Article 77 of the Chicago Convention provides that the Council"shall determine in what manner the provisions ofthis Convention relating to nation ality ofaircraft shall apply to aircraft operated by international operating agencies". The Subcom mittee decided unanimously that such a determination would be binding on all Contracting States if made within the scope of the authority given to the Council by Article 77, that the provisions of the Chicago Convention relating to nationality ofaircraft include not only Articles 17 to 21 which appear in Chapter III entitled "Nationality of Aircraft'· but generally all articles of the Convention which either expressly refer to nationality of aircraft or imply it, and that the aircraft of an international operating agency would not be State aircraft within the meaning of Article 3 of the Chicago Con vention.
