("RIAA"), on its own behalf and on behalf of SoundExchange, presently an unincorporated division ofthe RIAA, submits the following comments in response to the Copyright Office Notice published at 67 Fed. Reg. 70093 (November 20, 2002). The members of RIAA and SoundExchange, which are not entirely co-extensive, own the copyrights in more than 85% of all the sound recordings legitimately sold in the United States. The Librarian of Congress has designated SoundExchange as the agent to receive royalty fees and statements of account submitted by eligible nonsubscription transmission services under provisions ofthe Section 112 and 114 licenses that are directly at issue in the above-referenced proceeding. 37 C.F.R. $ 261.4(b). Accordingly, RIAA and SoundExchange each have a significant interest in the royalty rates that are the subject of the proceeding referenced above. See 17 U.S.C. $ 803(a)(1). Attached as Exhibits A and B are lists of RIAA and SoundExchange members. These lists, particularly the SoundExchange list, may be amended as additional record companies join one or both organizations. On behalf of its members, RIAA is engaged in ongoing negotiations with the affected services and remains hopeful that voluntary agreements will be reached and that CARP proceedings will be avoided. If CARP proceedings are required to set terms and rates for the Section 114 statutory license for some or all of the services involved in this proceeding for the relevant period, RIAA or SoundExchange, or both, intend to fully participate in any such proceedings. Likewise, RIAA or SoundExchange, or both, intend to fully participate in any CARP proceedings to set rates and terms for the Section 112 statutory license for the relevant period. Determination to get through it is very important as is belief that you will get through it. I faced my toughest challenge in my life when both my parents passed away, within a year of each other, when I was 18. I had to leave my home in Brooklyn during my sophomore year at N.Y.U and go to live with my sister, her husband and their one-year-old daughter in Bayside, Queens. Because of them and an active support group of friends at N.Y.U – where I became President of the college’s Student Council – I didn’t face my loneliness and feelings of being an “orphan” until I was living alone at Harvard Law School a few years later. Given I had a lifetime aggregate sum of $4,000 to my name, I was dependent on a full tuition scholarship which I would lose if I didn’t maintain at least a “B” average. With no one from my support group present to help me get through this period of deep anxiety, I turned to the law school’s psychiatrist for a year to help get me through this dark transitional period. During this time, I learned a critical life lesson: it is certainly no sign of weakness to get professional help when needed. My next major life turning point occurred in the year 1960. I was an associate at the law fi rm of Rosenman, Colin, Petschek and Freund servicing clients such as CBS, CBS founder William Paley and other major corporations.
