This is the term preferred by the World Bank to refer to social and economic effects of land acquisition. The IFC policy in particular requires resettlement response to all those being economically and socially displaced. Easement This represents a formal right in properties ceded by the land owner to another for rights of access. The other types are the Right of Way and Wayleave. All the three do not amount to the rights of ownership on the part of residents although there are certain activities or actions which may be allowed such as putting up non-structural assets, e.g., ornamental plants in front of the legal property boundaries. Usually, an easement is recorded with appropriate survey information and legal text with the Registry of Lands and Deeds and is written into or read in conjunction with the respective title deeds. cut-off date Refers to a day on and beyond which any person who occupies land required for Project use, will not be eligible for compensation. The date is often the day when the assessment of persons and their property in the Project area commences. Development of the area covered under a moratorium is prohibited. Project- Is any person who, as a result of the implementation of the Affected project, loses the right to own, use, or otherwise benefit from a Person (PAP) built structure, land (residential, agricultural, pasture or undeveloped/unused land), annual or perennial crops and trees, or any other fixed or moveable asset, either in full or in part, permanently or temporarily. Affected people might be displaced either physically (“Physically Displaced People”) or economically (“Economically Displaced People”). Livelihood LR is the process by which a project-affected person (PAP) is Restoration given the opportunity to restore or enhance the means of earning an income which has been permanently lost due to involuntary economic displacement arising from a project’s land acquisition. On the other hand, Livelihood Restoration Plan is an operational instrument developed to remedy the effects of project –induced situations of restrictions in land access or use that only involve 5 | P a g e economic displacement, with no permanent or temporal physical displacement. Land This is the process of acquiring land under the legally mandated acquisition procedures of eminent domain Involuntary Occurs wherever and whenever there is compulsory acquisition Resettlement of land or defacto change in the use of land that is occupied or used done by a legally constituted authority in public interest. Land acquisition involves the physical or economic displacement of impacted persons due to project-related land acquisition and does not apply in situations of willing seller willing buyer where the transaction is purely voluntary and the buyer can not resort to expropriation. Economic Loss of income streams or means of livelihood resulting from displacement land acquisition or obstructed access to resources (land, water, or forest) resulting from the construction or operation of a project or its associated facilities. 6 | P a g e EXECUTIVE SUMMARY The Zambia Education Enhancement Early Learning (ZEEL) is a national project to be implemented by the Government of the Republic of Zambia (GRZ) under the Ministry of General Education (MoGE). The project aims to ensure children’s school readiness before entering primary school to equip them for formal learning. The Project aims to improve access to quality early childhood learning for children aged 3-6 years. It comprises four components namely: a. Increasing Equitable Access to Early Childhood Education b. Implement early childhood education quality standards c. Enhance delivery of quality early learning and care d. System strengthening, project management, M&E and communication The Zambia Enhancement Early Learning (ZEEL) is a $39.8 million World Bank project that aims to provide support towards Early Child Education Sector under the above 4 (four) components. The services will be directed at strengthening the cognitive, socio-emotional and physical development of children in the project’s targeted areas. This project will be implemented in the 10 provinces across the country and the benefiting districts and sites will be selected using a site selection criterion developed by the Ministry together with world bank. Rationale for the Resettlement Policy Framework The ZEEL project will consist of construction of additional infrastructure within existing school premises to include early childhood learning centers and other centers will also be built on green sites depending on the needs and demands in a particular community. The proposed school sites will need to be screened to ensure they are free of any encumbrances. If sites are not free of encumbrances, appropriate land acquisition processes will need to be adhered to. It is still unclear whether land will be acquired through voluntary land donation or outright purchase for areas that will not have readily available land in existing school premises. The selection of school sites has not yet been confirmed and therefore to manage any potential impacts of land acquisition, a Resettlement 7 | P a g e Policy Framework (RPF) has been prepared. To this effect the World Bank Environmental and Social Standard ESS5 related to land acquisition and land use restriction will be used. The RPF provides guidance on how social impacts will be ascertained; identified; evaluated; mitigated; and monitored. The RPF emphasizes the need to ensure
