Electronic currency has economic advantages, but it also has disadvantages including the risks of increased money laundering, fraud and more difficult enforcement actions for governments. Foreign currency payment obligations are discussed and analyzed in light ofthe current statutoryframework and recent English judicial decisions in order to expose the inadequacy of existing law in light of the monetary character of such obligations. Various strategies which might be pursued with regard to the enforcement offoreign currency obligations are discussed and the current legislative framework is criticized. The author concludes that the legal concept of money ought to be enlarged to embrace rapidly advancing technological developments in the area ofpayments, failing which the law may become out ofdate and irrelevant. The Bank of England describes central bank digital currencies (CBDCs) as “an electronic form of central bank money that could be widely used by households and businesses to make payments and store value”.1 The International Monetary Fund (IMF) describes them as a new form of money with three particular characteristics: 2 • They are in a digital/electronic form • They are issued by a country’s central bank (in the UK, this is the Bank of England.) • They are intended to serve as legal tender3 The money that we as consumers and businesses currently use in the UK does not meet all three of these conditions. 1 Bank of England, Discussion Paper. The opposite is true of electronic bank deposits: while digital, they are not issued by the central bank and don’t technically count as legal tender (largely because ‘legal tender’ has a narrow technical definition which, according to the Bank of England itself, “has no use in everyday life”4). In other words, while banknotes are liabilities of the central bank, bank deposits are liabilities of the commercial bank.
