Cherokee Ethnogenesis in Southwestern North Carolina

Rodning Dozens of Cherokee towns dotted the river valleys of the Appalachian Summit province in southwestern North Carolina during the eighteenth century (Figure 16-1; Dickens 1967, 1978, 1979; Perdue 1998; Persico 1979; Shumate et al. 2005; Smith 1979). What developments led to the formation of these Cherokee towns? Of course, native people had been living in the Appalachian Summit for thousands of years, through the Paleoindian, Archaic, Woodland, and Mississippi periods (Dickens 1976; Keel 1976; Purrington 1983; Ward and Davis 1999). What are the archaeological correlates of Cherokee culture, when are they visible archaeologically, and what can archaeology contribute to knowledge of the origins and development of Cherokee culture in southwestern North Carolina? Archaeologists, myself included, have often focused on the characteristics of pottery and other artifacts as clues about the development of Cherokee culture, which is a valid approach, but not the only approach (Dickens 1978, 1979, 1986; Hally 1986; Riggs and Rodning 2002; Rodning 2008; Schroedl 1986a; Wilson and Rodning 2002). In this paper (see also Rodning 2009a, 2010a, 2011b), I focus on the development of Cherokee towns and townhouses. Given the significance of towns and town affiliations to Cherokee identity and landscape during the 1700s (Boulware 2011; Chambers 2010; Smith 1979), I suggest that tracing the development of towns and townhouses helps us understand Cherokee ethnogenesis, more generally. -

JOHN ROSS'S DECISION In the spring and early summer of 1861 Ross counseled neutrality, not just for the Cherokees, but for all the tribes of Indian Territory. As the summer drew to a close, Ross, subjected to tremendous pressures from inside and outside the Cherokee Na tion, realized the impossibility of that stance. Facing his as sembled people, he expounded on the validity of both the Union and Confederate causes. He acknowledged the importance of the Cherokees' treaty with the federal government in whose hands lay the tribe's trust funds. The tribe's policy of neutrality seemed successful to that point, but Ross addressed his greatest concern, the unity of the Cherokee Nation, with the following words: The great object with me has been to have the Cherokee people harmonious and united in the full and free exercise and enjoyment of all of their rights of person and property. Union is strength, dissension is weakness, misery ruin! In time of peace together! in time of war, if war must come, fight together. 2 His speech contained no surprises and nothing indicated what was to follow. Ross concluded: The permanent disruption ofthe United States into two governments is now probable. The State [Arkansas] on our border and the Indian nations about us have severed their connection from the United States and joined the Confederate States. Our general interest is inseparable from theirs and it is not desirable that we should stand alone. The preservation of our rights and of our existence are above every other consideration. The Cherokee’s Claim to a Congressional Delegate Assessed Under the Canons of Construction* The Treaty of New Echota is the pact between the Cherokee Nation and the United States which served as the legal basis for Cherokee removal via the infamous Trail of Tears. The Treaty of New Echota contains several promises made by the United States in exchange for the Cherokee ancestral land in North Carolina and several other southern states. One of these promises, found in Article 7, states that the Cherokee “shall be entitled to a delegate in the House of Representatives of the United States whenever Congress shall make provision for the same.” Article 7 has been the recent subject of controversy due to its textual ambiguity and historical implications of possible Native American representation at the federal level. These potential ramifications, coupled with the mounting pressure from the Cherokee Nation claiming that Article 7 grants the Tribe an affirmative right to a delegate, warrants an investigation into Article 7’s effect. From its robust body of precedent on Native American treaty interpretation, the U.S. Supreme Court has developed a set of rules called the Indian law canons of construction which federal courts apply when the effect of a treaty involving Native Americans is at issue. This Recent Development sets out to shed light on the implications of Article 7’s delegate promise by applying the canons to its text to ultimately determine whether the United States is legally bound to grant the Cherokee Nation’s request for a delegate in the U.S. -

Emphasis is placed on the Cherokee, Cree~, Chickasaw, and Seminole Indians, but all tribes and portions of Indian Territory tribes loyal to the United States during the Civil War are included in the study. Confederate military control of Indian Territory early in the Civil War forced the Indians loyal to the United States to flee north from Indian Territory. Before the war had ended,·approximately 10,500 Feder al refugee Indians had scattered across Arkansas, Missouri, Kansas, Colorado, and :Mexico. The reasons why these Indians remained loyal to the United States, their exodus from Indian Territory, their exile, and their return to Indian Territory are documented and evaluated in this study. The suffering and death expe:i;ienced by these refugees are unique in Civil War history, and far surpassed the de.privation and sacrifices made by other civilian populations.
