2014-2015 New Jersey Analytical Report COMMERCIAL FEEDS FERTILIZERS LIMING MATERIALS CIRCULAR 576 OCTOBER 2015 F O R E W O R D The New Jersey Department of Agriculture’s Division of Marketing and Development offers producers, retailers, wholesalers and consumers a wide variety of quality assurance services. Included among its responsibilities, the division’s Bureau of Agricultural Chemistry is mandated by law, N.J.S.A. 4:4-1 through 4:4-20, N.J.S.A. 4:9-1 through 4:9-15 and N.J.S.A. 4:9-16 through 4:9-21, to sample and analyze animal feeds (including pet foods), commercial fertilizers (including indoor plant foods), soil conditioners and liming materials. The Bureau registers manufacturers, inspects products, analyzes samples and enforces the law. The goal is to maintain and insure the quality of these agricultural commodities. A current list of feed, fertilizer and lime registrants; the consumption data for feed, fertilizer and lime in New Jersey; the New Jersey fertilizer tonnage report; and results of the analytical work performed during the period from July 1, 2014 to June 30, 2015, are summarized in this publication. EXECUTIVE SUMMARY The Division of Marketing and Development, Bureau of Agricultural Chemistry, inspected a total of 7,917 lots of various commodities for compliance with the respective laws and registration requirements of the State of New Jersey. When unregistered products were found, either the company was required to apply immediately for registration or their products were removed from the market. During the period covered by this report, the agricultural product agents in the Bureau of Agricultural Chemistry took 356 official samples of commercial animal feed. Protein determinations were run on all feed samples with Twenty of them (5.62%) found to have values below the label guarantee. Three (.84%) had a fat content that did not meet the guarantee value. Ninety nine of canned pet foods sampled were checked for moisture content. Seventy six producers were unregistered at the time they were sampled. A total of 249 official samples of commercial fertilizers were collected for laboratory tests during the report period. Of these, 245 carried a nitrogen guarantee and Twenty nine (11.84%) were below the guaranteed value for nitrogen content. A total of 189 samples were analyzed for available phosphate and forty one (21.69%) were below their guarantee. Twenty two (10.00%) of 220 samples failed to meet their soluble potash guarantees. A total of 585 micro-nutrients analyses were performed. In the samples tested, the following percentage was found to be below guarantee levels: none in calcium; 1.79% in magnesium; 5.47% in sulfur; 13.41% in boron; 41.82% in copper; 4.05% in iron; 9.33% in manganese and 4.88 in Zinc. Two samples were unregistered at the time of sampling. The Bureau sampled 3 agricultural liming materials during this inspection period. Of this, the samples did not fail to meet the calcium oxide and the magnesium oxide guarantee. Theses samples did not fail to meet the fineness specification. These data are not to be interpreted as a complete evaluation of the suitability of these agricultural chemicals for a specific purpose. Many factors other than physical and chemical composition must be considered. The Fertilizer and Soil Conditioner Law require manufacturers to compensate consumers for lots of fertilizer judged to be deficient. Each year the unit value for each of the primary plant nutrients is determined. The commercial value of deficient lots is dependent upon the magnitude of the deficiency multiplied by the unit value of the nutrient involved. The penalty assessed is equivalent to five times the commercial value. When the ultimate consumer of the deficient lot of fertilizer cannot be determined, the penalty is paid to the State Treasurer. During the period covered by this report, $10,193.89, was refunded to consumers and $4,691.63 was transmitted to the State Treasury. Agricultural lime use in New Jersey increased from 84,543 tons in 2013 to 104,343 tons in 2014. Animal feed consumption increased from 768,649 tons in 2013 to 776,500 tons in 2014. A total of 215,830 tons of fertilizers was distributed in 2014, a decrease from 260,540 tons in 2013 It is estimated that the 61% of these commodities were used on farms. A. The commercial fertilizer, feed and lime product shall be deemed to be misbranded: 1. if its labeling is false or misleading in any particular; or 2. if it purports to be or is represented as a commercial fertilizer, feed and lime unless label includes nutrient to the definition of identity. B. The commercial fertilizer, feed and lime product shall be deemed to be adulterated: 1. if it contains any deleterious or harmful ingredient in sufficient amount to render it injurious to be beneficial to plant or animal when applied in accordance with directions for use on the label, or its adequate warning statements or direction for use, which may be necessary to protect plant or animal life are not shown upon the label; 2. if its composition falls below or differ from that which it is purported to possess by its labeling.
