The facts charged against the defendant were harboring and boarding colored persons, not inhabitants of the State of Connecticut, in violation of the act of the last Session of the General Assembly. Plea — Not Guilty. ORDER AND RULING ON DEFENDANTS’ MOTION TO DISMISS This case arises from the State of Connecticut’s arrest and prosecution of the pro se plaintiff, Harold Turner, after he published to his website commentary denouncing two Connecticut legislators for their purported role in “infringing on the constitutional rights” of the Catholic Church and encouraging his readership to “take up arms” and “put down by force” those legislators. Turner was prosecuted for several crimes under Connecticut law and ultimately acquitted. After his acquittal, Turner filed with the U.S. District Court for the District of New Jersey a complaint against eight Connecticut state employees asserting six types of claims: (1) conspiracy to deprive Turner of his constitutional rights, in violation of 42 U.S.C. §§ 1983 and 1985; (2) criminal conspiracy to deprive Turner of his constitutional rights, in violation of 18 U.S.C. § 242; (3) malicious prosecution; (4) common law malicious prosecution; and (5) tortious1 interference with business relations. Annulment of Marriage - Decree Entitled to Full Faith and Credit. By traditional legal doctrine, a marriage creates a status which, viewed as a res, has its situs at the domicile ofthe married parties. Under this theory, a divorce action to terminate a status-res is considered an action in rem which must be brought at the situs, that is, the domicile. If a divorce is granted by a state where at least one of the parties to the marriage is domiciled, the decree is valid and entitled to full faith and credit everywhere. 1 Jurisdiction to grant annulments has followed an analogous, but somewhat different course. An annulment differs concep­ tually from a divorce in that a divor~e terminates a legal status, whereas an annulment establishes that a marital status never existed. The absence of a valid marriage precludes strict reliance on divorce cases in formu­ lating jurisdictional grounds in annulment actions, for no res or status can be found within the state.2 The courts, however, have recognized a state's interest in providing a forum for annulment actions, and state practice has evolved a multiple jurisdictional basis which has been en­ dorsed by the Second Restatement.

It is brought pursuant to the provisions of the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§1346(b) and common law tenets concerning negligence. Giannaccio’s wife, Alene Giannaccio (“Alene”) alleges loss of consortium as a result of the harms and losses sustained by Giannaccio. The defendant has filed a motion for summary judgment pursuant to Fed. R. Civ. P. 56. The issues presented are: (1) whether the independent contract exception under the FTCA precludes this action; (2) whether the discretionary function exception under the FTCA insulates the United States from liability in this action; (3) whether the United States had notice of the alleged dangerous condition; and (4) whether the statute of repose within Conn.
