the Hartebeestpoort Dam in the north. A new residential area, Steyn City, is located on the southern boundary. The Northern WwTW falls within a rural area. Page 2 August 2019 Proposed Desludging and Lining of Dam 02 within the Northern WwTW Background Information Document Figure 1: Locality Map Page 3 August 2019 Proposed Desludging and Lining of Dam 02 within the Northern WwTW Background Information Document 3 ENVIRONMENTAL LEGAL FRAMEWORK 3.1 Basic Assessment (BA) Process Nemai Consulting has been appointed by Knight Piésold (Pty) Ltd on behalf of Johannesburg Water (JW) as the independent Environmental Assessment Practitioner (EAP) to undertake the BA Process for the Proposed Desludging and Lining of Dam 02 in the Northern WwTW in terms of the Environmental Impact Assessment (EIA) Regulations of 2014 (as amended on 07 April 2017), published in Government Notice (GN) No. R982 in terms of the National Environmental Management Act (Act No. 107 of 1998) (NEMA). The proposed project requires Environmental Authorisation in terms of the EIA Regulations of 2014 (as amended), that were promulgated in terms of NEMA, from the Competent Authority, i.e. the Gauteng Department of Agriculture and Rural Development (GDARD). Activities listed in GN No. R. 983 of the amended 2014 EIA Regulations (07 April 2017) are associated with the proposed development, which therefore triggers a BA Process. The purpose of the BA Process is to identify and evaluate potential impacts, to recommend measures to avoid or reduce negative impacts and to enhance positive impacts. As part of the BA Process, a Basic Assessment Report (BAR) will be compiled which will contain details of the assessment conducted, all comments from IAPs, potential impacts that have been identified and the associated proposed mitigation measures. A draft copy of the BAR will be made available for public review, prior to finalisation and submission of the BAR to GDARD. Only registered IAPs will continue to be notified of the BA Process as it unfolds. 3.2 Water Use License Application (WULA) Further notice is hereby given in terms of the National Water Act (Act No. 36 of 1998) (NWA) to lodge a WULA as the proposed development will take place within a non-perennial watercourse. This triggers the following water uses in terms of NWA: • Section 21 (c) – Impeding of diverting the flow of water in a water course; and • Section 21 (i) – Altering the bed, banks, course or characteristics of a watercourse. A WULA is thus required to be undertaken in order to obtain a Water Use License (WUL) from the Department of Human Settlements, Water and Sanitation (DHSWS). Page 4 August 2019 Proposed Desludging and Lining of Dam 02 within the Northern WwTW Background Information Document 4 PUBLIC PARTICIPATION A Public Participation Process will be conducted in terms of Chapter 6 of GN No. R982 of the 2014 EIA Regulations (as amended on 07 April 2017) of the NEMA. The Public Participation Process will involve the following: • Site notices will be erected at prominent points around the Northern WwTW to inform IAPs in the area; • BIDs will be distributed to adjacent landowners of the Northern WwTW; • BIDs will be distributed to the identified interest groups in the area for the project; • Notices regarding the project will be e-mailed or faxed to the ward councillor(s) in the area and stakeholders (including authorities and state departments); and • Notices will be placed in a local newspaper. This BID serves to notify all IAPs of the proposed development. IAPs are encouraged to register for the project in order to participate in the BA and WULA Processes and for any concerns to be addressed. Only registered IAPs will continue to be notified as the BA and WULA Processes unfold, such as dates of public meetings, if organised, and review periods. The closing date to register as an IAP is the 27 September 2019.
