The development of Russian criminal and penal legislation, considering the humanization of the State’s criminal policy, leads to the emergence of new mechanisms for the humanization of criminal punishment and criminal responsibility itself. Many of them are of great scientific interest, such as the exemption from criminal liability with the imposition of a judicial fine. The authors examine the legal framework, the procedural order to apply this mechanism, the problems that arise in the courts that apply it in practice, the opinions of legal experts on its essence and the problems that arise in relation to its application. Methodologically, it is a documentary investigation close to legal hermeneutics. By way of conclusion, the results contain various provisions that clarify the place of this legal and procedural mechanism for exemption from criminal liability, among other mechanisms used for the same purpose. The authors make several notable proposals to improve the regulatory framework of the mechanism under study, which eliminates several identified problems associated with its use. * Doctor of law. Aplicación de las Reglas sobre la exención de responsabilidad penal con la imposición de una multa judicial: problemas, características y experiencia Resumen Este artículo examina el marco legal y los aspectos prácticos del uso de la exención de responsabilidad penal con la imposición de una multa judicial. El desarrollo de la legislación penal y penal rusa, considerando la humanización de la política criminal del Estado, lleva a la aparición de nuevos mecanismos para la humanización del castigo penal y la responsabilidad penal propiamente dicha. Muchos de ellos son de gran interés científico, como la exención de responsabilidad penal con la imposición de una multa judicial. Los autores examinan el marco legal, el orden procesal para aplicar este mecanismo, los problemas que surgen en los tribunales que lo aplican en la práctica, las opiniones de los expertos legales sobre su esencia y los problemas que surgen en relación con su aplicación. En lo metodológico se trata de una investigación documental cercana a la hermenéutica jurídica. A modo de conclusión los resultados contienen varias disposiciones que aclaran el lugar de este mecanismo legal y procesal de exención de responsabilidad penal, entre otros mecanismos utilizados para el mismo propósito. Los autores hacen varias propuestas notables para mejorar el marco regulatorio del mecanismo en estudio, que eliminan varios problemas identificados asociados con su uso. Introduction Federal Law of July 3, 2016, No. 323-FL supplemented the Criminal Code of the Russian Federation (2016) with another portion of stories testifying to the state’s steady adherence to the policy of humanization and liberalization of the criminal legislation of the Russian Federation. The updating of criminal and criminally-remedial legislation arose scientific and practical interest among legal scientists and practitioners. Scientific works appeared that made a certain contribution to the development of the science of criminal law and law enforcement practice. The Legislative Code of Criminal Procedure did not remain without the attention of the legislator.

The article aims to present social ties of the Republic of Bashkortostan based on voice cell phone data, which covers 12 million calls from and to the region during the first five days of March 2020. About 96% of calls are made within the republic and only 4% of them are interregional. The people of the Republic of Bashkortostan have close connections with those who live in neighboring regions (Orenburg, Sverdlovsk oblast, the Republic of Tatarstan and especially Chelyabinsk oblast). Being a part of the Ural Economic Region, the Volga Federal District and Volga-Ural Macro Region, the republic has turned mostly towards Ural regions. We also found that the republic has close social ties with Moscow and Moscow region, St. Petersburg and Leningrad oblast, as well as Krasnodar kray, Samara oblast and two Autonomous Districts: Khanty-Mansi and Yamalo-Nenets. We estimated the number of persons who possessed Bashkir SIM-card and were outside the republic during the research period – 183 thousand; the most of them were in the abovementioned regions. While conversation between residents lasts 50 seconds, which is among the smallest values, the calls to and from republics of Altai, Tyva, Khakassia, Sakha and Magadan oblast are 5-8 times longer.

Oktyabrskoj revoljucii, 3-a, Ufa, RB, the Russian Federation, [email protected] Abstract The features of the accumulation of heavy metals in the organs of the birch (Betula pendula Roth) which growing on industrial dumps within the Republic of Bashkortostan were studied. The studied birch stands grow on the dumps of the copper-pyrite deposits of the Sibay branch of the Uchaly mining and processing plant and the Uchaly mining and processing plant. The content of copper, zinc, cadmium, manganese, cadmium, strontium, iron, nickel, chromium and lead was determined. Analyzes were carried out on an ICP-MS (Plasma quad pq2-turbo plus, Usa) installation using inductively coupled plasma mass spectrometry. The content of heavy metals was determined in the vegetative organs (leaves), in the shoots, in the bark and in the root system of birch.

The article presents the results of a study of the social and environmental problems of a small town with a developed mining industry. The authors have tested the methodology for assessing social and ecological tension for the city of Sibay in the Republic of Bashkortostan based on the approaches by I.A. Sosunov for the regions of Russia. The key indicators of the analysis were the data of official information on the socio-economic and ecological state, a sociological survey and a comprehensive assessment of the state of the environment. As a result, the index of social and ecological tension of the city was calculated in the context of settlements: Gorny (3.7) - Yuzhny (3.2) - city center (2.7) - Zoloto (2.6) - Vostochny (2.4) - Dom Rybaka (2.3) - Arkaim (1.6). The use of the category of social and environmental tension in the proposed interpretation allows for a comprehensive analysis of the urbanized territories of the mining region, which determine its environmental safety and sustainable development, their ranking, and also development of a set of economically justified measures to be included in the programs of the strategic development of the region.
