November 2006 China Human Rights and Subscribe Rule of Law Update View PDF Version United States Congressional-Executive Commission on China Senator Chuck Hagel, Chairman | Representative Jim Leach, Co-Chairman Message From the Chairmen Reform of the Death Penalty Review Process The Commission commends the recent positive steps that China's leaders have taken to help minimize wrongful executions and provide greater procedural due process to criminal defendants. In September, the Supreme People's Court and Supreme People's Procuratorate issued reform measures that establish concrete guidelines for death penalty appeals. On October 31, the Chinese government passed an amendment that requires all death sentences to be reviewed by the Supreme People’s Court. The new amendment brings the primary law governing China's judiciary into conformity with other laws governing the criminal process and incorporates into law policy goals that the Supreme People's Court established in October 2005, when it issued a new five-year reform program for the Chinese judiciary. As a next positive step, the Commission urges the Supreme People’s Court to give full effect to its October 2005 commitments, by issuing a judicial interpretation to settle unresolved issues in the death penalty review process and to clarify its own procedures for review. Announcements Translation: Reform of the Death Penalty Review Process The Congressional-Executive Commission on China has prepared translations of the Decision on Amending the PRC Organic Law of the People's Courts, issued by the National People’s Congress Standing Committee on October 31, and the Trial Provisions on Several Issues Regarding Court Hearing Procedures in Death Penalty Appeals Cases, jointly issued by the Supreme People’s Court (SPC) and Supreme People’s Procuratorate (SPP) on September 21. -

ONE THE SUPREME COURT AND THE MAKING OF PUBLIC POLICY IN CONTEMPORARY CHINA Eric C. Ip Post-Mao China saw profound social, economic and legal changes. This paper analyzes an often neglected aspect of these transformations: the evolution of the Supreme People’s Court (SPC) into an increasingly influential political actor in national law and policy-making. The SPC has self-consciously redefined its mandate to manage state-sponsored legal reforms by performing an expansive range of new functions such as issuing abstract rules, tightening control over lower courts and crafting out a constitutional jurisprudence of its own at the expense of other powerful state actors. It is more assertive than ever its own vision of how law should develop in the contemporary People’s Republic of China (PRC)SPC action can be broadly consistent with the Chinese Communist Party (CCP) interests, autonomous and expansive at the same time. However, the SPC’s reform initiatives are inevitably constrained by the vested interests of major bureaucratic players as well as the Party’s insistence on maintaining the Court as an integral administrative agency of its public security system. Eric C. Ip is working towards a doctorate at Oxford University's Centre for Socio- Legal Studies. A student of the political science subfields of comparative constitutional design and judicial politics, he earned his undergraduate degree in Government and Laws from The University of Hong Kong, and an LL.M. (distinction) degree from King's College, University of London. He is an Academic Tutor in Law and Politics at St. John's College, The University of Hong Kong; an Academic Fellow at The Institute of Law, Economics, and Politics; and a member of the American Political Science Association and the British Institute of International and Comparative Law. -

Simply I am going to talk about unity. The purpose of unity is to pursue even greater victory. Now the Soviet revisionists attack us. Some broadcast reports by Tass, the materials prepared by Wang Ming,[i] and the lengthy essay in Kommunist all attack us, claiming that our Party is no longer one of the proletariat and calling it a “petit-bourgeois party.” They claim that what we are doing is the imposition of a monolithic order and that we have returned to the old years of the base areas. What they mean is that we have retrogressed. What is a monolithic order? According to them, it is a military-bureaucratic system. Using a Japanese term, this is a “system.” In the words used by the Soviets, this is called “military-bureaucratic dictatorship.” They look at our list of names, and find many military men, and they call it “military.”[ii] As for “bureaucratic,” probably they mean a batch of “bureaucrats,” including myself, [Zhou] Enlai, Kang Sheng, and Chen Boda.[iii] All in all, those of you who do not belong to the military belong to this “bureaucratic” system. -

Informe El anuncio de China continental del establecimiento de una Zona de Identificación de Defensa Aérea en el Mar de China Oriental, que incluye en su perímetro a las deshabitadas Diaoyutai, también provocó revuelo en Taiwán. Taipei, que calificó la decisión de “lamentable”, reunió a su Consejo de Seguridad Nacional y estableció contacto con EEUU y Japón, significando que ni sus reclamos de soberanía ni la leve superposición de esta nueva zona con la propia de la República de China motivarían cambios en la delimitación de su propia área. Por su parte, Beijing hizo saber que la citada zona concuerda “con los intereses de ambos lados del Estrecho”. A la pregunta de si Taiwán la aceptaría o no, el gobierno no ha respondido de manera definitiva pero 1 las aerolíneas han empezado a entregar sus planes de vuelo a China continental (al igual que Singapur o Filipinas y, unos días después, Corea del Sur y EEUU, por el momento) argumentando razones de seguridad. Taipei, señaló que la decisión, que en ningún caso fue objeto de consulta previa, no es favorable para el positivo desarrollo de las relaciones a través del Estrecho y así se lo hará saber al continente “a través de los canales adecuados”. La oposición acusó al gobierno de respuesta “muy débil” ante tal violación de la soberanía taiwanesa. Los diputados del PDP y la UST ocuparon el estrado de la presidencia del Yuan legislativo para protestar, exigiendo medidas enérgicas. -

ISBN 986-7291-85-9.] Although 2006 marked the 40th anniversary of the launching of the Great Proletarian Cultural Revolution, understanding of this trau- matic event in mainland China is still largely limited within the parameters established by the 1981 Resolution on CPC History.1 Yet as even those who were teenagers at the time move into old age, oral history is being used to explore some of the most sensitive issues. This is shown by the appearance of two books written by mainland authors and published in Hong Kong and Taiwan. Chen Boda's Last Oral Recollections is an attempt by Chen Boda's son, Chen Xiaonong, to rehabilitate his father's reputation after he was condemned in 1980 by the reformist leadership as a counter-revolutionary for his part in the Cultural Revolution. In the process it provides new versions of the key events that took place at the centre of power. Memories of Tibet,by the leading Tibetan literary figure, Weise, Woese, born 1966), gives a view far removed from Beijing by bringing together interviews with 23 grass-roots activists from various ethnic groups and setting these in the context of the debate over how much responsibility the indigenous population of Tibet should bear for the destruction wrought on its heritage.
