    RESEARCH PAPER 02/37 Gibraltar’s Constitutional 22 MAY 2002 Future “Our aims remain to agree proposals covering all outstanding issues, including those of co-operation and sovereignty. The guiding principle of those proposals is to build a secure, stable and prosperous future for Gibraltar and a modern sustainable status consistent with British and Spanish membership of the European Union and NATO. The proposals will rest on four important pillars: safeguarding Gibraltar's way of life; measures of practical co-operation underpinned by economic assistance to secure normalisation of relations with Spain and the EU; extended self-government; and sovereignty”. Peter Hain, HC Deb, 31 January 2002, c.137WH. In July 2001 the British and Spanish Governments embarked on a new round of negotiations under the auspices of the Brussels Process to resolve the sovereignty dispute over Gibraltar. They aim to reach agreement on all unresolved issues by the summer of 2002. The results will be put to a referendum in Gibraltar. The Government of Gibraltar has objected to the process and has rejected any arrangement involving shared sovereignty between Britain and Spain. Gibraltar is pressing for the right of self-determination with regard to its constitutional future. The Brussels Process covers a wide range of topics for discussion. This paper looks primarily at the sovereignty debate. It also considers how the Gibraltar issue has been dealt with at the United Nations.     At the Court at Buckingham Palace THE 14th DAY OF DECEMBER 2006 PRESENT, THE QUEEN’S MOST EXCELLENT MAJESTY IN COUNCIL Whereas Gibraltar is part of Her Majesty’s dominions and Her Majesty’s Government have given assurances to the people of Gibraltar that Gibraltar will remain part of Her Majesty’s dominions unless and until an Act of Parliament otherwise provides, and furthermore that Her Majesty’s Government will never enter into arrangements under which the people of Gibraltar would pass under the sovereignty of another state against their freely and democratically expressed wishes: And whereas the people of Gibraltar have in a referendum held on 30th November 2006 freely approved and accepted the Constitution annexed to this Order which gives the people of Gibraltar that degree of self-government which is compatible with British sovereignty of Gibraltar and with the fact that the United Kingdom remains fully responsible for Gibraltar’s external relations: Now, therefore, Her Majesty, by virtue and in exercise of all the powers enabling Her to do so, is pleased, by and with the advice of Her Privy Council, to order, and it is ordered, as follows:- Citation, commencement and interpretation 1.-(1) This Order may be cited as the Gibraltar Constitution Order 2006.     Tax Insights from International Tax Services Dutch and Luxembourg dividend withholding tax exemption after CJEU ruling on Gibraltar companies May 8, 2020 In brief The Court of Justice of the European Union (CJEU) on April 2 ruled that a company incorporated under the laws of Gibraltar and resident in Gibraltar does not meet the legal form requirement, and is not subject to taxation as provided under article 2, a) of the EU Parent-Subsidiary Directive and the annex thereto. Gibraltar and Netherlands structures Since the withholding tax exemption under Dutch domestic law contains neither the legal form requirement nor the taxation requirement set forth by the EU Parent-Subsidiary Directive, the above ruling is not anticipated to adversely impact the application thereof with respect to distributions from a Dutch subsidiary to a Gibraltar tax-resident parent company. Gibraltar and Luxembourg structures The CJEU mentioned in its decision, in line with the Advocate General’s conclusion, that the judgment is without prejudice to the question of the application of the fundamental freedoms available in the Treaty of the Functioning of the EU (TFEU), which are applicable for all European countries. The CJEU did however not treat this point in further detail. Based on this, companies could still potentially invoke the fundamental freedoms to be entitled to the dividend withholding tax exemption. In detail CJEU ruling summary The CJEU ruling considers how to apply the EU Parent-Subsidiary Directive in the context of a parent company established in Gibraltar.
