Destacan dos tipos de visiones: la del periodista villano y la del periodista ético. Con un número inferior de producciones encontramos películas que abordan la influencia que sobre el periodismo tienen los grandes propietarios. En este artículo se abordan cuatro películas que se han ocupado del poder de las cor­ poraciones mediáticas y de otras corporaciones en los medios. Se analizan: “Network, un mundo impla­ cable”, “Murrow”, “Buenas noches y buena suerte” y “El dilema”. Los temas más importantes de etas películas son el poder de los propietarios sobre los periodistas, los efectos negativos de la financiación comercial y lo que se denomina agonía del periodismo. There are two types of visions: the journalist villain and the ethical journalist. With a lower number of films dealing with the influence of journalism have the large landowners. In this article addresses four movies that have dealt with the power of the media corporations and other corporations in the media. Are analyzed: “Network”, “Mur­ row”, “Good Night and good luck” and “The Insider”. The most important themes of tabs films are the power of the owners on the journalists, the negative effects of trade financing and what is called agony of journalism. El poder corporativo En este artículo se estudia el tratamiento que el cine estadounidense ha dado al poder corporativo en los medios de comunicación. Ahora el poder del propietario es mucho más difícil de delimitar y de desentrañar porque este tipo de empresas hunde sus raíces en las com­ plejas redes del poder. Pero, además el poder de las corporaciones puede ser impuesto desde fuera de los medios. Comerciales de medios tienen en la publicidad su princi­ pal fuente de financiación, de hecho programan de una forma determinada para atraer a los anunciantes más importantes y estos también trabajan en función de las grandes corporaciones cuyos productos anuncian. Para Noam Chomsky y Edward S. Herman el tamaño y la forma de financiación comercial de las empresas, constituyen dos herramientas por las que la clases domi­ nantes puede utilizar los medios para mantener a la sociedad civil en sintonía con un statu quo determinado que favorece a las grandes corporaciones, sean estas de medios o no. De esa forma los medios son fabricantes de consenso. Y, para el caso en que medios o periodistas decidan actuar al margen de la “main stream”, las empresas dis­ ponen de medios muy eficaces para imponer silencio. Si el periodista persiste en el di­ senso con la empresa puede ser despedido sin contemplaciones. Además, el poder corporativo no solo hace tabla rasa del buen periodismo, sino también de la calidad de sus programas (Chomsky y Herman, 1990: 24­42, 42­50). La publicidad comercial como forma de financiación exclusiva ata a los medios a los grandes anunciantes. A este respecto, recordamos la afirmación de Schiller (1978) para quién, ya en los tiem­ pos de la radio, se trataba sobre todo de emitir publicidad, cualquier otra considera­ ción resultaba innecesaria. Todavía más radical es la afirmación de Dallas W. Smythe (1981) según la cual el papel de los medios comerciales es vender audiencias a los anunciantes. La audiencia es una mercancía y la programación una emisión continua de publicidad, emitida en bloques entre los que la audiencia encuentra el “free lunch”. Y, años antes, Theodor W. Adorno nos había dejado su análisis profético de la indus­ tria cultural. Pues bien, aquí hemos escogido cuatro películas norteamericanas que nos hablan precisamente del poder corporativo. Tres están basadas en hechos reales. “Murrow” y “Buenas noches y buena suerte” nos cuentan la vida Edward R. Murrow, una figura insigne del buen periodismo estadounidense, que se enfrentó con éxito a J. Edgard Hoover, al Comité de Actividades Norteamericanas y a Joseph McCarthy, pero fue derrotado por patrocinadores de programas, anunciantes y productores de telebasura. “El Dilema” narra cómo, la misma empresa que Murrow, ordena un vergonzoso si­ lencio a sus servicios informativos, para evitar que una gran tabacalera interponga una demanda millonaria y dé al traste con la operación secreta de venta de la CBS a Westinghouse. La última “Network, un mundo implacable” es una esperpéntica fic­ ción donde se crítica crudísimamente la intrusión del poder corporativo en una em­ presa de televisión. Es la más antigua de las cuatro, pero viendo luego las otras tres se empieza a pensar que de ficción no tiene más que l nombre. Además la crítica o la sátira, en el último caso, se aplica a todo el sector de la televisión comercial ameri­ cana no solo a la muy real CBS y a la imaginaria UBS. Pero además, estas producciones son una foto fija del estado de la sociedad norteamericana de su tiempo 2. Cine, periodismo y periodistas El cine se ha ocupado de los medios y los periodistas desde los orígenes del sonoro. La primera mitad del siglo XX es particularmente rica en producciones sobre esta te­ mática en las que participaron excelentes guionistas, directores y actores que obtu­ vieron un buen número de galardones. “Ciudadano Kane” (1941), por ejemplo, está considerada por muchos con la mejor película de todos los tiempos y obtuvo un óscar al mejor guión (Welles y Mankiewitz) y fue galardonada como mejor película por el National Board of Review y el Círculo de críticos de Nueva York. “Ciudadano Kane” es además una película cuya temática está muy próxima a la de las tratadas aquí. Hay sin embargo una diferencia: el poder lo ejerce un magnate (“media mogul” en terminología anglosajona), no una corporación. El magnate es además perfectamente visible. Son películas de este tipo: “Caballero sin espada” (1939), “Ciudadano Kane” (1941), “Juan Nadie” (1941), “El manantial” (1949), “El cuarto poder” (1952” Y “RKO 281: La batalla por ciudadano Kane” (1999). Cono ya hemos señalado no son todas pero sí las más significativas. Viendo estas películas figuras como Rupert Mur­ doch o Silvio Berlusconi viene rápidamente ante nosotros. Aquí los problemas plan­ teados son la ausencia total de valores éticos de estos personajes (por mucho que pregonan lo contrario) y las limitaciones de todo tipo para el desarrollo del buen pe­ riodismo en las empresas que controlan y en las que compran. Un cambio de propie­ dad suele llevar aparejado un cambio en la línea editorial, en la jerarquía de temas que interesan al medio y el modo en que deben ser tratadas, si le ética del periodista o sus derechos, entran en conflicto con las del dueño del medios, podría perder su em­ pleo. Lo precedente, tanto para el cine como para la realidad, no sugiere un modelo simple de estímulo­respuesta, por el que determinado medio responderá siempre de la misma forma con respecto a tal o cual asunto. Pero no se puede negar que los mag­ nates basan en la posesión de medios de comunicación su poder. Todos estos perso­ najes son, además, de las clases adineradas. Sin embargo, las películas en que se describe el comportamiento de los empresa­ rios (media mogul o media corporation) no son las más numerosas ni las más anali­ zadas (si exceptuamos a “Ciudadano Kane”).

    Edward R. Murrow Edward Roscoe Murrow (April 25, 1908 – April 27, 1965), born Egbert Roscoe Murrow,[1] was an American broadcast journalist and war correspondent. He first gained Edward R. Comerford* The most important aspect of the war on terror is the application of the rule of law to break the backs of terrorist organizations.' INTRODUCTION In the years since September 11, federal prosecutors have intensi- fied their efforts to bring criminal prosecutions as part of the war on terror. An essential tool in these efforts is the material support stat- ute, 18 U.S.C. § 2339B, which prohibits the provision of material sup- port to designated foreign terrorist organizations. Using the material support statute, the government has charged a number of defendants in the war on terror, including John Walker Lindh and the "Lackawanna Six" defendants. Although often de- scribed as a terrorist financing law, 2 recent cases illustrate the impor- tance of the material support statute not just to restrict terrorist fundraising, but to combat all types of support to terrorist organiza- tions.

Menell** ABSTRACT The Defend Trade Secrets Act of 2016 ("DTSA") was the product of a multi-year effort to federalize trade secret protection. In the final stages of drafting the DTSA, Senators Grassley and Leahy introduced an important new element: immunity "for whistleblowers who share confidential infor­ mation in the course of reporting suspected illegal activity to law enforce­ ment or when filing a lawsuit, provided they do so under seal." The mean­ ing and scope of this provision are of vital importance to enforcing health, safety, civil rights, financial market, consumer, and environmental protec­ tions and deterring fraud against the government, shareholders, and the public.
