Staff Sergeant Scott Smith appeared before Council to review the calls for service for 2005 - 2007. Wellington North accounts for 15% of the calls for service. Violent crime - sexual assault and other assaults have decreased. Propel-ty crime - break & enter, and mischief have decreased; theft of auto and theft under $5,000 have increased; theft over $5,000 as remained the same. County wide the OPP is concerned with the increasing number of domestic, mental health, theft from motor vehicle and impaired driving calls they attend. The OPP is seeking community assistance with community participation, the Lock it or Lose it program and the R.1.D.E program.

2. Thomas Schneider, Schneider Power Inc. Re: Proposed Wind Generating Turbines

Mr. Schneider appeared before Council to discuss his proposed Arthur Wind Farm Project. He provided inforlnation as to where the project will be located, advantages of the site, environmental assessment and studies completed, community relations, construction activities, background information for Schneider Power, past projects and owners. MI. Schneider requested Council assistance with a public meeting for a Zoning By-law Amendment.

We have reviewed the returned tenders (six tenders returned in total) and find them in order.

The low tender bid is submitted by Reeves Constnrction Limited of Mount Forest for the amount ' of $450,854.20. The other bidders are: - Maloney and Pepping Consbuction Limited of Stratford ibr the mount of $559,251-00 Newton Bridge Solutions Ltd. of Guelph for the amount of $561,029.74 Finnbilt General Contracting Ltd, of StratFord for the amount of $596,786.86 - Premier Concrete Jnc, of Seaforth for the amount of $604,953.37 - Maackon Corporation of Guelph for the amount of $649,426.66 All amounts include the 5% GST.

Reeves Construction Limited is a well-lcnown contractor who has successfully completed several bridge projects for us in the past, many of which have been in the Township of Wellington-North. Reeves Construction Limited would be able to complete the project in a satisfactory manner and in the time specified in the contract documents. We recommend that the contract be awarded to Reeves Construction Limited for the amount of $450,854.20 (GST included) subject to fmal valuation of the completed work and contingent on all approvals being obtained.

1. Declarations of Pecuniary Interests There were no declarations of pecuniary interests.

2. ED0 Report - Linda Reader ED0 report handed (see attached) regarding the EDCO conference. Linda attended EDCO Conference last week. The conference focus was on economic development in the Province. The growth in Ontario has been in a steady decline since the 1950's compared to the rest of Canada.

Through Economic Development the Township can focus on providing current industries with education and training on the advantages of multiculturalism and globalization; encourage entrepreneurs and innovation and help industries conduct business more easily in Wellington North. Tourism will allow us to brandtmarket Wellington North and create an image in the global marketplace. "The Places to Grow" available from the Ministry of Public Infrastructure Renewal is a great document that outlines geographicall y where growth is focused in Southern Ontario including Wellington North. Economic Development priority is small to medium businesses. Marketing your community is never finished.

3. Delegation, Humber College - Robert Taweel, Joe Andrews Humber College presentation: Joe Andrews, Director of Humber College Orangeville Campus - conducted a presentation about the campus. See attached information. Humber College - leading in advanced learni ng, 18,000 day time students, 55,000 part time students. In 2005 Humber College partnered with the Town of Orangeville to establish full service campus. The Orangeville campus is targeted to phase one in the late fall 2009. Currently running three full time programs: 1. Early Child Hood Education, 2. Police Foundation, 3. Business and Business Administration.

Robert Taweel, Industry Liaison Officer lnnovation Hum ber College - Humber's Centre of lnnovation works with organizations and business to foster/apply new ideas and innovations. The goal is to help small and medium businesses with innovation.

The Innovation Centre at Humber partners with 10 Colleges and Universities that together have access to the latest equipment, technology and innovation practices. Their Mandate (see attached) focuses on key growth sectors as determined by Province. Question asked how the Township can access the center. To help local businesses Humber's Centre of lnnovation can conduct symposiums, or for any industries that have a need conduct an information session or meet one on one with the business. Any challenges businesses are facing the College can look at solving. Question asked about the old Mount Forest Arena and if the centre has any ideas for it use. First steps would be to conduct a think tank, look into other program support available from Humber and follow - up with a dialogue with WN and the community. Robert is looking into what expertise at Humber we need to bring in after meeting at the Arena in January. So far the Coordinator of the Sustainable Energy program and the Associate Dean of the Built Environment are involved. Potential areas include Hospitality and Recreation.

4. December 12,2007 approval of minutes Motion: to pass the minutes with the following addition to the ED0 Report second paragraph regarding the website "Mary felt if it is the EDO's responsibility, then an extra person for input of information would be required". 6. Business Arising out of January gth~inutes a. Economic Development Budget The Finance committee has conducted preliminary review of the budget and asked for $20,000 to be removed from the budget. Original budget figure was $1 79,320. ED0 Linda Reader provided financial sheet with recommendations on which financial lines and dollars could be removed.

After review and discussion the committee agreed to remove funds from the following lines. Marketing Line 5033: Student Salary $ 6,300 Advertisement (magazine) $ 3,000 Community Project $ 4,300 Total Marketing Line $73,600

Delegation Tourism Committee - Chair Jeannette Jamieson Presentation made by Tourism Chair Jeannette Jamieson - requesting tender for the development of the Butter Tart Trail website. See attached letter. The Butter Tart Trail has received three awards to date and for the Butter Tart Trail to continue with its marketing process the Tourism Committee would like to have approval for a Butter Tart Trail website. The Butter Tart Trail (BTT) is in its third year and although not a big budget item it has become well known and a brandinglmarketing tool for the Township. The website could further promote the Butter Tart Trail with links to different venues; provide advertisement, marketing schemes and questionnaires. With the development of the new website, the Tourism Committee wants to ensure that the advertisement and promotional material that we have used to date in our campaign can be used on the website. These designs are key to our promotion of the Butter Tart Trail. The graphic designer used is superb and has helped us produce rural advertising that markets our area well. The Tourism Committee would also like to suggest Butter Tart Trail be used through out the Township to further market our area, much as the Bruce does for their area. Tourism is a new marketing tool for the Township, but we have had people drive through our area for years and now are able to bring then into the Township using outside dollars. Promoting the Butter Tart Trail promotes the Township. It has given us a marketing advantage and we now need to take the next step for advertising and promotion. Letter brought forth from CAO Lori Heinbuch and was read by E DO Linda Reader - see letter attached. Letter stated new Township website is being considered and will be developed by Frey Communications. Linda Reader commented that utilizing the graphic designer is key for the Butter Tart Trail. The Graphic Designer's images are copy righted and can only be used with the design of the Butter Tart Trail as they have been designed. Another concern would be with the time-line of the website. We are looking at a short time-line in order to have it up and running for thi s marketing season. Mary Schmidt: I agree that the Tourism committee was given the go ahead for the Butter Tart Trail and have been very successful. One artist cannot emulate another. John Matusinec: The Tourism Committee has done a great job and it would be counter productive to not the committee continue with the marketing of the Butter Tart Trail. Dale Small: From what I understand from the letter by the CAO the website designer is willing to meet and work with whomever to find out what the requirements is needed for the websi te.

Consensus from the Economic Development Committee for the Butter Tart Trail to have its own website and to meet with Frey Communications to see what they can provide and time-line for a website.

8. Arthur Revitalization Report - Mary Schmidt Next meeting will be about fund raising ideas. The Arthur Revitalization Committee will be going forth with purchasing new garbage cans. The committee will be speaking with Public Works Department to see what is available for purchase. Flower pole racks to be implemented in and confirming the number of poles as the number of hydro poles are designated to increase. Mary will speak with them and confirm number of poles.

9. New Business

Application forms for the 2008 BTT are available and we are starting to receive registrations. February 29th is the tentative date to meet and discuss a Township wide promotion.

Dave Small requested a follow up to the visioning session held in January. We would like to hear the final report and any suggestion he might have. Action: EDO, Linda Reader to contact him and ask for the final report.

WHEREAS the work of the Municipal Property Assessment Corporation provides services to both municipal governments and the provincial government for the purpose of collecting property taxes; and

WHEREAS Ontario municipalities pay for MPAC services and costs and the Province does not;

THEREFORE BE IT RESOLVED that the City of Ottawa request that the Province of Ontario pay a proportional share of MPAC costs related to education property taxes; and

BE IT FURTHER RESOLVED that the City of Ottawa communicate this request to MPAC Board of Directors, LUMCO, MARC0 and AM07s Regional and Single Tier Caucus to solicit the support for this request.

BE IT FURTHER RESOLVED that the City of Ottawa communicate this request to the Association of Municipalities of Ontario for distribution to their membership.

WHEREAS the Council of the Corporation of the Township of North Frontenac having passed and c~rculatedto the Assocration of Munrcrpalities (AMO); ~inrstrres;Members of the ~e~kl'ativeAssembly; the Prem~erof Ontarro; and all Ontario mun~c~palities,recerved the endorsement of over 100 munrcrpalities of North Frontenac's Resolution #344-05on August 18,2005 stating that until such time as the Government of the Province of Ontarro removes the obligation of funding the many socral programs through the municipal property tax base, the ~ownsh:~of North FroGenac recommends that the Government immediately develops and institutes, for the smallest rural munlcrpalities, minimum capital program funding thhsholds that are inversely proportionate to the~rpermanent and non- permanent populations; (see copy attached)

AND WHEREAS the current Federall~rovincialprograms continue to allocate some funding to Municipalities on a per capita basis and the year-round populations of many of the smallest rural -- mun~cipalitiescontinue to add pressure to already inadequate infrastructure;

AND WHEREAS approximately 274 municipalities In Ontarlo have populations of under 10,000 people and the large urban municipalities continue to receive fund in^- that the smallest rural mun~cipalitiesdo not qualifyjor (i.e. ~rans~&ation/Transitfunding);

AND WHEREAS the Council of the Township of North Frontenac supports the request from the City of Waterloo in calling upon the Provincial and Federal governments to re-examine how mun~cipalitiesare funded in regards to infrastructure and work together with a view to providing long term and susta~nable infrastructure funding programs to assist the City of Waterloo and all upper, lower and slngle tier municipalities in addressing their infrastructure roles and responsibilities:

AND WHEREAS the Council of the Township of North Frontenac supports the request for support from the City of Waterloo in petitioning the Province of Ontarlo to fully exempt all Ontario municipalities from paylng Provincial Sales Tax (PST), with the understanding that the savings realized be mandated to fund existing infrastnrcture renewal in local municipalities;

AND WHEREAS the Council of the Township of North Frontenac endorses the request for support from the Municipality of North Grenville In requesting the government of the Province of Ontano to commit 118'~of the current 8% Prov~ncialSales Tax to Municrpalities to fund Municipal Infrastructure Programs;

NOW THEREFORE, BE IT RESOLVED that to be falr and equitable, the Council of the Townships of North Frontenac: Lanark Highlands; Greater Madawaska and Addington Highlands petition the Province of Ontario to exempt at the very least all Ontario municipalities with populations under 10,000 from paying Provincial Sales Tax (PST) to ass~stwith supporting infrastructure in small rural municipalities that cannot be reasonably sustained through property taxation.

AND WHEREAS the current Munrcrpal Funding Agreement for the Transfer of Federal Gas Tax Revenues states that the Association of Munlclpalities of Ontarlo (AMO) will allocate the Funds to Munlcrpalities on a per capita basis;

AND WHEREAS the level of infrastructure Investment in the smallest rural municlpalities (less than 10,000 people) (per North Frontenac Township's Resolution #344-05 of August 18,2005), even with the banking of Federal Gas Tax Funding over several years, cannot be reasonably or meaningfully sustained by the property tax yield;

AND WHEREAS municipalities with growth will receive more funding and municlpalities with little growth will receive less funding, if the Federal Gas Tax continues to be transferred to municipalities on a per capita basis:

NOW THEREFORE, BE IT RESOLVED that to be fair and equitable, the Councils of the Townships of North Frontenac; Lanark Highlands; Greater Madawaska and Addington Highlands recommend that the Government immediately base the Federal Gas Tax transferred to municipalities on year-round population, (permanent and non-permanent populations) whlch would include seasonal residents (i.e, per number of households);

AND FURTHER THAT all Ontario municipalities endorse these recommendations through their respective Councils and respond to the Federation of Canadian Municipalities (FCM) Board; Association of Municipalities of Ontarlo; to their local Members of the Legislative Assembly of Ontario; and to the Premier of Ontario; to their Members of Parliament, to the Minlster of Finance and to the Prime Minister of Canada.

Re: 2008 Municipal Road and Bridge Infrastructure Investment

As announced in the 2008 Provincial Budget, I am pleased to advise you that the Township of Wellington North has been approved to receive funds in the amount of $733,945 towards your municipal road and bridge capital investment needs.

Addressing municipal road and bridge capital investment needs is an important part of maintaining and improving the province's transportation network, economic success and Ontarians' quality of life. To this end, the approved funds will be transferred to you by June 30, 2008, at which time the province will also provide details on reporting requirements and other accountability related requirements. These requirements will include as a minimum a description of the types of eligible expenditures for which the funding is intended, and requirement for a final report on how the funds were used. WELUNGTON COUNTY OFFICIAL PLAN: The subject lands are designated RESIDENTIAL and CORE GREENLANDS in the Mount Forest Urban Centre. The Greenlands System designation protects hazardlands. This feature is located entir,ely an the retained parcel. According to Section 10.6.2 "New lots may be created in Urban Centres provided that the land will be appropriately zoned."

Section 10.2.2 states that 'Where the County is concerned that a proposed lot in or adjacent to the Greenlands System could negatively impact a natural feature or function, the County may require an environmental impact study to assess potential impacts and means of mitigation."

Legal or technical is defined as "severances for purposes such as easements, corrections of deeds, quit claims, and minor boundary adjustments, which do not result in the creatlon of a new lot".

We have no Minimum Distance Separation 1 (MDSI) concerns due to the applicability of guideline 8 which states: "Where a new lot is proposed with an existing dwelling, and that dwelling is already located on a lot separate from the subject livestock facility, MDSI is not applied..."

MELUNGTON COUNIY OFFICIAL PLAN: The subject lands are designated PRIME AGRICULTURAL and CORE GREENLANDS, The feature protected by the Greenlands system designation includes hazardlands.

Sectionl0.3.6 of the County of Wellington Official Plan "permits lot line adjustments were no adverse effect on agriculture will occur and are encouraged where more viable operations will result or an undersized lot is made useable given the requirement for appropriate sewer and water systems".

The matters under Section 10.1.3 were also given consideration.

LOCAL ZONING BY-LAW: The lands to be severed are zoned Agricultural (A) and the lands to be'retained are zoned Agricultural site specific (A-28). Both the retained and severed parcels will comply to the frontage and area requirements.

I am enclosing the complete "Draft" Forest Conservation By-law for your review and comments. This by-law is intended to replace the current Tree By-law No. 3961-94, in effect since 1994.

Most area Regions and Counties have already enacted new, similar by-laws under the Municipal Act ov& the last few years. ~illiamsand Associates, Forestry Consultants, were retained by Wellington County to prepare the new by-law. A "stakeholder" committee was formed and this group has been meeting over the last year to try to ensure a balanced approach and that various interests are addressed - agriculture, farm drainage, environment, loggers, sawmills.

I have enclosed the complete draft by-law. I have also enclosed Planning Report PD2008- 12 which provides an overview of the by-law and the ongoing process. Please provide us with any comments that you might have by May 16,2008. Subsequent to this we will be setting times for a public meeting(s) to get the views of the general public.

By separate letter, we are contacting loggers and sawmills operating in the County and asking for their input.

A By-law Respecting the Conservation and Sustainable Use of Woodlands Y-

WHEREAS SECTION 2 (c) of the Municipal Act, 2001, S.O. 2001, c. 25 states that The County of Wellington is given powers to foster the municipality's current and future economic, social and environmental well-being;

AND WHEREAS SECTIONS 135,136,139 and 138 oftheMunicipa1 Act, 2001, S.O. 2001, c. 25 give The County of Wellington the power to pass and enforce by-laws respecting the destruction and injuring of trees in a woodland;

NOW THEREFORE, the Council of the Corporation of the County of Wellington.hereby enacts as follows: ..

SECTION I. DEFPMTIBNS

In this By-Law:

(a) "basal area" means the sum of the basal areas of the individual trees of a dbh greater than 10 cm (4 in) which comprise a woodland (expressed in square meters per-hectare or square feet per acre). The basal area of an individual tree is the cross-sectional area of the tree stem or trunk taken at the point of measurement of dbh. For purposes of enforcing this By-law, basal area shall be determined by using a 4% strip cruise (where trees are measured on 2-meter (6 foot)-wide parallel strips regularly spaced across the woodland;

(b) "building permit" means a building permit as issued under the Building Code Act, 1992, S.O. 1992, c. 23, or any successor thereof;

(b) "bush cord" means a measure of stacked wood measuring 4 by 4 by 8 fi or 128 cubic feet (123 by 123 by 246 cm or 3 .9 cubic meters) of wood and air;

(c) "business days" means any day falling on or between Monday and Friday of each week but does not include New Year's Day, Family Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Civic Holiday, Labour Day, Thanksgiving Day,

Remembrance Day, Christmas Day and Boxing Day; r

(d) "Calendar Year" means January 1 through December 3 1 of a year;

(e) "Certified Tree Marker" means an individual who has completed all requirements to be certified by the Ontario Ministry of Natural Resources to mark trees according to a silvicultural prescription; Draft March. 2008 Wellington County Forest Conservation By-Law

"Christmas TreePlantation" is an area planted with appropriate tree species and managed for the production of Christmas trees. This means that the trees and area is regularly tended to produce trees to be sold as Christmas trees. A Christmas tree plantation must have been tended for the production of Christmas trees within the last five (5) years. If it has not been tended as a Christmas-tree plantation within five years it is considered a woodland if the area meets the stocking requirements Section 1 (ah);

"circumference" means the measurement of the outer boundary of the stem or hnkof a tree, including the bark;

"Clerk" means the Clerk of The County of Wellington or his or her designate;

"unforested corridor" means a break in the forest cover or forest canopy, which includes but is not limited to, highways and roads, railway rights-of-way, drains, lanes, paths, golf course fairways, utility lines or natural open spaces;

"Council" means the Council of The County of Wellington;

"County" means the county of Wellington;

"County Staff' means employees of the County of Wellington and contract parties authorized to act on behalf of the County of Wellington;

"dbh" (diameter breast height) means the diameter of the stem or hnkof a tree measured at a point of measurement that is 1.37 metres (4.5 feet) above the highest point of the ground at-the base of the stem or trunk of the tree;

"destroy" means any action which causes or results in the irreversible injury or death of a tree;

"diameter" nems a (length of) straight line from side to sids through the centre of a stm or trunk of a tree, including the bark;

"drip line" means a line running directly beneath the outerrnost branches of the trees fonning the perimeter of the Woodland;

"excess damage" is disturbance to the forest floor or waterways andlor damage to trees not specified for cutting or other vegetation in excess of levels specified in Schedule "F" of this by-law;

"Forester" is a Registered Professional Forester, or Associate Member in good standing with the Ontario Professional Forester's Association who is authorized to prepare silvicultural prescriptions that apply to the County and subject woodland;

"forest stand" means that part of the Woodland that is a contiguous group of trees sufficiently uniform in species composition, arrangement of age classes and condition to be a homogeneous and distinguishable unit for forestry management purposes; Draft March, 2008 Wellington County Forest Conservation By-Law

(t) "good forestry practices" means the proper implementation of harvest, renewal and maintenance activities known to be appropriate for the forest and environmental conditions under whch they are being applied and that minimize detriments to forest values including significant ecosystems, important fish and wildlife habitat, soil and water quality and quantity, forest productivity and health, aesthetics and recreational opportunities of the landscape;

(u) "hazardous condition" is where a tree, due to damage, health problems or structural weakness, is a condition that presents a significant risk of injuring persons or property;

(v) "injury" means lasting dmage to a tree which has the effect of inhibiting or terminating its growth, but does not include pruning or removing branches for maintenance purposes;

(x) "officer" means an individual appointed by the County by By-law, for the administration and enforcement of this by-law and such individuals as hereby designated as provincial offences officer pursuant to Subsection 135(11) of the Act; -

(y) "own use" means use that does not indude a sale, exchange or other-disposition of trees destroyed or injured;

(2) "permit" means a permit to injure or destroy trees issued under Section 5 of this by-law;

(aa) "person" includes, but is not limited to an individual, partnership or corporation;

(ab) "point of measwement" means the point on the stem or trunk of the tree measured above the highest point of the ground in an undisturbed state. In the case of coppice or clump growth where the point of fusion occurs at or above the point of measurement for dbh, the coppice or clump growth shall be deemed a single tree and "point of measurement" shall mean the point on the stem or trunk measured above thehighest point of the ground in an undisturbed state. In the case of coppice or clump growth where the point of fusion occurs below the point of measurement for dbh, each stem or trunk in the coppice or clump growth shall be deemed a separate tree and "point of measurement" shall mean the point on each tree stem or trunk measured from the point of fusion;

(ac) "prescribed species" means the species of trees as listed in Parts I, I1 and 111 of Schedule "A" of this By-law, titled "Protected Tree Species";

(ad) "silvicultural prescriptiony'means a site specific operational plan, approved by a forester, that describes the existing forest conditions, the forest management objectives for an area, and prescribes the methods for marking, harvesting and regenerating the subject forest in a manner that accommodates other resource values as 'identified;

(ae) "tree" means any species of woody perennial plant, including its root system, which has reached or can reach a height of at least 4.5 metres (15 ft) at physiological maturity, provided that where multiple stems grow fi-omthe same root system, the number of trees shall be the number of steins with discrete, apical tips; Draft -March, 2008 Wellington County Forest Conservation By-Law

(af) "tree marker" means any person who has marked trees for cutting. This incl~~des landowners, timber buyers, Certified Tree Markers or Foresters. Certified Tree Marker is defined in Section 1 (e);

(ag) "watercourse" means a natural or man-made waterway containing flowing water at least part of the year;

(ah) "woodland" means land, one hectare (2.47 acres) or more in area, measured to the drip line and including any unforested comdors equal to or less than 30 metres (98.4 feet) in width, with at least:

(i) 1,000 trees, of any size, per hectare (405 trees, of any size, per acre);

(ii) 750 trees, measuring over 5 centimetres in diameter, per hectare (304 trees, measuring over 2 inches in diameter, per acre);

(iii) 500 trees, measuring over 12 centimetres in diameter, per hectare (202 trees, measuring over 4.7 inches in diameter, per acre); or

(iv) 250 trees, measuring over 20 centimetres in diameter, per hectare (101 trees, measuring over 7.9 inches in diameter, per acre),

but does not include a cultivated hitorchard, nut orchard, tree nursery, or Christmas tree plantation. For the purpose of the definition of woodlands, all measurements of the trees are to be taken at 1.37 metres (4.5 feet) from the ground. For purposes of enforcing this By-law, tree density shall be determined by using a 4% strip cruise (where trees are measured on 2-meter (6 foot)-wide parallel stips regularly spaced across the woodland.

SECTION 2. PROmITION

2.1 No person shall cause or permit the injuring or destruction of a tree growing in a woodland: (a) unless exempted by Section 3 of this by-law; or (b) except in accordance with a permit issued under Section 4 of this by-law.

2.2 No person shall: (a) contravene the terms or conditions of a permit issued under this by-law; or (b) cause or permit the contravention of the terms or conditions of a permit issued under this by-law. Drsft March, 2008 Welling-ton County Forest Conservation By-Law

2.3 No person shall operate a vehicle, machinery or equipment or conduct operations in a manner or at a time that: (a) unnecessarily destroys or injures any tree that is to remain standing after the destruction or injuring of trees is completed in accordance with this By-Law; (b) results in the leaving of any part of a tree in a watercourse including any trees that -have not been cut, but have been pushed, knocked over or otherwise ended up in a watercourse; (c) results in excessive damage to unmarlted trees, the forest floor or soil as determined

using procedures described in Schedule F, '

2.4 No person shall fail to comply with an order issued under this by-law or remove or deface any order thzt has been posted pursuant to this by-law.

SECTION 3. EXEMPTIONS

3.1 Despite Section 2 of this by-law, this by-law does not apply to : (a) activities or matters underteen under a licence issued under the Crown Forest Sustainability Act, 1994; (b) the injuring or destruction of trees by a person licensed under heSurveyors Act to engage in the practice of cadastral surveying, or his or her agent, while making a survey; (c) the injuring or destruction of trees imposed as a condition to the approval of a site plan, a plan of subdivision or a consent under Section 41,51, or 53, respectively, of the Planning Act or as a requirement of a site plan agreement or subdivison agreement entered into under those sections; (d) the injuring or destruction of trees imposed after December 3 1,2002 as a condition to a development permit authorized by regulation made under Section 70.2 of the Planning Act or as a requirement of an agreement entered into under the regulation; (e) the injuring or destruction of trees by a transmitter or distributor, as those terns are defined in Section 2 of the Electricity Act, 1998, for the purpose of constructing and maintaining a transmission system or a distribution system, as those terms are defined in that section; Draft March, 2008 Wellinnion County Forest Conservation By-Law

(f) the injuring or destruction of trees undertaken on land described in a licence for a pit or quarry or a permit for a wayside pit or wayside quarry issued under the Aggregate Resources Act; (g) the injuring or destruction of trees undertaken on land in order to lawllly establish and operate or enlarge any pit or quarry on land: (i) that has not been designated under the Aggregate Resources Act or a predecessor of that Act; and (ii) on which a pit or quarry is a permitted land use under a by-law passed under Section 34 of the Planning Act; (h) the injuring or destruction of trees required in order to erect a building or structure, in respect of which a building permit has been issued, provided that the total area within which trees are injured or destroyed is within 15 metres of the outer edge of the building or structure or proposed building or structure;

- (i) the injuring or destruction of trees that is reasonably required in order to install and provide utilities to the construction or use of a building or structure in respect of which a building permit has been issued, including the installation of a primary septic bed; (i) the injuring or destruction of trees that is reasonably required in order to install a single lane driveway for vehicular access to a building or structure in respect of which a building permit has been issued; (k) the injuring or destruction of trees provided that no more than 20 trees or up to the equivalent of 15 cubic metres (for example: six (6) bush cords and/or 3,000 board fest) of wood are injured or destroyed in a calendar year from an owner's property, provided that the injury or destruction of trees does not reduce the density of the trees so that the area does not meet the definition of a woodland, and that the injuring or destruction of trees is consistent with good forestry practices; (1) the injuring or destruction of Eastern White Cedar trees provided that no more than the equivalent of three (3) bush cords of wood are injured or destroyed in a calendar year from an owner's property, and that the injuring or destruction of trees is in accordance with good forestry practices; or (m) the injuring or destruction of trees that are in a hazardous condition. SECTION 4. PE S

4.1 Upon application by an owner, the County may issue the following permits: (a) Good Forestry Practices Permits; (b) Circumference Permits; and (c) Clearing Permits.

4.2 The County hereby delegates to an officer the power to issue a permit under Subsections 4.3, 4.4,4.5 and 4.6 of this by-law and to impose conditions to such permits.

4.2.1 Before a Good Forestry Practice Permit or Circumference Permit Application

is submitted, the trees to be injured or destroyed must be marked with paint at -

approximately 4.5 feet (1.3 meters) above ground on at least two sides to the - Officer's satisfaction.

4.2.2 A vertical paint line shall be placed at the tree base below the saw line and extending to the ground to the Officer's satisfaction.

4.2.3 Before a Clearing Permit Application is submitted, the boundaries of the area

- specified in the application or the trees to be removed, must be marked--with paint to the Officer's satisfaction.

GOOD FBF&STRY PRACTICES PE=TS

4.3 The County may issue a Good Forestry Practices Permit to permit the injuring or destruction of trees provided that the injuring or destruction of trees is conducted in accordance with good forestry practices as prescribed in a silvicultural prescription prepared and stamped by a Forester, and provided fbrther that the trees to be injured or destroyed are marked, in accordance with the prescription, by a Forester or Certified Tree Marker as specified in Sections 4.2.1 and 4.2.2.

4.4 Despite Subsection 4.3 of this by-law, the County may issue a Good Forestry Practices Permit to a landowner who has marked trees on their own property, provided that an officer is satisfied that the injuring or destruction of trees is consistent with good forestry practices and the trees are marked as specified in Sections 4.2.1 and 4.2.2. 4.5 The applicant shall erect and display a public notice sign regarding the Good Forestry Practices Permit at the entrance to the Woodland in a position that ensures that it is clear and visible to all persons, and the notice shall be in the form of Schedule "J" or that approved by the Officer.

4.6 The County may issue a Circumference Permit to permit the injuring or destruction of trees provided that: (a) the trees are of a species listed in Schedule "A"; and (b) the trees have attained the diameter or circumference measurement applicable to such tree species as set out in the said schedule, measured at the highest point of measurement available on the treelstump, provided in Schedule A or at the stump; and (c) the trees or area-of trees to be injured or destroyed are marked with paint as specified in Sections 4.2.1 and 4.2.2.; and (d) the portion of the woodland where trees are marked for cutting, the injuring or destruction of trees shall not have the effect of :

(i) . reducing the basal area of trees measuring at least 24.5 centirnetres (9.5 inches) D3H to below 15 square metres per hectare (65 sq. ft per acre); or (ii) reducing the number of trees in woodlands below the nurnber of trees necessary to constitute a woodland; or (iii) reducing below 12.5 trees per hectare (5 trees per acre) in a woodland the number of trees in Part 1 of Schedule "A" which have reached or exceeded

4.7 The applicant shall erect and display a public notice sign regarding the Circumference Permit at the entrance to the Woodland in a position that ensures that it is clear and visible to all persons, and the notice shall be in the form of Schedule "J" or that approved by the Officer. 4.8 Where a person intends to injure or destroy trees and the proposed activity does not meet the requirements set out in Subsections 4.3,4.4, or 4.5 of this by-law, an application may be made for a Clearing Permit. 4.8.1 The County may issue a Clearing Permit to permit the injuring or destruction of trees provided that County Council or County Staff that have been delegated the authority is satisfied that the injuring or destruction of trees will be in compliance with agricultural and natural environment policies adopted by County Council fiom time to time. 4.8.2 An officer may issue a Clearing Permit to permit the injuring or destruction of trees provided that the total area of tree removal does not exceed 0.5 hectare, and provided that the officer is satisfied that the injuring or destruction of trees will be in compliance with agricultural

- adnatural environment policies adopted by County Council from timeto time.

4.9 The applicant shall erect and display a public notice regarding the Clearing Permit at the entrance to the Woodland in a position that ensures that it is clear and visible to all persons, and the notice shall be in the form of Schedule "I" or that approved by the Officer.

SECTION 5. MPkICA'kl[ON PROCESS

5.1 Every person who intends to injure or destroy a tree where a permit to do so is required under this bylaw shall first complete and s~bdzn applicztion for a permit in the cmieili fonn approved by the County.

5.2 An application for a permit shall: (a) be accompanied by the applicable fee as prescribed in Schedule "B"; and (b) contain a description of the proposed activity.

5.3 An application for a permit shall be deemed incomplete, and no permit shall be issued if: (a) the application has not been completed in full; (b) the owner of the woodlands or woodlot has not signed the application; (c) the paej who will be undertslking or responsible for the injuring or desh-uciion of trees has not signed the application; or Draft March, 2008 Wellington County Forest Conservation By-Law

(d) the application fee has not been paid.

5.4 In addition to the requirements set out in Subsections 5.1, 5.2 and 5.3 of this by-law, an application for a Good Forestry Practices Permit shall include a silvicultural prescription prepared in accordance with Subsection 4.3 of th~sby-law and the name of the Forester or Certified Tree Marker who marked the trees in accordance with the prescription; or

5.5 In addition to the requirements set out in Subsections 5.1, 5.2 and 5.3 of this by-law, an application for a Circumference Permit shall include the name of the individual who marked the trees to be injured or destroyed in accordance with Subsection 4.5 of this by-law, unless otherwise directed by an officer under Subsection 4.4 of ths by-law.

5.6 & addition to the requirements set out in Subsections 5.1, 5.2 and 5.3 of this by-law, an application for a Clearing Permit shall include: (a) an explanation of the necessity for the proposed activity and the rationale for selecting

, the area; and (b) an environmental impact study if required by the County to satisfy the requirement determined by the County.

5.7 Upon receipt by the County of an application for a permit, the owner shall permit an officer to enter upon his or her property and undertake such site inspections 2s may be required to consider the application. An officer may undertake a site inspection prior to, during and after the proposed activity.

5.8 The County may impose conditions to a permit that may include: (a) the manner and timing in which the injuring or destruction of trees is to be carried out; (b) the qualifications of persons authorized to injure or destroy trees; (c) the species, size, number and location of replacement trees to be planted; and (d) measures to be implemented to mitigate the direct arid indirect effects of the injuring or destruction of trees on the natural environment. 5.9 A permit issued pursuant to this by-law shall expire one year after the date of issuance, except that an officer may, upon request, renew the permit for a further period(s) of one year.

5.10 A decision regarding an application-for a permit shall not be made by the County until such time as all the required documents have been filed, the applicable fee has been paid and any required inspections have been undertaken.

SECTION 6. ORDERS TO DISCONTm ACTMTY

6.1 Where an officer is satisfied that a contravention of this by-law has occurred, the officer may make an order requiring the person who contravened the by-law or who caused or permitted the injuring or destruction of trees in contravention of the by-law to stop the injuring or destruction of trees (i.e. Stop Work Order). This includes the immediate stoppage of all work, including the movement or disposal of wood, soil or other material, and the removal, destruction, burning or burying of logs, stumps or logging debris.

6.2 An order issued under this section may be served personally, or served by sending it by mail

to the last known address of: . - (a) the owner of the woodland; and (b) the corporation, company, person or persons identified as injuring or destroying a tree or trees.

6.3 Where service of an order is made by mail, service shall be deemed to have been effected on the fifth day after the order is mailed.

6.4 Where service cannot be carried out under Subsection 6.2 of this by-law, the officer shall place a placard containing the terms of the order in a conspicuous place on the owner's property, and the placing of the placard shall be deemed to be sufficient service of the order on the person or persons to whom the order is directed. SECTION 7, APPEmS TO

7.1 Pursuant to Section 136 of the Municipal Act, an applicant for a permit may appeal to the Municipal Council:

(a) if the County refuses to issue a permit, within 30 days after the refusal; . . (b) if the County fails to make a decision on the application, within 45 days after the application is received by the County; or (c) if the applicant objects to a condition in the permit, within 30 days afcer the issuance of the permit.

SECTION 8. EIVFORaMENT

8.1 The provisions of this by-law may be enforced by an officer appointed by by-law of County Council for the administration and enforcement of this by-law.

8.2 Pursuant to Subsection 137(1) of the Municipal Act, an officer may, at any reasonable time, enter and inspect any land to determine whether this by-law, an order under this by-law, a condition to a permit, or a court order under Subsection 138 (2) of the Act is being complied with.

8.3 For the purpose of determining compliance with this by-law, the points of measurement listed in Schedule "A" shall be used to deterrnfne whether a tree which has been injured or ciestroyed would have attained the minimum measurement required by this by-law.

9.1 Any person who contravenes any provision of this by-law, or an order issued under Section 137(3) of the Municipal Act is guilty of an offence and is liable: (a) on first conviction, to a fine of not more than $10,000 or $1,000 per tree, whichever is greater; and (b) on any subsequent conviction, to a fine of not more than $25,000 or $2,500 per tree, whichever is greater. 9.2 Despite Subsection 10.1 of this by-law, where the person convicted is a corporation, (a) the maximum fines in Subsection 10.1 (a) are $50,000 or $5,000 per tree, whichever is greater; and (b) the maximum fines in Subsection 10.1 (b) are $100,000 or $10,000 per tree, whichever is greater.

SECTION 80.

10.1 An owner of a property shall be presumed to have injured or destroyed or caused or permitted to be injured or destroyed a tree growing in a woodlands, or contravened or caused or permitted the contravention of the terms or conditions of a permit issued under this by-law, as the case may be, which presumption may be rebutted by evidence to the contrary on a balance of probabilities.

SECTION 11. GEiVERAIL

11.1 Schedules "A" through "B" shall form part of this by-law. 1 1.2 The short title of this by-law is the "Forest Conservation By-law". 11.3 Tree By-law No. 3961-94 of the County of Wellington is hereby repealed. 11.4 Despite Subsection 11.3 of this by-law, Tree By-law No. 3961-94 of the County of Wellington shall continue to apply to proceedings in respect of matters that were initiatedprior to its repeal. 11.5 This by-law shall come into effect on ,2008. 11.6 If any section or sections of this By-law or parts thereof are found by any Court to be illegal or beyond the power of the Council to enact, such section or sections or parts thereof shall be deemed to be severable and all other sections or parts of this By-law shall be deemed to be separate and independent there from and continue in full force and effect unless and until similarly found illegal.
