Catastrophe Overtakes the Palestinians
Catastrophe A Note from the Editors Overtakes the Sami Hadawi’s life (1904–2004) mirrors Palestinians: that of many Palestinians of his generation. He grew up in Palestine during the British Memoirs, Part II Mandate years and was forced out in 1948, never to be allowed to return. He lived in Sami Hadawi exile the rest of his life and devoted his energy to the cause of Palestine. He became a well-known scholar of the Nakba, devoting his life to researching and documenting its effects on the Palestinians, in particular the refugees. Hadawi’s memoirs were circulated privately in English in 1996 in two volumes. In Jerusalem Quarterly 53, we published a selection from these memoirs about his early childhood in Jerusalem, titled “Sodomy, Locusts, and Cholera.” Below we publish a section dealing with the destruction of Palestine in 1948.1 The text reprinted here deals primarily with the memories of the author during May 1948, the same month in which Israel was declared a state over most of Palestine, while Jordan annexed the eastern part of the country as the kingdom’s West Bank and Egypt took over the administration of the Gaza Strip. The text below is faithful to the original with two exceptions: spelling, punctuation, and capitalization have been regularized; and we have added a few explanatory notes. This dissertation addresses this question by examining the economic behavior of a stateless people, the Palestinians, over a hundred year period, from the last decades of Ottoman rule in the early 1900s to the present. Through this historical narrative, it investigates what happened to the financial and economic assets of ordinary Palestinians when they were either rendered stateless overnight (as happened in 1948) or when they suffered a gradual loss of sovereignty and control over their economic lives (as happened between the early 1900s to the 1930s, or again between 1967 and the present). -

The Arab Bedouin Indigenous People of the Negev/Nagab
The Arab Bedouin indigenous people of the Negev/Nagab – A Short Background In 1948, on the eve of the establishment of the State of Israel, about 65,000 to 100,000 Arab Bedouin lived in the Negev/Naqab region, currently the southern part of Israel. Following the 1948 war, the state began an ongoing process of eviction of the Arab Bedouin from their dwellings. At the end of the '48 war, only 11,000 Arab Bedouin people remained in the Negev/Naqab, most of the community fled or was expelled to Jordan and Egypt, the Gaza Strip and the Sinai Peninsula. During the early 1950s and until 1966, the State of Israel concentrated the Arab Bedouin people in a under military administration. In this (سياج) ’closed zone known by the name ‘al-Siyāj period, entire villages were displaced from their locations in the western and northern Negev/Naqab and were transferred to the Siyāj area. Under the Planning and Construction Law, legislated in 1965, most of the lands in the Siyāj area were zoned as agricultural land whereby ensuring that any construction of housing would be deemed illegal, including all those houses already built which were subsequently labeled “illegal”. Thus, with a single sweeping political decision, the State of Israel transformed almost the entire Arab Bedouin collective into a population of whereas the Arab Bedouins’ only crime was exercising their basic ,״lawbreakers״ human right for adequate housing. In addition, the state of Israel denies any Arab Bedouin ownership over lands in the Negev/Naqab. It does not recognize the indigenous Arab Bedouin law or any other proof of Bedouin ownership over lands. -

ISRAEL 2019 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary This section covers Israel, including Jerusalem. In December 2017, the United States recognized Jerusalem as the capital of Israel. It is the position of the United States that the specific boundaries of Israeli sovereignty in Jerusalem are subject to final status negotiations between the parties. The Palestinian Authority (PA) exercises no authority over Jerusalem. In March 2019, the United States recognized Israeli sovereignty over the Golan Heights. A report on the West Bank and Gaza, including areas subject to the jurisdiction of the PA, is appended at the end of this report. The country’s laws and Supreme Court rulings protect the freedoms of conscience, faith, religion, and worship, regardless of an individual’s religious affiliation, and the 1992 “Basic Law: Human Dignity and Liberty” protects additional individual rights. In 2018, the Knesset passed the “Basic Law: Israel – The Nation State of the Jewish People.” According to the government, that “law determines, among other things, that the Land of Israel is the historical homeland of the Jewish people; the State of Israel is the nation state of the Jewish People, in which it realizes its natural, cultural, religious and historical right to self-determination; and exercising the right to national self-determination in the State of Israel is unique to the Jewish People.” The government continued to allow controlled access to religious sites, including the Temple Mount/Haram al-Sharif (the site containing the foundation of the first and second Jewish temple and the Dome of the Rock and al-Aqsa Mosque). -

And that's totally fine, because nothing is happening. It's almost one year since Operation Protective Edge. How time flies when you're Israeli. Moti Madmoni of the Schmerling Meat Bar, located at Alonit Junction at the entrance to Gaza, begins to organize his day. During the war, soldiers, journalists and foreigners swarmed here as the skewers of meat flowed out continually. "We did pretty well during the war," he says with a smile. He then describes how hard it was to stand over the grill while his son, a Golani soldier, was fighting on the inside. "But I prefer the quiet, although I don't believe in it. Another round is just a matter of time. This isn't genuine peace—the next battle will come and we'll accept whatever comes with love. We're not leaving. We're here and that's it." I talk with everyone I see, the vast majority of whom don't want to be photographed or quoted by name. -

'The Volunteer Tent'
September 2012 SUMMARY OF ACTIVITIES: 2011-12 AT ‘THE TENT’ – OUR ARAB-JEWISH BEDOUIN VOLUNTEER CENTER Celebrating a decade of social action and active citizenship, the ‘Volunteer Tent’ is NISPED-AJEEC’s flagship youth and young people’s community involvement program. In 2002, a small group of community activists from AJEEC pitched a tent of hope and change, founding the Arab-Bedouin Volunteer Center (The Volunteer Tent). Today, the Tent is a hub of volunteerism, community work and Arab-Jewish cooperation engaging some 700 volunteers and benefitting 10,000 people in the recognized and unrecognized Arab Bedouin villages of the Negev. The ‘Tent’ recruits volunteers from within the Arab-Bedouin community, provides them with professional training and ongoing supervision, identifies community needs and deploys volunteers throughout the Bedouin towns and villages of the Negev in a variety of programs designed to meet these needs. The primary focus of the ‘Tent” programs is on children and youth at risk. 1 In 2011-12, 700 volunteers: Arab Bedouin university and college students, high-school students; Jewish high school graduates from the Scouts youth movement and Arab Bedouin high school graduates, among them 67 full-time gap-year volunteers conducted a wide range of educational and social enrichment programs in which some 7,000 children and youth participated on a regular basis at least once a week throughout the year. Several thousand others – both children and adults- benefited from a variety of special community–based projects and activities organized by the volunteers in the Bedouin towns and villages of the Negev. An important factor contributing to the success of our volunteer programs are the strategic partnerships forged over the years and significantly expanded this year. -

Theoretical Inquiries in Law 4.2 (2003) Colonialism, Colonization, and Land Law in Mandate Palestine: The Zor al-Zarqa and Barrat Qisarya Land Disputes in Historical Perspective Geremy Forman & Alexandre Kedar* This articlefocuses on land rights, land law, and land administration within a multilayered colonial setting by examining a major land dispute in British-ruled Palestine (1917-1948). Our research reveals that the Mandate legal system extinguished indigenous rights to much land in the Zor al-Zarqa and Barrat Qisarya regions through its use of "colonial law"- the interpretation of Ottoman law by colonial officials, the use of foreign legal concepts, and the transformation of Ottoman law through supplementary legislation.However the colonial legal system was also the site of local resistance by some Palestinian Arabs attempting to remain on their land in the face of the pressure of the Mandate authorities and Jewish colonization officials. This article sheds light on the dynamics of the Mandate legal system and colonial law in the realm of land tenure relations.It also suggests that the joint efforts of Mandate and Jewish colonization officials to appropriate Geremy Forman is a Ph.D. candidate in the University of Haifa's Department of Land of Israel Studies.
