The Territorial Clause of the Constitution authorizes the Congress to “make all needful Rules and Regulations respecting the Territory or other Property” of the United States.2 Relying on the Territorial Clause, the Congress has enacted legislation making some provisions of the Constitution explicitly applicable in the insular areas. In addition to this congressional action, courts from time to time have ruled on the application of constitutional provisions to one or more of the insular areas. You asked us to update our 1991 report to you on the applicability of provisions of the Constitution to five insular areas: Puerto Rico, the Virgin Islands, the Commonwealth of the Northern Mariana Islands (the CNMI), American Samoa, and Guam. You asked specifically about significant judicial and legislative developments concerning the political or tax status of these areas, as well as court decisions since our earlier report involving the applicability of constitutional provisions to these areas. legislation covered the 1953 and 1954 crops of basic commodities if the producers had not disapproved marketing quotas and also extended, through 1955, the requirement that the effective parity price for the basic commodities should be the parity price computed under the new or the old formula, whichever was higher. Extra-long staple cotton was made a basic commodity for price support purposes. TOWARD FLEXIBLE PRICE SUPPORTS At the end of the Korean War in 1953, the specter of surpluses once again dominated agricultural policymaking. The debate over levels of support (high and fixed versus a flexible scale) was renewed. The administration of Secretary Ezra Taft Benson increasingly favored flexible supports which would drop as supplies increased. Most Congressmen from agricultural districts, on the other hand, wanted to continue fixed supports. A growing number of agricultural economists moved from their near unanimous preference for flexible supports in the late 1940s to a belief that only strong production controls and high price supports could assure acceptable farm income in a period of growing productivity. For the immediate postwar period, USDA commodity programs continued much as before. Support levels for basic crops remained at 90 percent of parity for 1953 and 1954. Secretary Benson proclaimed marketing quotas for the 1954 wheat and cotton crops on June 1, 1953, and October 9, 1953, respectively. The major types of tobacco and peanuts continued under marketing quotas. Quotas were not imposed on corn but corn acreage allotments were reinstated in 1954 for the first time since before World War II (with the brief exception of 1950). -

&EPA United States Office of Transportation and Air Quality Environmental Protection March 2021 Agency Coming Soon: Tribal and Insular Area Grants: Diesel Emissions Reduction Act (DERA) Request for Applications Request for Application (RFA) opens late April 2021 The U.S. Environmental Protection Agency (EPA) is excited to announce plans to request applications for projects that achieve significant reductions in diesel emissions. EPA anticipates awarding approximately $5 million in total DERA funding and plans to have no mandatory cost share requirement for projects. Eligible Organizations Eligible entities include tribal governments (or intertribal consortia) and Alaska Native villages, or insular area government agencies which have jurisdiction over transportation or air quality. Ibr$f)3 t’ II BY THECOMPTiOLLER GENERAL’ Report To The Congress OF THEUNITED STATES Limited Progress Made In Consolidating Grants To Insular Areas Title V of Public Law 95-134 allows Federal agencies to consolidate grants to US. Insular Areas--Virgin Islands, Guam, American Samoa, Trust Territory of the Pacific Islands, and the Government of the Northern Mariana Islands. Grant consolidation provides a means to min- 115743 imize the administrative and financial burdens associated with the Federal assistance system. Because title V is discretionary, not all Federal agencies have chosen to consolidate grants, and those that have are approaching consoli- dation differently and conservatively. Further, Federal agencies are restricting the Insular Areas’ flexibility to redirect funds to meet I local needs and are applying varying interpre- tations to the provisions of title V. To deal with these issues, the Congress should amend title V. GGD81-61 JULY NJ,1981 L .
