WELSH STATUTORY INSTRUMENTS 2011 No. 683 (W.101) LOCAL GOVERNMENT, WALES The Pembrokeshire (Communities) Order 2011 Made - - - - 7 March 2011 Coming into force in accordance with article 1(2) and (3) The Local Government Boundary Commission for Wales has, in accordance with sections 54(1) and 58(1) of the Local GovernmentAct 1972(1), submitted to the Welsh Ministers a report dated April 2010 on its review of, and proposals for, communities within the County of Pembrokeshire. The Welsh Ministers have decided to give effect to those proposals with modifications. More than six weeks have elapsed since those proposals were submitted to the Welsh Ministers. The Welsh Ministers make the following Order in exercise of the powers conferred on the Secretary of State by sections 58(2) and 67(5) of the Local Government Act 1972 and now vested in them(2). Title and commencement 1.—(1) The title of this Order is The Pembrokeshire (Communities) Order 2011. (2) Articles 4, 5 and 6 of this Order come into force— (a) for the purpose of proceedings preliminary or relating to the election of councillors, on 15 October 2011; (b) for all other purposes, on the ordinary day of election of councillors in 2012. (3) For all other purposes, this Order comes into force on 1 April 2011, which is the appointed day for the purposes of the Regulations. Interpretation 2. This document provides the Welsh Government’s Report to the National Assembly for Wales on the Marine Protected Areas network, in response to recommendation 10 of the Environment and Sustainability Committee’s Marine Inquiry. Recommendation 10: By the 31 December 2013, the Welsh Government should voluntarily lay before the Assembly a report that meets the requirement of section 124 of the Marine and Coastal Access Act 2009. This report should include an appraisal of the environmental status, governance and enforcement of existing marine protected areas. 2. Section 124 of the Marine and Coastal Access Act 2009 (the Marine Act) requires the Welsh Ministers to lay a report before the National Assembly for Wales on the extent to which it has achieved the objectives in the Marine Act to use conservation sites to contribute to a UK network of marine protected areas. The report must cover further steps needed to meet the network objectives, as well as specific details on any Marine Conservation Zones that have been designated. 3. The network objectives as detailed in section 123 of the Marine Act are that European marine sites (Special Areas of Conservation, Special Protection Areas), Sites of Special Scientific Interest and Ramsar sites form a network which contributes to the conservation or improvement of the marine environment in the UK marine area; where the features which are protected by the sites comprised in the network represent the range of features present in the UK marine area; and recognises the conservation of a feature may require the designation of more than one site.

  • Evidence Review of the Trophic Status of the Milford Haven Waterway
    Executive Summary The purpose of this report is to provide an overview of the available evidence relating to the trophic status of the Milford Haven waterway and to recommend whether a case for designation as a Polluted Water (Eutrophic) should be made under the terms of the Nitrates Directive. The report reviews available data and compliance with other relevant European directives. The EC Nitrates Directive (91/676/EEC) requires that waters which are eutrophic due to nitrates derived from agricultural sources, or are at risk of becoming so unless preventative action is taken, must be identified as Polluted Waters (Eutrophic) and areas of land draining into these waters, and which contribute to their nitrogen pollution, must be designated as Nitrate Vulnerable Zones (NVZs). Opportunistic macroalgae, phytoplankton and nutrient data have been reviewed in this and previous studies undertaken for the Nitrates, Urban Waste Water Treatment and Water Framework (WFD) directives. Milford Haven waterway is at Moderate status and hypernutrified compared to WFD nutrient standards. Phytoplankton blooms do not occur in the waterway, but within the sheltered bays and inlets there is widespread and often dense growth of opportunistic macroalgae species, primarily Ulva sp. Evidence from WFD monitoring in the Milford Haven Inner water body shows that dissolved inorganic nitrogen (DIN) levels are Moderate and this is reflected in the opportunistic macroalgae classification, which also achieves Moderate status. Therefore, this transitional water body is currently failing to meet Good status, which is required for WFD compliance by 2027. The WFD DIN classification demonstrates that the waters of the Milford Haven Outer water body are also at Moderate status and are hyper-nutrified according to WFD standards, but assessments did not demonstrate failures of phytoplankton or opportunistic macroalgae quality elements at water body level.
