That Uisce Eireann are obliged to inform the house holder if a lead pipe is present when they are installing the water meter. It is felt that they have a legal and moral obligation due to the health risks associated with lead pipes.

4826. Motion in the name of Councillor Andrew Montague

That the chief executive report who is responsible for trimming the trees at 136a Aulden Grange and make sure that they are trimmed. This situation has been dragging on for over a year when I first put down Question 122 to the NCAC on 2/9/2013. In reply to question 107 on 16th December 2013, the chief executive stated: "Parks and Landscape Services are in communication with the NRA to clarify responsibilities and future maintenance of this open space and associated planting.

4827. Motion in the name of Councillor Micheál MacDonncha

This Area Committee urges City Council management and the Chief Fire Officer to ensure that the lessons of Priory Hall have been fully learned and implemented in fire safety and construction; we view with concern the Government's failure to ensure that this is done by stronger legislation and by increased resources for local authorities for inspections and enforcement, and we urge Government to do so.

That this area committee supports the restoration to the housing allocations list those people from the North Central area who were removed because they joined the RAS scheme.

4829. Motion in the name of Councillor Michael O’Brien

That this area committee calls for an end to the practice of compulsory independent living courses for formally homeless people who have been housed by approved housing bodies.

4830. Motion in the name of Councillor Deirdre Heney

That necessary action be taken have the laneway to the rear of houses 9 to 15 Philipsburg Avenue cleared of rubbish, overgrowth and rubble ets as residents, backing onto this laneway, many of whom are elderly, complain of filth and rat infestation of the lane to the extent they are unable to access the rear of their homes with any ease; and that a full report me made on the matter including what action has been taken to date to resolve this on-going problem.

4831. Motion in the name of Councillor Naoise O’Muirí

That no permanent parking ban be implemented on Dollymount Beach and that full consultation with local representatives, the public and vulnerable beach users takes place prior to any changes to vehicular access.

4832. Motion in the name of Councillor John Lyons

This local area committee believes that due to the severe housing crisis being experienced by thousands of people across the city of Dublin, the provision of social housing must become the top priority of Dublin City Council. The city council must do everything within its power to

ensure that the housing needs of the 16,000 families languishing on the social housing waiting list are met as a matter of the utmost urgency. And so this local area committee believes that the redevelopment project being carried and paid for by Dublin City Council to the apartment complex at Priory Hall presents a great opportunity to address this crisis in a concrete manner: the 185 apartments must be offered to those on the local area's social housing waiting list.

This local area committee demands that the appropriate funding for the Darndale Park Renewal Project be included in Dublin City Council's Budget 2015. The amount of funding to be discussed and decided amongst the local area staff and the various stakeholders involved in the project at October's meeting of the Darndale Park Renewal Project.

That this area committee favours the building of social and affordable housing on available and suitable council owned land banks by means of directly employed council labour over any

4814. Motion in the name of Councillor Deirdre Heney

That the manager please refer to complaint from a local resident who complains about the fact that HGV's., car transporters etc use Collins Avenue as a thru-way from the Malahide road to the Swords road and on to the M1/M50 and make the necessary arrangements to prevent this this type of traffic using this route e.g. direct the HGVs to use the N32, a much wider road than the urban Collins Avenue. Order: Report to Councillor.

This committee recognises the invaluable community resource that is the Darndale/Belcamp Intergrated Childcare Service, otherwise known as the Jigsaw creche, is fully cognisant of the devastating impact its closure would have on the local community, particularly the families that avail of the centre's services and the workers employed there, and demands that the new Minister For Children & Youth Affairs, James Reilly, liaise with the relevant state agencies to secure the €200,000 in funding needed to ensure that the quality childcare this centre provides to two hundred and fifty children each and every day is guaranteed not only for this year but long into the future. A letter outlining this demand from the area committee will be sent to the Minister Department for Children & Youth Affairs as a matter of urgency. Order: Agreed. The Committee agreed that the Jigsaw Action Group attend the September Meeting to give a 10 minute presentation.

That this committee welcomes the Local Authority Construction Initiative for Darndale that will see 35 new homes built in the Buttercup area at a cost of €35 million and supports the demand that a social clause be activated in this instance which would require of the main contractor the following:

(i) To recruit one long term unemployed person from the local Dublin 17 area, directly or through the supply chain, for each €1,000,000 of project value while retaining all current employees of the company;

(ii)To recruit one apprentice from the local Dublin 17 area, directly or through the supply chain, for each €2,000,000 of project value. Order: Agreed

Proposal A request to have the public right of way extinguished over the laneway to the rear of 80-118 Collins Avenue and 25-59 Collins Park, Donnycarney, Dublin 9 was received from residents. The extent of the proposed extinguishment is shown on Drawing No R.M. 26293 (copy attached). The North Central Area Committee at its meeting on 28th April, 2014, agreed to initiate the statutory procedures to extinguish the Public Right of Way over the above area.

Statutory Requirement By public advertisement on 7th May, 2014 representations or objections were invited by 25th June, 2014. No objections were received.

Service Checks A service check was carried out and there were no objections. Public Lighting Services require that one building mounted street light in this laneway is removed at an estimated cost of €350.00. Residents have been advised.

Recommendation I recommend that the Committee approve the extinguishment of the public right of way over the area as shown on Drawing No. R.M. 26293 for consideration later by the City Council.

With reference to the proposed disposal of the Fee Simple interest in the property known as No. 106 Upper Drumcondra Road, Dublin 9

Dublin City Council hold a site at Upper Drumcondra Road in fee simple subject to and with the benefit of a lease to Joseph J. Flanagan dated 22nd July 1927 for a term of 150 years from the 29th September 1926 subject to an annual rent of €63.50 (£50.00).

By way of Indenture of Sub-Lease dated the 16th June 1928 a portion of this site now known as No. 106 Upper Drumcondra Road was sub-leased by Joseph J. Flanagan to Brigid Coghlan for the term of 148 years from the 25th March 1928 subject to a yearly rent of €25.40 (£20.00).

Oisin Nolan Solicitors acting on behalf of Ann Harper, Dervilla Whelan and Paul Casey who claim to hold the sub-lessee’s interest has applied to purchase the fee simple in the premises which is more particularly shown outlined in red on Map Index No.SM-2014-0238-002. The Law Agent has confirmed that the sub-lessee’s have a statutory entitlement to acquire the Council’s fee simple interest therein.

It is proposed to dispose of the fee simple in the premises 106 Upper Drumcondra Road to Ann Harper, Dervilla Whelan and Paul Casey for the sum of five thousand euro and subject to terms and conditions:

1. That the property comprises an area of c. 135m² and is shown outlined red on the attached copy Map Index No. SM-2014-0238-002.

2. That Dublin City Council holds the fee simple Interest in the property.

3. That the site is held under Indenture of a Lease dated 22nd July 1927 to Joseph J Flanagan for a term of 150 years, commencing on 29th September 1926 and subject to a rent of €63.50 per annum.

4. That the purchase price for the fee simple interest shall be the sum of €5,000 (five thousand euro), plus VAT if applicable, to be apportioned between Dublin City Council and the Head Lessee. Price applicable for a period of six months only from the date of this letter.

5. That the portion of the purchase price payable to Dublin City Council shall be the sum of €3,250 (three thousand, two hundred and fifty euro), plus VAT if applicable.

6. That the portion of the purchase price payable to the Head Lessee shall be the sum of €1,750 (one thousand, seven hundred and fifty euro), plus VAT if applicable.

7. That the annual head rent payable shall be reduced by €15.90 per annum as a result of this transaction.

8. That the purchasers shall be prepared to pay any rent, rates and charges outstanding up to and including the date of sale.

9. That the purchasers shall pay the City Council’s professional fees of €800 plus VAT and the legal costs of transfer of €850 plus VAT.

10. That this proposal is subject to the necessary consents and approvals being obtained.

I refer to an item agreed arising from North Central Area Committee Meeting held on 21stJuly, 2014, Ref: 4803, Items for the following meetings : Grass Cutting contract specifications in the North Central Area. Landscape maintenance operations, on soft landscape public open space, including grass cutting is carried out throughout the city by Parks and Landscape Services through a combination of direct labour units and contract. The contract is over a three year period and applies to a range of roadside margins, roadside open space, and public open space which is mapped. The current contract runs for the period of 2013 to 2016 inclusive. The contract is supervised by the supervisory staff of Parks and Landscape Services in each of the service’s administrative districts of which there are three that overlap with the North Central Area. The Landscape Maintenance 2013-2016 contract is designed to achieve a consistently good standard of presentation of contract maintained areas appropriate to the function and use of the open space, and is a performance based contract. With regard to grass mowing it provides for regular mowing operations during the growing season, at a frequency not to require removal of cuttings in order to sustainably maintain the quality of the sward without requiring to add nutrients, or to have additional disposal pressures on landfill facilities, or other disposal facilities. The frequency of such works is on an approximate 14 day cycle (grass margins and roadside open space), and 7day cycle for residential open space and small parks defined. The works include litter picking, mowing and weed control as per maintenance schedule, and inclusive of critical dated, with mowing maximum height 60mm, subject to the type of open space. It is a requirement of the contract that contractors provide tick sheets of completed works which are received and assessed by supervisory staff of Parks and Landscape Services, prior to certification of payment which is ongoing through the period of the contract. Contractors are also required to adhere to a range of statutory regulation including such areas as employment, machinery, welfare health and safety at work. Grass maintenance operations are influenced by growing conditions, ground conditions and weather conditions which can impact specific schedules as it can with the direct labour delivery of such operations, and the impacts are discussed with contractors during the course of the contract. When areas are missed and/or complaints are received, and concerns are raised by the public or public representatives, these issues are brought to the attention of the contractors by this service at the earliest possible time. Should the standards indicated in the contract not be met Parks and Landscape Services can withhold payment until the required standard is achieved. There are a number of contractors employed under the contract of which one is dedicated to that area which forms the current North Central Area.

Report re use of Pavilion in Fairview Park

Dublin City Council developed a changing room pavilion at Fairview Park which has been in use since autumn 2012. The facility has been made available for use by local sports clubs mainly from the north inner city through a sports permit application process on a room to room basis.

There is a charge is for the use of these changing rooms. The charge is a contrbution towards the maintenance and running costs associated with the changing rooms use. Clubs will be charged €200 per room for the 2014/15 season. The current charge does not meet the full costs to run the building. Should all ten rooms be paid for by the current user groups, Dublin City Council will recieve €2,000 from clubs in relation to paying the pavilions bills.

HIGHLIGHTS OF SUMMER 2014

Donnycarney Bike week Event

On Tuesday June 17th Le Cheile Community and Youth centre in Donnycarney played host to a wonderful bike event. Coordinated by DCC staff in partnership with youth workers, local Garda and Juvenile Liaison Officers the event was very successful. The event ran from 3.30 to 6pm and attracted 30 young people and their families. On the day there were numerous events that young and old could participate in such as bicycle limbo, emergency stop, balance tests, slalom courses and a road skills test. Bicycle themed quizzes and puzzles were also present on the day. The opportunity was given for attendees to have their bicycles repaired and to sign up for a bicycle maintenance programme. All young people received a goody bag and a medal for participation while winners of the various events won medals also. A special award went to two girls who remembered to bring their own helmets.

CDYSB Sports Integration Week

60 young people aged 13-15yrs from 7 Youth Projects in the North Central Area took part in the annual CDYSB Sports Integration Week. This week involved planning, organising and delivering 3 days of competition and an away day for all groups to enjoy new friendships made. Over the 4 days the young people took part in league format of competitions in 8 events in 5 venues. The sports included basketball, volleyball, dodgeball, Olympic handball and Athletics events Shot putt, javelin, 80 metre sprint, long jump and 400m relay. Facilities used were Le Cheile, St Monica’s YC, ALSAA Sports Hall and Irishtown Stadium. On the morning of the first day all young people and leaders took part in a number of ice breaker games to allow the groups to get to know each other prior to the competition starting. This helps enormously in setting the tone for the 4 day event and creating an environment focussed on fun and fair play with a healthy competitive edge. The event ran from 11am to 4:30pm each day with teams playing in around robin competition to gather points for winning as well as fair play. On the 4th day all the young people that took part spent the day in Zipit Tibradden where the overall winners and the winners of the Fair Play award were announced. In a very close competition St Monica’s Youth Project was crowned winners for 2014 and Trinity Youth Project took the Fair Play award.

The funding for projects in 2014 was divided into two streams. One stream of funding was designated for local projects and the other for regionally focused projects. On 3rd July the Department announced the allocation nationally for 880 separate projects throughout the country. DUBLIN CITY COUNCIL SWIMMING POOLS The refurbishment to the swimming pool located on Sean McDermott Street, Coolock and Crumlin are near completion, with the final works taking place in the Crumlin Swimming pool. LORD MAYOR 5 ALIVE CHALLENGE UPDATE MAY Following on from last years success of the Lord Mayor 5 Alive Challenge, Lord Mayor Oisín Quinn agreed the initiative was well worth rolling out again in 2014. The Challenge has now finished and the last race was the DCC/BHAA race on the 5th April. Over 140 people completed all five races and the Lord Mayor hosted the reception at the Mansion House on Friday 9th May. Over 140 people attended and received their scroll and medal. Jim Aughney organiser of the Dublin City Marathon and the Race Series in the and Dick Hooper were guest speakers on the night. The programme was evaluated by the coordinator by developing a questionnaire through Survey Monkey, 79 people completed the questionnaire which gave great feedback on the programme and suggestions on how to improve the initiative going forward in 2015. Meeting for Lord Mayor Challenge 2015 taking place in Mansion House on 12th August.

GO FOR LIFE GAMES On Saturday 7th June Age & Opportunity hosted their 3rd annual Go For Life Games and Dublin City Council sent their selected team of 15 ( male & Female) which were chosen from our trial Go for Life games in Cabra Parkside on 30th May to go forward and take part in the games. The team competed against other counties in three games. 1) Flisks 2) Bowling 3) They enjoyed the day were they were provided with refreshments and a hot meal. The older adult groups will continue to play these games going forward into 2015 and compete again in early 2015 to play for Dublin City.

DCSN YOUNG PEOPLES SMALL GRANT SCHEME – JUNE 2014 Over 100 applications were received from various sports clubs operating across the City. A total of 89 clubs were successful in their grant application and each awarded€568.00. Following on from the Grant Applications we will now use this base line data to develop a questionnaire for clubs through Survey Monkey to see what are the needs and supports that clubs are looking for and if we can provide assistance to these clubs through our club development workshops. The Questionnaire will go out to all clubs in September. Next DCSN meeting will take place on 10th September.

BIKE WEEK - 14TH – 22ND JUNE 2014 Following on from the planning stages of the partnership between Dublin City Council Sport & Recreation Section and the Roads & Traffic planning department, a successful roll out of local programmes were delivered by the Sport & Recreation Development Team. A total of 6 programmes were rolled out across the City for people of all ages and abilities, types of programmes delivered were taster bike sessions, Cycle Safe courses, BMX mountain biking and even Track Cycling. One of the programmes provided the children with an amazing opportunity to be part of the International Track Cycling Grand Prix at the Velodrome on Sundrive Road by taking part in their own track cycling race as part of the DCC /Track Cycling Superstars programmes.

DUBLIN CITY SPORT & RECREATION EZINE The Ezine has been created to promote and advertise the programmes & initiatives that the Sport & Recreation Officers continue to plan implement and deliver on the ground. There will be two Ezines per year (1st and 2nd Q) and it will be emailed both internally and externally to all relevant agencies/organisations/National Governing Bodies/Coaches/Clubs & Local Sports Partnership. The Ezine will be used as a tool to highlight and advertise our programmes and to keep all key stakeholders up to date with up and coming programmes and events. The 1st Ezine will be released week commencing 18TH August.

SMARTER TRAVEL WORKPLACES PEDOMETER CHALLENGE 2014 (8TH SEP – 5TH OCT) This year the Sport & Recreation Section will be responsible for the roll out of the Smarter Travel Workplaces pedometer challenge for Dublin City Council. This four week initiative aims to get people moving and walking more by using their very own pedometer to count and record their steps. They must enter as part of a team of four and prizes will be awarded to the teams who cumulate the most points. It is hoped that we will use this initiative as a catalyst to try and create walking groups within the workforce and encourage staff to get active by walking and cycling.

DIT /FAI & DCC SPORT & RECREATION SPORT FOR ALL MODULE This project is at the planning stages but will see a joint partnership with DIT /FAI and Dublin City Sport & Recreation in proving Leisure Management students with a new module based on the principles and framework of the Gaelic 4 Girls programme. It will offer both coaching and refereeing qualifications, with a specific focus on disability sports inclusion. DCC Sport & Recreation officers will use these student coaches to help deliver specific soccer focused disability programmes in their local areas. The students will also have access to the CARA Disability Inclusion Training course that is facilitated by the Dublin City Sports Network .It is hoped this module will be available to offer to the students in September.

It is planned that the 3rd DIT CARA Sports Inclusion Disability training will be delivered in October (date TBC) The course is aimed at providing leaders, coaches, Sport development staff and volunteers in sport with knowledge and awareness on how to include people of all ages with disabilities in their sport. The course is certified by Coaching Ireland.

DCSN / DCSN SPECIAL PROJECTS WORKING GROUP The next DCSN Meeting is scheduled for Wednesday 10th September. A special projects subgroup of the network has been formed to work towards planning & implementing potential new projects that can be delivered in the local community with specific focus on identified gaps & needs within those communities. The subgroups has met and are currently working on finer details of the programme and will have a report ready for the above meeting. The coordinator has been elected onto the board of the Federation of Irish Sport, it is hoped that this election can only strengthen the link with Dublin City Council Sport & Recreation and be an invaluable partnership in terms of promoting the ongoing work Dublin City Council do in terms of sports provision.

DUBLIN LOCAL SPORTS PARTNERSHIP ANNUAL SPORT DEVELOPMENT SEMINAR THEME 2014: SUPPORTING PHYSICAL ACTIVITY & SPORT IN SCHOOLS Each year the Dublin /Wicklow &Kildare Local Sports Partnership collaborate in a joint Sport & Physical activity development seminar, and each year there is a different theme and focus group decided on. This year we aim to provide as much information to schools, as to what they can access and do in terms of promoting sport & physical activity within the school setting. The proposed date is 1ST October and venue TBC. Dublin City schools will receive letters inviting the principal and responsible teacher for PE/Sport /physical Activity to the 4 hr seminar. There will be guest speakers from ESRI to share up to date sport research, Active Schools Presentation, representation from the IPPEA and other TBC. Each Local Sports Partnership will also present a case study from one of their schools who were successful in implementing a sports programme/project.

That the chief executive report who is responsible for trimming the trees at 136a Aulden Grange and make sure that they are trimmed. This situation has been dragging on for over a year when I first put down Question 122 to the NCAC on 2/9/2013. In reply to question 107 on 16th December 2013, the chief executive stated: "Parks and Landscape Services are in communication with the NRA to clarify responsibilities and future maintenance of this open space and associated planting.

Report:

The maintenance of the area to the west of the boundary wall of 136a Aulden Grange is included in the contract responsibility of the National Roads Authority associated with the maintenance of the M1.( Ref: NRA-MMaRD Network A, Dr.Ref: DB/101, January 2014, Jn2 Santry). This information was supplied to Parks and Landscape Services by the NRA following the communication referred to above. The open space to the south of Coolock Lane is not included in this area and the grass maintenance of this open space is being carried out by Parks and Landscape Services.

This Area Committee urges City Council management and the Chief Fire Officer to ensure that the lessons of Priory Hall have been fully learned and implemented in fire safety and construction; we view with concern the Government's failure to ensure that this is done by stronger legislation and by increased resources for local authorities for inspections and enforcement, and we urge Government to do so.

The Building Control (Amendment) Regulations 2014 came into effect on 1st March 2014. The Regulations represent one of the most significant changes to the Building Control Code since the introduction of the Building Control Act in 1990. The Regulations seek to redress failings in the old system and prevent the future reoccurrence of poorly constructed dwellings, pyrite damage and structures breaching fire regulations left as a legacy of a poorly regulated housing boom. The Regulations impact on all stages of the building process from initial design to completion.

Historically, the policing of the process relied on a self-assessment model involving builders and professionals who provided opinions on compliance. Under the new model an Assigned Certifier, who can be a registered Architect, Engineer or Building Surveyors, inspects building works at key stages during construction. The Assigned Certifier and the Builder will both certify that a finished building complies with the requirements of the building regulations.

In addition to this legislative strengthening the City Council has increased the technical staffing within its Building Control Division with the recruitment of a Senior Building Surveyor and a Senior Executive Building Surveyor.

In summary, the new Building Control Amendment Regulations require:

 The submission of compliance drawings and documentation to Building Control Authorities.  Setting out and executing an inspection plan by the Assigned Certifier.  Signing of mandatory certificates of compliance by the designer prior to construction and by the Assigned Certifier and the Builder when a building is complete. Once the building is constructed, a Certificate of Compliance on Completion must be submitted to the Building Control Authority for inclusion on its statutory register.

The mandatory certificates are clear, unambiguous statements on statutory forms stating that each of the key parties to a project certifies that the works comply with the building regulations and that they accept legal responsibility for their work. This new statutory certification is a key consumer protection measure and an important element in the pursuit of an improved culture of building control.

Compliance is improved by the two main factors:

1. A person who signs a statutory certificate for a building which subsequently proves to be non- compliant, can be held legally liable for the consequences. 2. Greater onus is now placed on professionals to provide consumers with a more comprehensive service and failure to do so incurs the risk of being censured, suspended or ultimately removed from their professional body.

Dublin Fire Brigade will continue to assess fire safety designs and issue Fire Safety Certificates under the Building Control Act and in addition will use the appropriate mechanisms under the Fire Services Act 1981 and 2003 as appropriate.

That this area committee supports the restoration to the housing allocations list those people from the North Central area who were removed because they joined the RAS scheme.

Report:

Following the enactment of the 2009 Housing (Miscellaneous Provisions) Act and the subsequent 2011 Housing Regulations, Housing Applicants housed under the Rental Accommodation Scheme after 1st April 2011 were removed from the Housing List in accordance with the legislation. However, in accordance with the current Allocations Scheme, those RAS tenants are eligible to apply for a transfer from their accommodation after two years tenancy similar to all other Voluntary Housing Body and City Council tenants.

Dublin City Council RAS tenants who were housed prior to April 2011 and who wish to transfer to other social housing supports are currently eligible to apply on the transfer list and retain their original date of their housing application.

During the passage of the 2014 Housing Bill through the Houses of the Oireachtas and development of the new Housing Assistance Payment (HAP), concerns were raised that tenants that become part of the HAP System should be entitled to avail of all social housing options like other social housing tenants.

Recently in August, by way of Housing Circular 36/2014, the Department of the Environment, Community & Local Government advised Local Authorities that the 2011 Regulations will be revised in the near future. The intention is to amend the Social Housing Regulations so as to ensure that all social housing tenants, including those in receipt of HAP will still be able to access other social housing supports through the transfer system, whereby they can apply to transfer to other social housing options such as the Local Authority or Approved Housing Body. This in effect will also mean that all RAS tenancies will also be considered within this revision process following the introduction of the revised Regulations.

It is the City Council’s intention to review all RAS tenants housed after 2011 whose applications were cancelled and who may now wish to access other social housing options and they will be given the benefit of their original application date when being included on the transfer list.

That no permanent parking ban be implemented on Dollymount Beach and that full consultation with local representatives, the public and vulnerable beach users takes place prior to any changes to vehicular access.

Report:

Dublin’s North Bull island is a Nature Reserve and Wildlife park which is administered and maintained by Dublin City Council Parks and Landscape Services.

As a major Dublin City Council Park, North Bull Island comes under Parks bye laws made by Dublin City Council in exercise of the powers vested in it by part (vii) of the Local Government Act 1994 in relation to the control and regulation of the use of parks, open spaces and recreational playing grounds owned, controlled by, or in the charge of the Council whether open or enclosed.

The Bye-Laws are in force to ensure that parks, open spaces and recreational playing grounds and their facilities are used to the maximum extent, in safety. The administration of Parks and Open spaces Bye Laws is the responsibility of Dublin City Councils Parks and Landscape Services.

Up to the early 1990s’ the beach was fully open to vehicle access and it was traditional for people to learn to drive on the beach, something that would be seen as totally inappropriate today. Subsequently areas of the beach were cordoned off by boulders for car parking however this was informal with no markings or regulation. The increasing number of people sea bathing, the success of kite surfing and other recreational activities has created its own pressures with regard to maintenance, public order and public safety.

Recently there was an incident on the beach where a car which was stuck in the sand led to a woman being injured. Due to the haphazard nature of parking, emergency vehicles had difficulty attending to the incident. For this reason and following strong advice from the Gardai, management in the Parks Service made a decision to cease vehicular access to Dollymount Beach with the exception of emergency and other authorised vehicles.

It is important to note that this recent incident was the culmination of a number of incidents over many years where the 24 hour access to the beach from the causeway has resulted in anti-social activity and concern for public safety. Vehicular access to the beach has caused several challenges to An Gardai Siochana over the years both from a public safety, crime prevention and traffic management perspective.

The overall issue of safety was already under review by Dublin City Council and consideration was being given to restricting the access which would have involved a process of consultation etc. however the recent serious incident resulted in the decision having to be brought forward and there was no opportunity for consultation or for giving adequate notice.

We are happy to consult with those people most affected by the restriction of the access, but the public safety issue raised by An Garda Siochana was significant and they are continuing to monitor the situation. Dublin City Council will continue to co-operate with any recommendations made by the Gardai to improve public safety for all users of the island.

Temporary barriers have been installed at the end of the causeway to prevent cars accessing the beach however the beach is fully accessible for pedestrians, wheel chair users and cyclists. The distance from the set down at the roundabout to the beach is about 50m. Signage has now been put in place for set down areas and disabled parking close to the beach access and these will be improved with road markings.

There are also temporary barriers to prevent vehicle access to the beach from the North Bull wall. This part of the island is in the ownership of the Dublin Port Company which has indicated that it will gift its lands to the city council as part of a ‘community gain’ from their development of the Port. When this happens Dublin City Council will seek to improve car parking capacity from the North Bull Wall. It should be noted however that the wooden bridge restricts traffic movements to this part of the island and that at peak periods of use, traffic congestion is inevitable.

It should also be noted that for events and other approved activities, vehicles will be allowed access to the beach under permit from the Parks and Landscape Service. If there are individuals or groups who are incapacitated and cannot traverse the 50m distance from the roundabout to the beach, City Council Parks Service staff that manage the wildlife conservation, lifeguarding and beach maintenance will meet with them to see how their requirements can be accommodated.

Car parking is available along the Causeway and at the end of the Bull wall and it is considered that in times of peak use no amount of car parking would cater for the numbers using the island.

It is acknowledged that some regular users who park their cars directly on the beach will be inconvenienced by the change, but safety was the main reason/rationale for the decision to cease vehicular access.

The situation will be monitored, however it is considered that keeping the beach free of motor vehicles is in accordance with best practice and is beneficial in the long term for public safety, for improving maintenance, for the enjoyment of beach goers and for achieving the nature conservation objectives which define the island as a unique and special place in the City.

This local area committee believes that due to the severe housing crisis being experienced by thousands of people across the city of Dublin, the provision of social housing must become the top priority of Dublin City Council. The city council must do everything within its power to ensure that the housing needs of the 16,000 families languishing on the social housing waiting list are met as a matter of the utmost urgency. And so this local area committee believes that the redevelopment project being carried and paid for by Dublin City Council to the apartment complex at Priory Hall presents a great opportunity to address this crisis in a concrete manner: the 185 apartments must be offered to those on the local area's social housing waiting list.

Report:

The refurbishment of the Priory Hall complex is being carried out in accordance with the Framework Agreement put in place by the Government and agreed by all the stakeholders. The project is being facilitated by Dublin City Council with costs recouped from the DOECLG.

The Agreement provides that the refurbished complex will, as with the original development involve a combination of private, social and other forms of housing.

When complete it is proposed that the City Council will retain ownership of 35 units as before.

This local area committee demands that the appropriate funding for the Darndale Park Renewal Project be included in Dublin City Council's Budget 2015. The amount of funding to be discussed and decided amongst the local area staff and the various stakeholders involved in the project at October's meeting of the Darndale Park Renewal Project. Report: The ongoing funding of improvements associated with the Darndale Park Renewal Project will be considered in the context of the preparation of estimates for Parks and Landscape Services for 2015. There are a number of improvements planned to take place during the balance of 2014 and into 2015 over and above the current work plan for drainage works, pond improvement works and playing pitch improvement works at Darndale Park and the Darndale Park Improvement Project will be kept informed of progress with regard to these proposed works. The Darndale Park Renewal Project is a collaborative response to the issues facing Darndale Park. These include low utilisation, public perceptions of safety, the need for physical improvements to enhance and secure the park and anti-social behaviour particularly horses, quad bikes and incidences of drug dealing. The project in itself is a recognition that that the problems can only be solved by increased community involvement and the engagement of other relevant key stakeholders. Since the groups inception the City Council has been tackling the issues and together with the other members, have been prioritising the measures needed to deliver improvements.

From the physical perspective improving the security of the entrances to the park to deter horses and quad bikes was a priority as was deterring vehicular access from Belcamp Lane. Three new 'kissing gates' and a substantial barrier at Belcamp lane were initially provided and their effectiveness will influence further measures with the other entrances. These gates are a compromise between the need for access for users, particularly disabled users and effective measures to deter horses and quad bikes. There are boundary issues with the Park that the Committee are examining in regard to the optimum solution.

It was also indentified by the community at an early stage that there need to be a physical presence in the park to help maintain it and assist with its ongoing usage. A successful community employment model was identified based on a similar scenario in the nearby Belcamp Park. This is a successful collaboration with our Parks Services and the Dean Swift Sports Club. A similar proposal was developed in conjunction with the Moatview/Fairfield Development Association but it was not sanctioned by the Department of Social Protection. A revised proposal based on the Government's Gateway programme has been discussed with the Department and there is a high confidence that an acceptable proposal can be developed.

In relation to further improvements, significant works are needed to upgrade the pitches, pond and playground. Funding has been secured from a number of external sources to fund the pond improvements, carry out drainage to the pitches and carry out some limited works to the playground. It has to realised that a full programme of work would involve significant recourses being committed in a time of reducing recourses. Essentially, these would have to be diverted from other projects. What needs to happen is that that the key priorities have be indentified, costed and agreed in the context of a multi year programme. We will work with the group to achieve this aim and will provide such resources as can be made available to achieve a phased improvement in the park. Following the publication by the Government of the 1st National Survey of Unfinished Housing Developments (UHD’s) 2010, the then Ministers for Housing and Local Services; and Planning, Sustainable Transport and Horticulture established an Advisory Group on Unfinished Developments to advise the Minister on actions to ensure the effective management and resolution of unfinished developments. In turn each local authority, established a sub group dedicated to unfinished housing developments within their jurisdiction, thereby relaying all relevant information to a National Co-Ordination Committee. The Dublin City Council Unfinished Housing Development Task Force held its first interdepartmental meeting in May 2011.

The Dublin City Council Unfinished Housing Development Task Force has a number of responsibilities including providing guidance and input to stakeholders/residents in identifying the best ways to resolve problematic sites and specifically, in regard to necessary measures to provide for the safety and security of unfinished developments, at present and in the future.

At this time, Dublin City Council is investigating all avenues available to ensure any outstanding site issues/challenges are resolved. The site in question is not under the ownership of Dublin City Council but has been hoarded off by the stakeholder(s), in the interests of security and health and safety. There is no current plans in place to landscape the land, however the involvement of Dublin City Council may be required in the future if further remedial action is required. Dublin City Council will continue to monitor the site in the future and if necessary levy the stakeholder where deemed appropriate. In addition, the issue of dumping on the lands will be brought to the attention of our Waste Management Section to take appropriate action against the people involved.

Dublin City Council has prepared and adopted a Local Area Plan (LAP) for Clongriffin- (details supplied) (North Fringe) area. This LAP is the outcome of successful collaboration with Fingal County Council, the North Fringe Forum, the Department of Education and Skills and the major landowners. It provides a coherent road map for the phased completion of this large residential area and includes an environment and open space amenity strategy. The lands details supplied (to the east of Burnell and south of Churchwell) are designated in the plan as the site of the future (details supplied) Town Centre. The plan notes that its development together with the lands at Belcamp lane "has the potential to deliver complementary housing- plus retail, commercial, employment and infrastructure to enhance the area" The provision of "mixed use development that creates a vibrant and sustainable place" is "fundamental to the masterplan vision of a vital, urban town centre" it adds. The environment and open space amenity strategy does not propose the development of playing pitches at this location but overall the strategy will provide a quantum of open space that will meet the needs of an area of this size.

The location and amenity value of the nearby Fr Collin's Park should be noted and the original proposals for this park included an extension of amenity lands and sports facilities south of Main Street to occupy public Z9 zoned recreational lands to the rear of the Trinity Sports and Leisure complex. Facilities and a sports centre here would form an extension of Fr Collin's Park and provide significant amenity value. While the plan notes that there are opportunities for "temporary uses and treatments of vacant sites", the key role that this site plays in the future development of the area and the availability of significant facilities at Fr Collin's Park make this site undesirable for even temporary use as playing pitches. In addition diverting funds and resources for this purpose would delay the future development of public Z9 zoned recreational lands to the rear of the Trinity Sports and Leisure complex which is the current priority.

Outdoor recreational facilities and amenities are provided through the network of parks and open spaces provided for in the development of the North Fringe area and in accordance with the local area plan/master plan for the neighbourhoods in this area. All weather pitch/ training facilities are planned on lands to the south of Fr. Collins Park and on an area of Donaghmede Park, the latter which is currently being constructed. The former has Part 8 Planning approval and will be constructed in due course. These facilities will provide all weather ball game/training facilities to the (details supplied), Clongriffin and Donaghmede areas.

Dublin City Council has prepared and adopted a Local Area Plan (LAP) for Clongriffin-(details supplied) (North Fringe) area. This LAP is the outcome of successful collaboration with Fingal County Council, the North Fringe Forum, the Department of Education and Skills and the major landowners and has brought forward a coherent road map for the phased completion of this large residential area. The LAP addresses the theme of community and social infrastructure and during the consultation phase of the LAP it was identified that the area required a multi-functional space to provide a community centre. In addition the original planning permission for the (details supplied) area provided for a number of key community services and facilities centred on a square that would ultimately create a community hub for social infrastructure. The creation of the 'community square' sought to accommodate a primary school site, enterprise centre, library etc in addition to a, community centre. While the Community & Social Development Team in North Central would agree with that assessment, the ownership, management, funding and sustainability of such a facility raises serious questions.

The initial capital funding of such a facility would either be developer led or funded through a combination of development levies and central government funding. Given that the redevelopment of many of the key development sites identified in the LAPs has not progressed, the knock-on effect has been that the associated community gain, environmental and other improvement works identified in the LAPs have not been realised. In this regard the LAP noted that owing to financial constraints on both private and public funding the provision of key facilities such as the library, community centre and sports and leisure centre have not been either constructed or not yet operating within a purpose built unit. It accepts that the provision of these facilities will be a longer term project and require an updated feasibility assessment.

There is also a community facility at Unit 60,, Main Street, Congriffin. This facility provides the opportunity to promote and develop community programmes within the North Fringe Area. This facility has been extensively used over the past four years by various department within Dublin City Council, Garda Clinic, Health Services Executive, Fibromyalgia Support Group, Yoga classes, local residents including both Belmayne & Clongriffin, Trinity Youth Club, Baby Massage classes and Parent & Toddler Group,. Dublin City Council and Gannon Properties continue to promote and cover the relevant costs associated with Unit 60.

At present indoor sporting facilities and a swimming pool is provided by the Trinity Sports and Leisure Services located to the south of . While the LAP also noted that Father Collins Park provides ample outdoor sporting activities that would be considered adequate to meet the needs of the current and future community. Nevertheless a proposal was developed for an all weather pitch on lands adjoining Trinity Leisure Sports Centre. A Part 8 Planning Consultation process was initiated but funding was dependant of Sports Capital allocation but the 2014 application was unsuccessful.

While the Community development team will continue to build the capacity of the local community and will continue to seek out options and funding for development of the community infrastructure the LAP provides the mechanism to keep the importance of such facilities on the agenda and progress their provision.

The Public Domain Unit and Litter Wardens regularly monitor and remove Cash for Cars signs in the North Central Area. It is estimated that approximately 100 and 120 signs are removed per month. Waste Management staff have also reported that they have removed 200 signs over the last 3 months from the North Central Area (This includes stickers from utility boxes). It has been noted that the erection of the signs has slowed somewhat over the previous week.

The City Council has initiated enforcement proceedings in accordance with Part VIII of the Planning & Development Acts 2000 – 2013 in relation to the address in question. A Warning Letter was issued to the developer on 15th August, 2014 and the Council is required by the planning code to allow the recipient up to 4 weeks to respond to the complaint made. After that 4 week period, the Council will establish whether further enforcement action is warranted.

A site inspection was carried out by the Planning Enforcement Officer on 20th August, 2014. The inspection revealed that a single storey structure was under construction to the rear of the property. The structure is unauthorised as it is in excess of the 25sqm area as stated in the conditions and limitations attached to Class 3 of Schedule 2 of the Exempted Development Regulations.

The property owner has informed the Council that they intend to apply for retention planning permission of the structure within the next few weeks. The enforcement matter will be monitored by the Council following the expiry of the period for response to the warning letter with a view to ascertaining if a retention planning application has been made. The complainant will of course be advised in writing of the outcome and whether further enforcement action is warranted.

The signal timings at the junction of (details supplied) Road were reviewed and a change was made in February 2014 which resulted in more time being allotted for the right turn. These roundabouts form part of a major orbital route extending eastwards from the M50 to the R809 as far as Baldoyle, facilitating access to the city from urban centres including (details supplied 1), Belmayne, Donaghmede, Clongriffin and further afield.

The National Transport Authority Design section commissioned a report by CSEA on the design of the Hole in the Wall Road Roundabout Junction, in 2013. One of the options developed by the Consultants is to remove the roundabout and replace it with a signalised junction, but the report also recommends some interim measures that can be put in place in the short term.

Due to funding constraints the full signalisation of the junction will not take place at this time; however it is proposed to progress the completion of the bus lane. The completion of the bus lane at the Hole in the Wall Road will improve pedestrian facilities (including mobility impaired pedestrians), cycling, public transport and general traffic facilities on the Hole in the Wall Road approaching the roundabout.

Funding has been sought and approved by the National Transport Authority to continue the bus lane on the Hole in the Wall Road . This work should take place in 2014.

Regarding the (details supplied 1)l roundabout. It is not envisaged that any measures will be undertaken until such time the developments to the North of this junction including Belmayne are complete and taken in charge.

Replacement tree planting is carried out where there is a failure of planting and where suitable planting pits are identified.

Resources are generally available to be able to service bins from the level of incidental litter that would arise through normal use of the public open space. This service encourages participation with all schemes that are targeted on minimising the impact of dog waste on public open space. Requests have been forwarded through the North Central Area Office to Waste Management Services to consider placement of some bins close to entrances to the park referred to which could assist an increased level of participation of dog waste control by dog owners. Any bins supplied are subject to the resources available to that service.

Dog owners use the nearest litter bins outside the parks to dispose of the dog waste.

A fire safety certificate is a design certification issued normally in advance of construction, in a way similar to that of a planning permission. Dublin City Council is not responsible for the certification of the completed structure.

Completion certification is a matter for professionals retained by the Developer. It is a matter for the purchaser’s expert advisers to advise on the adequacy of that certification. The statutory duty of care under fire safety legislation in respect of any premises rests with the owner or occupier or the person in control.

In January 2012 a construction defect was identified in the (details supplied) Residential Development. Sections of the Development were constructed by (details supplied) Ireland (now in receivership).

It is understood that NAMA contractors are currently completing remediation of Cell P7 which was constructed by (details supplied) Ireland.

Correspondence with NAMA does not relate to the premises the subject of the email referred to and may only be accessed if it falls within the relevant statutory procedure.

It is open to the owner of the premises to engage a reputable Chartered Engineer or Fire Safety Consultant or Registered Architect to conduct a fire safety audit of his premises to establish if any remediation is required, and to carry out such remediation works as may be identified or to take such steps as may be open to him to procure the carrying out of necessary works. The cost of any such remediation works is a matter for agreement between the parties.

Reply:

Following the enactment of the 2009 Housing (Miscellaneous Provisions) Act and the subsequent 2011 Housing Regulations, Housing Applicants housed under the Rental Accommodation Scheme after 1st April 2011 were removed from the Housing List in accordance with the legislation. However, in accordance with the current Allocations Scheme, those RAS tenants are eligible to apply for a transfer from their accommodation after two years tenancy similar to all other Voluntary Housing Body and City Council tenants.

Dublin City Council RAS tenants who were housed prior to April 2011 and who wish to transfer to other social housing supports are currently eligible to apply on the transfer list and retain their original date of their housing application.

During the passage of the 2014 Housing Bill through the Houses of the Oireachtas and development of the new Housing Assistance Payment (HAP), concerns were raised that tenants that become part of the HAP System should be entitled to avail of all social housing options like other social housing tenants.

Recently in August, by way of Housing Circular 36/2014, the Department of the Environment, Community & Local Government advised Local Authorities that the 2011 Regulations will be revised in the near future. The intention is to amend the Social Housing Regulations so as to ensure that all social housing tenants, including those in receipt of HAP will still be able to access other social housing supports through the transfer system, whereby they can apply to transfer to other social housing options such as the Local Authority or Approved Housing Body. This in effect will also mean that all RAS tenancies will also be considered within this revision process following the introduction of the revised Regulations.

It is the City Council’s intention to review all RAS tenants housed after 2011 whose applications were cancelled and who may now wish to access other social housing options and they will be given the benefit of their original application date when being included on the transfer list.

With regard to the specific case (details supplied), this applicant has already been given the benefit of their original application date in February 2006. On the transfer waiting list, there are currently 120 applicants ahead of them for Housing Area B (Kilbarrack/Darndale), 130 applicants ahead of them for Area E (Cabra / Finglas and 40 applicants ahead of them for Area D (Ballymun).

Where RAS tenants have to leave the property due to the Landlord not renewing their contract, they are regarded as a priority for alternative accommodation. However, it has proved extremely difficult to source alternative private rented accommodation for such cases. In addition to trying to source Landlords with properties interested an joining the RAS Scheme, the Allocations Section are endeavouring to accommodate such cases by various means such as with Approved Housing Bodies and City Council housing stock.

Fairview Park, including the playground area is maintained by direct labour of Parks and Landscape Services, based at a depot located in the park. It is not possible for this Service to provide a full time presence at the playground, however the area is included in the area covered by the park ranger at Fairview Park while on duty and therefore litter arising is addressed on a daily basis. Abuse of the area after park opening hours does occur, and the Gardaí are advised when such activity is noted and where damage arises, and this Service is aware that Fairview Park is visited by the Gardaí. On occasion the after hour activity at the playground area involves homeless persons, and Housing and Community Services and the Gardaí are advised when this occurs. This Service interacts with a voluntary group what also carries out litter lifting at this park mainly on Saturdays, and it is the intention that the frequency of the activity of this group will increase at this location.

It is not Dublin City Council policy to provide “slow” signs in residential areas where the speed limit of 50k or lower exists where the onus is on the motorist to drive with due care and at a speed appropriate for the prevailing conditions as this would lead to a proliferation of such signs throughout the city.

Speed tests will be conducted to determine if traffic calming is required.

“Can the Manager please provide details for the rationale/decision-making process for introducing a left-turn filter in Fairview for turning on to the Malahide Road?”

Reply:

A new left turn filter arrow was recently installed at the junction of Fairview and Malahide Road in order to improve bus flow along the Malahide Road route. This installation was recommended by the Dublin City Council Public Transport Priority project, a scheme funded by the National Transport Authority (NTA) that looks at key public transport routes with a view to improving travel times and ensuring consistent travel times. The project found that there was an opportunity to run the left turn more frequently, thus delivering more green time for the buses.

Reply:

Dublin City Council Maintenance Department recently carried out an inspection of vacant units in (details supplied) and there are currently no units that would be suitable for the process of conversion. There was recently a retrofit of the units to improve the energy efficiency of the units. The units were insulated and the windows were replaced. There are no plans to replace the doors in the units at (details supplied). Should tenants believe that there are problems with the doors they can inform their liaison officer and the problem be investigated by the maintenance section.

His interest in accommodation with an approved Housing Body has also been noted and in particular his interest in Cluid Housing Association. I am not currently in a position to state what his prospects might be, however, his application will be given every consideration for future nominations to the Voluntary Sector.

Reply:

Any incidences of anti-social behaviour should be reported to the local Gardaí. Presently there is no date set for the next North Central JPC.

The Councillor, Residents, Gardai and management of (details supplied) Castle were met on- site with Parks and Landscape Service over a year ago and it was decided that the shrubberies under the trees on the open space would be removed if the residents all agreed. Up until now none of the residents or anyone from the original meeting have contacted the Council with their decision.

In relation to the waste material that backs onto the graveyard Parks and Landscape Service will arrange for the removal of the ‘camp’ by the end of this month.

The land in question is not in the charge of Dublin City Council Parks and Landscape Services - regarding its ownership, a letter received from Survey and Mapping from 2004 states that there is no record in Property Section of the Council owning this site and no registered title for this land in Registry office therefore it is still in private ownership. It must be noted that in 1972 a proposal to acquire this area under Derelict Sites act was made but there is no record of this ever occurring.

A contractor has been procured to undertake the repairs that relate to road maintenance issues. Repairs are scheduled to be carried out in the coming weeks.

The proposed wastewater treatment plant is located outside the Dublin City Council area and is the responsibility of Fingal County Council.

However, Peter O’Reilly and Geoff O’Sullivan, Fingal County Council will be giving a presentation on the Greater Dublin Drainage Project at the September North Central Area Committee meeting.

Reply:

The question refers to the premises known as the Kilbarrack Community Hall which is owned by Dublin City council but leased to Kilbarrack & District Community Association (KADCA) ref A23- 7164. KADCA had requested permission to sub-lease part of the premises to the Kilbarrack Coast Community Programme (KCCP) and the completion of this process will make responsibility for matters such as access etc a matter for the leasees in the first instance.

“To ask the manager why the initial 10 million estimated cost of carrying out remedial works to the Priory Hall apartment complex has now reached 27 million and will he provide a detailed breakdown of the figures when providing the answer.”

Reply:

The figure of 10 million referred to an initial proposal for a limited scope of works required to bring the complex into compliance with the Building & Fire Regulations with residents returning to live in their properties.

This proposal was not accepted and was replaced with the current Framework Agreement which was put in place by the Government and agreed with all the stakeholders concerned.

The Framework provides for the total refurbishment of the complex to a high marketable standard.

The estimated construction costs are broken down as follows:  Construction - €20.6m  V.A.T. - € 2.8m  Project Management - € 2.7m

This cost will be offset by the sale of 65 apartments acquired from the IBRC at nominal value.

Reply:

The Priory Hall complex consists of the following:

1. Existing City Council units – 35 2. Buy to Let Landlord units – 23 3. Owner Occupied/IBF units – 64 4. Miscellaneous, i.e. Cash Purchasers, etc. – 5 5. Retail Units - 4 6. IBRC Units owned by DCC - 65

Under the terms of the Framework Agreement the following is proposed:

Items 1 & 2 ownership will remain as is. Item 3 will be sold with proceeds used to discharge outstanding loans. Items 4 & 5 proposals to be agreed. Item 6 units to be sold with proceeds used to partially fund refurbishment costs.
