The Surveillance Dimensions of the Use of Article Social Media by UK Police Forces Elena M. Egawhary Columbia University, USA [email protected] Abstract This paper explores the various surveillance practices involved in the use of social media for communication and investigation purposes by UK police forces. In doing so, it analyses internal policy documents and official guidance obtained through freedom of information (FOI) requests sent to 46 police forces in the United Kingdom. This analysis finds that UK police forces advise their staff to simultaneously engage in both surveillance and counter-surveillance strategies in their use of social media as a policing tool. Introduction The use of social media by UK police forces falls into two broad categories: communication (or engagement) and investigation (or operational use). UK police forces began registering corporate accounts on Twitter and Facebook for communication purposes for the first time in 2008. However, UK police forces’ use of the internet for investigative purposes dates back to April 2001 with the creation of the National Hi-Tech Crime Unit (NHTCU) to “investigate attacks on the Critical National Infrastructure; major internet based offences of paedophilia, fraud or extortion; information from seized electronic media and gather intelligence on cybercrime and cybercriminals” (Corbitt 2001: 29). Prior to 2001, most of the responsibility for using social networking sites to investigate crime fell to a small number of digital evidence recovery officers who were “swamped and learning on the job” (Thomas 2005) resulting in a reportedly “huge workload” (Goodwin 2005). This suggests that the use of social media in UK policing began in an unstructured way and “on the basis of initiatives by individual officers and subsequently with varying degrees of official support” (Crump 2011: 1). -

For requests submitted by the same applicant these can be aggregated together for cost purposes. For any force where Section 12 is relevant we are happy for you to issue a refusal notice and provide an explanation as to why cost is relevant. However, if a request just relates to comms data (e.g. case no 1440/14) there is no harm in including the number of RIPA applications that would require a manual search as the total number of comms data only by force has been disclosed previously and is published. With regard to requests asking for ALL RIPA APPLICATIONS, if it relates to several years of information, we can see no harm in stating how many RIPA applications you would have to search through in that time period for excess costs to apply. In 1962, the Royal Commission on the Police formally acknowledged HMIC’s contribution to policing. HMIs are appointed by the Crown on the recommendation of the Home Secretary and report to HM Chief Inspector of Constabulary, who is the Home Secretary’s principal professional policing adviser and is independent of both the Home Office and the police service. Introduction to the Area Cumbria is a non-metropolitan County in North West England. Cumbria's largest settlement and only city is Carlisle, in the north of the County. The largest town, Barrow-in-Furness, in the south, is slightly smaller. The County's population is largely rural. The County of Cumbria consists of six districts (Allerdale, Barrow-in-Furness, Carlisle, Copeland, Eden and South Lakeland), and has a population of just under half a million. Cumbria is one of the most sparsely populated counties in the United Kingdom, with 73.4 people per km2 (190/sq. mi). The Chief Constable for Cumbria Constabulary Code of Corporate Governance 2017/2018 P a g e | 1 Introduction The statutory responsibilities of the Chief Constable ‘to maintain the Queen’s Peace’ are outlined in various Police Acts. The Police and Social Responsibility Act 2011 (PR&SRA), which introduced Police and Crime Commissioners, re-enforced the operational independence of the Chief Constable and clarified his role in supporting the delivery of the Commissioner’s Police and Crime Plan. The PR&SRA also established the Chief Constable for Cumbria Constabulary (the Constabulary) as a separate corporate sole. Accordingly, the Chief Constable is responsible for ensuring that business of the Constabulary is conducted in accordance with this statutory and regulatory framework and in accordance with proper standards. This includes ensuring that public money is safeguarded, properly accounted for and used economically, efficiently and effectively. In fulfilling this overall responsibility, the Chief Constable is responsible for putting in place proper arrangements for governance, including risk management and the arrangements for ensuring the delivery of the functions and duties of his office. In doing this, the Chief Constable approves and adopts annually this Code of Corporate Governance, ‘The Code’. The Code gives clarity to the way the Chief Constable governs and sets out the frameworks that are in place to support the overall arrangements for Cumbria Constabulary. The Code is based on the core principles of governance set out within the CIPFA/SOLACE good governance standard for public services which has ‘proper practices’ status. On an annual basis the Chief Constable will produce an Annual Governance Statement (AGS). -

Cumbria Narpo newsletter Spring / Summer 2020 Opening remarks from the Chair 11th March was the second Annual General Meeting of the Cumbria Branch having joined the Cumberland and Westmorland with Furness branches. I am delighted to say that I was re-elected as the Chair of the Branch a position I really do enjoy and can say that all has gone well since the amalgamation. Although life hasn’t been easy as our national database has undergone many changes and updates with still more to come under the reorganisation of the membership database. As you will see from our obituary section we have lost many friends since our last newsletter, which is always sad, but our members tell us that they appreciate being kept informed if former colleagues die. As you will appreciate in many cases spouses played a vital role in an officers police career and were known to many of the Cumbria police family as the serving officer so we have therefore decided to continue reporting their deaths, if we are notified. Narpo Cumbria send out obituary notices by email and sympathy cards by post to the family of every deceased officer or family member even if those it refers to were not members of our association. We don’t discriminate between member and non-member but feel their colleagues would wish to be informed should they have passed. We receive many email replies with kind words and memories of the person no longer with us. Rights of Data Subjects Notice Section 44 Data Protection Act 2018 Version 1.0 May 2020 National Law Enforcement Automatic Number Plate Recognition (ANPR) Capability (NAC) The National Law Enforcement Automatic Number Plate Recognition (ANPR) capability (NAC) enables the police and other law enforcement agencies (LEA) to benefit from operational use of ANPR. It consists of: • the National ANPR Service (NAS) which is a single national system comprising standardised functionality to enable use for operational response, investigation and intelligence purposes as well as a single national store of data, and; • the National ANPR Infrastructure (NAI), which is a network of ANPR cameras, communications links, firewalls and other related supporting components. Controllers The joint controllers for the NAS are: a) The ANPR lead within the National Policing Chief’s Council (NPCC) who is designated as the lead controller b) Chief officers of police forces in England & Wales (Schedule 1) c) The Heads of other LEAs (Schedule 1) d) The Secretary of State for the Home Department (HO) (Schedule 1) The controllers for the NAI are the chief officer of the police force or LEA that manages the components of the NAI within their organisation. The HO has established a central point of contact to support and manage data subject enquiries and any requests may be submitted to either [email protected] or to the police force or LEA directly using contact details as shown in Schedule 1. Legal basis and Purpose of Processing ANPR Data The NAC operates under a complex framework of legislation of general application, including the General Data Protection Regulations (GDPR), the Data Protection Act (2018) (DPA), the Surveillance Camera Code of practice issued under the Protection Of Freedoms Act 2012 (PoFA) and Common Law.
