The Scheduling of Programs Has Become Part of the Children's Television Debate
The scheduling of programs has become part of the children's television debate. The argument is that stations are scheduling programs in the early morning hours when children are not awake. The data revealed that this is not the predominant trend in the scheduling practices of independent stations. Ofthe 322 children's educational and informational programs broadcast per week, only ten programs (3.1 %) were broadcast prior to 6 AM. In other words 96.9% of the programs were aired at 6 AM or later. Further analysis indicates that 70 programs (21 %) were broadcast before 7 AM. Accordingly, approximately 80% ofthe programs broadcast by independent stations aired at 7 AM or later. 2. Educational Specials: Apart from regularly scheduled 30 minute programs, there have been significant increases in the number of educational specials appearing on independent television stations. These specials can be either 30 minutes or sometimes an hour in length. During the first quarter of 1990, independent stations broadcast 19.5 hours of educational specials. The number ofeducational specials broadcast during the first quarter of 1994 tripled, amounting to 63.5 hours. (See Exhibit D.) With respect to scheduling, all of the educational specials broadcast during the period were aired after 7 AM. Indeed, the most popular time periods for these specials were between the hours of 11 AM and 5 PM. - 8- Importantly, a significant number of these specials were produced locally by the stations themselves. INTRODUCTION 1. Seal Rock Broadcasters, LLC, (“Seal Rock”), licensee of television broadcast station KCBA, Salinas, California (“KCBA”), filed the above-captioned petition for special relief seeking to modify KCBA’s designated market area (“DMA”) to include the Charter Communications, Inc. (now Falcon Cable Systems Company II, L.P.) (“Falcon”) cable system communities of Gilroy, Morgan Hill and areas of Santa Clara County, including San Martin, California (“cable communities”). Falcon and KTVU Partnership, licensee of television broadcast station KTVU(TV), Oakland, California (“KTVU”), filed oppositions, to which KCBA replied. For the following reasons, we grant the petition. II. BACKGROUND 2. Pursuant to Section 614 of the Communications Act and implementing rules adopted by the Commission in Implementation of the Cable Television Consumer Protection and Competition Act of 1992, Broadcast Signal Carriage Issues (“Must Carry Order”), commercial television broadcast stations are entitled to assert mandatory carriage rights on cable systems located within the station’s market.1 A station’s market for this purpose is its “designated market area,” or DMA, as defined by Nielsen Media Research.2 A DMA is a geographic market designation that defines each television market exclusive of others, based on measured viewing patterns.
