Babiskin* INTRODUCTION For the second time ever, the Supreme Court addressed the affirmative defense of fair use to copyright infringement in the context of parody in Campbell v. Acuff-Rose Music, Inc. ~ The unanimous opinion found a parody rap version of Roy Orbison's song "Oh, Pretty Woman" by the group 2 Live Crew could be a fair use within the exceptions to the protections of the Copyright Act of 1976. 2 The fair use defense is an inconsistent and confusing area that has been called "the most trouble- some [issue] in the whole law of copyright. "3 The Campbell decision helps preserve the flexible, case-by-case analysis intended by Congress and recognizes the value of parody both as a form of social criticism and catalyst in literature. The decision affords wide latitude to parodists, emphasizing the irrelevance of the judge's personal view of whether the parody is offensive or distasteful. It is unclear whether future courts will interpret this holding to be limited to fair use of parody in the context of song, or whether they will construe it more broadly to confer substantial freedom to parodists of all media. It is also unclear what effect this decision will have on the music industry's practice of digital sampling. This article will review the historical background of fair use in the context of parody and the case law preceding the Supreme Court's decision. A detailed discussion of the lower courts' decisions will be followed by analysis of the Supreme Court's decision and its implications for the future.

But we were certain about Roy Orbison. The first time I contacted a case of the Orbies was upon the demise of my first relationship in junior high school. She implied it was over by taking a pair of pliers to a dime-store ring with a design of a knight in shining armor. I would sleep with the transistor radio under the pillow; that night WLS played "Only the Lonely." The message was clear. I was not alone. At the second annual induction dinner for the Rock 'n' Roll Hall of Fame in January, Bruce Springsteen introduced Orbison by explaining, "In '74, just prior to going in the studio to make `Born To Run,' I was looking at Duane Eddy for his guitar sound and I was listening to a collection of Phil Spector records and I was listening to `Roy Orbison's All-Time Greatest Hits.' I'd lay in bed at night with just the lights of my stereo on and I'd hear `Crying,' `Love Hurts,' `Running Scared,' `Only the Lonely' and `It's Over' fillin' the room. "Some rock 'n' roll reinforces friendship and community, but for me, Roy's ballads were always best when you were alone and in the dark." I read that quote to Orbison during a recent conversation we had at his home here and asked him where he reached for a style that is isolated yet so personal.

BURR* In Living Color, the television show, produces a parody called Am I Black or White?1 of Michael Jackson's video and song Black and White.' Michael Jackson's song, with its theme that "it makes no difference whether you're black or white," observes American soci- ety as color-blind. The In Living Color sketch pokes fun at Michael Jackson's naivete and perceived identity crisis. At the end of Am I Black or White?, the lead character destroys a car with a baseball bat, and then is arrested by white police officers and carried away as he mumbles "I must be black." Michael Jackson does not sue.
