Lyden hereby realleges and incorporates by reference paragraphs 1-9, inclusive, as though fully set forth herein. 2ND AMENDED COMPLAINT .doc 3 Case 3:13-cv-00662-HZ c Document 23 Filed 12/06/13 Page 4 of 58 Page ID#: 6153 11. Plaintiff Robert M. Lyden ("Lyden") has a history as a coach, educator, and innovator. Lyden received dual Masters' Degrees in History and Public Administration from the University of Minnesota in 1982 and 1988. 12. Lyden also filed several patent applications and worked as an independent inventor between March, 1985 and May, 1990. 13. Between May, 1989 and May, 1990, Lyden approached and disclosed to Nike, Inc. several of Lyden's inventions, and these were later excluded from Nike, Inc.'s ownership under the terms of Lyden's "Employee Invention And Secrecy Agreement" executed on August 8, 1990. 14. In May, 1989, Lyden disclosed to Nike, Inc. as an independent inventor the three dimensional shoe upper design and pattern shown in a photo which was taken with a copy of"The Minnesota Daily" newspaper dated May 8, 1989, attached hereto as Exhibit C, and shortly afterwards Lyden was informed by Mr. Dan Potter that the shoe upper pattern had been seen by Nike, Inc.'s lead designer, Mr. Tinker Hatfield, and also that he liked it. 15. Between August 31, 1989 and May, 1990, Lyden disclosed to Nike, Inc. a disclosure for a speedsuit relating to track & field entitled "Aerodynamic Athletic Apparel Background For U.S. Patent Application And I OR Trademark Protection," dated August 31, 1989, attached hereto as Exhibit D. 16. In 1990, given Lyden's demonstrated knowledge of athletics, footwear and patents, Potter invited Lyden to apply for a position opening in the patents department at Nike, Inc. 2ND AMENDED COMPLAINT.doc 4 Case 3:13-cv-00662-HZ Document 23 Filed 12/06/13 Page 5 of 58 Page ID#: 6154 0 0 Factual Background. Continued (Lyden and Nike, Inc. May, 1990 -September 9, 1996) 17. Lyden hereby realleges and incorporates by reference paragraphs 1-16, inclusive, as though fully set forth herein. 18. Lyden was hired by Nike, Inc. as "Patents and Inventions Assistant" to assist Potter in Nike, Inc.'s patent department in May, 1990, and Lyden worked as a regular employee for Nike, Inc. at its world headquarters located in Beaverton, Oregon until September 9, 1996. 19. Mark Parker was the Corporate Vice-President with oversight of the Design and Research & Development Group, and later the General Manager of Nike, Inc. during the time Lyden worked as a regular employee for Nike, Inc. 20. In July, 1990, Lyden was assigned to gather information for a design patent for a shoe upper which was named the HUARCHE by Nike, Inc. designer Mr. Tinker Hatfield. The shoe upper designs of Hatfield relating to the so-called HUARCHE style athletic shoes were later the subject of several U.S. Design Patents, e.g., U.S. Design 322,505, attached hereto as Exhibit E, which resembles the three dimensional shoe upper design of Lyden shown in Exhibit C. 21. Many so-called HUARACHE style athletic footwear were later made by Nike, Inc. and commercially successful. Hatfield received a national design award for the HUARACHE shoe design. 22. Between May, 1990 and September 9, 1996, Lyden assisted both Nike, Inc.'s in-house and external patent counsel in numerous patent litigations. In the course of the litigation "Wolverine World Wide, Inc. and Brooks Shoes, Inc., vs. Nike, Inc.," Civil 2ND AMENDED COMPLAINT.doc 5 Case 3:13-cv-00662-HZ Document 23 Filed 12/06/13 Page 6 of 58 Page ID#: 6155 0 Action No. 1:92-cv-886, which concerned the HUARACHE style shoe upper, a former member ofNike, Inc.'s patent department found Hatfield's original drawing relating to the photocopy which had been backdated to January 13, 1989 in Lyden's presence, but it was actually drawn on an oversized board dated June 13, 1989, thus after the date of Lyden's submission to Nike, Inc. in May, 1989. It was then apparent that a misappropriation of Lyden's design and invention had taken place. 23. Nike, Inc. needed to have actual ownership of the HUARACHE upper design because the company had sold and continued to sell millions of dollars of HUARACHE style footwear products, and so Lyden proposed to Nike, Inc. in-house patent counsel that Nike, Inc. simply pay him for one season of design work at Hatfield's level of compensation. Nike, Inc. delayed but eventually agreed to Lyden's suggestion and the result was the "Intellectual Property License Agreement" dated December 19, 1997, attached hereto as Exhibit F. 24. As part of the "Intellectual Property Agreement," Exhibit F, Lyden also granted to Nike, Inc. a non-exclusive license agreement to the invention and know-how associated with the aerodynamic apparel disclosure of Lyden made in August, 1989, Exhibit D, should Nike, Inc. possibly choose to make such aerodynamic apparel in the future. 25. Between May, 1990 and September, 1996, besides assisting Nike, Inc.'s in- house and external patent counsel, Lyden also made contributions to Nike, Inc.'s research and development efforts. As a result, Lyden is a named inventor on four design patents and fourteen utility patents assigned to Nike, Inc. 2ND AMENDED COMPLAINT.doc 6 Case 3:13-cv-00662-HZ Document 23 Filed 12/06/13 Page 7 of 58 Page ID#: 6156 0 0 26. As discussed in paragraph nine of Lyden's letter to Nike, Inc.'s in-house patent counsel Mr. James Niegowski dated April21, 2010, which is attached hereto as Exhibit Q, Lyden had suggested and made drawings resembling the later commercialized Nike, Inc. FREE athletic shoe during the time Lyden served an employee and consultant to Nike, Inc. between May, 1990- September 9, 1998, e.g., an outsole design by Lyden resembling the FREE is attached hereto as Exhibit Z. 27. However, when Nike, Inc. later filed for utility patents relating to the FREE athletic shoe Lyden was not recited as one of the named inventors, and more importantly, Nike, Inc.

  • Southern Oregon Past& Medford's Nike Connection: Bill Bowerman By
Medford’s Nike Connection: Bill Bowerman By Dennis Powers Former Medford High football player and coach, Bill Bowerman, later went on to become a legend in coaching track--and a co-founder of Nike. He played for another stand-out, Prink Callison, whose Medford teams had a 44-game win streak at one time and won three state championships from 1926 to 1928. The 1928 Medford “Tigers” (as the team was called then)--one of the best teams ever in Southern Oregon--averaged 36 points a game, limited opponents to 40 points for the entire season, and Bill Bowerman was their left end. Born in 1911, Bowerman moved to Medford when he was 10 years old. Raised by his mother and aunts (his father left the family when he was 2), he was “a mean little kid,” by his own admission. When he went out for football as a sophomore, Callison wouldn’t put up with his antics and kicked him off the varsity team to junior varsity. Bowerman credits both him and Superintendent Hedrick (for whom the middle school on East Jackson Street is named) as disciplinarians who straightened him out. He also played basketball and edited the school newspaper. After high school, he went to the University of Oregon (“OU”) and became a quarter- mile runner under legendary Ducks’ track coach, Colonel Bill Hayward; this coach became the mentor under which Bowerman modeled himself and learned the “concepts of greatness,” as he reminisced. With his bachelor’s degree in 1934, Bowerman decided to attend medical school, but he first had to earn tuition.

  • A Tale of Two Tracks
A Tale of Two Tracks One track stood as a monument to history, a reminder of memories and iconic moments that made the little cowtown that is Eugene into “TrackTown U.S.A.” The other stands ‒ only partially, at the moment ‒ for a desire to innovate towards the future and pursue success at any cost, even that of nostalgia. The former of the two Hayward Fields has long been leveled to the ground, with the remains of the historic East Grandstand having been demolished into splinters and carted away. The latter Hayward Field is still a work in progress over a year later, and feelings towards the new track, which was labeled as a “renovation” by the University of Oregon but which in reality is a complete rebuild, are split across the campus. “I don’t think it’s a secret Phil Knight owns UO,” Erin Masterson, a sophomore at UO, says as she sits cross-legged while her pet ball python Casper winds his narrow yellow and white body around her arms. “He puts so much money into the sports programs which in turn bring so much money back into the school.” Phil Knight, a founder of Nike, and the University of Oregon have a long history together, but it all started right in the middle of Hayward Field. As legend has it, Knight and Bill Bowerman, the co-founders of Nike, created and sold the first “waffle-soled” shoes out of Knight’s trunk at Hayward, and the rest is history. Knight, along with other private donors, is contributing the 200 million dollars needed to build the track, which allowed UO to secure the bids to host both the 2020 Olympic trials and the IAAF World Outdoor Track & Field Championships in 2021 in Eugene.

EDDY LU: I grew up in the ’80s, and that was when Michael Jordan was in his prime. All the commercials and the visual imagery of Michael Jordan dunking, shattering backboards, and criss-crossing over people. That was my impression, of course. What shoes was he wearing? He was wearing his Jordans. You know, his Nikes. HOFFMAN: That’s Eddy Lu, cofounder of GOAT, the online marketplace for premium sneakers that every sneakerhead knows. As a child of the ’80s and a basketball fan, Eddy has vivid memories of Jordan – and his Nikes. Jordan played his first NBA game for the Chicago Bulls in 1984, and signed his Nike endorsement deal the same year. Right away, he started making news, making plays… and Nike started making Air Jordans. LU: I still remember the price tag. They were $130 at Foot Locker. I couldn't afford ’em. Like any kid, you want something, but your parents will buy you something that's comparable. So instead of the Jordans, they maybe would get me the Penny Hardaways or even the Charles Barkleys, or another shoe that was worn by an iconic player, but they just couldn't justify buying the premium Jordans. And I think that really helped fuel my passion and my nostalgia for sneakers, and even Jordans, right to this day. GOAT stands for Greatest Of All Time. We love sneakers, Michael Jordan was our idol, and he was the GOAT.

What drives the companies to use athletes as spokesperson and how do they cope with risks involved in it? As recently news have been filled with scandals involving athletes with multimillion endorsement deals how could have these been avoided and what are the effects on endorsing companies? Main focus of the study is to investigate what kind of methods marketers use to ensure a successful endorsement campaign? Secondary focus was on researching what kind of risks companies face when cooperating with a star athlete? This thesis uses secondary data as its main source of information. Conducted research show that even though use of athletes as endorsers can be very risky, it can also lead to success. In celebrity endorsement only certainty is uncertainty. It was also discovered that marketers often value extremely different attributes when selecting a female endorser than they do with male endorsers. 2 Keywords: Marketing Communications, Celebrity endorsement HELSINKI METROPOLIA UNIVERSITY OF APPLIED SCIENCES UNIVERSITY OF LINCOLN Koulutusohjelma: European Management Pääaineet Lincolnin yliopistossa: Markkinointi ja Mainonta Opinnäytetyön aihe: Urheilijat mainostajina – Urheilutähdet pelaamassa mainonnan kentällä Tekijä: Petri Myllylä Vuosi: 2010 Sanamäärä: 9129 Abstrakti Tämä opinnäytetyö tutkii julkisuuden henkilöiden käyttöä mainonnassa, keskittyen etenkin urheilijoihin.

Some of the objectives of the Nike Track Club will be as follows: (1) To de velop and promote age-group competition, fun-runs, and road races; (2) To provide coaching for those interested; (3) To offer numerous workshops, lectures, and se minars on the subject of running as presented by key resource people here in the Bay Area and from throughout the country; (4) To provide a clearing house for pam phlets and other materials; (5) To encourage executives of business, industry, and government to promote and support physical fitness/running programs. So whether you're a sub-2:20 marathoner or a beginning runner, the Nike Track Club extends an open invitation to join them.
