A newspaper exposé written by British journalist W.T. Stead, “The Maiden Tribute of Modern Babylon” sounds just like the sordid sex ring of Jeffrey Epstein, who died of an apparent sui- cide in prison on Aug. 10. The difference is that Stead’s account appeared over a centu- ry ago, in London’s Pall Mall Gazette in the summer of 1885. In the four-part series, investigative journalist W.T. Stead graphically detailed the ways that wealthy Victorian men pro- cured young girls for sex. Ironically, Stead was the only one who ended up in jail.

Lured by the promise of a better life On July 6, 1885, the first article in Stead’s exposé was pub- lished. Stead revealed how thousands of girls, most of whom were between 13 and 15 years old, were bought for sex by prominent London men, including a “well-known member of Parliament,” a cabinet minister, a doctor and a clergyman who obtained a 12-year old virgin for £20. As soon as it hit London’s newsstands, the story went viral. Stead already had a reputation as a fearless editor who advocat- ed “Government by Journalism” and didn’t shy from sensation- alism. The Gazette’s reporting was front-page news in the U.S., with covering the scandal and the reaction by English authorities. Instead of working to swiftly shut down the illicit sex trade and identify those involved, London’s city solicitor ordered police to seize copies of the Gazette and to arrest vendors for selling copies of the paper. Despite — or because of — the attempted censorship, copies sold well above their cover price. Thousands waited outside newspaper offices for their chance to buy each new installment. Those who could get their hands on a copy learned about how women recruited young girls, and how the authorities who knew about it failed to intervene. Stead interviewed women who explained how they enticed girls to enter the homes of wealthy men with promises of meals, money and jobs. Looking out for “pretty girls who are poor,” brothel keepers and professional procurers recruited orphans, shop girls, servants and nursemaids to “visit” gentlemen. “The police knew all about them long ago,” Stead added, not- ing that officers were discouraged from pursuing leads, while prosecutors intimidated potential witnesses. Stead interviewed some of the men who paid for the girls. They assured him that the maidens willingly – sometimes ea- gerly – consented. APPEAL TOO LATE TO STOP FORECLOSURE Appellate Division, Second Department The Appellate Division, Second Department affirmed an order concerning the foreclosure of a mortgage from Hon. Lawrence Knipel of Kings County Supreme Court, Civil Term. Mid-Island Mortgage Corp, the alleged successor in interest to the note and mortgage, commenced to foreclose the mort- gage on April 29, 2011 and claimed that Cordella and Kenneth Johnson had defaulted on their $243,000 mortgage. According to the affidavit of service, Cordella was personally served with the summons and complaint by Mid-Island. Cordella’s counsel filed a notice of appearance on May 23, 2011. After that, Cordella failed to interpose an answer or move to dismiss the complaint in the time required by law. Two days before the scheduled foreclosure sale, she moved via order to stay the sale, to vacate the judgment of foreclo- sure and sale, and to dismiss the complaint based on her claim of lack of personal jurisdiction due to improper service. The Supreme Court denied that motion, and the Appellate Division, Second Department affirmed upon Cordella’s appeal. Hon. William Mastro, Hon. Ruth Balkin, Hon. Sheri Roman and Hon. Francesca Connolly agreed that Cordella did not move to dismiss the complaint for lack of personal juris- diction until several years after appearing in the action and after the judgment of foreclosure and sale had been issued. As such, she waived any claim that the Supreme Court lacked personal jurisdiction over her in this action. —Mid-Island Mtge. Corp. v. Johnson, 2017-07886, August 7, 2019 ——— EMERGENCY DOCTRINE MAY NOT APPLY IN BUS FALL INJURY Appellate Division, Second Department The Appellate Division, Second Department reversed a decision from Queens County Supreme Court, Civil Term this week. Liang-Ying Ren was allegedly injured when she fell on a moving bus owned and operated by the Metropolitan Transportation Authority and the New York City Transit Authority. Ren maintained that she fell when the bus entered an intersection with the green light in its favor. At that time, the bus driver slammed on the brakes to avoid impact with a fire truck that was approaching the intersection. The Supreme Court granted the defendant’s motion for summary judgment dismissing the complaint based on the emergency doctrine. Hon. Alan Scheinkman, Hon. Leonard Austin, Hon. Jeffrey Cohen and Hon. Sylvia Hinds-Radix disagreed with the lower court’s ruling. They explained that although the driver testified at her deposition that she heard the firetruck’s siren before she entered the intersection and slowed down, Ren testified that the bus operator was driving “pretty fast” and that there was no change in speed. Therefore, the justices concluded that whether the driver was faced with an emergency situa- tion not of her own making, and whether her actions were reasonable is a triable issue of fact. —Liang-Ying Ren v. Doe, 2018-07876, August 7, 2019 ——— RELATION-BACK DOCTRINE APPLIES IN WRONGFUL DEATH SUIT Appellate Division, Second Department Dr. Makul Arya appealed an order from Hon. Gloria Dabiri of Kings County Supreme Court, Civil Term in the Appellate Division, Second Department last week. That order allowed the representatives of Carmen Otero, now deceased, to add Arya, a third-party defendant, as a direct defendant in a law- suit to collect damages for Otero’s wrongful death at Wyckoff Heights Medical Center. After complaining repeatedly of abdominal pains, Otero was diagnosed with a bowel obstruc- tion and died on May 1, 2009, approximately three weeks after receiving a colonoscopy by Arya and surgery at the med- ical center. Hon. Alan Scheinkman, Hon. Reinaldo Rivera, Hon. Jeffrey Cohen and Hon. Sylvia Hinds-Radix explained that while the statute of limitations to add Arya as a direct defen- dant had expired, the amendment would be allowed if it was established that the relation-back doctrine applied. In order to establish the applicability of the relation-back doctrine, the representatives of the deceased had to demonstrate that all three criteria of the doctrine were met. The justices affirmed the lower court’s decision finding that the claims arose out of the same conduct or event, thus meeting the first criteria, that the second criteria concerning unity of interest was clearly met because all defendant’s worked at the medical center and that the third criteria was met because Arya knew or should have known that, but for a mistake in the initial filing, the action would have been brought against him as well. —Rivera v.
