Эта война унесла жизни десятков тысяч людей и повлекла за собой серьезные раз- рушения объектов гражданской инфраструктуры, имущества и источников средств к существованию в Азербайджане. Оккупированные территории были этнически зачищены от всех азербайджанцев: более 1 миллиона человек были вынуждены оставить свои дома и имущество на этих территориях. В настоящее время на этих территориях осуществляются преднамеренные действия с целью добиться их колонизации и аннексии. Такие действия включают размещение по- селенцев, разрушение и присвоение объектов исторического и культурного наследия, эксплуатацию, разграбление и незаконный оборот имущества, при- родных ресурсов и других богатств на оккупированных территориях. 20-07545 (R) 100620 150620 *2007545* A/74/881 S/2020/503 Имею честь представить Вам доклад о международно-правовых обязатель- ствах Армении как воинственной державы, оккупирующей азербайджанскую территорию, подготовленный по просьбе правительства Азербайджанской Рес- публики профессором Малкольмом Шоу, королевским адвокатом, при под- держке Наоми Харт, барристера адвокатской палаты “Essex Court Chambers”, Лондон (см. приложение)*. Данный доклад представляет собой обновленный ва- риант доклада, представленного и опубликованного в январе 2009 года (A/63/692-S/2009/51), и содержит следующие основные выводы: • Регулярные вооруженные силы Армении принимали непосредственное участие в захвате Нагорно-Карабахского региона и семи прилегающих к нему районов Азербайджана. • Армения незаконно установила на оккупированных азербайджанских тер- риториях марионеточный режим и продолжает поддерживать его суще- ствование различными способами, в том числе посредством сохранения во- енного присутствия на этих территориях. Армения не может снять с себя ответственность за эти нарушения международного права, просто пытаясь скрыть свою роль агрессора за ширмой марионеточного режима. • Международное право запрещает приобретение территории с примене- нием силы, и, следовательно, никакие действия, предпринимаемые Арме- нией или ее марионеточным режимом на оккупированных территориях Азербайджана, не могут изменить существовавший ранее правовой статус этих территорий, которые, таким образом, остаются азербайджанскими по международному праву. • Армения несет государственную ответственность за нарушения ею между- народного гуманитарного права и международного права прав человека. К таким нарушениям относятся попытки изменить азербайджанские законы и правовую систему, существующую на оккупированных территориях, по- сягательства на имущественные права и повреждение или уничтожение объектов культурного и исторического значения, создание поселений ар- мян на оккупированных территориях, ненадлежащее обращение с покро- вительствуемыми лицами и насильственные исчезновения. • Армения обязана как прекратить совершаемые ею нарушения, так и возме- стить ущерб в связи с ними. The present Report constitutes an updated version of the one presented on 23 January 2009 to the United Nations. 1 It examines the international legal responsibilities of the Republic of Armenia (“Armenia”) as the belligerent occupier of the internationally recognised territory of the Republic of Azerbaijan (“Azerbaijan”).2 The Report addresses the following issues: (a) Is Armenia an occupier in international law of Azerbaijani territory? (b) If so, what are Armenia’s duties as an occupier of Azerbaijani territory with regard to issues such as the maintenance of public order, the preservation of the Azerbaijani legal system and the protection of human rights in the territory in question? So, it seems that Ankara knows much more than do the Azerbaijani forces themselves, who are allegedly alone in their fight against the mighty Armenian aggressors. Meanwhile, Azerbaijani President Ilham Aliyev undertook another Twitter advance announcing the capture of the villages of Mirak and Kavdar in the Jabrayil district, Mashadiismayilli and Shafibayli in the Zangilan district, and Basharat, Garakishilar and Garajalli in the Gubadli district. The Azerbaijani military also reported clashes in the district of Adhere. In the last 48 hours, according to Azerbaijan, Armenian forces suffered multiple casualties and lost over two dozen equipment pieces. Fortified positions and settlements controlled by Armenian forces in the central and northern parts of Nagorno-Karabakh are regularly being targeted with air and artillery strikes by Azerbaijani forces. This information was accompanied by the release of the photo evidence showing the wreckage of the plane and the identity of the pilot, Armenian Air Force Major Valeriy Danilin. If true, this would represent a significant further escalation, indicating spillover of combat into Armenia proper.     Karabakh is Azerbaijan! Karabakh is ancestral Azerbaijani land, one of its historical regions. Musa MARJANLI The name of this region translates into Russian as a “black garden”. Editor-in-Chief According to another version, it is a “large garden” or a “dense garden”. Up until the region was seized by the Russian Empire at the beginning of the 19th century, Karabakh was part of various Azerbaijani states. I will not bore you with arguments about who lived in Karabakh, who ruled it in certain historical periods – materials about that are available in most of the previous issues of IRS-Heritage. I only want to note that until the beginning of the 20th century, there was not a single Armenian ruler in Karabakh and indeed on the territory of present-day Armenia. This fact is graphic evidence that the Armenians always constituted an insignificant part of the population of these regions. On 14 May 1805, the ruler of the Karabakh Khanate, Ibrahim Khan, and the commander of the Russian troops, Prince P. Tsitsianov, signed the Treaty of Kurekchay, according to which the khanate was included in the Russian Empire. Subsequently, the Gulustan Peace Treaty of 18 October 1813 and the Turkmenchay Peace Treaty of 10 February 1828, signed as a result of two Russian-Iranian wars, formalized the final transfer of northern Azerbaijani khanates to the Russian Empire. Having taken possession of this land, Russia, striving to reinforce the Christian presence in the region, immediately began a systematic resettlement of Armenians here from Iran and the Ottoman Empire, placing them primarily on the lands of the former Azerbaijani khanates.
