  • Advocates' Recommendations for California's November 2020 Elections
May 22, 2020 The Honorable Gavin Newsom The Honorable Alex Padilla Governor of California Secretary of State of California State Capitol Building, 1st Floor 1500 11th Street, 6th Floor Sacramento, CA 95814 Sacramento, CA 95814 RE: Revised Recommendations for California’s November 2020 Elections Dear Governor Newsom and Secretary of State Padilla: We write to update some elements of our coalition’s April 14 letter. As a group of advocates with many years of experience working to protect and expand voting rights in California, we respectfully submit this set of recommendations to help meet the challenges posed to November’s elections by the coronavirus pandemic. The primary revision to our recommendations is a shift to proposing that the minimum statewide ratio for in-person voting locations should be one for every 10,000 voters starting four days before Election Day. We applaud Governor Newsom’s Executive Order to provide every registered voter a vote-by-mail (VBM) ballot. But as the Governor, the Secretary of State, and legislative leaders have recognized, this is just a starting point. It is vitally important to move forward with the shared understanding that VBM is not a solution for everyone. We must address the risks posed by the potential reduction of in-person locations and expanded reliance on VBM - especially to communities that are underrepresented in our democratic system. These risks are well-documented and supported by data.1 They 1Asian-Americans Advancing Justice, Asian Americans Face Higher than Average Vote-by-Mail Rejection Rates in California (2017), bit.ly/AAAJIssueBrief; Romero, Mindy S., California Civic Engagement Project (CCEP), The California Voter Experience: Why African-American Voters Choose to Vote at the Polls or Vote-by-Mail, and How They Perceive Proposed Changes to California’s Voting System.

  • Governors and the Executive Branch
I' I 1 Chapter 9 Governors and the Executive Branch Ethan Rarick The history of modem American politics cannot be written without discussing Cali~omia governors. One former governor (Ronald Reagan) went on to serve as president ofthe United States, of course, but in addition to that three others ran for president (Earl Warren, Jerry Brown, and Pete Wilson), one served as chief justice of the United States (Warren), and another was a global celebrity who could not seek the presidency only because he was a foreign-born immigrant (Arnold Schwarzenegger). The status of the office as a potential presidential launching pad caused at least two other national political figures-U.S. Sen. William Knowland and former Vice President Richard Nixon-to 'run for governor, and although Nixon lost his gubernatorial bid he ofcourse went on to eventually win the presidency. Aside from national elective politics, California's chief executive governs more Americans than anyone save the pre~ident, sits atop a state with the world's ninth largest economy, and often occupies a place on the world stage similar ta the leaders ofmiddle-sized nations. The incumbent as of 2013, Jerry Brown, is no exception to any of these trends. • “The Rise and Fall of Rose Bird” Patrick K. Brown
THE RISE AND FALL OF ROSE BIRD A Career Killed by the Death Penalty by Patrick K. Brown © M.A. Program, California State University, Fullerton Justice Rose Bird, in the sixty-one capital cases heard by the California Supreme Court while she served as its Chief Justice, never voted to uphold a death sentence. Nearly every obituary written after her December 4, 1999 death made reference to this fact, noting that her votes on capital punishment led to her ouster from office in the election of 1986. This was true, both in reports from neutral observers and those written by organizations and individuals that could be characterized as sympathetic to her views. The New York Times, on December 6, 1999, wrote “[a]fter the death penalty was reinstated in California in the late 1970's, Judge Bird never upheld a death sentence, voting to vacate such sentences 61 times. She survived repeated efforts to recall her, but she was ousted after Governor George Deukmejian, a Republican, led an aggressive campaign against her. To this day, Ms. Bird’s name remains a kind of reflexive shorthand in California for ‘soft-on-crime liberal’.”1 In the ACLU News, published by the American Civil Liberties Union of Northern California, actor Mike Farrell, of M.A.S.H. television series fame, and President of Death Penalty Focus, in a tribute to Justice Bird, wrote: Virtually without exception, obituaries of former California Chief Justice Rose Bird attribute her 1986 electoral defeat to her unwavering opposition to the death penalty. In fact, her purported opposition to the death penalty was not the motivation for conservatives who set out to remove the state’s first female 1 Todd S.
