It has been a life-changing experience for me, and the most challenging activity of my life. Having initially enrolled on to the LL.B course at the University of Huddersfield back in 2006, I did not imagine completing an LL.M, let alone being given the opportunity to undertake a Ph.D. The LL.M in 2012, was the beginning and some small step in to the research sphere; I did not envisage getting to the point where I would be defending a Ph.D thesis in Huddersfield several years later. A very special thanks to the Huddersfield Law Department for giving me this opportunity to carry out my doctoral research and for their financial support. In particular, I would like to express my earnest gratitude to my supervisor Professor Stuart Toddington for his patience, motivation, and wisdom. DATE:……………………… !6 ABSTRACT AND THESIS CLAIM This study examines the problems we face in making a coherent theoretical link between the international law of piracy and the law of the sea in the context of the rise in maritime piracy in Africa over the past three decades. It focuses on four nations affected by piracy in the Gulf of Guinea and Horn of Africa. Furthermore, the international law of piracy is concerned with two types of jurisdiction: prescriptive jurisdiction and enforcement jurisdiction. However, the law of the sea (UN Law of the Sea Convention) defines five types of jurisdiction: territorial seas, exclusive economic zone (EEZ), the continental shelf, high seas, and seabed or seafloor outside the area of claims of territorial seas under the EEZ. The above implies that where a State that has enforcement jurisdiction is unable or unwilling to enforce prescribed international laws against piracy, recourse ought to be had to a State with jurisdiction under the law of the sea. The current thesis seeks to demonstrate that maritime piracy has substantially increased in north-eastern and western parts of Africa because, albeit the development of the law of the sea has transposed towards acknowledging the rights (and obligations) of coastal States in order to defend their territorial seas with reference to the piratical incursions, not enough attention has been given to the consequences flowing from the fact that the coastal states in question do not possess the requisite resources and systems to enforce international law and/ or prosecute pirates. It is submitted here that piracy in its modern form in the Gulf of Aden and Gulf of Guinea is a transnational crime that may best be contained through a regional legal infrastructure. It is also argued that the multilateral approach of linking enforcement jurisdiction to Universal Jurisdiction is problematic since it translates into ‘relational statism’ that is, where States habitually pursue only their self-interests. As such, consistency and clarity in the international legal situation may best be achieved by recourse to a traditional ‘auto-limitation’ approach whereby jurisdiction is essentially territorial and can only be exercised by a State outside its territory where it obtains the consent of the territorial State (perhaps through Convention or Treaty) or in accordance with a permissive rule derived from international custom. Therefore the thesis of this study suggests the need for legal reform. Chapter 1 provides the background to the study as well as the framework for the research. The main research aims, objectives and research questions are addressed in Chapters 2, 3, 4, 5 and 6.     Couchenour 1 Piracy and Terrorism: How to Contain the Threat of Al-Shabaab and Maritime Piracy in Somalia By Thomas Couchenour The United States must help effective African militaries contain the al-Shabaab terrorist group and refrain from instigating piratical strikes rather than resorting to “imperialist intervention” in Somalia. Somalia is located in Eastern Africa, bordering Ethiopia, Eritrea, Djibouti, Kenya, and the Indian Ocean. Somalia achieved political relevance through terror organizations born under its people’s struggle for legitimate governance.i Somali maritime piracy presents a threat to an array of nations’ economic interests in the Gulf of Aden. Due to NATO and unilateral efforts from Russia, China, and India, Somali piracy damage has decreased substantially since 2011.ii The Somali terrorist organization, “al-Shabaab” is an Islamic extremist group allied with al-Qaeda and engages in similar attacks with assault weapons, dismemberings, and suicide bombings. Shabaab attacks haven’t exceeded the borders of Somalia, Kenya, and Uganda; though threats have recently been made against Washington and New York. The U.N. expects terrorist activity from al-Shabaab to increase following the US airstrike death of group Couchenour 2 leader, Ahmed Godane.iii Al-Shabaab currently presents a larger threat than maritime piracy despite issues with the Somali TFG and Kenyan and Ethiopian military forces. The present report is submitted pursuant to paragraph 30 of Security Council resolution 2125 (2013), in which the Council requested me to report on the implementation of that resolution and on the situation with respect to piracy and armed robbery at sea off the coast of Somalia. 2. The present report covers major developments on those issues since my previous report, of 21 October 2013 (S/2013/623), up until 15 October 2014. The assessment and observations herein are based on information provided by Member States and regional organizations, in conformity with paragraph 29 of resolution 2125 (2013). Information was provided by Australia, Denmark, Georgia, Greece, Italy, Panama, Turkey, the United Kingdom of Great Britain and Northern Ireland and the United States of America, as well as by the European Union and the North Atlantic Treaty Organization (NATO). The United Nations system, the International Criminal Police Organization (INTERPOL) and the Monitoring Group on Somalia and Eritrea were also consulted. II. Main developments regarding piracy off the coast of Somalia 3. Piracy and armed robbery off the coast of Somalia remain a major threat to shipping, although there were no incidents of hijacking of commercial vessels during the reporting period. The number of incidents reported to the International Maritime Organization (IMO) for the first three quarters of 2014 was 13, compared to the corresponding period in 2013, but credible reports suggest that ships continue to be targeted by Somali pirates.

This study adopts a multimethod research. It uses a quantitative approach as a nested framework for a comprehensive qualitative analysis. A process-tracing method based on classification and congruence techniques was then applied to construct a causal mechanism model, which helped to discover how the relevant factors worked together to produce Somali piracy. This study identifies and traces five evolutionary stages of Somali piracy from its genesis to its demise.
