Rascoff When scholars — especially legal academics — talk about intelligence oversight, they typically have in mind a set of processes and institutions designed to deter and detect illegality and abuse. In this Article, I focus on another sense of intelligence oversight and a different institutional actor capable of providing it. The kind of oversight that I describe and endorse is distinguished by its concern with promoting effective intelligence collection while seeking to minimize a wide range of costs, including diplomatic blowback, economic harm to American firms, and intrusiveness that threatens privacy rights. The institution that has begun to furnish this more holistic sort of oversight, and that enjoys conspicuous advantage over preexisting bodies in doing so, is the President, aided by his staff (including those serving on the National Security Council). Pressured by a constellation of prominent interest group actors, including allied governments and technology firms, the President has begun to weigh in on surveillance policy and to shape the metes and bounds of intelligence collection in a systematic fashion. This development — which I call presidential intelligence — bears a family resemblance to presidential administration, the turn to centralized, political control that has dominated the scholarship and practice of administrative law for over a generation. In this Article, I offer a descriptive account of the rise of presidential intelligence, a qualified normative defense of its value (as an addition to, rather than a replacement of, existing oversight bodies), and a set of prescriptions for how to design institutions in order to realize its full potential. The tectonic shift toward presiden- tial control of agencies has reverberated throughout the federal bu- reaucracy, including a large swath of the national security state5 — with the striking exception of the so-called “intelligence community.”6 A major reason for intelligence’s exceptionality is historical. In the aftermath of Watergate and the intelligence scandals exposed by the Church7 and Pike8 Committees, the reigning assumption was that, of the three branches of government that might exercise meaningful over- sight of the intelligence apparatus, the possibility of heightened presi- dential authority ought to be taken off the table. That is because the architects of the new oversight took presidential control as a given and saw in the White House–intelligence complex the capacity for tyranny and abuse. To resist executive dominance, they chose to empower the other branches of government and to interpose a range of traditional, as well as internal, separation of powers checks. At the core of this story is a political puzzle: Why did a largely successful policy that mostly stripped Iraq of its unconventional weapons lose support in American politics to the point that the policy itself became less effective? I argue that, within intellectual and policymaking circles, a claim steadily emerged that the only solution to the Iraqi threat was regime change and democratization. While this “regime change consensus” was not part of the original containment policy, a cohort of intellectuals and policymakers assembled political support for the idea that Saddam’s personality and the totalitarian nature of the Baathist regime made Iraq uniquely immune to “management” strategies like containment. The entrenchment of this consensus before 9/11 helps explain why so many politicians, policymakers, and intellectuals rejected containment after 9/11 and embraced regime change and invasion.

    World Powers Rivalry in Afghanistan and Its Effects on Pakistan Muhammad Karim Abstract Afghanistan, a landlocked country, has been the focus of great powers since 19 th century due to its strategic locations. Soviet Union and Great Briton were engaged in Afghanistan before the World Wars. After Soviet Union invasion of Afghanistan in 1979, the U.S. led West with the support of Muslim countries compelled the Red Army to withdraw in 1988. The country became a battle field of proxy wars among the regional and extra regional powers, creating instability in entire region. In aftermath of the 9/11, Afghanistan once again attracted attention of the world powers. Nature and complexity of Great Powers’ rivalry in Afghanistan has changed overtime. Instead of fighting against a nation state the world powers are fighting against the potential threats of extremism, terrorism and drug trafficking that makes the war more complicated, problematic and challenging. Currently, apart from Al-Qaeda and Taliban, Islamic State (IS) is also becoming an active stakeholder in Afghanistan. These developments make the Afghan problem more complicated and ripening the grounds for another civil war. The study argues that since Pakistan not only shares long borders but also history, culture, interests, happiness and sorrows with Afghanistan, therefore situation in Afghanistan always have direct bearing on the security matrix of Pakistan. US and NATO forces withdrawal from Afghanistan has provided an open field to Al-Qaeda/Taliban and IS in one hand and encourage regional and international players on another, creating security dilemma for Pakistan. In November, the Supreme Court declined to hear an unusual challenge to the program by the Electronic Privacy Information Center, which had sought to bypass lower courts (see page 15). In the meantime a presidential review panel issued a report on the issue with a series of recommendations that would impose new limits on the program. The outcome of these conflicts did not go for what the United States originally wanted. The recurring elements that have continue to plaque the United States in the Middle East is from fear and hubris. The case studies are the Soviet Afghan War, the Iraq War in 2003, and the current Yemen Civil War were the United States is currently supporting Saudi Arabia’s intervention in the country.     Brig Gen Kenneth Newton Walker Kenneth Walker enlisted at Denver, Colorado, on 15 December 1917. He took flying training at Mather Field, California, getting his commission and wings in November 1918. After a tour in the Philippines, he returned to Langley Field, Virginia, in February 1925 with a subsequent assignment in December 1928 to attend the Air Corps Tactical School. Retained on the faculty as a bombardment in- structor, Walker became the epitome of the strategic thinkers at the school and coined the revolutionary airpower “creed of the bomber”: “A well-planned, well-organized and well-flown air force attack will constitute an offensive that cannot be stopped.” Following attendance at the Command and General Staff School at Fort Leavenworth, Kansas, in 1933 and promotion to major, he served for three years at Hamilton Field, California, and another three years at Luke Field, Ford Island, and Wheeler Field, Hawaii. Walker returned to the United States in January 1941 as assistant chief of the Plans Division for the chief of the Air Corps in Washington, DC. He was promoted to lieutenant colonel in July 1941 and colonel in March 1942. During this time, when he worked in the Operations Division of the War Department General Staff, he coauthored the air-campaign strategy known as Air War Plans Division—Plan 1, the plan for organizing, equipping, deploying, and employing the Army Air Forces to defeat Germany and Japan should the United States become embroiled in war. The authors completed this monu- mental undertaking in less than one month, just before Japan attacked Pearl Harbor—and the United States was, in fact, at war.
