These seminars bring together civil society, business representatives, policy makers, academics and interested citizens to discuss and exchange views on tax avoidance and tax evasion. Further events are planned throughout 2018 in Austria (17 May), France (8 June), Italy (19 September) and Ireland (9 October). The Commission hopes that the roadshow seminars will further encourage active engagement on tax fairness principles at EU, national and local levels. In particular, a main aim seems to be to spread the tax debate currently ongoing at the EU-level into member states as well. Commission launches VAT MOSS portal 19 April The European Commission has launched a Mini-One Stop Shop (MOSS) portal for VAT purposes. The new MOSS portal provides comprehensive and easily accessible information on VAT rates for telecom, broadcasting and e- services, and explains how the MOSS can be used to declare and pay VAT on such services. 1 Commission proposes EU rules for whistleblower protection, covers tax avoidance as well 23 April The European Commission has published a new Directive for the protection of whistleblowers. -

CHAPTER G An Analysis of the Graded Property Tax Robert M. Schwab and Amy Rehder Harris Introduction In most jurisdictions, land and improvements are taxed at the same rate. The District of Columbia is no exception to this general rule. Consider two homes in the District, each valued at $100,000. Home A is a modest home on a large lot; suppose the land and structures are each worth $50,000. Home B is a more sub- stantial home on a smaller lot; in this case, suppose the land is valued at $20,000 and the improvements at $80,000. Under current District law, both homes would be taxed at a rate of 0.96 percent on the total value and thus, as Figure 1 shows, the owners of both homes would face property taxes of $960.1 But property can be taxed in many ways. Under a graded, or split-rate, tax, land is taxed more heavily than structures. -

Based on the analyses in which land is used as a factor of production, we can confirm that the taxation of land will lead to an increase in the growth rate of the economy. Particularly, we show that the introduction of a tax on land rents, a tax on the value of land or a stamp duty will cause the net price of land to decline. Further, we show that the nationalization of land and the redistribution of the land rents to the young generation will maximize the growth rate of the economy. Optimal Benefit-Based Corporate Income Tax Simon M Naitram∗ Adam Smith Business School, University of Glasgow June 26, 2019 Abstract I derive an optimal benefit-based corporate tax rate formula as a function of the public input elasticity of profits and the (net of) tax elasticity of profits. I argue that the existence of the corporate income tax should be justified by the benefit-based view of taxation: firms should pay tax according to the benefits they receive from the use of the public input. I argue that benefit-based corporate taxation is normatively fair. Since the public input is a location-specific factor, a positive benefit-based corporate tax rate is also feasible even in a small open economy. The benefit-based view gives three clear principles of corporate tax design. First, we should tax corporate profits at source. Second, the optimal tax base is location-specific rents. Third, profit shifting is normatively wrong. An empirical application of the formula suggests the optimal benefit-based corporate tax rate on public corporations in the United States lies in the range of 35 to 52 percent. 1 The relationship between MNE tax haven use and FDI into developing economies characterized by capital flight By Ali Ahmed, Chris Jones and Yama Temouri* The use of tax havens by multinationals is a pervasive activity in international business. However, we know little about the complementary relationship between tax haven use and foreign direct investment (FDI) in the developing world. Drawing on internalization theory, we develop a conceptual framework that explores this relationship and allows us to contribute to the literature on the determinants of tax haven use by developed-country multinationals. Using a large, firm-level data set, we test the model and find a strong positive association between tax haven use and FDI into countries characterized by low economic development and extreme levels of capital flight. This paper contributes to the literature by adding an important dimension to our understanding of the motives for which MNEs invest in tax havens and has important policy implications at both the domestic and the international level. Introduction Multinational enterprises (MNEs) from the developed world own different types of subsidiaries in increasingly complex networks across the globe. Some of the foreign host locations are characterized by light-touch regulation and secrecy, as well as low tax rates on financial capital. These so-called tax havens have received widespread media attention in recent years. In this paper, we explore the relationship between tax haven use and foreign direct investment (FDI) in developing countries, which are often characterized by weak institutions, market imperfections and a propensity for significant capital flight. -

Tax Insights from Transfer Pricing and Real Estate Business Disruption: Transfer pricing issues and considerations for the real estate investment trust industry May 5, 2020 In brief The current crisis has caused significant business disruption for almost every industry, but with particular impact on certain industries. Many real estate investment trusts (REITs) face difficulties as their tenants struggle to meet lease obligations, their real estate assets decline in value, and the ability of their employees to work remotely is challenged. Like many other businesses, REITs must adjust their operations to deal with business disruption arising from the current environment. For a REIT that has taxable REIT subsidiaries (TRSs), its transfer pricing policies can play a key role in its ability to respond to these challenges. This is because TRSs provide REITs with the increased operational flexibility to enter into transactions that may not be permissible for the REIT itself. However, when REITs enter into — or revise — transactions with TRSs based on changes in market conditions, careful consideration should be given to the rules governing the taxation of REITs and TRSs under Sections 856 and 857, as well as the transfer pricing rules under Section 482. Not doing so could result in unexpected excise taxes, REIT compliance concerns, and liquidity issues. The following summarizes common transactions between REITs and TRSs and key issues that should be considered from an income tax perspective. Highlights of the Unified Tax Reform Framework
HIGHLIGHTS OF THE UNIFIED TAX REFORM FRAMEWORK Lowers Rates for Individuals and Families The framework shrinks the current seven tax brackets into three – 12%, 25% and 35% – with the potential for an additional top rate for the highest-income taxpayers to ensure that the wealthy do not contribute a lower share of taxes paid than they do today. Doubles the Standard Deduction and Enhances the Child Tax Credit The framework roughly doubles the standard deduction so that typical middle-class families will keep more of their paycheck. It also significantly increases the Child Tax Credit. Eliminates Loopholes for the Wealthy, Protects Bedrock Provisions for Middle Class To provide simplicity and fairness the framework eliminates many itemized deductions that are primarily used by the wealthy, but retains tax incentives for home mortgage interest and charitable contributions, as well as tax incentives for work, higher education, and retirement security. Repeals the Death Tax and Alternative Minimum Tax (AMT) The framework repeals the unfair Death Tax and substantially simplifies the tax code by repealing the existing individual AMT, which requires taxpayers to do their taxes twice. Creates a New Lower Tax Rate and Structure for Small Businesses The framework limits the maximum tax rate for small and family-owned businesses to 25% - significantly lower than the top rate that these businesses pay today. To Create Jobs and Promote Competitiveness, Lowers the Corporate Tax Rate So that America can compete on level playing field, the framework reduces the corporate tax rate to 20% – below the 22.5% average of the industrialized world. To Boost the Economy, Allows “Expensing” of Capital Investments The framework allows, for at least five years, businesses to immediately write off (or “expense”) the cost of new investments, giving a much-needed lift to the economy. -
