1. DA No. 0607/2020 to construct a single storey dwelling with attached garage at Lot 1, DP 1116072, No. 79 Fig Hill Lane, Dunmore

a) Subject to the conditions of consent in Attachment 2 of this report, and

b) Subject to the concurrence of the Director General, Department of Planning, Industry and Environment being obtained as required by Shellharbour Local Environmental Plan 2013, clause 4.6(4)(b).

2. Upon receipt of concurrence as required by b) above, delegated authority be extended to Chief Executive Officer to approve the development application.

10.4 Amenity and Assets Directorate

10.4.1 Lease - Royal Life Saving Society of Australia ( Branch) - Shellharbour City Stadium, Croom Regional Sporting Complex (11632087)

Councillor Moran asked if the Royal Life Saving Society could apply for a rental subsidy anytime in the future or only when the lease is up for renewal. The Chief Executive Officer took the Question on Notice.

30 RESOLVED: Marsh/Murray

That:

1. Council approve the commencement of the formal process to enter into a lease agreement with Royal Life Saving Society of Australia (New South Wales Branch) for the occupation of office and storage (within a cupboard) within Shellharbour City Stadium located at Croom Regional Sporting Complex (Lot: 304, DP: 1223037) for a period of three years at a commencement annual rental of $16,000 (exclusive of GST) plus annual increases by consumer price index.

2. Council approve for the lease particulars to be placed on public exhibition for a period of 28 days calling for submissions.

3. if any opposing submissions are received as a result of the public exhibition process, or substantial changes are recommended for any reason, a further report be provided to Council for consideration.

4. Council enter into a lease for a term of three years with Royal Life Saving Society of Australia (New South Wales Branch), if at the conclusion of the exhibition period no opposing submissions are received and there

are no substantial post public exhibition changes proposed for any reason. Councillors will be informed of submissions and any post public exhibition changes for the proposal by memo.

5. the Mayor and Chief Executive Officer, or his nominated delegate, be authorised to sign any documentation associated with the lease, with Royal Life Saving Society of Australia (New South Wales), under Council Seal.

10.4.2 NSW Department Planning Industry and Environment 2020-21 Floodplain Management Grant Program (11627226)

That Council:

1. accept the NSW Government's funding offer of up to $160,000 towards the Council's Floodplain Risk Management Program, to undertake the “Review of Horsley Creek Floodplain Risk Management Study and Plan”.

2. allocate budget from stormwater levy funds as matching contributions to the grant in accordance with the table below, subject to the annual budget process and through adoption of the 3-Year Delivery Program.

That Council:

1. approve borrowings up to $8,175,000 (excl. GST) to fund the Warilla Beach Seawall Renewal. 2. invite financial institutions to provide loan borrowing quotations and that delegation be granted to the Chief Executive Officer to accept the most advantageous interest rate once received. 3. authorise the Mayor and Chief Executive Officer, or their nominated delegate, to execute any loan documents under common seal of Council. 4. approve the allocation of $50,700 from Crown Reserves Fund across 2021/22 - 2023/24 for Bass Point Littoral Rainforest Regeneration. 5. authorise the Chief Executive Officer, or their nominated delegate, to execute 2020-21 Coastal and Estuary Management Program Funding Agreements. 6. write to the Department of Planning, Industry and Environment thanking the NSW State Government for its assistance with the Grant allocation.
