Lyden ("Plaintiff" or "Lyden"), states and alleges, as follows: NATURE OF THE CASE 1. This is a patent infringement lawsuit brought under the patent laws of the United States, including 35 U.S.C. §§ 271, 281, 283-85. 2. In addition, this is an unfair competition and unlawful business, trade practices lawsuit arising under common law, and including ORS § 646.607, 646.608, and 646.638, but also ORS § 166.720, RICO. THE PARTIES 3. Robert M. Lyden is a private individual having a residence at 18261 S.W. Fallatin Loop, Aloha, Oregon 97007, in the United States. 4. Nike, Inc. is a corporation organized under the laws of the State of Oregon, having its World Headquarters and principle place of business at One Bowerman Drive, Beaverton, Oregon 97005, in the United States. -
A Tale of Two Tracks
A Tale of Two Tracks One track stood as a monument to history, a reminder of memories and iconic moments that made the little cowtown that is Eugene into “TrackTown U.S.A.” The other stands ‒ only partially, at the moment ‒ for a desire to innovate towards the future and pursue success at any cost, even that of nostalgia. The former of the two Hayward Fields has long been leveled to the ground, with the remains of the historic East Grandstand having been demolished into splinters and carted away. The latter Hayward Field is still a work in progress over a year later, and feelings towards the new track, which was labeled as a “renovation” by the University of Oregon but which in reality is a complete rebuild, are split across the campus. “I don’t think it’s a secret Phil Knight owns UO,” Erin Masterson, a sophomore at UO, says as she sits cross-legged while her pet ball python Casper winds his narrow yellow and white body around her arms. “He puts so much money into the sports programs which in turn bring so much money back into the school.” Phil Knight, a founder of Nike, and the University of Oregon have a long history together, but it all started right in the middle of Hayward Field. As legend has it, Knight and Bill Bowerman, the co-founders of Nike, created and sold the first “waffle-soled” shoes out of Knight’s trunk at Hayward, and the rest is history. Knight, along with other private donors, is contributing the 200 million dollars needed to build the track, which allowed UO to secure the bids to host both the 2020 Olympic trials and the IAAF World Outdoor Track & Field Championships in 2021 in Eugene. -

What drives the companies to use athletes as spokesperson and how do they cope with risks involved in it? As recently news have been filled with scandals involving athletes with multimillion endorsement deals how could have these been avoided and what are the effects on endorsing companies? Main focus of the study is to investigate what kind of methods marketers use to ensure a successful endorsement campaign? Secondary focus was on researching what kind of risks companies face when cooperating with a star athlete? This thesis uses secondary data as its main source of information. Conducted research show that even though use of athletes as endorsers can be very risky, it can also lead to success. In celebrity endorsement only certainty is uncertainty. MARK SMITH / HEDCHEQ Mark Smith joined Nike in April, 1989. Hired by then VP of Design Mark Parker to explore concept apparel and graphics. Quickly drafted into Nike’s work with In Living Color, Madonna, Janet Jackson, and Heavy D, he was identified as the go-to guy for “energy” projects, out of the box design and elevated presentations. His other primary contributions helped establish Nike’s newly forming International Tee Shirt Program. The original FORCE logo was his first global graphic brand product mark. In 1991, footwear guru, Tinker Hatfield tapped Smith to partner on AIR RAID, and ultimately hired him into Nike Footwear Design where he apprenticed with Hatfield on Jordan, Running, Training, Tennis, and concept ideations including N Series, ACG, and Relay. Smith helped elevate Nike product communication and presentation by bringing diverse creative disciplines to projects and team, including, audio-video direction and production, environmental and retail concepting, interactive computer and digital, as well as product, apparel, graphics, and branding design work. Smith’s multilingual “performance graphic” outsole design was a notable contribution to Air Jordan IX. Color, graphic, and support design duties on AJXIII, AJXIV, and AJXV continued to elevate Smith’s experience and teamwork with Hatfield and Michael Jordan. In 2000, Smith “took a break” from Nike to return to his family and West Coast beach roots in Southern California. “VP Design at Vans, that’s where I earned, in effect, a Masters of Business degree in a year and a day.” Returning to Portland in 2002, Smith rejoined Nike and slotted naturally into the Innovation Kitchen, Nike’s newly formed technical and creative ‘black-ops think tank’. -

SNEAKER SLANG GLOSSARY Every culture has it’s own unique slang that helps dedicated connoisseurs stay in tune with what they love to do. Sneakers aren’t much different, fanatics use these terms on a daily basis to communicate with each other. Every wonder what does DEADSTOCK mean? Well you came to the right place. We will school you on all of the trendy words that make up the sneaker culture. Deadstock - DS - Is one of the most common terms used amongst sneakerheads. It implies that the shoe up for sale is brand new and never worn or tried on. Very Near Deadstock - VNDS - If a shoe is worn slightly but is close to deadstock condition. Near Deadstock - NDS - If a shoe is worn consecutively and shows slight wear but can pass as deadstock if cleaned and worked on. Limited Edition - LE - A shoe that is produced in limited quantities and is only available through a select few retailers. Player Exclusive - PE- A shoe that was produced under the supervision of a specific athlete and customized with certain colors or patterns that are designed accordingly to the athletes team or country affiliation. Skateboard - SB - A shoe line dedicated to Skateboarding. Original - OG - A shoe that was introduced before a retro version was released. This term is best associated with Nike shoes. Air Max - AM- Nike initially introduced the the Air Max technology in 1987 on the Nike Air Max 1. The shoe is supported by an air cushioning that is placed underneath the foot.
