Explanation for the use of asterisks in the tables provided within this response

Where the number of excluded pupils (or, in the case of the final table, the number of exclusion incidents) was less than five but greater than zero, the number has been replaced with an asterisk. It is our concern that releasing the precise number, where there are so few, may allow for the identification of individual pupils.

The first data protection principle requires that the processing of personal data be “fair and lawful” and, in particular, shall not be processed unless at least one of the conditions in Schedule 2 is met. Therefore, in order to process this data for disclosure to you a Schedule 2 condition must be satisfied. There is no condition in Schedule 2 that would allow for the Council to disclose this information into the public domain. As no condition can be satisfied, to disclose this information would be a breach of the first data protection principle and therefore disclosure is exempt under section 38(1)(b) of the Freedom of Information (Scotland) Act 2002.

The way in which the Council manages data about living individuals is governed by the Data Protection Act 1998. Section 38(1)(b), clarified by section 38(2)(a)(i), of the Freedom of Information (Scotland) Act 2002 exempts from disclosure personal information the release of which would be in breach of any of the data protection principles listed in Schedule 1, Part 1 of the Data Protection Act. The Data Protection Act defines personal data as being data which relate to a living individual who can be identified from those data or from other data which is in the possession of a data controller or is likely to come into the possession of a data controller. The information you have requested falls into this category.
