The Office of Chief Registrar of the Federal Court of Malaysia has issued a Directive today dated 12 Jan 2021 entitled “Operasi Mahkamah Semasa Pelaksanaan Perintah Kawalan Pergerakan (PKP) Berkuat Kuasa Mulai 13 Hingga 26 Januari 2021” pertaining to Court operations during the MCO period in the affected areas with directives for both Civil and Criminal cases. Yassin, Perdana Menteri pada 11 Januari 2021 berikut adalah panduan pengendalian kes di Mahkamah di enam (6) negeri tersebut bermula pada 13 Januari 2021 hingga 26 Januari 2021 atau pada suatu tarikh lain yang akan diumumkan oleh Kerajaan: PENGENDALIAN KES SIVIL (a) Permohonan Perakuan Segera (i) Bagi permohonan perakuan segera di Mahkamah Persekutuan, Timbalan Kanan Pendaftar / Timbalan Pendaftar akan mengendalikan dokumen perakuan segera dan mendapatkan arahan selanjutnya daripada YAA Ketua Hakim Negara; (ii) Bagi permohonan perakuan segera di Mahkamah Rayuan, Pendaftar Mahkamah Rayuan / Timbalan Kanan Pendaftar akan mengendalikan 1 dokumen perakuan segera dan mendapatkan arahan selanjutnya daripada YAA Presiden Mahkamah Rayuan; (iii) Bagi permohonan perakuan segera di Mahkamah Tinggi, Timbalan Pendaftar (Pentadbiran / Pengurus) atau Penolong Kanan Pendaftar (Pentadbiran / Pengurus) akan mengendalikan dokumen perakuan segera dan mendapatkan arahan selanjutnya daripada YA Hakim / Pesuruhjaya Kehakiman yang bertugas; dan (iv) Bagi permohonan perakuan segera di Mahkamah Sesyen, Penolong Kanan Pendaftar Mahkamah Rendah akan mengendalikan dokumen perakuan segera dan mendapatkan arahan selanjutnya daripada Pengarah Mahkamah Negeri. (b) Pemfailan dan Pengurusan Kes (i) Bagi Mahkamah yang menggunakan sistem e-Kehakiman, pemfailan kes-kes baharu / notis rayuan dan dokumen-dokumen adalah melalui sistem e-Filing. Bagi Mahkamah yang masih belum mempunyai sistem e-Filing, pemfailan kes-kes baharu dan dokumen-dokumen akan dilaksanakan secara fizikal. Bagi kes-kes yang memerlukan kesegeraan, pemfailan boleh dibuat di Mahkamah berdekatan yang mempunyai sistem e-Kehakiman di negeri berkenaan; dan (ii) Pengurusan kes akan dijalankan melalui teknologi komunikasi jarak jauh. (c) Perbicaraan atau Pendengaran Kes (i) Bagi perbicaraan atau pendengaran kes sivil, Arahan Amalan Ketua Hakim Negara Bilangan 1 Tahun 2021 mengenai Pengendalian Prosiding Kes Sivil Melalui Teknologi Komunikasi Jarak Jauh Bagi Mahkamah Di Seluruh Malaysia yang telah diedarkan oleh Pejabat ini melalui e-mel bertarikh 8 Januari 2021 adalah terpakai; dan 2 (ii) Bagi Mahkamah Tinggi, Mahkamah Sesyen dan Mahkamah Majistret, pengendalian kes melalui teknologi komunikasi jarak jauh hendaklah dijalankan dari kediaman masing-masing. PENGENDALIAN KES JENAYAH (a) Pengurusan Kes (i) Pengurusan kes di Mahkamah Persekutuan dan Mahkamah Rayuan akan dijalankan menggunakan teknologi komunikasi jarak jauh iaitu melalui platform sidang video dan e-mel; dan (ii) Pengurusan kes di Mahkamah Tinggi, Mahkamah Sesyen dan Mahkamah Majistret boleh dibuat menggunakan teknologi komunikasi jarak jauh atas persetujuan pihak-pihak yang terlibat dalam prosiding berkenaan. (b) Permohonan Reman Permohonan reman di bawah seksyen 117 Kanun Tatacara Jenayah (KTJ) dan di bawah Akta Imigresen 1959/1963 akan dijalankan seperti biasa mengikut jadual bertugas yang telah ditetapkan manakala pelanjutan reman di bawah seksyen 259 KTJ akan dijalankan melalui teknologi komunikasi jarak jauh. (c) Pendaftaran Kes-Kes Baharu Bagi pendaftaran kes baharu, Pegawai Penyiasat hendaklah memaklumkan lebih awal kepada Mahkamah bagi tujuan persediaan dan tarikh sebutan yang seterusnya hendaklah ditetapkan selepas tamat tempoh PKP. 3 (d) Permohonan Jamin Bagi kesalahan yang boleh dijamin, Pengarah Mahkamah Negeri hendaklah memastikan urusan jamin dapat diproses seperti biasa dan penggunaan sistem e-Jamin adalah digalakkan. (e) Perbicaraan atau Pendengaran Kes Semua perbicaraan atau pendengaran kes di Mahkamah terbuka sepanjang tempoh 13 Januari 2021 hingga 26 Januari 2021 adalah ditangguhkan dan penetapan tarikh perbicaraan atau pendengaran yang baharu akan dimaklumkan kemudian. Dalam keadaan kes-kes yang mendesak, persetujuan YAA Hakim Besar Malaya atau YAA Hakim Besar Sabah dan Sarawak untuk menjalankan perbicaraan atau pendengaran kes di Mahkamah terbuka hendaklah diperolehi terlebih dahulu. Sehubungan dengan itu, semua arahan berhubung dengan pengendalian kes di Mahkamah seluruh Malaysia semasa tempoh PKP yang telah dikeluarkan oleh Pejabat ini bermula daripada 18 Mac 2020 hingga 3 Mei 2020 adalah terbatal. The constitution gives the federal and state governments the power to "control or restrict the propagation of any religious doctrine or belief among persons professing the religion of Islam." The constitution also defines ethnic Malays as Muslim. Civil courts generally ceded authority to Sharia (Islamic law) courts on cases concerning conversion from Islam, and Sharia courts remained reluctant to allow for such conversions. There was no change in the status of respect for religious freedom by the government during the reporting period. Muslims generally may not legally convert to another religion, although members of other religions may convert to Islam. Officials at the federal and state government levels oversee Islamic religious activities, and sometimes influence the content of sermons, use mosques to convey political messages, and prevent certain imams from speaking at mosques. The government maintains a dual legal system, whereby Sharia courts rule on religious and family issues involving Muslims and secular courts rule on other issues pertaining to both Muslims and the broader population. Government policies promoted Islam above other religions. Minority religious groups remained generally free to practice their beliefs; however, over the past several years, many have expressed concern that the civil court system has gradually ceded jurisdictional control to Sharia courts, particularly in areas of family law involving disputes between Muslims and non-Muslims.

    ABSTRACT A COVERT WAR AT SEA: PIRACY AND POLITICAL ECONOMY IN MALAYA, 1824- 1874 Scott C. Abel, PhD Department of History Northern Illinois University, 2016 Eric A. Jones, Director Piracy around the Malay Peninsula during the 19th century was extraordinarily prevalent and resulted in the death and loss of liberty for an untold number of people. This dissertation examines the connections between the piracy of this era and the political economies of the Straits Settlements and the Malay states in the region. Malays pirates often had the support of local rulers who required the goods and slaves brought back by pirates to reinforce their own political and socio-economic positions. The piratical system supported by the rulers was a component of the overall Malay economic system known as kerajaan economics, which helped maintain the status quo for Malay states. This system came under threat once Great Britain and the Netherlands worked to suppress piracy in the region and helped persuade the Malay elite to phase out state-sanctioned piracy. Some people living in Malaya took advantage of the characteristics of British and Malay political economies to engage in acts of piracy regardless of the policies of the British and Malay governments. This study of piracy enables us to understand better the experiences of people of various backgrounds living in 19th-century Malaya, along with how piracy influenced their worldviews. Malaysia’s Civil Litigation System Malaysia’s legal system is based on the common law. A parallel Shari’ah Law system exists alongside the civil justice system. However, Islamic Law, as applied and enforced in the Shari’ah Courts, only applies to those matters involving Family Law and Inheritance. In addition, only those professing the Islamic religion are subject to the jurisdiction of the Shari’ah Courts. A civil action may be initiated in the Magistrates’ Court, the Sessions Court or the High Court. The monetary jurisdiction of the Magistrates’ and Sessions Courts are limited to RM25,000 and RM250,000 respectively.1 Be that as it may, the Magistrates’ and Sessions Court do not have jurisdiction over certain matters, regardless of the monetary claim involved.2 Conversely, there are certain matters where the Sessions Court has unlimited monetary jurisdiction. 3 In relation to class actions, it is particularly significant that the Magistrates’ and Sessions Courts cannot grant declarations and injunctions, which is a common remedy sought in class actions. There are two High Courts in Malaysia, namely the High Court of Malaya and the High Court of Sabah and Sarawak. Both High Courts are of coordinate jurisdiction. There is no limit on their jurisdiction as far as the monetary amount and subject matter are concerned. The jurisdiction of both these High Courts is territorial in nature. Civil proceedings in Malaysia are governed by the Subordinate Courts Rules 1980 and the Rules of the High Court 1980.

ABSTRACT World Heritage designation which focuses on buildings and monuments frequently belies the complexities of human interaction with these structures and how this interaction changes over time. This study examines the interplay between local communities and the spaces and structures of the World Heritage Site of George Town, Malaysia. In the city of George Town, inscribed on the World Heritage List in part, for its tangible multicultural heritage and in recognition of its intangible heritage, I conducted work that problematised the relationships between its local communities and the postcolonial heritages they inhabit. Using grounded theory and employing observational work and semi-structured interviews, I explored how local communities construct and negotiate their own spaces and ‘sense of place’ within, but often disconnected from, the larger codified framework of the city’s ‘official’ heritage designation.
