WHAT WE CAN DO IN THE STRUGGLE FOR REPRODUCTIVE JUSTICE INTRODUCTION The term reproductive justice was introduced in the 1990s by a group of American Women of Color,1 who had attended the 1994 Inter- national Conference on Population and Development (ICPD), which was sponsored by the United Nations and is known as “the Cairo conference.” 2 After listening to debates by representatives of the gov- ernments of UN nation states about how to slow population growth and encourage the use of contraceptives and the extent to which women’s reproductive rights could/should be guaranteed, the group realized, as Loretta Ross later wrote, that “[o]ur ability to control what happens to our bodies is constantly challenged by poverty, racism, en- vironmental degradation, sexism, homophobia, and injustice . -

ROBERTS** INTRODUCTION There is little question that the sweeping changes in welfare pol- icy initiated by the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA) 1 will have an impact on fami- lies involved in state child welfare systems. If You Really Care About Educational Equity, You Should Care About Reproductive Justice!
If You Really Care about Educational Equity, You Should Care about Reproductive Justice! What is Reproductive Justice? The Reproductive Justice (RJ) movement places reproductive health and rights within a social justice framework.1 The movement supports the right of individuals to have the children they want, raise the children they have, and plan their families through safe, legal access to abortion and contraception. In order to make these rights a reality, the movement recognizes that RJ will only be achieved when all people have the resources, as well as the economic, social, and political power, to make healthy decisions about their bodies, sexuality, and reproduction.2 Advancing RJ will help to eliminate pervasive racial disparities in educational attainment by valuing the talents and abilities of those students who chose to become parents. Improving educational opportunities, especially for those in under-funded schools in marginalized neighborhoods, will also make parenting less desirable for teens whose odds of escaping poverty are not made any worse by having a child.3 Why is Reproductive Justice an Education Issue? Reproductive Justice demands that schools provide comprehensive sexuality education, which helps students prevent unintended pregnancies and increases their chances of graduating. Social injustices have created long-standing disparities in education access and quality. Schools in high-poverty districts receive significantly less funding than their higher income counterparts,4 reducing the chances of students in these districts to receive a quality education. High-poverty districts also often have more students who identify as People of Color.5 These educational inequities are also seen in the sexuality education provided to students. -

To address this gap, our issue briefs and primers are designed to illustrate how law and policies disparately impact individuals and communities. If/When/How is committed to transforming legal education by providing students, instructors, and practitioners with the tools and support they need to utilize an intersectional approach. If/When/How, formerly Law Students for Reproductive Justice, trains, networks, and mobilizes law students and legal professionals to work within and beyond the legal system to champion reproductive justice. We work in partnership with local organizations and national movements to ensure all people have the ability to decide if, when, and how to create and sustain a family. AFRICAN-AMERICAN Due to continuing institutionalized racism and a history of reproductive oppression,1 many African-Americans today have limited access to adequate reproductive healthcare, higher rates of reproductive health issues, and are disproportionately impacted by restrictions on family health services.2 Low-income people are especially likely to lack control over their reproductive choices, and in 2011, 25.9% of African-Americans lived at or below the poverty level, compared to 10.6% of non-Hispanic white people.3 Pregnancy: • 67% of African-Americans’ pregnancies are unintended, compared to 40% for non-Hispanic, white people.4 • Ectopic pregnancy rates in African-Americans have declined more slowly than the national rate. -

I frame the discussion by chronicling and critically assessing the body of work highlighting multiple explanations for the increased infection rates among black women, revealing the relative dearth of work that focuses on the everyday lives of women who are currently living with the disease. To begin to address this lacuna, I consider how researchers might tease out the various ways in which HIV-infected black women formulate, sustain, and interweave their economic survival strategies and intimate relationships. -

THE POLARIZATION OF REPRODUCTIVE AND PARENTAL DECISION-MAKING JAMIE R. ABRAMS∗ ABSTRACT Women’s abortion and parental decision-making in child rearing are constructed as polar- ized methods of decision-making in law, politics, and society. Women’s abortion decision-making is understood as myopic and individualistic. Parental decision-making is understood as sacrifi- cial and selfless. This polarization leaves reproductive decision-making isolated, marginalized, and vulnerable while parental decision-making is essentialized, protected, and revered. Both framings are inaccurate and problematic. A unified family decision-making framework that aligns abortion decision-making and parental decision-making reveals that both forms of deci- sion-making are more multi-dimensional, relational, and family-centered than currently under- stood. This Article exposes the ground to be gained by crossing longstanding boundaries in fami- ly law and reproductive rights to more accurately and inclusively frame decision-making. -

Killing the Black Body Race, Reproduction, and the Meaning of Liberty by Dorothy Roberts In 1997, this groundbreaking book made a powerful entrance into the national conversation on race. In a media landscape dominated by racially biased images of welfare queens and crack babies, Killing the Black Body exposed America's systemic abuse of Black women's bodies. From slave masters' economic stake in bonded women's fertility to government programs that coerced thousands of poor Black women into being sterilized as late as the 1970s, these abuses pointed to the degradation of Black motherhood—and the exclusion of Black women's reproductive needs in mainstream feminist and civil rights agendas. Now, some two decades later, Killing the Black Body has not only exerted profound influence, but also remains as crucial as ever—a rallying cry for education, awareness, and action on extending reproductive justice to all women. The Symbionese Liberation Army. The FALN. The Black Liberation Army. The names seem quaint now, when not forgotten altogether. But there was a stretch of time in America, during the 1970s, when bombings by domestic underground groups were a daily occurrence. The FBI combated these groups and others as nodes in a single revolutionary underground, dedicated to the violent overthrow of the American government. The FBI's response to the leftist revolutionary counterculture has not been treated kindly by history, and in hindsight many of its efforts seem almost comically ineffectual, if not criminal in themselves. -
