As per the instruction given in Memorandum PE.457/2017/Co-Op/TI dated 27.07.2020 of the Director of Vigilance and Anti Corruption, Chennai,.I am registering a case in Tirunelveli V&AC Cr.No.03/2020 u/s 120-B.167, 109, 34 of'Indian Penal Code and 13 (2) r/w 7, 13 (1) (d) (i) (ii) (ijj) of Prevention of Corruption Act 1988 against the above said accused officers 1 to 4. The accused No.1 Tr.Sri Renganathadurai was working as Assistant General Manager, (Finance), Tirunelveli District Milk Producers Co-Operative Union from 22.05.2018 to 09.06.2020. The accused No.2 Tmt.Chitra Devi, Deputy Registrar, Dairying, Viruthunagar was working from 02.08.2017.to 30.04.2020. As per guideline in Letter in R.C No.10749/15N1 dated 13.11.2015 of CMD and DD, Chennai and proceedings in R.C No.4773/2013/N1 dated 23.12.2014 of CMP and DD, Chennai, the accused 1 to 4 are fixed as assessment/interview committee members for the selection of Extension Officer Grade II and Junior Executive Officer post in Tii unelveli Milk Producers Co-Operative Union. The Special bylaws, the above said guidelines, Proceedings, Education qualification, Experience for respective posts, Mode of appointment, Advertisement, Scrutiny of application are clearly framed for selection of candidates for the respective post. The candidates should produce resolution cum experience certificate issued by the Board of the MPCS concerned. The certificate produced as such should be based on the records of the society concerned. In production of essential documents for selection, it was mandatory that the candidate shall produce copy of the resolution cum experience certificate passed by the present Board officials of MPCS concerned. Witness Tr.K.Murugesan was one of the candidate eligible on certificate verification as prescribed for the post. He had produced the resolution certificate cum experience certificate on 05.10.2017, a day prior to the oral test after the resolution passed by MPCS on 04.10.2017, wherein the witness Tr.Murugesan is working. Accordingly considering his eligibility, he was called tor the oral interview held on 06.10.2017 in continuation of the qualification in written examination. But he was not selected, stating that he did not produce the resolution cum experience certificate issued by MPCS concerned and as such he was not eligible. Witness Tr.Murugesn on recollection of events before interview, held on 06.10.2017, between him and accused No.1 and understood that the reasons for non selection that this witness did not heeded to the demand of Rs.5,00,000/- made by A-1 l r.Sri Renganatha durai on 05.10.2017 at his office for selecting for the post concerned. Further it is revealed that four candidates namely Tr.G.Govindaraj, I mt.Ziporakalarani, Tr.lmmanuvel Devasahayam and Tr.Ponvixon also did not produce the resolution cum experience certificate of the Board are appointed as Extension officer Gr-ll, even then they are selected. In addition to the other in eligibility against them such as suspension of services of Tr.Govindaraj for 11 years, not sending milk to Aavin during the period of service as Secretary by Tmt.Ziporakalarani, variation in name as Immanuel instead of Immanuel Deva Sahayam as in educational qualification certificate, pending recovery proceedings against Tr.Ponvixon. This shows that candidates . who complied the demand of Rs.5,00,000/- in the circumstances stated above are selected and witness Tr.K.Murugesan who did not heed for the demand of Rs.5,00,000/- was not selected. Thus it reveals that the accused No.1 to Accused No.4 have entered into criminal conspiracy in between 21.08.2017 and 06.10.2017 with each other with common intention of demanding and receiving illegal gratification other than legal remuneration with the intention to perform or cause performance of public duty dishonestly and by framing incorrect records by rejecting eligible candidates as ineligible and by selecting ineligible candidates as eligible by consciously aiding and abetting mutually with each other and selected ineligible candidates who compiled the demand of Rs.5,00,000/- as on the circumstances existed on the date of interview by abusing the official position as public servants and rejected the eligible candidate Tr.K.Murugesan who failed to comply and pay the demand of Rs.5,00,000/- to the accused and thereby, prima-facie, the accused appears to have committed offences punishable u/s 120-B.167, 109, 34 of Indian Penal Code and 13 (2) r/w 7, 13(1) (d) (i) (ii) (iii) of Prevention of Corruption Act 1988. I am, therefore, registering a case in Cr.No.03\2020 u/s 120-B.167, 109, 34 of Indian Penal Code and 13 (2) r/w 7, 13(1) (d) (i) (ii) (iii) of Prevention of Corruption Act 1988 on 31.07.2020 at 15.00 hrs against the accused 1 to 4 for the above said offence for the purpose of taking up investigation.
