P/06/0069 APPLICANT(S) NAME: Mr M Segal PROPOSAL: Renew application no. P/03/0135 to erect approximately 80 dwellings LOCATION: Land At Maerdy Site, Rhymney, Tredegar. This application is in respect of the renewal of outline permission for residential development with all matters reserved for subsequent approval apart from the means of access. The application was presented to the planning committee held on the 16th August 2006. Members agreed the Officers recommendation that the application be deferred to enable the completion of a Section 106 Agreement that will require: - 15% of the total number of units developed on the site shall be developed as affordable housing. - The provision of an area of open space, which is reasonably related in scale and location to the development, or alternatively, a contribution of a commuted sum will be sought for provision of off-site. - A contribution to be agreed towards the creation of or improvement to existing recreation space in the catchment area of the site. On completion of the Section 106 Agreement, officers are delegated to approve the application subject to conditions. Members should be advised that, since that committee date, despite numerous reminders this Council has been unable to obtain any response in this matter from the developer. In the circumstances it is considered appropriate that the application should be refused. RECOMMENDATION that Planning Permission is refused for the following reasons:- (1) In the absence of the completion of a Section 106 Agreement, requiring an element of affordable housing, the provision of open space or alternatively a contribution of a commuted sum together with a contribution to be agreed towards the creation of or improvement to existing recreation space in the catchment area of the site, the development would be contrary to Policy H3 and Policy L9 of the Council Approved Unitary Development Plan. PREFACE ITEM APPLICATION NO. P/06/0609 APPLICANT(S) NAME: Mr G Davies PROPOSAL: Change use of part of yard and modify Condition (7) of planning permission P/03/1260 LOCATION: Penyfan Processing And Recycling Depot, Penyfan Pond Lane, Manmoel Road, Oakdale, Blackwood. This application was reported to Planning Committee on 14 February 2007 following a site visit. A decision was deferred to allow further information to be sought from the applicant. Also the opportunity was taken to consult neighbouring industrialists. Copies of the previous reports are attached. One e-mail has been received from the neighbouring carpet factory expressing concern about the effect of airborne dust on the efficiency of their process, and the quality of the yarn and the carpet. Problems were experienced for some 18 months when the Oakdale coal tips were removed. They state that dust can by-pass filtration systems, especially during summer months when vents and doors are open, and express concern about the detrimental effect on the 350 jobs at the premises. Following the site meeting the following comments were conveyed to the applicant with a view to overcoming some of the problems observed:- • Access from Rush Drive should be considered. • The surface of the lane leading to the site should be improved and a footpath introduced. • An assessment should be carried out and submitted by an environmental consultancy of the likely impact of the new processes at the site on air quality, with particular emphasis on dust. That should then inform a scheme for the control of airborne dust. • A scheme for the prevention of mud being carried onto the highway should be submitted to include as a minimum the surfacing of a significant part of the entrance into the site, and the provision of wheel washing facilities. • A scheme of drainage should be submitted that ensures that dirty water does not pool on the lane adjacent to the entrance. • A denser scheme of landscaping should be submitted, and advice should be sought from the appropriate officers of the council as to whether it would be appropriate to carry out further screen planting in that part of Penyfan Pond Country Park on the opposite side of the lane. The applicants responded in the following manner. • There is an intervening landowner between the application site and Rush Drive. • The poor condition of the lane is due to water running from the remainder of the lane, and from the park, and the applicants have maintained the road in the past. The maintenance of the lane and the provision of a footpath are for the highway authority to consider. • A licence to operate the current process has been issued by the Environmental Health Department, and the proposed operation is a closed circuit wet process that will not generate any additional dust. • A scheme for the prevention of mud is under consideration. • A cut off drain will be provided at the entrance to the site, but this will not prevent the pooling of water in the lane and on Manmoel Road where there is little or no drainage. • A scheme of landscaping has been submitted, but it is inappropriate to plant within the Penyfan Country Park. The application is now returned to Committee for Members to determine. RECOMMENDATION that Permission is granted subject to the conditions outlined in the attached report. ________________________________________________________________________ PREFACE ITEM APPLICATION NO. P/06/0648 APPLICANT(S) NAME: Mrs J Porter PROPOSAL: Erect single storey extension LOCATION: 52 Tanybryn Pontymister Risca NP11 6JR This application was reported to the Planning Committee on 16 August 2006 with a recommendation that permission be granted; a copy of the original report is attached as an appendix. Consideration of the application was deferred to allow speakers to address the Committee, which took place at the meeting on 13 September. Consideration was further deferred for a site visit which took place on 25 September. During the discussions on site it was noted that if the roof to the proposed extension were hipped the objector’s concerns would be addressed. The application was further considered by the Committee at its meeting on 4 October, when it was resolved to defer consideration to allow the applicant to submit amended plans indicating the amended roof design, on receipt of which officers would grant permission on the basis of the amended drawings and subject to the conditions recommended in the original report. The applicant was requested in writing to submit such amended drawings and a reminder letter was sent in early March 2007. No amendment or other communication has been received from the applicant and it is considered that the application should now be determined on the basis of the scheme as originally submitted. The scheme was considered by officers to be acceptable and it is recommended that permission be granted subject to the standard condition as recommended in the original report.
