Paul Bremer III, in his capacity as the chief administrator of the Coalition Provisional Author- ity (CPA), introduced several transitional justice mechanisms that set the *Eric Stover is Director of the Human Rights Center at the University of California, Berkeley, and Adjunct Professor in the School of Public Health. In 1991, Stover led a team of forensic scientists to northern Iraq to investigate war crimes committed by Iraqi troops during the Anfal campaign against the Kurds in the late 1980s. In March and April 2003, he returned to northern Iraq where he and Hania Mufti monitored the compliance with the 1949 Geneva Conventions by all sides to the conflict. He returned to Iraq in February 2004 to assist Mufti in investigating the status of documentary and physical evidence to be used in trials against Saddam Hussein and other members of the Ba'athist Party. -

COALITION PROVISIONAL AUTHORITY ORDER NUMBER 82 IRAQI NATIONAL FOUNDATION FOR REMEMBRANCE Pursuant to my authority as Administrator of the Coalition Provisional Authority (CPA), and under the laws and usages of war, and consistent with relevant U.N. Security Council resolutions, including Resolutions 1483 and 1511 (2003), Recognizing that the Iraqi people have long suffered from terrible abuses of their fundamental freedoms and human rights, Acknowledging that the Iraqi people are still uncovering long-hidden evidence of the brutality inflicted on them by the previous regime, Noting that accounting publicly for the past atrocities and educating the Iraqi people about them will serve as a crucial safeguard against future abuses of fundamental freedoms and human rights, Desiring that the establishment of monuments, memorials and other historical and artistic exhibitions will create a lasting record of the crimes committed against the Iraqi people, a tribute to Iraqi resilience and a caution to future generations, I hereby promulgate the following: Section 1 Purpose The Iraqi National Foundation for Remembrance (the “Foundation”) will take steps to ensure that the atrocities of the previous regime are memorialized so that current and future generations of Iraqis will understand and remember this dark period of Iraqi history and take those steps necessary to preserve an open and democratic government which protects human rights, fundamental freedoms and dignity. Section 2 Establishment 1) The Iraqi National Foundation for Remembrance is hereby established. 2) The Foundation will consider proposals from across the nation on how best to memorialize the victims of these brutal atrocities and the sacrifices made by Iraqi individuals and the communities of Iraq. -

However, the Iraqi Kurds’ political autonomy, and territorial and economic demands, have caused friction with Prime Minister Nuri al-Maliki and other Arab leaders of Iraq, and with Christian and other minorities in the north. Turkey and Iran were skeptical about Kurdish autonomy in Iraq but have reconciled themselves to this reality and have emerged as major investors in the Kurdish region of Iraq. Superimposed on Kurd-Arab di Despite limited agreements allowing for new oil exports from the Kurdish region, the major outstanding issues between the Kurds and the central government do not appear close to resolution. Tensions have increased now that Kurdish representation in two key mixed provinces has been reduced by the January 31, 2009, provincial elections. The disputes have nearly erupted into all-out violence between Kurdish militias and central government forces in mid-2009, potentially undermining the stability achieved throughout Iraq in 2008 and causing the U.S. military to propose new U.S. deployments designed to build confidence between Kurdish and government forces. The Obama Administration has not, to date, indicated that the Kurdish-central government disputes would derail or delay a major drawdown of U.S. forces in Iraq between now and August 2010. -

The Bush Administration asserts that establishing democracy in Iraq will catalyze the promotion of democracy throughout the Middle East. The desired outcome would also likely prevent Iraq from becoming a sanctuary for terrorists, a key recommendation of the 9/11 Commission report. The Bush Administration asserts that U.S. policy in Iraq is now showing substantial success, demonstrated by January 30, 2005 elections that chose a National Assembly, and progress in building Iraq’s various security forces. The Administration says it expects that the current transition roadmap — including votes on a permanent constitution by October 31, 2005 and for a permanent government by December 15, 2005 — are being implemented. Others believe the insurgency is widespread, as shown by its recent attacks, and that the Iraqi government could not stand on its own were U.S. and allied international forces to withdraw from Iraq. Some U.S. commanders and senior intelligence officials say that some Islamic militants have entered Iraq since Saddam Hussein fell, to fight what they see as a new “jihad” (Islamic war) against the United States. -

Humud Analyst in Middle Eastern and African Affairs March 9, 2016 Congressional Research Service 7-5700 www.crs.gov RS21968 Iraq: Politics and Governance Summary Iraq’s sectarian and ethnic divisions—muted toward the end of the 2003-2011 U.S. military intervention in Iraq—are fueling a major challenge to Iraq’s stability and to U.S. policy in Iraq and the broader Middle East region. The resentment of Iraq’s Sunni Arabs toward the Shiite- dominated central government facilitated the capture in 2014 of nearly one-third of Iraqi territory by the Sunni Islamist extremist group called the Islamic State (IS, also known as ISIL, ISIS, or the Arabic acronym Da'esh). Iraq’s Kurds are separately embroiled in political, territorial, and economic disputes with Baghdad, but those differences have been at least temporarily subordinated to the common struggle against the Islamic State. U.S. officials assert that the Iraqi government must work to gain the loyalty of more of Iraq’s Sunnis—and to resolve differences with the Kurdistan Regional Government (KRG)—if an eventual defeat of the Islamic State is to result in long-term stability. Prospects for greater inter- communal unity appeared to increase in 2014 with the replacement of former Prime Minister Nuri al-Maliki with the current Prime Minister, Haydar al-Abbadi. Although both men are from the Shiite Islamist Da’wa Party, Abbadi has taken some steps to try to compromise with Sunnis and with the KRG. However, a significant point of contention with the KRG remains the KRG’s marketing of crude oil exports separately from Baghdad. -

Prados Specialists in Middle Eastern Affairs Foreign Affairs, Defense, and Trade Division Summary The Kurdish-inhabited regions of northern Iraq are relatively peaceful, development is proceeding there, and long-repressed Kurdish leaders now occupy senior positions, including the presidency. However, there are concerns that the Kurds are using their political strength to serve their own interests at the expense of a unified Iraq, in the process inflaming longstanding Turkish concerns about Iraqi Kurdish autonomy. Pre-War Background The Kurds, a mountain-dwelling Indo-European people, comprise the fourth largest ethnic group in the Middle East. Although their origins are believed to go back more than two millenia, they have never obtained statehood. An initial peace settlement after World War I held out hopes of Kurdish independence, but under a subsequent treaty they were given minority status in their respective countries — Turkey, Iran, Iraq, and Syria — with smaller enclaves elsewhere in the region. (See dark gray area of map). Kurds now number between 20 and 25 million, with an estimated 4 to 4.5 million in Iraq, roughly 15 to 20 percent of the Iraqi population. With a few exceptions, Kurds are Muslims of the Sunni sect and speak a language (consisting of several dialects) akin to Persian. To varying degrees, Kurds have been objects of discrimination and persecution in the countries where they reside. -

Since then, policy makers, intelligence agencies, media, and academics have been scrambling to find ways to combat the momentum that ISIS has gained in their quest to establish an Islamic State in the Middle East. This paper will examine ISIS and its ability to build an army and enlist the support of native Iraqis who have joined their fight, or at the very least, refrained from resisting their occupation in many Iraqi cities and provinces. In order to understand ISIS, it is imperative that the history of Iraq be examined to show that the rise of the militant group is not solely a result of contemporary problems; rather, it is a movement that is nearly 40 years in the making. This thesis examines Iraqi history from 1968 to present to find the historical cleavages that ISIS exploited to succeed in taking and maintaining control of territory in Iraq.
