Conditions of Sale Before bidding, all prospective purchasers should carefully read the Conditions of Sale of this catalogue and be registered by completing a Bidder Registration Form. 2. Payment of Lots Purchased Payment shall be made on the day of purchase by cash or cheque made payable to Greyhound Racing SA or GRSA. Any interested purchasers requiring credit, must contact Sarah Webster at GRSA on (08) 8243 7100. Credit applications will be accepted no later than close of business Friday, 20th October,2017. 3. All Purchasers please note the GST registration status of the Vendor on each pedigree page in the catalogue. Where a Vendor is registered for GST, GST is inclusive in the sale price. 4. Announcements To avoid making costly errors, please pay close attention to all announcements made by the Auctioneer, especially concerning greyhounds on which you intend to bid. 5. Acknowledgement to Purchase After making the final bid on a greyhound, you will be asked to complete and sign the Official Greyhound Sale Form. 6. Cataloguing All greyhounds in this Sale have been catalogued on the basis of their salability. There is no warranty given or implied by the Auctioneer or Vendor as to the soundness or fitness for a particular purpose of any greyhound offered for sale in this Auction. 7. Pre-Sale Inspection of Lots Act in your own interest by inspecting all Lots prior to purchase. Vendor’s approval must be obtained before a veterinary inspection is made. 8. Release of Greyhounds In order to move a greyhound from the Sales Complex, you must obtain a release slip from the Racing Office which is to be presented to the officials on duty. Naming papers (excluding Victorian bred) will be handed to the purchaser on completion of payment. 9. Care of Pups Should suitable kennelling and care not be declared through prior arrangement, the Auctioneer has the right to appoint a carer of the purchased Lot(s) with all costs of transport and care being billed to the purchaser at current kennelling market rates. 10. Race Series’ and special exemptions A major race series from the 2017 Industry Puppy Auction will be conducted in June 2019 on dates to be determined. There will also be a minor race series over 388m in May with the Heats and Final at Wednesday meetings and a 515m series in July with Heats on a Wednesday and Final on a Thursday (days subject to change). A written nomination form must be lodged with GRSA prior to the meeting closing date for the heats of the series (closing time for nominations for the race to be advised at a later date). It is the purchaser’s responsibility to notify GRSA in writing of change of ownership or change of address. GRSA will not be held responsible for any problems arising from failure to do so. Heats (as many as required) will be conducted for all series’. All lots sold on the day of the sale are eligible for the race series’ in 2019. Prizemoney The prizemoney for the major series Heats will be as per the normal Thursday night Special Event prizemoney levels. The prizemoney for the winner of the Final will be $16,000. The prizemoney for the minor race series’ will be normal budged prizemoney for the meetings. Bonuses The following bonuses will be distributed to the nominator of each of the placegetters in the major series Final: 1st- $3,500, 2nd-$2,500, 3rd- $1,500. Special exemptions Non SA Bred greyhounds sold via the Auction will become eligible to receive the grading exemption in relation to Grade 6, as if they were SA Bred greyhounds. 11. To be eligible for the race series’ and special exemption linked to this Auction, the commission paid shall be 11% of the sale price or reserve price. 12. The auction will be a ‘reserve’ auction with a $500 minimum bid. If there is no bid, the lot will be passed in and the commission paid on the reserve price which will be due and payable for the greyhound to be eligible for the race series’ and special exemptions. Auction Commences at 12 noon Sunday, 29th October. Inspections from 10.30am CONDITIONS OF SALE 1. In these conditions: “Auctioneer” means and refers to Greyhound Racing SA Ltd. “Auctioneer’s premises” means and refers to the Greyhound Racing Complex at Angle Park. “Lot” means and refers to an animal entered for the Sale the subject of this catalogue or any other catalogue supplementary thereto. “Purchaser” means the person, corporation or corporations to whom a Lot is knocked down upon the sale thereof by auction or to whom a Lot is sold after such auction by the Auctioneer. “Purchaser” or “person” includes a body corporate. “Singular” / “Gender” every word in the singular number shall be construed as including the plural number and every word in the plural number shall be construed as including the singular number. Every word of the masculine gender shall be construed as including the feminine gender and every word of the feminine gender shall be construed as including the masculine gender. “Vendor” means the person or corporation on whose behalf a Lot is offered for sale. 2. Auction conduct 2.1 The auction will be a ‘reserve’ auction with a $500 minimum bid. If there is no bid, the lot will be passed in and commission paid on the reservice price will be due and payable. 2.2 If the vendor does not wish to pay the commission, the greyhound will not be eligible to compete in the race series or be eligible to receive the exemptions in regards to Grade 6. 2.3 A bid cannot be made or accepted after the fall of the hammer unless the auctioneer decides to put the lot up again as a result of a disputed or void sale. 2.4 The last price called by the auctioneer at the fall of the hammer shall be the amount at which the lot has been sold. 2.5 In the event of a disputed bid, the auctioneer is the sole arbitrator of the successful bidder or the auctioneer may decide to put the lot up again. 2.6 The auctioneer may refuse to accept a bid which, in the auctioneer’s opinion, is not in the best interests of the vendor and need not give reasons for doing so. 2.7 A bidder shall be deemed to be a principal unless, prior to bidding, the bidder has given to the auctioneer a copy of written authority to bid for or on behalf of another person. 2.8 The successful bidder at the auction sale must give to the auctioneer at the fall of the hammer the purchaser’s name or the bid card number which identifies the purchaser, or the name of the person on whose behalf the successful bid was made. 2.9 As soon as practicable after the fall of the hammer, the buyer shall if requested by the agent, sign the agreement for sale. 2.10 If the purchaser fails to comply with any of these conditions, the lot or lots in respect of which such failure is made, may, if the auctioneer thinks fit, be put up again and resold. If upon such resale a lower price is obtained for any such lots than was obtained upon the first sale the difference in price shall be a debt due from the purchaser in default upon the first sale. 2.11 A vendor is bound by these terms and conditions by offering a greyhound for sale by Auction. 2.12 An agent (which includes an auctioneer) is bound by these terms and conditions by conducting an auction sale. 2.13 A buyer is bound by these terms and conditions by bidding at auction. 2.14 Only registered owners can bid on a greyhound. 2.15 Buyers will be given a registration number to bid with. Bidders must raise their hand to bid for a greyhound. No further bids will be taken after the fall of the hammer. 2.16 Any person who advances a bid on the lot shall do so on the express condition and understanding that should that person’s bid be the highest bid and such bid accepted by the vendor then that person will be held personally liable for the price so agreed upon, regardless of the fact that they may be acting on behalf of another party, either disclosed or undisclosed to the vendor or his agents, provided however, that this condition shall not in any way negate the vendor’s right to claim against any principal and in such case the bidders liability shall be constructed to be by way of guarantee. 2.17 Should any dispute arise between two or more parties the auctioneer shall adjudicate the dispute and his decision shall be final and binding. 3. Presentation of greyhounds 3.1 All greyhounds accepted for the Auction must be kenneled on the day of the Auction by the times provided by the Club.
