Section 1 General Information

1. Beijing Profile

1.1 Geographical location

Beijing is located at longitude between 115°25′ and 117°30′ E and latitude between 39°26′ and 41°03′ N. Surrounded by hills to its west, north and northwest, Beijing has a topography sloping towards the plains of the southeast. Hilly land makes up about two thirds of Beijing’s total area.

1.2 Land area

Beijing Municipality covers a total area of around 16,410 square kilometers.

1.3 Climate

Beijing has a temperate, subhumid continental monsoon climate with abundant sunlight. Its annual temperature averages 10-13 degrees Celsius, and its average annual precipitation is over 600mm. The four seasons are distinct in Beijing: dry springs and winters, rainy summers, and cool autumns. Beijing has a diversified topography. In its mountainous areas, vertical climate changes are marked enough to support significant plant diversity and therefore satisfy cross-seasonal exhibitions’ requirement for outdoor plantation growth.

1.4 Natural environment

Beijing lies at the foot of Yanshan Mountain, the north end of the North China Plain. It borders Shanxi Province and the Inner Mongolian Plateau on its northwest, and the Bohai Sea on its east. From the north border town Mohe to Haikou, the port city of China’s southern territory, Beijing is about in the middle. Beijing is the transport hub and military stronghold connecting the two sides of the Great Wall and the south and north of the Yanshan Mountain. Situated in the temperate subhumid

climate zone, Beijing has a monsoon-influenced continental climate with strong seasonality: short springs and autumns and long winters, with an average low of -3.7 degrees Celsius in January and an average high of 25.2 degrees Celsius in July. Annual precipitation is about 506.7 mm. The wind blows from the northwest in winters and from the southeast in summers.

1.5 Industrial composition

According to the Statistical Communiqué of Beijing Municipality on Economic and Social Development in 2016 jointly issued by Beijing Municipal Bureau of Statistics and the National Bureau of Statistics Beijing Survey Branch, by the end of 2016, Beijing had a permanent population of 21.729 million, of which 10.338 million live in urban function extension areas, accounting for 47.6% of the total, a drop of 1.4 percentage points from 2015. The population in urban new areas was 7.303 million, representing 33.6% of the total, up by 1.5 percentage points from the previous year. The number of permanent population living in core capital function areas and ecological conservation areas as a percentage of the total population in Beijing was 9.8% and 9% respectively, a drop of 0.2 percentage point and an increase of 0.2 percentage point respectively over the numbers of 2015. The Statistical Communiqué also reveals a continuous improvement in Beijing’s economic structure. Last year, Beijing’s industrial composition involving the primary, secondary and tertiary industries was adjusted to 0.5: 19.2: 80.3 from 0.6: 19.7: 79.7 in 2015. The share of tertiary industry was raised by a notable 0.6 percentage point. With a steadily growing economy, employment situation stayed basically stable. According to statistics, in 2016, about 428,000 urban jobs were created, an increase of 2,000 from the previous year; but the registered urban unemployment rate at the end of 2016 was 1.41%, up by 0.02 percentage point than the end of the previous year.

Since the beginning of the 21st century, Beijing’s economy has maintained a steady growth. Secondary and tertiary industries have become the mainstay of Beijing’s regional economy. The output value of tertiary industry in 2016 reached 763.9 billion yuan, contributing to 80.3% of the local GDP that year. The tertiary industry is shifting from a

conventional service industry to a modern service industry, and then towards a more information and knowledge based direction. In recent years, the modern service industry has witnessed great vigor and vitality. The finance industry, information transmission, computer service and software industry, and the manufacturing industry have become the three major supporting industries for Beijing’s modern service sector. Although the adjustment of Beijing’s industrial structure has shown initial results, and the hi-tech industry and modern service industry have taken shape, as the capital of China, Beijing’s political, cultural and diplomatic functions still lag behind other international metropolises. Its administrative service sector, exhibition and convention sector, logistics and tourism sector all need to be strengthened. Existing literature has summarized three characteristics of Beijing’s industrial structure transformation and its impact: first, with an advanced industrial structure second only to that of Shanghai, Beijing has basically completed its industrialization drive; second, Beijing’s industrial structure evolved quickly and now remains steady at a relatively advanced level; third, Beijing’s industrial structure transformation mainly occurs with resources being transferred from the primary and secondary industries to the tertiary industry, whereas nationwide, the transformation is mainly from the primary industry to the secondary and tertiary industries.

Beijing has a strong economy with a regional GDP of 24.48993 trillion yuan in 2016 and local fiscal revenue exceeding 508.13 billion yuan.

1.6 Transportation

Beijing is the first Chinese city to build and operate urban rail transit systems. In the past 40 years since the first rail line was built in Beijing, the capital’s rail transit system has contributed immensely to the development of the city and the daily commuting of the residents. In 2016, the total volume of cargo transported by rail reached 240.981 million tons, up by 3.7% year on year; the cargo turnover was 67.12 billion ton-kilometers, up by 7.6%. Passenger transport volume totaled 692.876 million, down by 1.1%; passenger traffic turnover was 188.84 billion person-kilometers, up by 8.1%.

1.7 The horticulture industry

In 2015, Beijing’s cultivated area of flowers and plants reached 3,984.03 hectares with a sales volume of 720.38 million yuan. Annual output of potted flowers (for sale) was 131.88 million pots, and that of cut flowers, 28.422 million. There had been 196 flower growing enterprises, 22 flower markets and 9,285 florists.

1.8 The tourism industry

With the continued improvement of economic and social fundamentals of Beijing and China, Beijing’s tourism industry keeps developing steadily, receiving 280 million tourists from home and abroad in 2016, an increase of 4.7% year on year, with a total revenue of 468.3 billion yuan, up by 8.4%. Throughout 2016, Beijing received a total of 4.165 million inbound tourists, down by 0.8%. They included 3.548 million foreign tourists, down by 0.8%, and 618,000 tourists from Hong Kong, Macao and , down by 1.0%. Foreign exchange revenue from tourism reached 5.07 billion US dollars, an increase of 10.1%. The total revenue from inbound and outbound tourism added up to 502.1 billion yuan, an increase of 9.0%. The number of outbound tourists through travel agencies was 5.713 million, up by 7.2%. Tourism keeps merging with the primary, secondary and tertiary industries, and has formed new business models and products such as agritourism, agroecology, industrial tourism, tech tourism, sports tourism and cultural tourism, thus extending the industrial chain and optimizing the industrial structure. In 2016, Beijing municipality approved the establishment of 191 travel agencies and issued 5,100 tour guide licenses, organized annual review for 29,000 guides, and gave star-ratings to 47 travel agencies, scenic sites and restaurants. Beijing’s international cooperation on tourism became more pragmatic. The 2014 World Tourism Cities Federation Fragrant Hills Summit was successfully held in Beijing. Over 320 delegates from 126 member cities and institutions attended its 18 thematic sessions and salon forums, concluding over 1,000 prospective agreements. Hence the World Tourism Cities Federation (WTCF) has further expanded its international influence; and signed multiple agreements and MOUs on tourism cooperation with cities/states including Copenhagen, Nevada, Brussels, Los Angeles, Ottawa, etc. and institutions

such as the Pacific Asia Travel Association and America International Travel Services Inc. From 2015 to 2017, China will implement the “515 strategy” for tourism development. That is, centering on the five goals of making tourism “civilized, orderly, safe, convenient and beneficial to the people and national development”, China will introduce 10 initiatives and 52 projects to upgrade the tourism industry, improve its development quality and efficiency, and quicken steps to make China’s tourism industry more modernized, IT-based and international, setting a benchmark for tourism development in Beijing.

1.9 The exhibition and convention industry

With abundant experience in hosting large-scale events, Beijing is the only city in China that has made into the top 10 of international convention cities with advanced facilities and a sophisticated supporting system. Beijing has successfully held many world-class exhibitions and conventions such as the 2008 Summer Olympics, the APEC Economic Leader’s Meeting in 2014, and the Belt and Road Forum for International Cooperation in 2017. These have all accumulated a lot of valuable experience and cultivated a great number of talents for Beijing to hold more large-scale international events in the future.

2. Basic Facts about Yanqing

2.1 Geographical location

Located in the northwest of Beijing, Yanqing District is about 74 kilometers away from the downtown. With an average altitude of over 500 meters above sea level, surrounded by hills on three sides and facing a reservoir on one side, Yanqing District is an important ecological barrier in the northwest of the capital. Here you will not only find the majestic Badaling Great Wall, Longqing Gorge, Kangxi Grassland, but also the Songshan Primeval Forest Park—the primeval forest park nearest to a modern metropolis, the Wild Duck Lake National Wetland Park—the largest in north China, and Silicified Wood National Geopark, which presents a geological heritage that took 140 million years to form. The clean water, soil and air of Yanqing help construct the four ecological corridors: Guihe River Ecological Corridor, Longqing Gorge Forest Park, North Hills Sightseeing Belt, and the Shoreland of Guanting Reservoir, 5

making Yanqing a veritable back garden of the capital and a green oxygen lounge.

2.2 Climate

Yanqing is reputed as the “summer capital” of Beijing with its unique climate. Its average annual temperature is about 8.4 degrees Celsius, and the average temperature of its hottest month is even 0.8 degrees lower than the reputed Chengde summer resort. The cool weather in summer makes Yanqing a good summer resort. Yanqing is also nicknamed the back garden of the capital. Its ratio of days with Grade II or above air quality is as high as 84%, leading the rest of Beijing for several years in a row, therefore is an ideal place for citizens to get close to nature and relax themselves.

2.3 Land area

The total area of Yanqing District is about 1993.75 square kilometers.

2.4 Natural resources and ecological environment

Natural resources:

Located in the transition zone between temperate and cool temperate, semi-arid and subhumid climate zones, Yanqing has a continental monsoonal climate with cold winters and cool summers. Its average annual precipitation is 611.7 mm, with its average temperature in the hottest month 1.4 degrees lower than Beidaihe Summer Resort. The highest peak in Yanqing is Haituo Mountain with a height of 2,241 meters, the second highest peak in Beijing municipality. Yanqing District has one national-level, two municipal-level and six district-level nature reserve areas, such as the Songshan Mountain, Yudu Mountain and Wild Duck Lake. Its wetland covers an area of nearly 50,000 mu (3,333 hectares), and the total area of the nine nature reserves make up 27.6% of the area of Yanqing District. Wild Duck Lake National Wetland Park is the largest nature reserve for wetland birds in north China and the only one in Beijing. Forty species of birds under first- or second-class state protection live on its water surface of over 1.5 million square meters.

Yanqing is endowed with an abundance of new and renewable energy resources. As the only new energy and renewable energy demonstration area in Beijing and a national green energy demonstration district, Yanqing’s new and renewable energy resources make up as much as 30% of its total energy consumption, the highest in Beijing. With an average of over 2,800 hours of sunshine annually, Yanqing has the richest solar power resources in Beijing. It also commands 70% of Beijing’s wind resources: the mean wind speed of Guanting Reservoir at a 70-m height exceeds 7 m/s, and its effective annual power generation time is over 1,800 hours. Yanqing has over 105 square kilometers of geothermal fields with depths of burial less than 2,500 meters and temperatures above 50 degrees Celsius, the highest reaching over 700 degrees Celsius. An annual generation of 200,000 tons of crop stalks and dead twigs, and 270,000 tons of livestock and poultry manure gives Yanqing plentiful biomass resources.

Ecological environment:

First, green coverage. Currently, with 2.41 million mu (160,667 hectares) of green area, Yanqing’s green coverage rate is as high as 70.04%, and its forest coverage rate is 57.46%. Guihe River Ecological Corridor, Shoreland of Guanting Reservoir, North Hills Sightseeing Belt, and Longqing Gorge Forest Park are the four ecological corridors of Yanqing, covering a total area of over 100,000 mu (6,667 hectares), which plus the nine parks with diversified styles make up 20% of the area of the Yanqing New Town. The urban green space ratio is as high as 64.39%, and per capita public green area is 42 square meters, constituting a scenery of “town and the surrounding gardens setting each other off”, which makes Yanqing “a town of mountains and waters with half a town of gardens”.

Second, air quality. Yanqing has been one of the best areas in Beijing in terms of air quality for many consecutive years. In 2016, the average concentration of PM 2.5 throughout Beijing Municipality was 73 µg/m3, while that of Yanqing District was only 60 µg/m3, and the average concentration of PM 10 in Yanqing was 73.9 µg/m3.

Third, water environment. Yanqing is the only district in Beijing

with its whole area designated as water source conservation area. With 46 rivers above the fourth order including 2 first-order rivers, Yanqing is endowed with abundant water resources. The total amount of water resources in Yanqing District is about 224 million cubic meters. It has one large-scale reservoir and 4 small and medium scale reservoirs.

2.5 Transportation

The total length of urban and rural roads in Yanqing District reached 2,033 kilometers, and almost all the Expo Village roads have been hardened. Yanqing has been actively engaged in building a sophisticated transport network that links Yanqing to the outside areas. The S2 suburban railway line, Phase I of G110 state highway, and Badaling expressway have all been up and running; the Beijing-Zhangjiakou Intercity Railway project was launched in 2015; construction of the Daxing-Yanqing expressway started in 2016; and the concession agreement for the Phase II project of G110 state highway has been signed officially.

2.6 Industrial development

First, peri-urban modern agriculture. The total sown area of grain in Yanqing is 204,000 mu (13,600 hectares), and that of vegetables is 28,000 mu (1867 hectares); the cultivated area of flowers and plants is 16,000 mu (1067 hectares); and some 42,900 mu (2860 hectares) has been dedicated to developing under-forest economy. Currently in Yanqing, there are 42 companies (production bases) that produce organic agricultural products with 58 certificates for organic products or organic conversion products. Annual output of organic agricultural products reached 40,000 tons with an output value of 415 million yuan, accounting for 21% of the total agricultural output value of the district.

Second, new energy and environmental protection. Currently Yanqing has 238 industrial enterprises, among which 38 are above the designated size and 10 are with an output value exceeding 100 million yuan. Yanqing also has 11 enterprises engaged in new energy and environmental protection sectors, including 5 with an output value above 100 million yuan. Yanqing pays special attention to developing the new energy and environmental protection sectors, and has developed industrial 8

chains that cover designing, R&D, innovation incubation, production, examination and demonstrative application for wind energy, solar power and biomass energy. Yanqing is leading the whole city in using new and renewable energies like wind and solar power. The institutional reform for Zhongguancun Science Park Yanqing Sub-Park has been completed, and the Service Center for Zhongguancun Yanqing Sub-Park has been established.

Third, tourism and leisure industry. Currently Yanqing boasts over 30 scenic spots, 19 of which are above A level, including one 5A-level scenic spot (Badaling Great Wall) and six 4A-level scenic spots (Longqing Gorge, Baili Landscape Gallery, Songshan Forest Park, the Water Pass Great Wall, Wild Duck Lake Wetland Park, and the International Grape Exhibition Garden). Yanqing has 14 star-rated hotels, 21 travel agencies, five national demonstration sites for recreational agriculture and rural tourism, 34 star-rated folk culture tourism villages, 1,024 star-rated folk culture tourism households and 53 rural tourism agencies. To boost local tourism development, tourism festivals with unique local features such as the “summer escape season” and the snow festival were held. In 2015, the International Grape Exhibition Garden was rated as a national 4A-level scenic spot, and the “magical wild gorge” received an A-level rating. The total tourism revenue in 2016 is estimated to reach 2.9 billion yuan, an increase of 7% year on year.

2.7 Green development

In 2013, Yanqing UNESCO Global Geopark was established. Yanqing successfully held the 80th F.I.C.C. Rally and the International Grape Conference in 2014, and the World Potato Congress in 2015. In 2019, Yanqing will host the Beijing International Horticultural Exhibition, and in 2022, Yanqing will be one of the three competition zones of the Olympic Winter Games co-hosted by Beijing and Zhangjiakou, providing the venues for alpine skiing, skeleton, luge and bobsleigh.

In 2015, the Yanqing Leadership Group for Preparation of the International Horticultural Exhibition 2019 Beijing China was set up. Now Yanqing is making every effort to advance the 93 projects of service facilities outside the Expo Site including transportation, municipal

facilities, landscaping, etc., so as to ensure effective connection between the facilities inside and outside the Expo Site. The Action Outline of Yanqing District for Beijing Expo 2019 has been issued; and Yanqing has seen an increasingly rich atmosphere for Expo culture by hosting a series of themed activities such as “All Citizens Learning English”, “Do My Part for the Horti-Expo”, etc. In 2016, the Yanqing Operation Center for Beijing 2022 Olympic Winter Games was set up. Also, Yanqing District has put together a leadership group and a working team for preparations of the Games, which have commissioned formulation of the master plan for the competition zone, venues and other infrastructure on behalf of the property owners, selected the leading team for the design of the National Alpine Skiing Center, National Center for Skeleton, Luge and Bobsleigh, and the Yanqing Olympic Village, developed a PPP public bidding plan, and launched the preparatory work for temporary roads to be used during construction, thus laying a solid foundation for the project construction.

In the next stage, Yanqing will mobilize all resources in the district to guarantee the success of Beijing Expo 2019 and the 2022 Olympic Winter Games. Yanqing will earnestly implement the action plan for preparation of the two events, complete the construction of supporting infrastructure as scheduled, and systemically improve the environment through afforestation, landscaping and treatment of polluted lakes and rivers, so as to ensure that the service capacity of the Expo Site and the Competition Zone will be up to the standard and requirements of the events. The events will in return drive the local development. A modern horticulture industry cluster has taken shape in Yanqing District. It aims to accommodate 50 enterprises with 100 research results and an annual sales revenue of 2 billion yuan by 2021.

3. Beijing Expo 2019

3.1 Title

The full title of the Expo is “International Horticultural Exhibition 2019, Beijing, China”. The short title is “Beijing Expo 2019”. It may also be referred to as “the International Horticultural Exhibition by the Great Wall”.

3.2 Category 10

A1 International Horticultural Exhibition (with BIE recognition)

3.3 Duration

Beijing Expo 2019 will last for six months, or 162 days, opening on April 29 and closing on October 7, 2019.

3.4 Exhibition area

The total Expo Site of Beijing Expo 2019 is about 503 hectares.

3.5 Goal

“A new horizon of world horticulture, a new model of ecological conservation”

Beijing Expo 2019 will be the first of its kind to be held at the foot of the Great Wall, one of the Seven Wonders of the World, since 1960. The profound Chinese culture will surely bring brand new elements to the horticulture expo and enrich its contents. Based on the experience of past expos, Beijing Expo 2019 will demonstrate horticultural achievements from all over the world, showcase China’s contribution to the world horticultural development by exhibiting the various cultivars that have spread to the rest of the world from China in the past 2000 years, and bring together horticultural products from different seasons and climate zones with the application of the most advanced technologies. Beijing Expo 2019 will attract a wide range of participants from all over the world, reaching an unprecedented scale. It aims to be one of the best horticulture expos in the world that is unique, of high-level, and boasts the largest number of quality exhibits, so as to push the world horticulture industry to a higher level.

In 2012, the Chinese government started to highlight the importance of ecological conservation throughout the whole process and in all the aspects of China’s economic, political, cultural and social development, with a view to building a beautiful China for generations to come. As the capital of China, it is of even greater significance for Beijing to develop a sound ecological civilization. Taking Beijing Expo 2019 as an opportunity, Beijing will vigorously promote an ecological culture that features

harmonious human-nature coexistence and sustainable development, learn from global achievements in green production, green consumption and green lifestyle, apply green technologies, and use green energies throughout the Expo based on the 3R (reduce, reuse, recycle) principle. Beijing Expo 2019 will apply and promote the achievements in low-carbon and green development, fully demonstrate the achievements of Chinese and world ecological civilizations in horticulture, so as to make new breakthroughs in the exploration and application of ecological civilization, and make Beijing Expo 2019 a green, low-carbon and environmentally friendly event as well as a new model for ecological civilization.

3.6 Theme and sub-themes

Beijing Expo 2019 takes “Live Green, Live Better” as its theme, and “Green Development” “Horticulture in Life” “Harmonizing with the Nature” “Education and the Future” and “Home of Hearts” as the sub-themes.

3.7 Expo Site

The Expo Site is located in the southwest of Yanqing District, 10 kilometers away from the Badaling Great Wall and Haituo Mountain. It stretches across the Guihe River, with the Yanqing New Town to its east and Guanting Reservoir to its west. With its north front facing the river, the Expo Site has the main exhibition zones in the middle, and its south near the urban construction area. Based on an overall consideration of ecological conservation, environmental protection and post-Expo utilization, the Expo Site is divided into three sections, i.e. the fenced area, unfenced area and the Expo village. The fenced area covers about 503 hectares. Taking into account multiple factors including exhibition requirements, traffic flow, municipal facilities and landscape design, and making best use of the natural landscape features, an overall layout of “one core, two axes, three belts and several zones” has been formed for the Expo Site. Of which, “one core” refers to the core landscape area; “two axes” refer to the Chinese landscape axis and the world gardening axis; “three belts” are the Guihe River ecological leisure belt, gardening experience belt, and horticulture industry development belt; and “several

zones” include the “Harmonizing with the Nature” exhibition zone (international horticulture gardens), “Flourishing Blossoms” exhibition zone (Chinese horticulture gardens), “Home of Hearts” exhibition zone (nature and the ecosystem gardens), “Gardening in Life” exhibition zone (world gardening town and cultural gardens), and “Education and the Future” exhibition zone (horticulture technology park and children’s gardens). The International Pavilion is located on the world gardening axis, and the international horticulture gardens are on both sides of the

axis.

3.8 Transportation

The Expo Site is about 74 kilometers away from the city center. On the basis of the existing Beijing-Lhasa Expressway and the G110 state highway, Yanqing is accelerating the construction of three new transport routes, namely, the Yanqing extension of Beijing-Zhangjiakou Intercity Railway, Daxing-Yanqing Expressway, and Beijing-Urumqi Expressway (Beijing to Urumqi direction) to provide external transportation support. Meanwhile, the road network around the Expo Site will be improved to form a sophisticated transport network that seamlessly connects with the three external routes, namely the Beijing-Lhasa Expressway, the Beijing-Urumqi Expressway and the Daxing-Yanqing Expressway.

3.9 Organizational structure and responsibilities

3.9.1 Responsibilities of the Organizing Committee and its structure

Major responsibilities:

Reviewing the strategies and action guidelines for the preparation of Beijing Expo 2019 and coordinating the formulation and implementation of relevant laws, regulations and policies; coordinating the participation of central departments and localities; deciding on the major issues that should be reported to the central government during the preparation and running of the Expo; making resolutions and decisions on Expo-related issues; inviting national governments and international organizations to participate in the Expo, and coordinating with the BIE and participating countries; and appointing a Commissioner General of the Expo.

Organizational structure:

Hu Chunhua, Vice Premier of the State Council, serves as Chairman of the Organizing Committee. Cai Qi, Secretary of CPC Beijing Municipal Committee, serves as first Vice-Chairman of the Organizing Committee. Other Vice-Chairpersons include: Chen Jining, Mayor of

Beijing; Jiang Zelin, Deputy Secretary General of the State Council; Jiang Zengwei, President of the China Council for the Promotion of International Trade (CCPIT); Zhang Jianlong, Administrator of the National Forestry and Grassland Administration; Li Baodong, Vice Foreign Minister; and Jiang Zehui, President of China Flower Association. The liaison department under the Organizing Committee is responsible for the daily liaison and coordination affairs. Deputy Secretary General of the State Council Jiang Zelin is the head of the department and CCPIT Vice President Wang Jinzhen is the executive deputy head. Office of the liaison department has been set at the CCPIT.

3.9.2 Responsibilities of the Executive Committee and its structure

Major responsibilities:

Implementing resolutions and decisions of the Organizing Committee under its leadership and reporting to the Organizing Committee on a regular basis about the progress and challenges during the preparation work; providing guidance and coordination to relevant departments of Beijing Municipality in their Expo-related work; and implementing tasks assigned by the Organizing Committee.

Zhang Gong, Vice Mayor of Beijing, is the Executive Deputy Director.

Section 2 Procedure for Participation

Official participation procedure is established in accordance with General Regulations and Special Regulation No. 2, specifying work procedure to be followed by official participants.

2. Confirmation

It is required that a confirmation of accepting the invitation be sent to the Chinese government through diplomatic channels. The will of official participation is considered confirmed once the Chinese government receives the document. According to the BIE conventions, the order in which national flags are arranged and Participants introduced in every ceremony accords with that in which the confirmations are received by the Chinese government.

3. Commissioner General of Section

Once the participation is confirmed, each Official Participant shall be represented by a Commissioner General of Section with the accreditation notified to the Chinese government through diplomatic means.

Commissioner General’s Responsibilities:

-- Be fully responsible for the organization and operation of his/her country’s exhibition section.

-- Ensure that personnel of the section engaged in exhibition, commercial and other activities abide by the regulations and provisions of the Expo.

4. Confirming the Form of Participation

Confirm the form of participation, i.e. participating in the indoor exhibition or building outdoor gardens, identify the location and area of the exhibition, and submit the application for exhibition area and the theme statement.

5. Signing the Participation Contract

The Participation Contract (Appendix III) will be signed by Beijing World Horticulture Expo Coordination Bureau and the Commissioner General of Section on behalf of the participant, and countersigned by the Commissioner General of the Expo, so as to form an agreement on

participation conditions. Participants must read through the Participation Contract before consulting with the Organizer.

The Participation Contract is mainly about:

 Location and area of the exhibition venues

 Participants’ commercial activities

 Participants’ rights and interests.

According to Article 13 of Special Regulation No.2, the Organizer provides assistance to qualified Participants. The content of assistance is stipulated in the Assistance Contract, which is included as an appendix to the Participation Contract.

Chapter 1 General Principles

Article 1

This contract aims to list the clauses concerning _____’s (name of the Participant) participation in Beijing Expo 2019.

General Regulations and Special Regulations of Beijing Expo 2019 approved by the Bureau International des Expositions (or “BIE” for short) will be included in this contract, equally binding for both parties.

According to the Convention Relating to International Exhibitions (or “the Convention” in short) signed in Paris on November 22nd, 1928, its amendments and supplements, as well as the General Regulations (especially Article 5) approved by the BIE, both parties shall recognize the authority of the Commissioner General of the Expo.

Chapter 2 Participant’s Exhibition

Article 2

1. The Organizer shall provide following exhibition area free of charge to the Participant:

(1) Outdoor exhibition area (for building exhibition gardens): the Organizer will provide as of January 1st, 2017;

(2) Indoor exhibition area (for setting up stands): the Organizer will provide as of November 15th, 2018.

The abovementioned exhibition area offered to the Participant is stipulated in Attachment I and included as part of this contract.

2. The Participant agrees to arrange the exhibition based on the theme of Beijing Expo 2019 stipulated in General Regulations and Special Regulation No.1, and in accordance with the Theme Statement which must be approved by the Organizer and be included in this contract

as Attachment II.

3. According to General Regulations and Special Regulations, the Participant must be responsible for decorating, maintaining, managing and cleaning the assigned exhibition area.

Article 3

1. According to Special Regulation No.10 referred to in Article 37 of General Regulations, the Organizer shall provide the Participant public services such as power supply, communications, water supply and drainage, waste disposal, etc.

2. Clauses and prices for the abovementioned services will be expounded in Special Regulation No.10.

Article 4

1. The Organizer shall provide the Participant information on relevant Chinese laws, regulations and policies pertaining to the latter’s participation in the Expo.

2. If required by the Organizer, the Participant shall submit to the Organizer the following information and documents:

-- The number and professions of the staff hired by the Participant for organizing and carrying out the exhibition.

-- Cargo and articles related to the Participant’s exhibition and planned to be imported.

3. The exchange of abovementioned information and other information will be mutually supplementary and help ensure the success of Beijing Expo 2019 and Participants’ exhibition.

Article 5

1. The Participant assumes full responsibility for selecting and arranging personnel of its exhibition and hiring staff in its exhibition area.

2. The Participant shall demand the following parties strictly abide by this contract, General Regulations and Special Regulations of the Beijing Expo 2019, as well as instructions given by the Organizer based on abovementioned regulations:

(1) Personnel in the Participant’s exhibition area and staff hired to fulfill relevant tasks of the Expo for the Participant;

(2) Parties and employees engaged in the exhibition or commercial activities held by the Participant;

(3) Parties and employees engaged in the exhibition arrangement in the Participant’s exhibition area;

(4) Other parties related to the Participant.

3. The Organizer shall promise not to communicate with the aforementioned people unless through the Participant.

Article 6

1. The Participant hereby agrees to the following:

(1) To ensure that its exhibition area opens to the public throughout the opening hours of the Expo;

(2) To authorize the Organizer to set up facilities in the exhibition area to ensure a successful Expo and allow the Organizer to maintain and repair the facilities if necessary;

(3) Unless otherwise agreed between the Organizer and the Participant, the exhibition area assigned to the Participant shall be cleared and restored to the same state as it was initially delivered to the Participant before December 31, 2019.

2. Should the Participant fail to honor these obligations; Commissioner General of the Expo holds the right to exercise relevant authority in accordance with Article 21 of General Regulations.

Chapter 3 Participants’ Commercial Activities

Article 7

1. If agreed by the Organizer, the Participant can open restaurant, offering to the public featured cuisine in designated areas approved by the Organizer. According to Special Regulation No.9, the Participant shall pay monthly royalties to the Organizer based on the restaurant’s turnover.

2. The “turnover” in this Article and Article 8 refers to after-tax total income, i.e., the total sum of revenue generated from conducting commercial activities during Beijing Expo 2019 deducting added-value tax and other taxes.

3. Specific terms and conditions related to the restaurant prescribed in this Article will be expounded in Special Regulation No.9 referred to in Article 37 of General Regulations.

Article 8

1. If approved by the Organizer, the Participant can sell to the public in designated areas approved by the Organizer photos, slides, postcards, audio and video products (including films, CD, DVD and other electronic media), books and stamps related to its country or organization.

If approved by the Organizer, the Participant may also sell a limited number of goods which the Organizer recognizes as good representations of the Participant’s country or organization, and replace items being sold during the Expo.

2. The Participant shall pay monthly royalties to the Organizer based on the turnover generated from selling products listed in the previous paragraph in accordance with Special Regulation No. 9.

3. Specific terms and conditions related to selling the products prescribed in this Article will be expounded in Special Regulation No.9 referred to in Article 37 of General Regulations.

Article 9

1. The Participant must keep a business record of the restaurant and products sold on a daily basis, so as to pay royalties to the Organizer accordingly. The record must be clear and complete. The Participant shall allow the Organizer to look up and copy the abovementioned record so as to audit the turnover.

2. The Participant must employ the cashier system specified by the Organizer to process the sales revenue generated from its commercial activities.

3. The area of commercial activities (including manufacturing, storage and sales) shall not exceed 20% of the Participant’s total exhibition area. Relevant details will be specified in Attachment III.

Article 10

1. The Participant holds the right to sell its exhibits, installation materials as well as other items used in the exhibition area at the end of the Expo, and shall abide by relevant laws and regulations of China.

2. No royalties will be charged by the Organizer for selling the abovementioned articles. However, according to Special Regulation No.7 referred to in Article 37 of General Regulations, the Participant shall waver the interest brought by goods designated for temporary import, pay tariff and other taxes, and abide by pertinent regulations of the Customs.

Chapter 4 Confer Rights and Interest to the Participant

Article 11

Privileges and special offers enjoyed by Commissioner General of Section and the staff are specified in Special Regulation No.12.

Article 12

1. Commissioner General of the Expo and the Organizer shall follow existing laws and regulations to ensure that the staff of the Participant has barrier-free access to exit, entry and residence.

2. The Organizer shall provide help in the following aspects to the staff of the Participant:

 Accommodation;

 Health related matters and insurance;

Article 13

The Commissioner General of the Expo and the Organizer shall coordinate efforts of government agencies, so that their actions may help ensure a successful Expo, especially to:

 Set up a Customs Office at the place most convenient for customs clearance;

 Help the Participant with the entry of all goods and articles necessary to the exhibition;

 Ease the import quota control on the products (including those offered in the restaurant) sold by the Participant if necessary;

 Recommend qualified agencies approved by the Organizer to represent the Participant in transport and customs clearance of goods, and the rates are to be determined. The Participant may decide whether or not to use the service provided by the agencies based on its own needs.

Article 14

The Organizer shall provide a list of recommended agencies vetted by the Organizer to the Participant, including agencies of transport, goods carrying and packaging, providers of other products and services as well as contractors of various kind, and request that these companies promise to treat the Participant with fairness.

The Participant may decide whether or not to use the products and services offered by the abovementioned providers based on its own needs.

The Commissioner General of the Expo and the Organizer shall coordinate with the recommended providers of goods and services, so as to get the most favorable offer for the Participant.

Article 15

Should disputes arise between the Participant and the Organizer, both parties have agreed to the following: if the dispute concerns the interpretation of the Convention and the BIE’s regulations, it shall be resolved through the BIE; under other circumstances, through the College of Commissioners General or its Steering Committee.

Both parties can also settle disputes by ways stipulated in Article 11 of General Regulations.

Chapter 5 Contract Coming into Effect

Article 16

This contract comes into effect from the date they are signed by both parties and countersigned by the Commissioner General of the Expo. If the contracts are dated differently, they come into effect from the date that the last party signed the contract.

Any communication and notice under this contract shall come in the written form.

Regardless of the forms in which a Participant assigns its commercial activities to a third party, the Commissioner General of Section of the Participant shall have direct responsibility for the act of the said third party. Pursuant to this contract, the Participant shall pay to the Organizer royalties arising from its commercial activities; and the Commissioner General of Section or his/her designated representative shall collect and deliver the royalties to the Organizer.

7. Commercial activities conducted by the Participant are part of the entire Expo Site commercial activities, and shall collectively be managed and coordinated by the Organizer.

Section 3 Theme Development

1. Theme Statement

The theme of Beijing Expo 2019 is “Live Green, Live Better”.

This theme derives from a new guiding principle formed throughout human’s history–advocating ecological civilization. Human lives have always been with nature and horticulture throughout the ages. . As a language with which mankind communicates with nature, horticulture is the art of plant and the culture of greenery as well as the extension and sublimation of life. Human’s subsistence depends on green ecological environment, without which there would not have been human. However, over the centuries, mankind has not paid enough attention to protecting the eco-environment and overly exploited nature for resources, thus severely hampering the balance of the green eco-environment as well as humanity’s own life, health, survival and reproduction. In the new era, innovative civilization calls for green lifestyle.

As a bond between mankind and nature, horticulture has become a way of linking a green lifestyle and quality living, delivering rich material life and spiritual pleasure to people. With continuous development of human society, mankind has turned from discovering and transforming nature to following, respecting and fitting in nature. Leading a green life has gained increasing popularity and mankind begins to place increasing emphasis on fostering a green and healthy environment.

As an international event joined by countries all over the world, Expo 2019 Beijing displayed a common aspiration for a green lifestyle by developing and communicating on the theme “Live Green, Live Better”. The theme will draw more attention to the development of horticulture and people’s health so that they will pay more attention to the innovation and growth of this industry, face challenges squarely and jointly build a better future. Through joint efforts of the Organizer and participants, Expo 2019 Beijing will make people aware that harmony and common growth between man and nature is the material basis for a beautiful homeland. It will inspire people to change their attitude towards life and

adopt a green lifestyle. It will also encourage more exploration of the role horticulture plays in improving health, bringing spiritual pleasure, and thus raise the quality of life, and make our life better in a broader sense.

Expo 2019 Beijing will give full play to its publicity so that more people will be supportive of a green and healthy lifestyle and join the efforts to build a beautiful homeland. World horticulture as a platform will be fully leveraged to expand people’s related knowledge, encourage them to explore new dimensions to it and search for new ways in which horticulture becomes integrated with green lifestyle. In so doing, people will be encouraged to get to know and comply with nature, respect lives, adopt a healthy lifestyle, touch souls and set a good new example of beautiful homeland and ecological civilization.

2. Content Structure

Themed as “Live Green, Live Better”, Expo 2019 Beijing developed five sub-themes, namely, Green Development, Horticulture in Life, Harmonizing with Nature, Education and the Future and Home of Hearts. The five sub-themes are mutually independent yet interconnected.

3. Theme Presentation

3.1 Green development

Going green and sustainable development are an important philosophy and aspiration of the global economic growth at present and in the decades ahead. Green development does not only refer to the philosophy of ecological civilization and environmental protection, it also represents a major shift in growth and production mode. We should promote green production and advocate comprehensive integration of innovation elements of green technology. We ought to establish a green supporting system facing talents, research and development, products and market. We seek to form an interconnected system centering on green economy, green development, collecting and releasing innovation potential and dynamism, so that innovation will become an enduring driving force in green transformation.

The Organizer holds high expectation that all countries will leverage

Beijing Expo 2019 as a platform to boost green and recycling economy as well as implement and explore sustainable development model centering on “Live Green, Live Better”.

3.2 Horticulture in Life

Horticulture is an important way for man and the nature to live in harmony. “It is the purest of human pleasures; without which buildings and palaces are but gross hand-works. It is not about nature” (Francis Bacon). Fruit trees and vegetables in the fields, parks and boulevards in the cities, parterres and green plants on the streets, bonsai and flower arrangement in the family spaces are all about horticulture. Horticulture is everywhere in people’s daily life including food, clothing, housing and transportation. For thousands of years, it nourishes, decorates and beautifies people’s life.

Expo 2019 Beijing will better encourage people to integrate horticulture in their daily life and pursue a green lifestyle, so that they will respect, love and return to nature all the more and “take pleasure in the idyllic scenery” (the Art of Garden-Building).

3.3 Harmonizing with Nature

Every country and nation has a plant representing its own culture. These special flowers and trees are inseparable from their life and have formed distinct custom and art through mutual interaction. They may even take on unique significance on the society, politics, economy, diplomacy, military affairs, culture and art, national integration, etc. The Expo as a platform will turn multicultural cooperation and integration into a common sense of commitment to fostering a beautiful homeland. People from different nationalities, religions and cultures will be motivated to come together, communicate with and appreciate each other for common prosperity, and strive for humanity’s common goals with an cooperative attitude.

The Organizer expects that during this Expo, more countries, local governments, international organizations, the civil society and research institutions will follow the trend of globalization, display their own cultural identity through cultural integration, share cultures and explore

opportunities for cooperation through gardening demonstrations, themed forums, business negotiations, case study and so on.

3.4 Education and the Future

Expo 2019 Beijing serves as a platform for raising awareness and nurturing love for gardening. It is not only about education, training and innovation in horticulture industry, but also encourages all participants and visitors to leverage the Expo as a platform for education through interaction and activity involvement. It helps establish an ecological concept among the whole society, especially the teenagers, and educate people to respect natural laws and love gardening.

Through technological innovations like drama, films, multimedia demonstration, the Organizer aims to display the ideas and future trends behind gardening, guide tourists to explore nature’s resources and bounty, and highlight the educational function, the value nature, technology, economy, creativity and aesthetics of the horticulture industry.

3.5 Home of Hearts

A beautiful homeland is one that nurtures people’s souls with its culture, and one that is environmentally friendly. Such a place features the integration of architecture and horticulture, cityscape and landscape. Gardens of different styles are like poems, trees and flowers are like languages, all of which attract people to immerse themselves in nature. To find spiritual happiness, people should be pleased with the natural environment, architecture, landscape while enjoy various art forms such as poems, paintings, couplets, theatre and sculptures.

The Expo Site is located on both banks of the beautiful Guishui River. The Organizer would like to encourage participants to take into account the unique landscape of the site so as to better reflect a ideally livable environment and a home of hearts.

4. Sub-Theme Statement

The Organizer will designate specific indoor and outdoor exhibition areas (both known as "exhibition areas") inside the Expo Site for official

5. Exhibition Project

Exhibition for indoor flowers and plants will be held in exhibition halls inside the Expo Site. For indoor exhibition, official participants and exhibitors should adjust their exhibits in accordance with the theme in a timely manner. Specific dates and arrangements for indoor exhibition will be announced by the Organizer later.

6. Deadline

Participating counties (or Commissioners General of Sections when applicable) shall submit by request their exhibition catalogues to the Organizer no later than December 1st, 2017.

Section 4 Admission

1. Opening Hours

1.1 The Expo Site and exhibition areas for official participants will be open to the public during the Beijing Expo 2019, i.e. from April 29 to October 7, 2019.

1.2 The Expo Site is temporarily set to be open daily between 9:00 and 21:00 (12 hours); the exhibition area for official participants is temporarily set to be open daily between 9:00 and 21:00 (12 hours).

1.3 Commercial service facilities in the public places of the Expo Site are set to be open daily between 9:00 and 21:00 (12 hours).

1.4 According to Special Regulation No. 9 Concerning Commercial Activities of Official Participants, the hours for commercial activities of official participants shall be the same as the daily opening hours of its pavilion.

1.5 The Organizer has the right to revise the opening hours of the Expo Site and the commercial service facilities specified in Item1.2 and Item 1.3 of this Section on specific dates and in necessary circumstances, but such revisions must have the consent of the Commissioner General of the Expo and the BIE, and the official participants shall be notified in advance.

1.6 In special circumstances, the Organizer has the authority to adopt provisional admission restriction measures to ensure safe and orderly operation of the Expo.

1.7 The Organizer may arrange otherwise for the trial operation period (if any).

2. Admission Requirements

2.1 All personnel entering the Expo Site must hold a valid ticket or admission permit. The Organizer has the authority to requesting anyone

entering the Expo Site to show their ticket or admission permit.

2.2 The Organizer will provide necessary entry convenience to official participants by issuing free tickets or admission permits to them. The detailed instructions will be later provided by the Organizer.

2.3 The Organizer has the authority to deny the entrance of anyone who might disturb the normal order of the Expo and demand any violator of the General Regulations or the Special Regulations to leave the Expo Site.

2.4 Controlled or prohibited articles as regulated by law and regulations are forbidden from being carried into the Expo Site. Animals are prohibited from entering the Expo Site without approval from the Organizer.

3. Tickets

3.1 The Organizer shall be responsible for determining the types of tickets and the price and terms of use for each type of tickets, but such decision shall be made after consulting and reaching consensus with the Commissioner General of the Expo.

3.2 Without prior consent from the BIE, no additional fees shall be charged for admission within the Expo Site.

3.3 The Organizer will provide official participants with a certain number of tickets for their formal receptions during the Expo, and also a certain number of tickets for their National Day. The detailed guide for determining the specific number of the tickets will be provided by the Organizer in due time.

3.4 The Organizer may set up VIP entrance, and the relevant rules will be formulated separately by the Organizer.

4. Admission Permits

4.1 The Organizer shall determine the types and terms of use for each type of personnel admission permits in light of actual needs.

4.2 Valid permit holders may enter the Expo Site during the preparation, exhibition and exhibition removal period of the Expo in accordance with the access time and method specified by the permit.

4.3 The Organizer shall set up an Accreditation Management Center to coordinate the application, issuance and management of various permits.

5. Issuance and Usage of Permits

5.1 The following people are eligible to apply for personnel admission permits:

a. Commissioner General and Deputy Commissioner General of Sections and heads of garden/pavilion;

b. VIP guests and staff of official participants;

c. Personnel commissioned by official participants to engage in construction, exhibit set-up and operations in the Expo Site;

d. Performers and other personnel commissioned by official participants to engage in events and forums in the Expo Site;

e. Journalists and other media staff of the official participants.

5.2 The Organizer will issue separate admission permits especially for the period prior to formal operations.

5.3 The Organizer will verify the personnel information and number of applicants and issue corresponding types of admission permits. The permits shall be used within the validation period and are not transferable.

5.4 Permit holders shall always carry the permit with them in the Expo Site and display it conspicuously.

5.5 In case of the permit getting damaged, lost or stolen, the relevant official participant may apply to the Organizer for reissue.

6. Personnel Admission

6.1 Personnel Classification

6.1.1 Participants

6.1.2 Operating personnel

Personnel employed or hired by official participants, who shall participate in exhibitions or commercial activities of official participants, provide security and sanitation services, and take charge of green space management.

6.1.3 Media personnel

Media personnel are those who are invited by official participants to cover the Beijing Expo 2019.

6.1.4 Activity-Organizing personnel

Activity organizing personnel are the staff engaged in the work of various activities and forums organized by official participants.

6.1.5 Construction workers

Construction workers are those responsible for venue construction and exhibition arrangement.

6.1.6 VIPs

VIPs are those invited or designated by the Organizer or relevant departments.

6.1.7 Others

The other people who are considered needed in the Expo Site by

official participants.

6.2 Admission management

Personnel shall enter the Expo Site presenting valid permits through specified entrances after security check and verification within the time specified by the Organizer.

6.3 Personnel permits

6.3.2 Applicable area of personnel permits

Personnel permits are valid within the 503 hectares of exhibition area of the Expo Site. Access to departments of communication, water, electricity and gas supply, administration, area for important events, and the rest area for VIPs shall be restricted.

7. Vehicle Admission

7.1 Vehicle classification

Vehicles of official participants shall be divided into the following categories: operating vehicles, VIP vehicles, special vehicles, construction vehicles and other types of vehicles. The Organizer shall issue permits in accordance with the category of vehicles.

7.2 Vehicle management

Vehicles shall enter the Expo Site with permits for the vehicle and with the permits of people riding the vehicle including both the driver and passengers, through designated entrances after security check and verification within the time specified by the Organizer.

7.3.2 Applicable area of vehicle permits

Vehicles permits are valid within the 503-hectareenclosed area in the Expo Site. Permits must be presented f entering the area.

Upon entering the Expo Site vehicles shall be parked in designated areas. Vehicle permits should be obtained from the accreditation management center.

8. Equipment Admission

8.1 Equipment management

Participants shall apply to the accreditation management center for equipment admission. The Organizer will review the application and issue permits corresponding to the type of the equipment.

8.2 Equipment Keeping

Participants shall appoint designated personnel to take charge of their own equipment after its admission. The Organizer shall not be held responsible for any loss or damage.

8.3 Equipment removal

Equipment and materials may be moved out of the Expo Site after examination and with permits for removal issued by the accreditation management center.

9. Permits Application

9.1 Application period

9.1.1 Construction and Exhibition Arrangement Period (from September 1, 2017 to April 20, 2019)

Application of permits for personnel, vehicles and equipment starts from June 1, 2017. Official participants who need to apply for permits used during construction and exhibition arrangement period must submit application 10 workdays in advance to the accreditation management center.

9.1.2 Exhibition Period (from April 29, 2019 to October 7, 2019)

Application of permits for personnel and vehicles starts from January 1, 2018. Official participants who need to apply for permits used during exhibition period can submit application 10 workdays in advance to the accreditation management center.

9.1.3 Dismantling Period (from October 8, 2019 to December 31, 2019)

Permits for personnel and vehicles applicable for exhibition period remain valid during dismantling period. Official participants who need to apply for permits during dismantling period can submit application 10 workdays in advance to the accreditation management center.

9.2 Application procedure

Permits for personnel and vehicles are issued by the accreditation management center.

9.2.1 General procedure

a. The applicant shall log onto the Organizer's official website to download the registration form or go to the accreditation management center to get the registration form, fill in the form as required, and submit it to the center with the signature of person in charge of it together with other required materials;

b. The Organizer reviews the material and determines the type and the period of validity of the permit;

c. The accreditation management center makes the permit;

d. The accreditation management center notifies the applicant to collect the permit;

e. The applicant shall sign after collecting the permit a receipt for the accreditation management center to keep.

9.2.2 Permit Reissue

If an exhibitor’s permit for personnel, vehicle or equipment is lost, the exhibitor shall apply to the accreditation management center for a replacement. The application procedure is as follows:

The applicant shall log onto the Organizer's official website to download the reissue form or go to the accreditation management center to get the form, fill in the form as required, and submit it to the center with the signature of Commissioner General of the Expo on it;

The Organizer reviews the material and determines the type and the period of validity of permit;

The accreditation management center makes the permit and notifies the applicant to collect the permit;

After collecting the permit, the applicant shall pay the replacement fee and sign a receipt for the accreditation management center to keep.

9.3 Documents required for application

10. Entrances and Exits

10.1 The Organizer will set up entrances and exits in the Expo Site respectively for visitors, staff of official participants, VIPs, vehicles, etc. based on the needs of the preparation and operations.

10.2 During the exhibition period, the entrances and exits will be open according to the opening hours of the Expo Site; while the passageway for staff of official participants will open appropriately earlier.

10.3 At the entrances and exits the Organizer has the authority to check tickets, admission permits or passes of any personnel and vehicle wishing to enter the Expo Site and perform security checks on them.

10.4 According to the Organizer’s regulations, staff of official participants are entitled to enter or exit the Expo Site beyond the opening hours if their job demands. Specific time and requirements in this regard shall be separately released.

10.5 According to the Organizer’s regulations, logistics service providers of official participants are entitled to enter or exit the Expo Site during night hours. Specific time and requirements in this regard shall be separately released.

10.6 To arrange one or more days tour prior to the official opening date for special guests such as media representatives, an agreement must be reached with the Steering Committee of the College of Commissioners General concerning the date(s) set for such tours.

Section 5 Construction of Gardens

Pursuant to the General Regulations, Special Regulation No.4 Concerning Construction, Installation, Labor Safety, Fire and Environmental Protection, Special Regulation No.5 Concerning the Installation and Operation of Machinery and Equipment, Special Regulation No. 10 Concerning Public Services provides more information on regulations related to construction conditions, procedures and management. It is applicable to outdoor exhibition areas in the Expo Site, including gardens for official participants (national gardens and international organization gardens) and exhibitors (gardens for provinces, municipalities, autonomous regions, Hong Kong, Macao and Taiwan; gardens for enterprises, innovative gardens and individual gardens).

1. Garden Construction Schedule

Participants may enter gardens and start construction and exhibition arrangement in accordance with organizational procedures for admission and construction after their design schemes are approved by the Organizer. Construction work shall be completed no later than October 31, 2018, and exhibition arrangement shall be completed no later than April 25, 2019. After acceptance of construction and arrangement project, the Expo will enter the period of trial operation and exhibition.

2. Garden Design and Schemes Review

2.1 Garden planning and zoning

The exhibition area is divided into six sections:

The world horticultural exhibition area mainly includes gardens for participating countries, regions and international organizations;

The Chinese horticultural exhibition area, the education and the future exhibition area, the horticulture in life exhibition area, the nature and ecology exhibition area, and horticultural technology development belt.

2.2 Technical documents

After participants have determined the location of their gardens, the Organizer will provide relevant technical documents to participants to help them with design. Technical documents include the following:

2.3 Supplementary materials

In the course of garden designing, if a participant wants to add supplementary materials as reference to the design, the participant shall apply to the Organizer in a timely manner, and the Organizer will reply within 7 workdays upon receiving the application.

2.4 Review of garden design schemes

Participants shall complete their design based on the documents provided by the Organizer and submit it within the required time. The

design may be carried out after being approved by the Organizer.

3. Admission and Construction Management

Pursuant to the General Regulations and Special Regulation No.4 Concerning Construction, Installation, Labor Safety, Fire and Environmental Protection, this document provides guidance for official participants in conducting garden construction within the Expo Site.

Contractors and suppliers who take on the construction, installation and furnishing work for official participants shall have qualifications and business licenses. They shall carry out construction and installation work pursuant to relevant laws and regulations.

Official participants shall not, in principle, alter the main structure, fixtures and devices of pavilions provided by the Organizer. If official participants need to make modifications other than the above-mentioned parts, they shall officially submit written application to the Organizer, and start construction upon approval.

Official participants shall supervise the work of contractors and suppliers to ensure their conduct is in compliance with Chinese laws and regulations. Official participants shall submit necessary documents and blueprints to the Organizer before construction. For further details, please contact the Organizer.

3.1 Construction preparation

The Organizer shall officially hand over gardens to relevant official participants from January 1st, 2017.

The Organizer shall officially hand over pavilions to relevant official participants no later than November 15th, 2018.

The Organizer shall hand over gardens and pavilions to official participants in accordance with the place, land parcel and area prescribed in the Participation Contract signed between the Organizer and official participants. During construction, official participants shall abide by the provisions in this document and instruct contractors and suppliers to do

the same.

3.1.1 Project Managers

a. On-site manager

Official participants shall appoint an on-site manager and inform the Organizer 10 day prior to the start of the preparation work.

In case of the on-site manager violating the laws and regulations, the Organizer may direct the participant concerned to dismiss the said manager, and the participant shall abide by the directives given in such case and appoint a new on-site manager within three days.

b. Technical supervisor

Official participants shall appoint a technical supervisor and inform the Organizer 10 days prior to the start of preparation work.

In case of the technical supervisor violating the laws and regulations, the Organizer may direct the participant concerned to dismiss the said supervisor, and the official participant shall abide by the directives given in such case and appoint a new technical supervisor within three days.

3.1.2 Designating service providers

Official participants may choose companies providing supervision, construction and supply services for gardens and pavilions from companies recommended by the Organizer. The recommendation list of service providers and their contact information will be provided by the Organizer in due course.

3.1.3 Technical preparation

a. On-site inspection of construction environment and conditions

Official participants shall urge contractors to send their professionals and technicians to gardens and pavilions to inspect on-site the construction environment and conditions.

b. Construction plans and documents on technical measures

Official participants shall urge contractors of gardens and pavilions to draw up construction plans and documents of technical measures for gardens and pavilions, which will be used as part of the important documents guiding the detailed construction work. A copy of the documents shall be submitted to the Organizer for record keeping.

The construction plans and documents of technical measures shall not be modified without authorization during construction; and in case there is a need to revise the content of these documents, contractors shall obtain approval from the original approver and inform the Organizer.

Official participants shall urge contractors to inform all members of management and operation of the objectives and measures prescribed in construction plans and documents of technical measures during various stages of the garden’s and pavilion’s construction.

c. Implementation of construction plans and technical measures

Official participants shall urge contractors of the garden and pavilion to comply with their contracts, the construction plans and documents of technical measures; manage construction; put in place labor force, materials, equipment and machinery; and ensure that construction activities are all carried out under the guidance of construction plans and documents of technical measures.

3.1.4 On-site preparation

a. Recheck the piles for boundary lines, coordinates and vertical control points of the gardens and pavilions

To make sure construction work of gardens and pavilions is carried out within boundary lines of the designated space provided by the Organizer, before construction preparation officially starts, official participants shall urge contractors to recheck on-site the piles for boundary lines, coordinates and vertical control points provided by the Organizer, and do the construction work accordingly.

b. Clearing and leveling

Official participants shall urge contractors of gardens to measure the elevation of the land, conduct ground clearing and leveling, and compact the roadbed and the yard area in accordance with the design scheme.

c. Temporary yard for building materials and equipment

Official participants shall urge contractors of gardens and pavilions to set up temporary yards by category for the storage of construction materials needed at different stages of construction, and assign designated personnel to manage the yard.

d. Exit/entry for personnel and vehicles

Construction personnel working for official participants shall apply to the Organizer for permits for themselves and their vehicles in order to enter and exit the Expo Site. Persons and vehicles without permits may only be allowed in and out of the Expo Site by registration.

e. Access to roads

Official participants shall clear the roads for construction. Fire lanes shall lead to gardens under construction and all temporary facilities, and be in compliance with relevant regulations.

f. Electricity

Official participants shall urge contractors of gardens and pavilions to submit in written form an application to the Organizer for electricity access in accordance with calculations and estimations of the temporary electricity consumption needed for construction and requirements for power supply prescribed in the construction plans and documents of technical measures.

g. Water supply

Official participants shall urge contractors of gardens and pavilions to submit in written form an application to the Organizer for water access

in accordance with calculations and estimations of the temporary water consumption needed for construction and requirements for water supply prescribed in the construction plans and documents of technical measures.

h. Official participants may put up temporary facilities as needed.

3.2 Construction management

3.2.1 Construction management

During construction, official participants shall urge contractors of gardens to perform the duty of schedule management, quality control and construction coordination in accordance with requirements raised by the Organizer and agreements made in their contracts; appoint designated personnel to attend meetings organized by the Organizer on time; finish construction of gardens on schedule with high quality; and properly handle accidents concerning construction schedule and quality in a timely manner while taking full responsibility for these accidents.

3.2.2 Safety responsibilities

During construction of gardens, official participants shall urge contractors to ensure construction safety management and fire safety, with special attention paid to safety in construction and the safety of personnel to prevent third party damage. Effective security measures shall be adopted to eliminate all unsafe factors.

Official participants shall ensure that contractors strictly abide by the laws and regulations concerning safety in construction and fire safety. In case of a safety accident caused by violations of relevant laws and regulations, the official participant and their contractors shall take full responsibility for the accident and the losses incurred.

3.2.3 Information management

Official participants shall urge contractors to keep monthly records of and timely report in written form to the Organizer the construction progress, management of quality and safety accidents, and the admission of main materials and equipment.

3.3 Environmental Protection

During the construction of the pavilions, official participants shall urge contractors to make environmental protection plans and supporting measures, and implement such plans and measures. Official participants and contractors shall be fully responsible for any violation of laws and regulations that causes disturbance to residents or pollution and damage to the environment.

3.3.1 Atmospheric environment protection

During the construction and demolition of the exhibition gardens and pavilions, official participants shall follow relevant regulations of Beijing Municipality and control dust pollution.

3.3.2 Water environment

Official participants shall request and urge construction contractors to prevent pollution to the water environment during the construction and demolition of the venues.

3.3.3 Solid waste

Recyclable and renewable materials shall be made best use of in the construction of temporary structures. Official participants shall consider the need for the separate collection, storage, transportation, treatment and disposal of waste in the design process.

Official participants shall place waste in areas designated by the Organizer, and make appointments with entrusted service providers recommended by the Organizer to transfer and treat the waste.

3.3.4 Noise control

Official participants shall request and urge construction contractors to strictly control construction noise during the construction and demolition of the pavilions, and prevent disturbance of residents.

3.4 Completion and usage

3.4.1 Completion of the exhibition gardens

Official participants shall ensure that the contractors complete as scheduled all the construction work, including the building of structures, installation and decoration, that meet the required standard, in compliance with the design paper, the contract agreement, the Completion Standards on Construction and Installation Projects and special rules made by the Organizer. The construction quality shall meet the required standard; the materials for completion shall be complete and correct; the payment for the construction project shall meet relevant requirements.

3.4.2 Materials for completion

Official participants shall urge the contractors to collect, verify, arrange and compile the materials for the completion of the pavilions in compliance with relevant regulations.

3.4.3 Completion acceptance

After the completion of the exhibition gardens, official participants shall submit a completion acceptance application to the Organizer.

3.4.4 Use and maintenance

The exhibition gardens without completion acceptance shall not be put into use.

From the day the exhibition gardens and pavilions become certified with completion acceptance documents till the date marking the end of the exhibition, official participants shall carry out on a regular basis examination and maintenance, and keep the gardens and pavilions in good condition. Expenses arising from daily maintenance shall be borne by official participants.

During the service period of the gardens and the pavilions, official participants shall not alter the structure and the mechanical and electrical facilities of the pavilions without permission. Official participants shall apply for permission from the Organizer and the design institution if it is necessary to make such changes.

The Organizer may enter the gardens and pavilions to examine the maintenance, arrangement, safety facilities and fire-fighting equipment of official participants. The Organizer has the right to make rectification instructions to official participants when necessary.

4. Trial Operation

The period for the internal trial operation of the Beijing Expo 2019 is March 1st to March 31st, 2019; and the period for trial operation with visitors is April 10th to April 20th, 2019.

5. Demolition of Exhibition Gardens and Restoration of the Site

Exhibits, facilities and equipment shall be re-exported by official participants before October 31st, 2019; all items not re-exported before the deadline shall be considered discarded and be disposed of by the Organizer.

Section 6 Exhibition Arrangement

This section applies to all indoor exhibition areas of Beijing Expo 2019, including the indoor exhibition areas of official participants and those of the non-official participants.

1. About Indoor Exhibition Areas

The Organizer provides indoor exhibition areas for participants

All indoor exhibition areas are located in designated areas in the Expo Site.

The exhibition area allocated to the participants will be determined upon the signing of Participation Contract. If participants wish to expand their indoor exhibition areas, they may submit an application in written form to the Organizer during the application period. The Organizer shall assess each participant’s application on the basis of the actual situation.

2. Time Limits

The areas used for indoor exhibition shall be handed over from the Organizer to participants from November 15th, 2018; the construction may begin as early as November 1st, 2018.

The exhibition proposal of participants shall be submitted to the Organizer for approval within the time limit prescribed by the Organizer.

The exhibition arrangement shall be completed by April 25th, 2019.

The demolition work may begin from October 8th, 2019 and conclude by December 31st, 2019 at the latest.

Demolition before the prescribed date and time is prohibited.

3. Assistance Provided by the Organizer

3.1 The Organizer may provide paid horticulture, maintenance and

cleaning services for exhibition areas of participants. The Organizer shall be responsible for the cleaning of the public area.

3.2 The Organizer shall provide a list of certified logistic companies for the transport of non-plant materials and exhibits (between exhibition areas and storage areas) and the removal of such materials from the exhibition areas to outside the Expo Site during the demolition period.

3.3 Technical documents provided by the Organizer

a. Drawings and instructions of relevant buildings, structures and mechanical and electrical design;

b. Information on the conditions of water supply, drainage, power supply, air-conditioning, heating telecommunication, television and other facilities;

c. Instructions on the use of venues

4. Application for Indoor Exhibition Areas

The participant shall fill in the application form and send the form to the Organizer with other relevant official documents via mail, fax or e-mail. The participant shall also submit a theme description to explain the theme and content of the exhibition. The theme of the exhibition shall be in line with the theme of the Beijing Expo 2019.

The Organizer shall examine the application according to relevant procedures.

After the application is approved, the eligible participant will receive the approval letter and relevant official documents from the Organizer.

The participant and the Organizer sign the Participation Contract, which defines the exhibition area for the participant.

After the contract is signed, the participant shall submit detailed documentations (e.g. design plans of the exhibition area) to the Organizer.

The distribution of exhibition areas shall not be binding unless the participant signs the participation agreement and receives the approval in written form.

5. Design Approval

The participant shall ensure that the design of the indoors exhibition areas conforms to the theme of the Beijing Expo 2019.

5.1 General requirements

a. The design of the exhibition areas shall give full consideration to the area and the conditions of the indoor stands.

b. The overall layout and space structure shall be reasonable, orderly, and with clear priorities.

c. The exhibition shall have distinctive features and themes. The exhibits shall be in harmony with the surroundings, with reasonable use of colors and illumination. The exhibition arrangement shall be open. The suspended ceiling may be used at certain part, as long as it is open.

d. The exhibition shall mainly present unique horticultural products, landscape and achievements, and promote featured horticultural derivatives, so as to showcase the horticultural culture and display new products, new technologies and new crafts of horticulture.

e. Non-horticultural exhibits shall be in line with the exhibition environment and the exhibition theme.

f. Participants shall agree that the total area for commercial activities (including the production area, the sales area and the storage area) will not exceed 20% of the total exhibition area. No commercial activity is allowed outside this area.

5.2 Submitting the design plan for indoor exhibition areas

The participant shall submit the indoor exhibition area design plan to the Organizer within the time limit for approval. The plan shall include:

the vertical view and the detailed drawing of decorations, the function division, the list of plant exhibits and other materials required by the Organizer. If the plan is approved, the Organizer shall issue the Confirmation Letter of the Indoor Exhibition Area Design Plan; if not, the Organizer shall give modification advice and set a time limit for the modification. The participant shall, upon receiving the advice, make timely adjustments and submit within the prescribed time limit a rectified plan to the Organizer for review and approval. During the examination period, the participant shall support relevant inquiry work.

6. Preparation for the Start

The areas used for indoor exhibition shall be handed over from the Organizer to participants from November 15th, 2018; the construction may begin as early as November 1st, 2018.

The Organizer shall hand over the indoor exhibition areas to the participants as prescribed in the Participation Contract. After the handover, the participants shall conform to all articles of this document during construction, sign safety and fire control agreements with the Organizer, and instruct relevant contractors and suppliers to conform to this document.

6.1 Basic requirements

The production, processing and installation techniques of woodwork, metals, plastics, and soft packages including the foundation platform, framework, handrail, and fence for exhibition arrangement shall be used in accordance with the Code for Construction Quality Acceptance of Building Decoration (GB50210-200). For exhibition arrangement with built-in exhibits, the water, electricity, and gas interface position and pipe routing shall base on actual situation. (i.e. The parallel distance between power lines and gas lines/water lines/data lines shall be no less than 300mm, while the cross distance no less than 100mm). Wire connectors shall be included in the connecting box with secure joints and evenly tight wrapping. Safety measures shall be put in place for electric earthing devices and storage battery (sets). Electric works shall comply with the requirements prescribed in this document as well as the Code of Acceptance of Construction Quality of Electrical Installation in Building 64

(GB50303-2002). Lines and cables shall be pre-embedded or have spaces reserved for the sake of various decorations shaped and combinations or connections of exhibits, so that the required equipment or techniques can be applied. Considering the overlap of construction areas, it’s best to have the sequence of work properly arranged.

6.2 Project managers

a. On-site manager

Each participant shall appoint an on-site manager, and inform the Organizer in the Notice on Appointing the On-Site Manager 10 days prior to the start of preparation work.

In case of the on-site manager violating the laws and regulations, the Organizer may direct the participant concerned to dismiss the said manager, and the participant shall abide by the directives given in such case and appoint a new on-site manager within 3 days.

b. Technical supervisor

The participant shall appoint a technical supervisor and inform the Organizer in the Notice on Appointing the Technical Supervisor 10 days prior to the start of preparation work.

In case of the technical supervisor violating the laws and regulations, the Organizer may direct the participant concerned to dismiss the said supervisor, and the participant shall abide by the directives given in such case and appoint a new technical supervisor within 3 days.

6.3 Funds for construction

The participant bears all expenses related to the indoor exhibition area, including preparation, construction, operation, maintenance, and removal.

6.4 Designating service providers

Official participants may choose companies providing supervision,

construction and supply services for indoor exhibition areas of the Expo Site from companies recommended by the Organizer. For details about the recommended companies and their contact information, please refer to the List of Recommended Service Providers compiled by the Organizer.

6.5 Technical preparation

a. On-site inspection of construction environment and conditions

Participants shall urge contractors to send professional technicians to indoor exhibition areas to inspect on-site the construction environment and conditions.

b. Panel review of construction blueprints and notifications

Participants shall organize the designers to explain to technical personnel sent by contractors and supervising companies the design ideas and main content of construction drawings; answer technical questions raised by technical personnel from contractors and supervising companies, and keep a record of the panel review of construction blueprints and the notification process. The record file, after signed by relevant parties, will then be used as a part of the design documents to guide the construction. A copy of the file shall be submitted to the Organizer for record keeping.

c. Producing the Construction Management Plan

Participants shall urge contractors of the indoor exhibition areas to draw up the relevant Construction Management Plan as one of the major documents guiding the specific construction. A copy of the document shall be submitted to the Organizer for record keeping.

Participants shall ensure that the Construction Management Plan compiled by contractors of the indoor exhibition areas be approved by the technical director of the contractors and kept on record by the Organizer before implementation. The Construction Management Plan cannot be revised without authorization during construction. In case there is a need to partially revise the document, contractors shall obtain approval from the original approver and inform the Organizer.

Participants shall urge contractors to inform with clarity all members of management and operation of objectives and measures prescribed in the Construction Management Plan during various stages of construction of the indoor exhibition areas.

d. Implementing the Construction Management Plan

Participants shall urge contractors of the indoor exhibition areas to comply with their contracts and the Construction Management Plan, manage construction, put in place labor force, materials, equipment and machinery, and ensure that construction activities are all carried out under the guidance of the Construction Management Plan.

6.6 On-site preparation

a. Recheck the conditions of the indoor exhibition areas

To ensure that construction work of the indoor exhibition areas is carried out within the designated space provided by the Organizer, before construction preparation officially starts, participants shall urge contractors of the indoor exhibition areas to recheck the locations and conditions of the indoor exhibition areas provided by the Organizer, and do their work accordingly.

b. Temporary yard for materials and equipment

Participants shall urge contractors of the indoor exhibition areas to set up temporary yards by category for the storage of materials needed at different stages of construction, and assign designated personnel to manage the yard.

c. Exit/entry for personnel and vehicles

Construction personnel working for participants shall apply to the Participant Service Center of the Organizer for permits for themselves and their vehicles in order to enter and exit the Expo Site and the indoor exhibition areas. Personnel and vehicles without permits may only be allowed for entrance/exit by registration.

d. Electricity

Contractors shall calculate and estimate the temporary electricity consumption needed for construction of the indoor exhibition areas and figure out the requirements for power supply based on the Construction Management Plan. The participants shall then submit in written form an application to the Organizer for electricity access accordingly.

e. Water Supply

Contractors shall calculate and estimate the temporary water consumption needed for construction of the indoor exhibition areas and figure out the requirements for water supply based on the Construction Management Plan. The participants shall then submit in written form an application to the Organizer for water access accordingly.

7. Construction Management

During construction of the indoor exhibition areas, Participants shall ensure that their contractors fully perform their duties in the management of the construction schedule, quality and coordination pursuant to requirements raised by the Organizer and agreements made in their contracts; appoint designated personnel to attend meetings organized by the Organizer on time; finish construction of the indoor exhibition areas on schedule with high quality; handle and take full responsibility for problems concerning construction schedule and quality in a timely manner. No Participants may make alterations to the public facilities in the Expo Site without the Organizer’s prior approval. Similarly, improvement plans drawn up by the Organizer may not be modified unless agreed by the Participants concerned or approved by the Steering Committee of the College of Commissioners General.

7.1 Safety liabilities

During construction of the indoor exhibition areas, Participants shall urge contractors to ensure safety management, with special attention paid to safety in construction and the safety of personnel to prevent third party damage. Effective security measures shall be adopted to eliminate all unsafe factors. Participants shall ensure that contractors strictly abide by

the laws and regulations concerning safety in construction of the indoor exhibition areas. In case of a safety accident caused by violations of relevant laws and regulations, the participant and their contractors shall take full responsibility for the accident and the losses incurred.

When glass materials are required to decorate the indoor exhibition area, tempered glass must be used; and the strength, thickness and installation methods shall be proper, reliable and safe. The nature and position of facilities inside the pavilion shall not be altered. Public facilities and equipment, fire control and electrical equipment, safety exits and visitor entrances in the pavilion shall not be blocked. Hanging articles are not allowed on standing columns, beams, enclosing fences and special pipelines in the pavilion. All structures shall be connected with the main structure.

8. Fire Prevention

During construction of the indoor exhibition areas, Participants shall urge contractors to attach great importance to fire prevention in accordance with relevant laws and regulations. Sufficient fire extinguishing equipment shall be put in place on site; constructors shall be given fire prevention knowledge and skills training; fire safety inspections shall be conducted; designated personnel shall be assigned to repair and maintain fire extinguishing equipment on a regular basis to ensure its effectiveness. Participants and their contractors shall bear full responsibility for the outbreak of fires and the losses incurred due to violations of relevant laws and regulations.

8.1 Materials for decoration and exhibition arrangement

Materials for interior decoration, exhibition arrangement and event set-up shall use non-inflammable or flame retardant material. Flammable or combustible materials that are needed for part of the construction shall be treated to meet non-inflammable or fire retardant standards.

8.2 Fire protection products

Fire protection products used for exhibition arrangement and events in the indoor exhibition area shall meet China’s related standards, quality

system management and market access requirements, and fire protection products that do not conform to regulations or pass inspections shall not be used.

8.3 Scope of examination

The interior decoration project and exhibition arrangement design shall be submitted to the Organizer for review.

8.4 Submitting materials for the fire prevention examination

The fire prevention examination shall be coordinated by the Organizer, with materials submitted through relevant agencies.

8.5 Fire control acceptance

After completion of the exhibition arrangement construction in the indoor exhibition area, Participants shall apply to the Organizer for fire control acceptance. The area shall only be used after they pass the fire control examination.

8.6 Fire safety management

The Participants shall properly manage the fire safety onsite during the construction of the indoor exhibition area.

During exhibition arrangement, Participants shall not bury, enclose, block or take the liberty to remove fixed indoor fire control facilities. The back of the stands shall not be used to store flammable articles.

The Participants shall not store class A/B hazardous articles in the exhibition area. Participants’ use of fire, electricity and gas shall meet relevant requirements; open fire or unauthorized connections of power/ gas lines are not allowed.

The Participants shall formulate a contingency plan, which shall be submitted to the Organizer before opening of the exhibition at the latest.

9. Environmental Protection

In the construction of the indoor exhibition area, adhesives, wooden furniture, wallpapers, PVC floor sheets, artificial board and products, carpets, carpet linings and carpet adhesives shall all be environmental friendly, meet the Code for Indoor Environmental Pollution Control of Civil Building Engineering (GB50325-2001), and Limit of Radionuclides in Building Materials (GB6566-2001) to ensure indoor environmental quality. Participants shall urge contractors to formulate environmental protection plans and supporting measures which shall be implemented faithfully.

10. Disposal of Construction Waste

Participants shall separately collect and store recyclable waste such as wood, plastics and metals and hazardous construction waste like discarded paint and decoration waste etc. during the construction and removal process. Participants shall place waste in areas designated by the Organizer, and make appointments with entrusted service providers recommended by the Organizer to transfer and treat the waste.

11. Completion and Usage License of Indoor Exhibition Area

11.1 Completion of indoor exhibition area

The Participants shall ensure that contractors complete the installation, decoration and all other exhibition arrangement work of the indoor exhibition area according to the time and quality required by relevant design papers, contract agreements, construction completion standards and the Organizer’s special regulations. The construction quality shall meet the required standard; the materials for completion shall be complete and correct; the payment for the construction project shall meet relevant requirements.

11.2 Materials for completion

Participants shall urge the contractors to collect, verify and arrange and compile the materials for the completion of the indoor exhibition areas in compliance with relevant regulations.

11.3 Completion acceptance

After the completion of construction of the indoor exhibition areas, the Participant shall apply to the Organizer for completion acceptance.

11.4 Usage license

Upon comprehensive examination and approval, the Organizer shall issue in written form a usage license to the Participant. Indoor exhibition areas that fail to obtain the usage license in written form shall not be put into use.

11.5 Maintenance of the indoor exhibition areas

During the time from gaining usage license to end of the exhibition, Participants shall carry out regular check, cleaning, maintenance, waste collection, replacement and maintenance of plant materials as well as other activities necessary for a smooth exhibition, and bear the daily maintenance expense. If the work mentioned above cannot be completed by the Participant, the Organizer can organize to complete the work from which all expenses arise shall be borne by the Participant.

During the usage of the indoor exhibition areas, the Participant shall not make unauthorized alteration to the structure, mechanical and electrical facilities in the indoor exhibition areas. Any alteration must be approved by the Organizer and the original design unit in advance. The Organizer will visit the indoor exhibition area to check the Participant’s work in maintenance, article arrangement, safety equipment and fire prevention equipment etc., and has the right to make rectification requests to the Participant if necessary.

12. Dismantlement

Exhibits, facilities and equipment shall be re-exported by Participants before October 31st, 2019; items not re-exported before the deadline shall be considered discarded; and the exhibition garden plus related exhibits shall be disposed of by the Organizer.

Instructions on exhibition arrangements, related to the plants, public

services, construction, machinery, instruments, and equipment installation and operation shall also meet the Beijing Expo 2019 General Regulations, Special Regulation No. 2 Concerning Conditions for Participating in the Expo, Special Regulation No. 4 Concerning Construction, Installation, Labor Safety, Fire and Environmental Protection, Special Regulation No.5 Concerning the Installation, Operation and Maintenance of Various Types of Machinery and Equipment, Special Regulation No.10 Concerning Public Services as well as this Participation Guide.

Section 7 Public Services

This section introduces public services for the Beijing Expo 2019, including sanitation and public health, safety supervision, water, gas, electricity, air conditioning, telecommunication, and network services etc. pursuant to the General Regulations and Special Regulation No.10 Concerning Public Services.

1. Sanitation and Public Health

1.1 Duties for sanitation

1.1.1 The Organizer is responsible for sanitation in public areas and public facilities in the Expo Site. Participants are responsible for the sanitation within their exhibition areas.

1.1.2 Participants shall take measures to ensure sufficient ventilation, natural and artificial lighting in the exhibition areas and take necessary measures against dampness, noise, quakes, and odor.

1.1.3 Participants shall ensure that the water supply and drainage, cleaning, natural/artificial lighting, power supply, ventilation, air conditioning, and heating facilities are in normal and safe operation in the outdoor exhibition areas.

1.1.4 The Organizer will provide comprehensive lighting and heating services for indoor exhibition spaces, and ensure timely maintenance of the public areas. The Organizer, within the technically feasible scope, is responsible for providing water, electricity and waste disposal in the indoor exhibition spaces.

1.2 Waste disposal

Waste is divided into household waste, construction waste, and bulky waste. Participants shall pay for the waste cleaning and disposal expenses within their exhibition areas as well as clean and dump the

waste to designated site outside exhibition areas, and the Organizer will collect the waste for free.

1.2.1 Household waste

The Organizer shall place at proper sites household waste containers for disposing and collecting household waste of various kinds.

Official Participants shall dump the waste by category in accordance with the requirements of the Organizer, and shall not dump construction waste and bulky waste into the collection containers of household waste.

The Organizer will arrange unified clearing of household waste at set time and site, and will increase the clearing frequency at peak time. The specific site and time will be provided by the Organizer at proper time.

1.2.2 Construction waste

Official Participants shall separately collect and store construction waste by category, and dump at sites designated by the Organizer. The Organizer advocates the use of green construction materials and the recycling of construction waste.

1.2.3 Bulky waste

Official Participants shall separately collect and store electronic and wooden bulky waste by category, and transport the waste to designated sites outside the exhibition areas for unified free clearing by the Organizer.

1.3 Standards and ways of conducting sanitation

1.3.1 The Organizer and Participants shall ensure that the sanitation standards at the Expo Site comply with laws and regulations.

Official Participants may, at their own expense, employ relevant service providers recommended by the Organizer or undertake the work of sanitation on their own.

1.3.2 Clean-keeping on the construction site and exhibition areas

During construction of the gardens, Participants shall build walls to enclose the construction site and align the walls with surrounding environment.

The construction site shall be kept clean at all time with measures to prevent flowing dust pollution. All construction vehicles shall operate after getting washed and cleaned, and those with dirt are forbidden to run on site, so as to keep the roads clean.

Official Participants shall maintain the external facades and ceilings of self-built structures tidy, complete, beautiful and compatible with the surrounding environment; ensure tidy roofs and no waste, sundries or illegal constructions; and keep the exhibition areas clean.

Official Participants shall do general cleaning in the morning and evening (before opening and after closing), manual cleaning tours in between, and more frequent cleaning on special occasions (peak time of visitors or special weather such as rainy days).

1.4 Green areas and protective fencing

1.4.1 The Organizer is solely responsible for the sanitation and preservation of green areas in public places, and jointly responsible with Participants for the maintenance of protective fencing around green areas within and outside the exhibition areas at the Expo Site.

1.4.2 In the green areas maintenance projects, the Organizer and Participants need to monitor the exhibited plants and green areas for forest pests. Physical, biological and other pollution-free techniques shall be used as the major measures in the prevention and control of the forest pests.

1.5 Extermination of harmful rodents and insects

Official Participants shall check the areas to which they have sanitation responsibility on a regular basis and remove standing waters of all kinds, so as to prevent vector breeding. Once vectors are found,

Participants shall take necessary and timely measures to get them eliminated.

If fail to eliminate the vectors immediately, Participants shall report to the Organizer in time and support the Organizer’s corresponding efforts. The Organizer will control the vectors and other harmful organisms at the Expo Site including the exhibition areas.

1.6 Food safety

1.6.1 Participants who sell food and beverage shall comply with the laws and regulations on food safety, such as the Food Safety Law of the People’s Republic of China and accept the supervision of relevant Chinese authorities. They shall ensure that the sanitation of their catering facilities in the process of installation and operation, their food supply and process of business operation meet the food safety standards of the Chinese Government.

1.6.2 In case of a food safety emergency, Participants shall immediately report it to the Organizer and cooperate with the Organizer in its investigation into and management of the accident.

1.6.3 If the food services offered by Participants cause any personal injury, Participants shall be held legally responsible.

1.7 Health requirement

1.7.1 Participants shall attach great importance to the sanitary and hygienic conditions of their exhibition areas.

1.7.2 Catering staff must undergo physical checkup at a healthcare institution designated by the Organizer and must have health certificates.

1.7.3 Participants shall comply with Regulations of Beijing Municipality on Smoking Control, and control smoking in all public places.

1.8 Preventive measures against infectious diseases

If an infectious disease prescribed in the Law of the People’s Republic of China Concerning the Prevention of Infectious Diseases is found in the Expo Site, Participants shall immediately report it to the Organizer and assist the Organizer in work such as disease prevention, monitoring, quarantine and treatment.

1.9 Emergency medical service system

The Organizer shall set up health centers and first-aid stations at the Expo Site and provide ambulances. In case an emergency, the Organizer shall provide the staff of Participants with medical and first-aid services.

If a staff member of Participants has chronic diseases and need to take certain medication, he/she shall bring his/her medicines. If a patient in need of first aid is spotted within its exhibition area, the Participant shall at once perform first aid on spot and inform the first aid station. The Participant shall, if possible, send the patient to the nearest first aid station.

Locations and contact information of the health centers and first aid stations will be released by the end of February 2019 by the Organizer.

2. Security and Surveillance

2.1 Responsibilities of the Organizer

2.1.1 During the Expo, the Organizer shall be responsible for the security of the Expo Site, set up an overall security system, and take necessary measures to maintain public security and order within the Expo Site. These measures include the following:

a. Ensure safety and security, and prevent crimes;

b. Raise public awareness of safety and make preventive arrangements against fire, traffic, stampede and other safety accidents;

c. Support the telecommunication authorities to ensure the safety of telecommunication;

d. Protect the personal and property safety of all people including Participants and visitors;

e. Maintain public order at the Expo Site;

f. Keep in touch with and give support to Participants and their security officers; and

g. Prepare security plans and implement special security measures for visiting VIPs.

2.1.2 The Organizer’s security staff shall wear uniforms and present identification cards when performing the above-mentioned duties.

2.1.3 The Organizer shall check the safety measures adopted at the Expo Site on a regular or non-regular basis to ensure personal safety and public order at the Expo Site.

2.2 Responsibilities of Participants

2.2.1 Participants shall be responsible for the security within their corresponding areas, take necessary measures to safeguard security and order, especially the safety of the visitors.

2.2.2 A Participant shall appoint a security officer responsible for security within its exhibition area, and report the name, ID, and contact information of the security officer to the Organizer for the record. The security officer shall undertake the security duties at the cost of the Participant (guards sent by the Organizer are excluded).

2.2.3 The responsibilities of security officers include:

a. Prepare and implement security plans for their exhibition areas;

b. Cooperate with the Organizer in maintaining security;

c. Ensure the safe flow of visitors within their exhibition areas; and

d. Participate in safety drills conducted by the Organizer.

2.2.4 In case of emergency, the Organizer may enter the exhibition area of a Participant, and the cost arisen from responding to the emergency shall be borne by the Participant.

2.3 Emergency measures

Official Participants shall, in case a crime, fire, stampede or other accident occurs in their exhibition areas, take necessary measures immediately, report it to the Organizer and follow its directives.

2.4 Fire prevention

2.4.1 Participants shall cooperate with the Organizer to ensure that there are emergency exits and evacuation routes in their exhibition areas that meet the requirement of the fire prevention laws and regulations.

2.4.2 The fire prevention measures taken by Participants shall be in line with Special Regulation No.4 Concerning Construction, Installation, Workplace Safety, Fire Prevention and Environmental Protection.

2.4.3 Noncombustible materials shall be used for the ceilings of buildings and structures. Under special circumstances where other materials have to be used, Participants shall report to the Organizer for approval.

2.4.4 Participants shall install fire prevention facilities and equipment in their exhibition areas as required at their own expense. Fire prevention facilities and systems of Participants shall be linked to the central fire prevention early-warning system of the Organizer.

2.4.5 Participants shall take necessary measures to prevent any fire hazard due to man-induced factors such as the use of electrical appliances, storage of inflammable and combustible materials and smoking.

2.5 Lost and found service

The Organizer shall offer lost and found service. Participants shall cooperate with the Organizer to take care of people who get lost and properly handle lost and found items within the Expo Site.

Official Participants shall hold the lost items found in their exhibition area for safekeeping, and immediately inform the Lost and Found set by the Organizer at the Expo Site. For the found item that remains unclaimed for more than one day, Participants shall submit it to the above-mentioned Lost and Found the next day before opening hours.

Official Participants shall take good care of the lost people found in their exhibition area, and immediately inform the Lost Persons Office set by the Organizer at the Expo Site, and send someone to escort the lost people to the above-mentioned office.

Locations and contact information of the Lost and Found and the Lost Persons Office will be released by the end of February 2019.

2.6 On-site management

2.6.1 The Organizer has the authority to formulate rules for maintaining security and order within the Expo Site. Participants shall ensure that all their staff members, engaged in exhibition and commercial activities, comply with such rules.

2.6.2 If a staff member mentioned above does not comply with the rules, the Organizer has the authority to ask him/her to leave the Expo Site.

3. Supply of Water, Gas, Electricity, Air Conditioning

3.1 The installation of facilities

3.1.1 The Organizer shall install necessary distribution networks for water supply and drainage, power distribution lines, and chilled water pipes for air conditioning, and heating pipes (hereinafter referred to as “supply and disposal facilities”), and connect them to the boundary of the exhibition areas allocated to Participants, to provide irrigation and domestic water, drainage, electricity, and other general services to Participants.

3.1.2 The supply and disposal facilities shall be installed at the expense of relevant service providers. Except for the facilities provided

by the Organizer for free, Participants shall install the supply and disposal facilities for their exhibition areas at their own expense.

3.2 Service contract and service charges

3.2.1 Participants shall sign service contracts with the providers of supply and disposal facilities (hereinafter referred to as “service providers”).

3.2.2 The charges shall be set in accordance with the local market price in Beijing.

3.3 Determination of service demand

Before signing service contracts, Participants shall provide service providers with written estimates of the maximum demand of each service calculated on the basis of their equipment to be used.

3.4 Maintenance of facilities

3.4.1 Participants are responsible for routine maintenance and examination of the supply and disposal facilities for their outdoor exhibition spaces at their own expense.

3.4.2 Participants shall guarantee routine maintenance and examination of the supply and disposal facilities for their indoor exhibition spaces.

3.4.3 If they detect any potential problem in the supply and disposal facilities, Participants shall immediately report to the Organizer and the Organizer shall direct the service providers to promptly solve the problem.

3.4.4 Participants are not allowed to install alternative supply and disposal facilities or modify existing facilities on their own without the approval of the Organizer.

3.5 Expenses for special installations

To meet their special needs, Participants may request the Organizer to install special facilities for water, electricity, chilled water for air conditioning, and heating pipes at their own expense.

3.6 Suspension, discontinuation and limitation of services

3.6.1 The Organizer may suspend relevant supply to Participants under the following circumstances:

a. If a Participant does not pay its bills on the due date and fails to meet the deadline of payment after receiving a prompt-note from the Organizer;

b. If a Participant rejects without legitimate justification or obstructs due on-site inspection by the Organizer; and

c. If a Participant violates laws and regulations or breaches the Service Contract.

3.6.2 The Organizer has the authority to discontinue or limit the supply of water, electricity, air conditioning and heating to Participants under the following circumstances:

a. Natural disasters or other force majeure;

b. Actual or potential failure in the supply and disposal facilities;

c. The supply and disposal facilities need repair, or work on other relevant facilities needs to be done; and

d. Security reasons.

3.6.3 With the exception of emergencies, the Organizer shall give prior notice to official participants of the date, duration and scope of the aforementioned suspension, discontinuation or limitation of services.

3.6.4 The Organizer shall not be held liable for damage or loss caused to official participants due to the suspension, discontinuation, or limitation of services.

3.7 Water pressure and quality

3.7.1 The pressure of water to be supplied by the Organizer to the Expo Site shall meet the needs for water during the exhibition.

3.7.2 The quality of water supplied for different needs to the Expo Site shall meet the relevant quality standards issued by the Chinese Government.

3.8 Installation of water facilities

3.8.1 The Organizer shall install water inlets to the exhibition areas (See also 3.1.1).

3.8.2 Official participants may install and operate other water supply equipment and pipes within their outdoor exhibition sites at their own expense. The Organizer shall be responsible for water supply facilities in indoor exhibition spaces, and the operation expenses shall be borne by official participants.

3.9 Installation of drainage facilities

3.9.1 Drainage facilities include collection, transmission, treatment and disposal systems for sewage, waste water and rain.

3.9.2 The Organizer shall install drainage pipes from the drainage mains to the exhibition areas of official participants (see also 3.1.1).

3.9.3 Official participants may install and operate other drainage pipes and other equipment in their outdoor exhibition sites at their own expense, and shall be responsible for the operation expenses of the drainage facilities in their indoor exhibition spaces.

3.10 Voltage

The Organizer shall provide a power distribution system with 380v three-phase AC, 220V single-phase AC, at a frequency of 50Hz.

3.11 Installation of power facilities

3.11.1 The Organizer shall install power facilities and safety devices such as distribution lines and section switches up to the boundary of outdoor exhibition sites and indoor exhibition spaces for official participants (See also 3.1.1).

3.11.2 Official participants shall be responsible for installing and operating other power facilities and safety devices within their outdoor exhibition sites at their own expense, and bear the operation expenses of power facilities within their indoor exhibition spaces.

3.12 Indoor air conditioning system and heating

The Organizer shall provide the air conditioning system and heating for the international pavilion.

4. Telecommunication and Network Services

4.1 Service provider

Pursuant to the Regulations of the People’s Republic of China on Telecommunications, fixed telephone, mobile communication, Internet, satellite communication and other telecom services shall be provided by specialized service providers to official participants, and the Organizer shall provide relevant assistance.

4.2 Telecom service contract and service charges

4.2.1 Official participants shall sign service contracts with telecom service providers regarding the supply of fixed telephone, mobile communication, Internet, satellite communication and other telecom services.

4.2.2 The charges of telecom services shall be set in accordance with the local market price in Beijing.

4.3 Installation

4.3.1 The Organizer shall install telecom service connections to the exhibition areas of official participants.

4.3.2 Official participants may install and operate other telecom facilities for their outdoor exhibition sites at their own expense, and bear the operation expenses of telecom facilities for their indoor exhibition spaces.

4.4 Responsibilities of official participants

4.4.1 Official participants shall not violate laws and regulations when using the telecom and Internet services.

4.4.2 Official participants shall install telecom conduits and other facilities at locations specified by the Organizer.

4.4.3 Official participants shall, through consultation with the Organizer, provide necessary space free of charge in their exhibition areas for the installation of public telecom facilities.

4.5 Approval and operation of radio stations

Official participants and telecom service providers shall obtain prior approval of the radio authority and comply with laws and regulations if they plan to set up and operate radio stations.

4.6 Prevention and elimination of electromagnetic interference

4.6.1 Official participants shall make sure that their radios and other equipment and facilities do not generate electromagnetic interferences such as radio waves and high-frequency currents that disrupt the normal functioning of the equipment or facilities of the Organizer or other participants, and shall eradicate such interferences once they are generated upon request of the Organizer and relevant departments.

4.6.2 If planning to install telecom facilities, official participants shall make sure the installation does not damage the outside or inside appearance of the exhibition areas and shall obtain prior approval of the Organizer for such installation.

4.7 Special installations and expense

Official participants may apply to the Organizer for permission to install special telecom facilities to meet their own needs at their own expense.

Section 9 Entry/Exit of Personnel

This section briefs you about the facilitating measures adopted by the Chinese government and the Organizer for the officials and foreign staff of official participants, as well as foreign journalists and visitors, concerning their entering/leaving China and residence in China during the periods of construction, exhibition arrangement, Expo duration and dismantlement.

1. Personnel Classification

1.1 Officials and staff

a. Officials include the Commissioner General of Section, the deputy Commissioner General of Section, Garden Director and deputy Garden Director.

b. Staff includes foreign performers and other foreign employees hired or employed by official participants, as well as foreign journalists covering the events of the Beijing Expo 2019.

1.2 Visitors

Visitors in this guide refer to non-Chinese visitors coming to China for the Beijing Expo 2019.

2. Entry

2.1 Officials and staff

According to the identities and passport types of foreigners coming to China, the visas may be categorized into diplomatic visa, courtesy visa, official visa, journalist visa and ordinary visa. Officials and the foreign staff of official participants, and foreign journalists applying for diplomatic, courtesy, official, and journalist visas please refer to the website of the Chinese Ministry of Foreign Affairs:

2.1.1 Ordinary visa

a. Visa types

Officials and the foreign staff of official participants whose stay in China is less than six months may apply for F visa (Visitor Visa); whose stay in China exceeds six months may apply for Z visa (Employment Visa). Foreign journalists covering the events of the Expo may apply for J-1 or J-2 visa (Journalist Visa).

b. Application procedure

Officials and the foreign staff of official participants, and foreign journalists who apply for ordinary visas shall go through the following visa application and immigration procedures:

●Officials and the foreign staff of official participants, and foreign journalists shall fill in the Visa Application Form of Beijing Expo 2019 (Appendix 1, hereinafter referred to as the Visa Application Form). After being signed by respective Commissioner General of Section, the form shall be submitted to the Organizer by mail. You may download the Visa Application Form at the official website of Beijing Expo 2019:

● After reviewing and approving the Visa Application Form, the Organizer will send out an Invitation Letter to the Beijing Expo 2019 (Appendix 2, hereinafter referred to as the Invitation Letter) and Beijing Expo 2019 Visa Notification (Appendix 3, hereinafter referred to as the Visa Notification) stamped by the Foreign Affairs Office of the People's Government of Beijing Municipality to officials and the foreign staff of official participants, and foreign journalists.

● Officials and the foreign staff of official participants, and foreign journalists may apply for Chinese visa at Chinese embassies, consulates and visa-issuing offices in their countries or transit countries with the Invitation Letter and Visa Notification.

Officials and the foreign staff of official participants, and foreign

journalists attending the Expo from countries having no diplomatic relations with China shall apply for visa at relevant Chinese embassies, consulates overseas or visa-issuing offices of the Chinese Ministry of Foreign Affairs in Hong Kong or Macao.

The Chinese Ministry of Foreign Affairs will notify relevant Chinese embassies and consulates to proffer convenient and efficient services to officials and the foreign staff of official participants, and foreign journalists.

2.1.2 Port visa

Officials and the foreign staff of official participants holding ordinary passports who need to enter China without obtaining visa in case of emergency, may take their Invitation Letter and Visa Notification to port-visa-granting offices stationed at the Beijing Capital International Airport authorized by the Exit and Entry Administration under the Beijing Municipal Public Security Bureau to apply for a port visa.

Port-visa-granting offices may not accept applications of citizens from certain countries.

Port-visa-granting offices shall not issue diplomatic, courtesy, official or journalist visas.

Port visa is a single-entry visa with a maximum stay of one month.

2.2 Foreign visitors

Individual foreign visitors attending the Expo shall apply for L visa (tourist visa). Host organizations in China shall apply for visas on behalf of foreign visitors; foreign visitors not to be received by any host organization shall apply for visa at relevant Chinese embassies and consulates overseas on their own. Group-tourism visa may only be applied through a travel agency.

3. Residence

3.1 Resident registration

In accordance with relevant Chinese laws and regulations, officials and the foreign staff of official participants and foreign journalists who need temporary residence in China shall make resident registration.

Officials and the foreign staff of official participants and foreign journalists who stay in hotels in or outside the Expo Village shall check in and make resident registration at the front desk of relevant hotels by presenting their passports.

Officials and the foreign staff of official participants, and foreign journalists who stay in the households of Chinese citizens outside the Expo Village shall, within 24 hours upon arrival, apply for resident registration at a local public security office by presenting their passports, identifications and Household Register of their homestay family, either in person or represented by their Chinese host family.

Officials and the foreign staff of official participants, and foreign journalists who stay in the house of foreigners or foreign organizations in China shall, within 24 hours upon arrival, apply for resident registration at a local public security office by presenting their passports, either in person or represented by their host individual/organization.

Officials and the foreign staff of official participants, and foreign journalists who stay in rented house in China shall provide their leasing contracts.

3.2 Residence permit

Officials and the foreign staff of official participants from countries having mutual visa exemption agreement with China, whose stay exceeds 30 days, shall apply upon arrival for the Foreigner’s Residence Permit from relevant Chinese authorities by presenting relevant registration form of temporary residence and other documents.

Officials and the foreign staff of official participants holding Z Visa (Employment Visa) shall, within 30 days upon entry, apply for the Foreigner’s Residence Permit from relevant Chinese authorities by presenting relevant registration form of temporary residence and other documents.

Officials and the foreign staff of official participants holding F Visa (Visitor Visa) are entitled to stay in China within the period of the validity of their visas exempting from any Foreigner’s Residence Permit.

Foreign journalists holding J1 Visa (Long-Term Journalist Visa) shall, within 30 days upon entry, apply for Foreigner’s Residence Permit from relevant Chinese authorities by presenting relevant registration form of temporary residence and other documents.

Foreign journalists holding J2 Visa (Short-Term Journalist Visa) are entitled to stay in China within the period of the validity of their visas exempting from any Foreigner’s Residence Permit.

During the Expo, all relevant formalities required for officials and the foreign staff of official participants, and foreign journalists after entering China may be completed through a One-Stop Service Platform provided by the Organizer.

3.3 Visa extension

If officials and the foreign staff of official participants and foreign journalists attending the Expo need to stay in China after their visas’ expiration, they shall apply for an extension in advance.

4. Exit

Officials and the foreign staff of official participants and foreign journalists shall leave China within the authorized duration of stay of their visas or residence permits.

Officials and the foreign staff of official participants and foreign journalists holding a Foreigner’s Residence Permit may enter and exit China for unlimited times within the authorized duration of stay.

If the number of entries permitted by the visa have been used up, yet officials and the foreign staff of official participants and foreign journalists have the need to return to China within the validity of their visa, they may apply for visa back to China at local public security offices or apply for a re-entry visa at Chinese embassies or consulates overseas.

Officials and the foreign staff of official participants and foreign journalists holding the residence permits shall hand in their residence permits for cancellation at the border checkpoint while leaving China if they do not plan to return to China afterwards.

Section 10 Customs Supervision, Inspection and Quarantine

The purpose of this section is, in accordance with the General Regulations, to introduce the rules of the customs supervision over relative personnel, goods and articles, and of inspection and quarantine.

Participants shall deal with the custom clearance procedures of relevant goods according to the rules and regulations, go through the formalities of custom declaration and inspection and quarantine for imports within a specified period of time as required by the China Customs, the inspection and quarantine authorities and the Organizer.

1. Custom Clearance

1.1 China Customs and the inspection and quarantine authorities of China will be responsible for processing the customs declarations and applications for inspection and quarantine verification respectively submitted by participants.

1.2 During the process of on-site examination made by the Customs and the inspection and quarantine authorities, the representative appointed by the participant shall be present. The Organizer is authorized to process the goods on behalf of the official participant in the absence of the representative with necessary and reasonable measures, and the participant concerned shall be responsible for the expenses and liabilities thus incurred.

1.3 Goods and articles brought to China by participants’ staff which are related to Beijing Expo 2019 and not for self-use shall be subject to necessary procedures with the permission from the Customs office and inspection and quarantine authorities at the entry port 45 days in advance. Valid documents shall be presented at the time of entry, indicating that the goods and articles are related to Beijing Expo 2019.

1.4 For the transportation, loading and unloading, and handling

operations of goods related to the Expo, the participants can choose from the designated logistic service providers listed by the Organizer, or select other carriers by themselves to transport their exhibits and goods to the Expo Site. For the transportation of goods within the Expo Site, the participants shall choose the logistic service providers designated by the Organizer. Each participant shall appoint a representative in China responsible for matters related to the goods, and inform the Organizer of his/her name, address and contact information at least 60 days prior to the first shipment of goods.

Each participant shall submit in advance to the Organizer a detailed transportation plan for all goods to be used during the Expo (including the reshipping plan following the close of the Expo). For goods to be transported from overseas, the transportation plan shall be submitted to the Organizer at least 45 days prior to the first shipment of goods (including plants); while for domestic goods, at least 15 days prior to the first shipment. Official participants shall immediately inform the Organizer of changes made to the transportation plan if any.

For goods imported by sea and by air, the official participant shall provide the Organizer prior to the shipping with additional information including names of the conveyance, voyage or flight numbers, departure places and dates, arrival places and dates, reference numbers of transportation bills, dimensions and weights of cargos, and types of the packaging material, as well as the names and contact information of the international freight forwarders concerned. For plant exhibits, information shall be provided, please refer to Schedule 1.

According to the laws and regulations, participants shall be responsible for the taxes and charges incurred in the process of entry and exit, transportation, customs clearance, inspection and quarantine, storage, loading and unloading, and handling.

2. Documents for Customs Clearance

According to the laws and regulations, participants shall submit the following documents for customs clearance:

a. Two copies of the list of exhibits indicating the names of plants

and other goods, H.S. coding, quantity, value, style, model, and major parts and accessories;

b. One original bill of lading or airway bill;

c. One original packing certificate;

d. Invoices;

e. Packing list;

f. Other documents for customs clearance as required by the Customs and the inspection and quarantine authorities.

The list of exhibits shall be submitted to the Organizer or the logistic service provider designated by the Organizer at least 30 days prior to the departure of goods, and other documents for customs clearance shall be submitted at least 3 days prior to the arrival of goods in Beijing to the Organizer or the logistic service provider designated by the Organizer.

In case there are catalogues, brochures, slides, CDs or promotional gifts in the shipment, the participant shall submit to the Organizer two samples for each item, and the Organizer shall deliver collectively these samples to the China Customs and inspection and quarantine authorities for examination.

3. Duty-free Goods

Promotional articles and samples provided by participants and exclusively distributed to visitors for use or consumption free of charge during Beijing Expo 2019 shall be exempted from import customs duty provided that the unit prices of such items are fairly low, they are not suitable for commercial purposes, and their quantity and total value are verified by the China Customs to be within a reasonable scope. A pertinent report shall be submitted by the participant to the Customs after the close of Beijing Expo 2019.

4. Goods Imported on a Temporary Basis

4.1 The exhibits, supplies and equipment imported by participants during Beijing Expo 2019 shall be treated as goods imported on a temporary basis, those to be re-exported after the close of Beijing Expo 2019 shall be exempted from customs duty and import VAT. Those to be retained for use or sale shall be subject to import procedures of customs and inspection and quarantine authorities in China and applicable customs duty and import VAT as per regulations.

4.2 Exhibits referred to as goods imported on a temporary basis include:

a. Goods for display during Beijing Expo 2019;

b. Goods and items required for demonstrating the exhibited machines or instruments;

c. Construction and decoration materials for setting up exhibition areas;

d. Movies, slides, video tapes, audio tapes, instruction manuals, advertisements, CDs and display devices used for the demonstration and promotion of the exhibits.

4.3 The supplies and equipment referred to as goods imported on a temporary basis include:

a. Equipment, instruments, supplies, transportation means and special vehicles required for the production of movies and TV programs managed by participants or in cooperation with the Chinese government, organizations or corporations;

b. Imported supplies for sports games or performances, transportation means and special vehicles required for the presentation of Expo-related sports games or cultural events organized by participants;

c. Imported equipment, instruments, tools, transportation means and special vehicles used for scientific researches and teaching activities conducted by participants related to Beijing Expo 2019.

The above-mentioned transportation means and special vehicles, if are used vehicles, shall be re-exported after the close of Beijing Expo 2019 and are prohibited from retaining for use or sale.

4.4 For the goods applicable to the use of ATA Carnet as prescribed in the international conventions that China has entered into relating to the goods of temporary importation, the Chinese customs authorities shall accept and encourage the use of the ATA Carnet.

Participants in possession of the ATA Carnet shall submit the valid original copy of the ATA Carnet, the accurate list of goods and other relevant documents when applying for temporarily imported and exported goods to the customs.

At the requests of the customs, participants without the ATA Carnet shall submit the Application of Temporarily Imported Goods, the list of temporarily imported and exported goods, a copy of the Participation Contract, receipts and other relevant documents to the Customs for temporary importation. The Decision of Approving the Temporary Importation Application will be issued once the application is approved. The list of goods shall be provided by the participants to the Organizer, and then submitted to the Customs by the Organizer for registration procedures 20 days prior to the arrival of goods.

5. Taxable Imported Plants and Goods

The plants, goods and articles imported by participants and sold within the Expo Site during the Expo shall be subject to applicable customs duty, import VAT and consumption tax (if any) according to applicable laws and regulations of China.

6. Plants and Goods Prohibited from Entry

As specified in the List of Goods Prohibited from Being Imported to the People’s Republic of China and other applicable laws and regulations, import of the following goods is prohibited:

a. Arms, imitation arms, ammunition and explosives of all kinds;

b. Counterfeit currencies and negotiable securities;

c. Printed matters, films, photos, audio and visual tapes and discs, storage media for computers and other articles which are harmful to the political, economic, cultural and moral interests of China;

d. Deadly poison of all kinds;

e. Opium, morphine, heroin, marijuana and other addictive drugs and psychotropic substances;

f. Animals, plants and their products listed in the Catalogue of Animals and Plants, and Animal and Plant Products Prohibited from Being Carried or Mailed into the People's Republic of China (including the invasive species defined by the Ministry of Ecological Environment of China);

g. Food, medicines and other articles coming from epidemic stricken areas and harmful to man and livestock or those capable of spreading diseases;

h. Gambling chips;

i. Other goods and articles prohibited of importation by the Chinese government.

7.Plants and Goods Requiring Approval

The import and export of goods within following categories requires special approval according to relevant laws and regulations.

7.1 Examination and approval of common imported plants and competent authority

Crop seeds and nursery stocks: Participants or their designated agents shall, six months in advance, apply to the Chinese agricultural authority for the examination and approval of the imported seeds, as well as the inspection and quarantine of imported seeds and nursery plants. Upon entry, an application for inspection and quarantine shall be filed to

the Chinese inspection and quarantine authorities at the port of entry and the Note for Customs Clearance of Inward Goods shall be obtained, with which participants or their designated agents shall go through the custom clearance procedures at China Customs.

Forest tree seeds and nursery stocks: Participants or their designated agents shall apply to the Chinese forestry authority for the Examination and Approval Certificate for Imported Forest Tree Seeds, Nursery Stocks and Other Propagating Materials in advance, so as to proceed with the inspection application to the Chinese inspection and quarantine authorities at the port of entry and obtain the Note for Customs Clearance of Inward Good. Participation will be permitted only after the seeds and nursery stocks pass the inspection and quarantine process.

Plant products: Participants or their designated agents shall apply to General Administration of Quality Supervision, Inspection and Quarantine of China for the Examination and Approval Certificate of the Quarantine of Imported Plants and Animals in advance, so as to proceed with the inspection and quarantine application to the Chinese inspection and quarantine authorities at the port of entry and go through the custom clearance procedures with the obtained Note for Customs Clearance of Inward Good at China Customs.

7.2 Permit for plants prohibited from entry and competent authority

Participants or their designated agents shall comply with the Law of the People’s Republic of China on the Quarantine of Imported and Exported Animals and Plants and its implementing regulations, applicable rules and regulations, and international conventions, and obtain the Examination and Approval Certificate of the Quarantine of Imported Plants and Animals from the General Administration of Quality Supervision, Inspection and Quarantine of China in advance as well as the special permit for the plants from certain countries and areas listed in the Catalog of the People’s Republic of China of Entry-Prohibited Objects for the Quarantine of Imported Plants. Meanwhile, the Examination and Approval Certificate of the Quarantine of Imported Plants and Animals shall also be obtained in advance for the growth

media of imported plants.

7.3 Animals and animal products

The entry and exit of animals and animal products shall comply with the Law of the People’s Republic of China on the Quarantine of Imported and Exported Animals and Plants, as well as relevant regulations and international conventions, and participants shall obtain the Examination and Approval Certificate of the Quarantine of Imported Plants and Animals from the General Administration of Quality Supervision, Inspection and Quarantine of China in advance. Participants or their designated agents shall go through the custom clearance procedures with the Note for Customs Clearance of Inward Goods issued by the Chinese inspection and quarantine authorities.

7.4 Wild animals and plants

The entry and exit of wild animals and plants shall comply with the laws and regulations of China concerning the protection of wild animals and the relevant international conventions. The export of the wild animals and plants under special protection of China or their products, or the import and export of wild animals and plants or the products whose import and export is restricted by international conventions to which China is a party, shall be approved by the competent authorities of wildlife under the State Council. The Import and Export Permit shall also be obtained from the Chinese authority for the entry and exit of endangered species. Participants or their designated agents shall go through the custom clearance and inspection and quarantine procedures with the Import and Export Permit at the China Customs and the inspection and quarantine authority respectively.

7.5 Food and cosmetics

The entry of food and cosmetics shall comply with the laws and regulations of China concerning the regulation of food and cosmetics. The food and cosmetics carried into China for self-use and for the Expo are not for sale and shall be released within a reasonable quantity by the Customs. According to relevant provisions, the food and cosmetics shall be subject to inspection and quarantine in advance if necessary. For food

and cosmetics that exceed the quantity for self-use, the participants or their designated agents shall go through the customs clearance procedures at the customs with the Note for Customs Clearance of Inward Goods issued by the inspection and quarantine authorities.

7.6 Drugs

The entry and exit of drugs shall comply with relevant Chinese laws and regulations on drug administration. While importing and exporting drugs through China, participants or their designated agents shall apply for relevant permission and approval documents from the Chinese drug supervision and administration authorities, and use the approval documents for customs clearance.

7.7 Photography and video recording equipment

Participants or their designated agents shall go through clearance procedures at the Customs Office for temporarily importing photography and video recording equipment brought by accompanying reporters; the procedures require presentation of supporting documents issued by the Information Department of the Chinese Ministry of Foreign Affairs, the All-China Journalists Association, and the Foreign Affairs Office of the People’s Government of Beijing Municipality, as well as the guarantee provided by relevant organizations receiving the participants’ delegation. All pieces of equipment shall be re-transported out of the territory after conclusion of the Expo on schedule.

7.8 Radio transmission equipment

The importing of radio transmission equipment shall be conducted in accordance with relevant Chinese laws and regulations. While importing or carrying radio transmission equipment into the Chinese border, participants shall follow Regulations of the People's Republic of China on the Management of Radio Operation, apply to the Chinese commerce authorities for import permit, and use the permit for customs clearance. For TV relay equipment, participants are also required to get approval from the Chinese radio and television authorities; for TV relay vehicles entering the country, permits from the Chinese public security authorities are required, in addition to the permits issued by radio operation

regulation departments and the radio and television authorities. No individual is allowed to carry or mail wireless radio and TV transmission equipment into the border.

7.9 Satellite TV ground receiving equipment

The importing of satellite TV ground receiving equipment shall be conducted in accordance with relevant Chinese regulations. While importing satellite TV ground receiving equipment, participants must obtain supporting documents from the Chinese state administration authorities of press, radio and television, as well as approval documents from the Chinese commerce authorities; the Customs will grant clearance upon presentation of the approval documents. No individual is allowed to carry or mail satellite TV ground receiving equipment into the border.

7.10 Wooden packing materials

Wooden packing materials passing in and out of the territory shall follow requirements of the IPPC and relevant Chinese laws and regulations on inspection and quarantine.

7.11 Foreign vehicles entering China

Foreign vehicles entering China shall follow relevant Chinese laws and regulations.

7.12 Religion-related printed matter and audiovisual products

According to regulations of the China Customs on the entry and exit of printed matter and audiovisual products, a reasonable quantity of religion-related printed matter and audiovisual products for personal use purpose, may be carried or mailed into China by individuals. Printed matter and audiovisual products disseminating religious ideas are prohibited from importation.

7.13 Old mechanic and electric products

Old mechanic and electronic products to be used for the Expo shall be inspected by the quality supervision, inspection and quarantine

authorities of China in accordance with relevant Chinese laws and regulations on inspection and quarantine, and on the inspection and supervision of old mechanic and electric products.

7.14 Other articles defined as requiring approval by the Chinese government

8. Goods to be Re-Transported out of the Territory

Temporarily imported goods being re-transported out of the territory will be exempted from customs duty, import VAT and import consumption taxes (if any). Participants shall follow the re-transport procedures in accordance with relevant laws and regulations and write off the temporary importation.

9. Goods to be Formally Imported

9.1 If temporarily imported goods are damaged, lost or stolen and can therefore not be re-transported out of the territory after conclusion of the Expo, participants shall present proof to China Customs in accordance with relevant laws and regulations, declare the goods to accept inspections of China Customs and the Chinese inspection and quarantine authorities, and complete importation formalities in the same way as the general import goods.

9.2 If temporarily imported goods are to be retained for sale after the Expo, participants shall declare the goods to China Customs and the Chinese inspection and quarantine authorities 30 days prior to the conclusion of the Expo, and complete the importation formalities. If the goods are subject to permit or license management, participants shall also present relevant permit documents to China Customs in accordance with the regulations.

10. Goods Discarded, Re-Shipped Abroad, Destroyed, Damaged or Lost

10.1 Upon approval of the competent Customs authorities, exhibits or materials may be discarded by participants, and goods in wooden packing shall be submitted to the Chinese inspection and quarantine

authorities for proceeding.

10.2 Plants imported shall be used only for the Expo, cannot be reused for other purposes after conclusion of the Expo, and shall be destroyed or transported back under the supervision of the Chinese inspection and quarantine authorities, and agricultural and forestry plant quarantine departments. Quarantine disposal fees incurred shall be borne by the participants.

10.3 For goods to be transported back, participants shall go through transportation and tax refund process in accordance with relevant laws and regulations. For goods to be destroyed, participants shall get the goods through quarantine disposal process in accordance with inspection and quarantine laws and regulations. Participants shall make accurate customs declaration in terms of the quantities and monetary values of the goods to be destroyed onsite, and undergo normal importation procedures. However, the customs duty, import VAT and import consumption taxes (if any) may be exempted, provided that they are verified by the Customs in advance, and are destroyed under the Customs supervision. In such circumstances, the participant concerned shall be responsible for the removal of the goods out of the exhibition section under the supervision of the Customs, and bear all costs arising therefrom.

10.4 Participants shall declare to the Customs and undergo normal importation procedures for goods damaged or lost, or goods with less actual quantity than that on the exhibits list for unknown reasons, or goods disposed of by participants without the Customs approval. However, taxes may be reduced or exempted for goods damaged or lost as a consequence of force majeure, if verified and confirmed by the Customs. For items subject to license management, participants shall also present relevant documents of accreditation to the Customs in accordance with relevant regulations.

11. Donations from Overseas

For imported articles donated by foreign governments or international organizations as gifts to the Organizer of the Expo for use in Expo-related activities, the Organizer shall submit to the Customs a written application, along with a letter by the donating government or 107

organization, a Certificate for Imported Goods Donated by Foreign Governments or International Organizations and China’s Commitment to International Treaties issued by the competent authority of Chinese government, and a list of the imported goods. The imported goods that satisfy the above conditions shall be charged with lower or exempt from customs duty, while other donated goods shall be subject to the applicable Laws and Regulations of China.

12. Labeling Instructions

12.1 Each piece of shipment shall be labeled at least on two sides of the package with standard shipping marks, using standard metric units to indicate the dimensions and weight. For the goods to be uploaded, the locking point shall be marked; and for the goods of irregular shape, the gravity point shall be marked.

12.2 The shipping marks shall indicate information such as the title of the Expo, name of the participant, contact person and his/her telephone number, garden or booth and pavilion numbers, gross (net) weight, dimensions, package number, and country of origin.

12.3 For certain goods that require special handling, participants shall strictly follow international conventions on package labeling by using special signs such as “Fragile” and “This Side Up”, in addition to the above shipping marks.

109 Section 11 Accommodation and Logistics

This section introduces the accommodation and relevant logistics services provided by the Organizer to the personnel of official participants, pursuant to Special Regulation No. 6 Concerning the Accommodation of the Personnel of Official Participants. The Organizer will build an Expo Village where accommodation and logistics services will be provided to the staff of official participants. The accommodation fee will be borne by the official participants. The personnel of official participants refer to relevant personnel involved in their participation in the Expo, whose identities shall be confirmed by the Commissioner General of Section.

The official participants may also arrange accommodations outside the Expo Village for their personnel. The Organizer will provide information of other accommodations around the Expo Site and necessary help. Before the official opening of the Expo Village, the Organizer will help official participants with the reservation of other accommodations nearby.

The Organizer will set up a room Booking Center for inquiries involving accommodation and for accepting applications for rooms. The Center will deal with the applications in order of receipt of applications. The Booking Center will provide the following services:

a. Information Services: the Booking center will provide information and inquiry services in Chinese, English, French and other languages.

b. Acceptance of Applications: the Booking Center will accept and confirm applications for rooms in the Expo Village submitted by official participants.

c. Assistance: if accommodation in the Expo Village is not available for certain reasons, the Booking Center shall help arrange for official participants other accommodations outside the Expo Village.

d. Coordination: in case of overlapping of applications by different participants, the Booking Center shall help with coordination. 110

1. The Expo Village

1.1 Overview

Located in the town of Yanqing in Yanqing District, the Expo Village borders Yanqing New Town at the east and the enclosed area (the main venue) at the west. The Village situates near the No.2 main entrance at the southeast side of the enclosed area for the Beijing Expo 2019, right across the road from the main venue.

The Expo Village covers an area of 7 hectares during the event, with a floor area of about 100,000 square meters, large enough to accommodate 2,000 people at the same time. Properties under planning include a world-class five-star hotel (the Expo Hotel), a spa-themed hotel (the Spa Hotel), apartments for staff of participants and other residences.

1.3 Accommodation application, check-in and checkout of the Expo Village

In principle, every official participant may apply for up to three to five rooms in the Expo Village for its personnel at a time, pursuant to Article 7 of Special Regulation No.6 Concerning the Accommodation of the Personnel of Official Participants.

The Expo Village can accommodate a maximum of 2000 people at the same time. Due to the limited number of rooms, the Booking Center will follow the rule of “first come, first served” when dealing with the booking applications of the official participants.

The accommodation services will be available until December 31st, 2019.

1.3.1 Accommodation application

Official participants can submit their accommodation application forms to the Organizer for rooms in the Expo Village. Each official participant shall submit its application in the name of the Commissioner General of Section representing the country or the international organization, at least 6 months prior to the check-in time and no later than January 31st, 2019.

a. Application Documents

Official participants shall fill in and send the Expo Village Accommodation Application Form for Official Participants of the International Horticultural Exhibition 2019 Beijing China (see the attachment, thereafter referred to as the Accommodation Application Form) signed by the Commissioner General of Section to the Booking Center via fax, e-mail or mail.

The Organizer will update the Accommodation Application Form as

soon as possible and post it in the Participation Guide as well as the official website of the Expo.

b. Acceptance of the Application

The Booking Center will arrange accommodation according to the order of time at which the applications are received. When the applied type of property is not available, the Booking Center shall make appropriate adjustment and allocate similar types of property to the official participants. Should there be no available rooms in the Expo Village, the Booking Center will assist, free of charge, the official participants with the reservation of other accommodations.

c. The Notice of Acceptance

The Booking Center will issue a notice of acceptance to the official participants, feeding back the arranged accommodation information within 30 days after receiving the application.

d. Application Confirmation

Official participants shall submit a written confirmation to the Booking Center via fax or e-mail within 20 days after receiving the notice of acceptance. Without such confirmation, the Booking Center will no longer reserve the arranged rooms.

e. Application for Changes

Official participants shall submit new accommodation application forms with indications of application changes, if any change is to be made after the accommodation application is submitted or the notice of acceptance is issued.

1.3.2 Check-in

a. Change of the Check-in Time

If there is any inconsistency between the actual check-in date and the contracted date in the Accommodation Agreement (including early

and late check-in or cancellation), the official participant shall inform the Booking Center seven days in advance in written forms signed by the Commissioner General of Section.

b. Accommodation Agreement

When checking in, personnel of official participants shall sign in written forms the Accommodation Agreement with the property management organization of the Expo Village

c. Deposit

Official participants shall pay a certain amount of deposit to the property management organization upon check-in. Check-in procedures will only be proceeded after the deposit is paid.

d. Obtainment of Entry Passes for the Expo Village

Upon check-in, the personnel of official participants shall fill in the information registration form (including name, sex, nationality, passport number and room number), and obtain the Expo Village entry passes through the Booking Center for free. Should there be any change in the guest list, the official participant shall inform the Booking Center, which will register the information of the new guests and issue entry passes to them.

e. Extension of Stay

If the personnel of official participants need to extend their stay in the Expo Village, the official participants shall submit in written form an application to the Booking Center signed by the Commissioner General of Section seven days in advance. The Booking Center will respond to the application in a timely manner.

1.3.3 Checkout

a. Early Checkout

If an early checkout before the contracted date is requested, the

personnel of official participants shall inform the Booking Center three days in advance.

b. Billing Mode

Accommodation fee and related charges incurred in the Expo Village shall be settled monthly with the property management organization. For tenancy of less than a month, the fee will be calculated on daily basis and settled at the end of the lease.

c. Payment Methods

Official participants may settle the payment by cash or credit card in RMB.

2. Logistics Services in the Expo Village

The Organizer will provide and adjust the public service facilities based on the number of people staying in the Expo Village and their needs. The details and prices of the public services shall be announced in due time.

2.1 Transportation services

2.1.1 The schedule of commuter buses will be announced later.

2.1.2 Parking

There will be a temporary parking lot to the southwest of the Expo Village, of which the management method will be announced later.

2.2 Catering and shopping services

There will be lobby bars, all-day dining restaurants, Chinese restaurants and executive lounges, serving Chinese food, western food, fast food, plus cafés, teahouses, dessert shops and large-scale banquet facilities in the Expo Village hotels to satisfy the needs of the personnel of official participants.

2.3 Information services

Dedicated lines of optical cable will be laid in the Expo Village with high capacity, multi-interfaces, and full coverage, and information and communication transmission platform will be built with high bandwidth, strong security, and multiple applications. A combination of permanent base stations and temporary facilities will solve the problems in mobile communication for the personnel of official participants. A public commercial center and Internet cafes will be established to meet the demands of working and Internet accessibility. In hotels and apartments of the Expo Village, every room will be equipped with communication and Internet interfaces that are available upon request for paid use.

The Guidebook to Life in the Expo Village will be provided in the Expo Village for the personnel of official participants to learn about the services and facilities in it. Besides, electronic bulletin boards will be set up in the Expo Village for important notices to the personnel of official participants.

2.4 Health and medical services

There will be clinics, medical emergency treatment stations, drug stores, laundry shops, and cleaning service stations in the Expo Village to provide first aid, medical and sanitation services to the personnel of official participants.

2.5 Others

In the Expo Village, there will be functional public facilities and services that meet the general needs of the personnel of official participants, including post offices, express delivery services, hair and beauty services, bank branches, taxi stands, public washrooms, gyms, water supply stations, smoking spots, and dustbins.

Section 12 Commercial Activities

Pursuant to the General Regulations of the Beijing Expo 2019 and Special Regulation No.9 Concerning Commercial Activities, this section aims at providing information on official participants’ commercial activities within their exhibition areas. Official participants shall endeavor to present the cultural traditions of their country or organization, and the theme of the Expo.

1. Types of Commercial Activities

The commercial activities in the context of this document refer to the operation of restaurants and sales of goods by official participants in their respective areas approved by the Organizer.

1.1 Restaurants

The restaurants operated by official participants shall mainly serve the food with their national flavors or specialties.

1.2 Retail stores

Official participants may sell to the public photographs, slides and postcards, sound and video recordings (on films, CDs, DVDs or other electronic media), books and stamps from their country or organization. Subject to the Organizer’s approval, official participants may also sell limited types of articles which are truly representative of their respective countries (animals imported excluded). Plants imported shall be subject to necessary procedures and can only be sold with the permission from the Customs office and inspection and quarantine authority. Articles for sale may be replaced during the Expo.

2. Authorization of Commercial Activities

Official participants shall submit in advance to the Organizer for approval proposals on the type of restaurants to be operated, the type, price and the price labeling of the food and goods to be sold, and the location, area, size, style, capacity and management methods of the

commercial establishments. Such proposals shall also be submitted to the relevant Chinese authorities for examination and approval.

Official participants need to obtain from the Organizer prior approval before installing automatic vending machines for their commercial activities. The machines shall display conspicuously information concerning the operator and relevant licenses and certificates specified by laws and regulations.

Any change to the above items shall be subject to the consent of the Organizer.

3. Operation of Commercial Activities

3.1 Responsibilities of Commissioner General of Section

Pursuant to Paragraph 2 of Article 22 of the General Regulations, the Commissioner General of Section shall have full responsibility for commercial and other activities in each national section. Regardless of the forms in which an official participant assigns its commercial activities to a third party, the Commissioner General of Section of the official participant shall have direct responsibility for the act of the said third party.

Pursuant to Article 7 of the Special Regulation No.9 and the Participation Contract, official participants shall pay to the Organizer royalties arising from their commercial activities. The Commissioner General of Section or his/her designated representative shall collect and deliver the royalties to the Organizer.

Official participants shall pay taxes on their commercial activities pursuant to laws and regulations.

3.2 Business hours

The business hours of commercial activities shall be determined by the Organizer in light of the type and location of commercial activities of official participants and the daily opening hours of the Expo.

The opening hours of a retail store of an official participant shall be the same as those of its exhibition area. The opening hours of a restaurant of an official participant shall be subject to Special Regulation No.13 Concerning Admissions.

Under urgent circumstances such as force majeure, the Organizer may ask official participants to change the business hours of their commercial activities to ensure the successful running of the Expo. For loss arising from the change of business hours, official participants shall not claim compensation from the Organizer.

Official participants shall not suspend their commercial activities without the approval of the Organizer.

3.3 Areas for commercial activities

Pursuant to Paragraph 1 of Article 13 of Special Regulation No.4, the space to be built into indoor exhibition shall not exceed 20% of the total exhibition space assigned to the official participant. Approval by the Organizer is required for additional indoor exhibition space. Pursuant to Paragraph 3 of Article 22 of General Regulations, the space to be used by an official participant for commercial activities shall not exceed the 20% of the total indoor exhibition space assigned to the official participant or 100 m2, whichever is smaller. If its exhibition area is over 2000 m2, an official participant may negotiate with the Organizer about the area that can be used for commercial activities.

Official participants shall conduct commercial activities only within the area approved by the Organizer. Without the approval of the Organizer, official participants shall not transfer the area for commercial activities or conduct commercial activities elsewhere.

Commercial activities of the official participants shall not be conducted at the compromise of the exhibition, or separate the exhibition areas and plants display relevant to the theme of the Expo.

3.4 Royalties

Official participants shall pay to the Organizer royalties arising from

their commercial activities. The Commissioner General of Section or his/her designated representative shall collect and deliver the royalties to the Organizer. Royalties shall be collected monthly and the way of delivery shall be stipulated separately by the Organizer.

Royalties shall be calculated as a proportion of the after-tax revenues (sales revenues after VAT) from commercial activities as follows:

a. Restaurants: 8%;

b. Sales of goods: 10%.

Outstanding royalties shall be transferred by official participants to the Organizer’s designated bank account within two months as of the end of the Expo.

3.5 Handling of sales income

Each official participant shall keep a record of daily sales income and report it to the Organizer in a way specified by the Organizer. The official participant shall open an account at a bank designated by the Organizer and deposit the daily sales income in that account within the time limit set by the Organizer. The Organizer may require the official participant to provide a detailed report about its sales income and account statements in a specified time, and audit, when necessary, the financial situation of the commercial activities.

Official participants shall use the cash register system designated by the Organizer to handle the sales income from their commercial activities.

3.6 Transport of goods

Official participants shall comply with the requirements set forth by the Organizer when transporting goods, materials, equipment and other items related to commercial activities.

3.7 Quality of goods

Official participants shall comply with laws and regulations to

ensure the quality of goods they sale, and protect the legitimate rights of consumers.

3.8 Currency and price

Commercial activities in the Expo Site shall be settled in Renminbi (RMB). The Organizer shall offer RMB exchange service within the Expo Site.

Official participants shall indicate clearly to visitors the prices of goods for sale in their sections of commercial activities.

3.9 Personnel management

Official participants shall report to the Organizer the person in charge of commercial activities, names, ID and contact information of the sales people, and other information specified by the Organizer; and shall immediately inform the Organizer when the information reported has been changed,

The salespeople shall participate in training provided by the Organizer and wear identity badges when on duty.

In case of breach of laws and regulations or disruption of order of the Expo by the salespeople, the Organizer may direct the official participants concerned to have the said salespeople out of the Expo Site or stop them from engaging in commercial activities. Official participants shall follow the directives of the Organizer.

Section 13 Events and Forums

Events and forums are important forms manifesting the theme of Beijing Expo 2019. The host encourages participants to participate in events and forums that comply with the theme of Beijing Expo 2019.

1. Events

1.1 Definition

Events refer to cultural, recreational and performing arts activities of various kinds held before and after the Expo’s opening.

1.2 Events categories

Events during the Expo can be categorized into three groups: events organized by the Organizer; organized by the Organizer and undertaken by participants; and organized by the Organizer with invited participants’ cooperation.

1.2.1 Events during the Expo

a. Events organized by the Organizer

This kind of events shall be organized and carried out by the Organizer within the Expo Site showcasing the Expo theme and national features. For example, opening and closing ceremonies, China’s National Day, festooned vehicle parade and on-site performances.

b. Events organized by the Organizer and undertaken by participants

This kind of events shall be organized by the Organizer and undertaken by participants showcasing the horticulture and national culture of respective nations and international organizations, for example, the National Days.

National Days shall be organized by the Organizer and undertaken by the participating nations and international organizations. Participating

nations can submit their applications in accordance with procedure set out by the Organizer; and the Organizer shall coordinate and arrange for the activities during the Expo. Participating countries can organize themed activities to demonstrate their Expo theme and national culture, and promote friendly exchanges with other countries in culture and arts.

c. Events organized by the Organizer with invited participants’ cooperation.

This kind of events shall be wide-ranging, diverse and with mobile performances, as a carnival in the Expo Site organized by the Organizer. Participants may recommend their distinctive cultural performances or exhibitions of arts to the Organizer; and after getting those activities reviewed, the Organizer shall incorporate them into the carnival based on the schedule of each participant. Thus, the performances and exhibitions will be held in multiple venues in a multiple-dimensional way.

1.3 Event application method

1.3.1 National Days

a. Application procedure

Official participants are entitled to host their National Day activities on any day during the Expo (except for the Opening and Closing ceremonies and important Chinese festivals). Official participants shall submit their applications to the Organizer through the official website before August 31, 2018, and propose three alternative dates with reasons stated briefly. (Please refer to Appendix 2 and 4 for sample forms.) After receiving the applications, the Organizer shall make coordinated arrangements based on full respect for the customs of the participants, and confirm with them about the date, venue and arrangements in a timely manner. b. Principles of arrangement

The Organizer will observe the following principles while making arrangements for dates and venues of the events:

●Treat every official participant’s application equally and ensure fair option of choosing the date for their National Day;

●Do our best to satisfy the needs stated in the applications made by official participants;

●In case of a National Day application overlapping another in time/venue, the Organizer shall in principle coordinate requests on a “first come, first served” basis.

c. Venues

National Day events may use the platform in the square before the International Pavilion or the Performance Center.

d. Expenses

The Organizer shall provide to official participants free venues, public services (such as water and electricity) and infrastructure for performance (such as the stage, basic lighting and sound equipment). Any special requirements other than the aforesaid facilities, equipment or services shall be taken care of by official participants on their own, and the Organizer may provide assistance. Without the Organizer’s approval, official participants shall not host events irrelevant to the theme of Beijing Expo 2019; and shall not charge visitors for tickets for any event.

1.3.2 Carnival performances

a. Application procedure

Official participants shall apply to the Organizer through the official Expo website prior to August 31, 2018 with thorough introduction of the event content and reasons to host such event. (Please refer to Appendix 6 for sample form.) The Organizer shall make coordinated arrangements after receiving the applications, and confirm with the party undertaking the events about the date, venue and arrangements in a timely manner.

b. Principles of arrangement

In accordance with the general plan of the Carnival, the Organizer shall satisfy the time/venue needs raised by participants in their applications for featured events to the best of its ability. In case of an application by one official participant for featured events overlapping with another in time and venue, the Organizer shall coordinate by following the “first come, first served” principle and the general plan of the Carnival.

c. Venues

The Carnival events shall be coordinated by the Organizer according to their contents to appropriate venues. (Please refer to Appendix 5 for details on venues.)

d. Expenses

The costumes and properties necessary for the performance shall be prepared by the applicants on their own. The Organizer shall provide appropriate assistance according to the scale of the events and relevant circumstances.

2. Forums

2.1 Definition of forums

Forums refer to all types of forums held around the opening of the Beijing Expo 2019. Official participants may apply for organizing forums during the Expo, and their forms and contents shall be in line with the theme of the Expo.

2.2 Types of forums

Beijing Expo 2019 shall hold three types of forums—summit forum, theme forum and public forum, according to the levels and scopes of the forums.

2.2.1 Summit forum

Summit forum is a meeting held under a certain theme or a certain type of themes. The theme shall be determined by the Organizer, and the official representative of the host country shall attend the forum. Official representatives of participating countries, heads of international organizations and official representatives from provinces and cities at home shall be invited to the forum.

2.2.2 Theme forum

Participants shall submit theme proposals to the Organizer, who will then choose the themes to convene the meeting, based on the Expo theme and principles. The participants may submit themes related to the Expo, ecological progress and unique horticultural concepts of the participating countries based on their own needs, and recommend relevant experts to attend the forum. The Organizer shall make overall arrangements during the Expo according to the specific situations. The public participators have to apply for attendance in advance, and the application method shall be released on the official website of the Expo.

2.2.3 Public forum

Public forum is a BBS section set up by the Organizer on the official website of the Beijing Expo 2019. The public may join the discussion of the topics and leave messages or comments through the Internet.

2.3 Applying for the forum

2.3.1 Participating in the summit forum

Official representatives of participants are entitled to attend the summit forum of the Beijing Expo 2019. Official participants shall submit the list of the attendees to the Organizer through the official website of the Expo before December 30th, 2018. (Please refer to

appendix 8 for sample form) After receiving applications, the Organizer shall arrange activities in the principle of fully respecting the requirements of official participants and send confirmation back to them timely. On the opening day of the forum, guests shall enter venue by registered information.

2.3.2 Participating in the theme forum

Official participants may apply for themed forums related to the theme of the Expo, ecological conservation concepts, unique horticultural culture, etc. Official participants need to fill in the application forms (please refer to appendix 9 for sample form), recommend relevant “themes”, experts and scholars to participate in the forums, and submit applications to the Organizer through the official website of the Beijing Expo 2019 before August 31st, 2018. After receiving applications, the Organizer shall arrange activities in the principle of fully respecting the requirements of official participants and send confirmation back to them timely. The theme forums are open to the public, and for detailed information on public participation, please refer to the official website of Beijing Expo 2019.

2.3.3 Participating in the public forum

Official participants and the public can all log in the official website of the Beijing Expo 2019 www.horti-expo2019.com to access the public forum, make conversations, exchange views with each other and leave messages or comments.

2.4 Site arrangement

Venues for the summit forum and theme forums shall be arranged by the Organizer, while the public forum shall take place via Internet on the official website of Beijing Expo 2019.

Appendix 1: Arrangement for Activities on the “National Day” in Beijing Expo 2019

I. Time Arrangement

Beijing Expo 2019 lasts for 162 days from April 29th to October 7th, 2019. “National Day” activities for various countries can be arranged at any date during the Expo, except for the days of the opening and closing ceremonies and major Chinese holidays (such as the opening ceremony on April 29th, closing ceremony on October 7th, Dragon Boat Festival on June 7th, the Chinese Valentine’s day on August 7th, Mid-Autumn Festival on September 13th, Double Ninth Festival on October 7th, etc.).

II. Venue Arrangement

The venue could be the stage on the square of the International Pavilion, the Performance Center, etc.

III. Program of the “National Day”

Based on their “National Day”, participating countries will showcase, in the form of introduction and marketing, the basics about their participation in the Expo, their concepts and themes, planning and layout, and preparatory progress. The “National Day” activities shall fall into two categories, mandatory activities (including meeting with the Organizing Committee of the host country, signing ceremony, flag-raising ceremony, group photographs, performances of the participating countries, tour visits, reception banquet, etc.) and optional activities (including participation invitation, marketing, and business matchmaking, etc.).

(I) Admission

Time: 9:30am-9:45am

Venue: autograph wall of the International Pavilion square and VIP meeting rooms.

Host: arranged by the Chinese side

Appendix 7 Optional Venues

1. Grand Theatre of the Performance Center

(1) The total area of the main stage (oval-shaped with a long diameter of 38m, a short diameter of 26m and a height of 15.4m) is 765 m2. An area of 1,263 m2 (round-shaped with a radius of 25m) is reserved on the periphery as an on-water stage, a semi-open venue.

(2) The stage has the capacity to sustain 1200kw grand stage illumination, 400kw grand stage machinery and 80kw grand stage acoustic equipment.

(3) The area of the spectator stands is 1,200 m2 (roughly 54m×19m).

(4) The Grand Theatre has six audience seating zones and one VIP seating zone, ready to accommodate 1000 people (including 33 VIP seats). There are 15 seat rows with a distance of 1.2m in-between. The VIP seats are located in the center, from Row Five to Row Seven with a distance of 1.8m in-between. Wooden seats are set up on the landscape retaining wall for regular audience, while VIP seats are temporarily arranged during the Expo.

(5) Two barrier-free seats and two accompanying seats are arranged in the first row. A space of 1.1m×0.8m is earmarked for each barrier-free seat, and the accompanying seats are set up nearby.

Section 14 Competition and Assessment

1. Awards

The Organizer has set up categories for Outdoor Gardens Awards, Indoor Exhibition Areas Awards and Special Awards for official participants who make the greatest contribution to and best demonstrate the theme of the Expo: Live Green, Live Better.

During the Expo, the Organizer shall also set up awards for non-official participants, other organizations and individuals who have contributed to the preparation and holding of the Expo.

All official participants who have not relinquished their part in the competition in written form shall be eligible to attend the international competition.

2. Assessment and Award Presentation

Official participants shall be notified of details on award assessment and presentation, especially on assessment criteria six months prior to the opening of the exhibition.

All awards shall be presented at the Award Ceremony or in batches prior to the closing of the Expo.

3. Composition and Operation of the Jury

3.1 The jury is composed of an odd number of judges nominated by the Organizer and invited by the International Association of Horticultural Producers (AIPH), while the judges invited by the AIPH shall outnumber the judges nominated by the Organizer by one. The chairperson and the majority of the jury members shall come from countries other than the host country. Members of the jury shall be finalized three months before the opening of the Expo.

3.2 The host shall nominate renowned personages in fields of horticulture exhibition of the Expo or the Expo theme development, and

shall ensure professional standards of the jury. Members of the jury shall not represent their countries or organizations, but rather shall exercise their duties independently.

3.3 A panel of experts invited by the host shall be the jury for Special International Competition Award.

3.4 Members of the Jury shall vote to elect their chairperson.

3.5 The Jury’s meeting shall be convened and chaired by the chairperson and organized with assistance from the host.

3.6 Arrangement of Jury, the awards setup plan and issues pertaining to award assessment shall all be planned prior to the opening.

Section 15 Publicity and Media Services

The Beijing Expo 2019 has set up a Media Center that serves journalists from the trial operation, the opening to the closing. Here, journalists may register, access the Internet and communication services. Work area, press briefing room, lounge and information area shall be set up; and reservations for accommodation, transportation and catering will be provided.

Details about the Media Center will be released in due course.

Section 16 Insurance

1.Insurance Responsibilities

1.1 Participants referred to in this Participation Guide include:

a. Official participants;

b. Non-official participants.

1.2 The following parties are also deemed as participants in this Participation Guide:

a. Businesses or individuals who have signed commercial contracts with the Organizer;

b. Lessors who provide the Organizer with immovable or movable property under contracts signed with the Organizer;

c. Contractors who undertake construction, installation and dismantlement under contracts signed with the Organizer;

d. Parties who provide those listed in a to c with entertainment and media services or exhibits;

e. Parties who undertake construction, installation and dismantlement within the Expo Site for those listed in a to d;

f. Parties who have lawful rights and interests for the property used by the Expo besides those listed in a to e.

1.3 Participants listed in 1.1 shall notify the participants listed in 1.2 of this Participation Guide and require the latter to present legally binding written documents as proof of observance of this Participation Guide and honoring their due obligation arising therefrom.

2. Compliance with Laws and Regulations

2.1 All participants shall comply with the relevant laws, regulations and rules of China, the General Regulations and the Special Regulations of Expo, and the additional instructions and directives issued by the Organizer.

2.2 Additional instructions and directives are issued by the Organizer to provide more information on related subjects and further specify the rights and obligations of participants and the Organizer.

3. Compulsory Insurance

3.1 Industrial injury insurance

Pursuant to the Labor Law of the People’s Republic of China, Labor Contract Law of the People’s Republic of China and Regulations on Employment Injury Insurance, enterprises and private businesses within the territory of China shall purchase employment injury insurance for their employees to ensure that they will have medical treatment and financial compensation in case of work place injuries, occupational diseases, disability, loss of ability to work or death during their employment. The employment injury insurance is under the management of the labor and social security departments of the Chinese government.

3.2 Medical insurance

Pursuant to the Labor Law of the People’s Republic of China and the Decision of the State Council on Establishing a Basic Medical Insurance System for Urban Employees, all employers in cities and towns, including enterprises (SOEs, collective enterprises, foreign-invested enterprises, private businesses, etc.), government departments, public institutions, social organizations, private non-enterprise institutions and their employees shall participate in basic medical insurance program. Medical insurance is under the management of the labor and social security departments of the Chinese government.

3.3 Compulsory traffic accident liability insurance for motor vehicles

Participants shall ensure compulsory traffic accident liability

insurance cover for motor vehicles used by themselves and their staff working at the exhibition section for the Expo in accordance with the Chinese laws. Pursuant to the Law of the People’s Republic of China on Road Traffic Safety and Regulations on Compulsory Traffic Accident Liability Insurance for Motor Vehicles, motor vehicles not covered by the compulsory liability insurance shall not be on-road, registered by the motor vehicles administrative departments or inspected by the inspection agencies. To ensure that the loss is fully covered by insurance, the participants may purchase additional insurances as stipulated in this Participation Guide.

The minimum requirement for each insurance type listed in this Article shall be decided by the Organizer, and the specific coverage for each insurance type shall be subject to the terms and conditions of the insurance contract or to the public announcement issued by the Organizer. Participants must provide the Organizer with duplicate copies of the above insurance contracts and documents proving payment of relevant insurance premiums.

4.Required Insurance

The required insurance for the Expo as provided for in the General Regulations and the Special Regulation include:

4.1 Comprehensive liability insurance;

4.1.1 In the event of any accident caused by the Organizer or the participants during the insurance period in the insured areas which results in personal injury or financial loss of a third-party, the insurer shall be liable for financial compensation which the Organizer or the participants assume under the laws of China.

4.1.2 The maximum amount of compensation for each accident or compensation accumulated during the insurance period is RMB billion yuan which includes legal costs and other expenses.

4.1.3 Under general circumstances, the period of coverage of a comprehensive liability insurance contract is: for the Organizer, from the date on which construction starts in the Expo Site to the date on which all

exhibition spaces are completely cleared; for the participants, from the date on which the Participation Contract, commercial contracts or other contracts and agreements come into effect to the date on which the plots, or exhibition spaces are returned to the Organizer.

4.1.4 The Organizer shall purchase for itself and all participants the comprehensive liability insurance on the most favorable terms. The participants shall be responsible for their pro-rata share of the cost, which is proportional to the exhibition area they occupy.

4.2 Property insurance

4.2.1 The property insurance covers buildings and structures, facilities, equipment, merchandise, articles for daily use and other property that are owned, rented, looked after by, or under the care or control of the insured in the insured areas, excluding animals (with fish and shellfish included) and plants.

4.2.2 The insured amount of a property insurance contract is determined as per the actual or assessable value of the property insured.

4.2.3 Under general circumstances, the period of coverage of a property insurance contract is:

For existing buildings and structures in the Expo Site, from the date mutually agreed by the insurer and the insured to the date on which the dismantlement/removal commences;

For buildings and structures, facilities and equipment to be built in the Expo Site, from the date the project is partially or totally checked and accepted or put into use to the date of dismantlement/removal;

For merchandise, articles for daily use and other property, from the delivery date of the insured property to the insured area to the departure date of the transport vehicle shipping the insured property from the insured areas.

4.2.4 The Organizer and participants shall purchase property insurance for the property owned, rented, looked after by, or under the

care or control of the Organizer and participants respectively. If the property insured by the Organizer is used by any participant, the participant shall pay the Organizer the amount applicable to that property.

4.3 Insurance for construction and installation projects

4.3.1 Property covered by the insurance for construction and installation projects include the construction and installation projects as well as materials, machines and equipment used for the projects that are owned by or under the care or control of the insured in the insured areas.

4.3.2 The insured period for construction and installation projects shall start on the date of commencement of construction or delivery of materials and equipment to the construction site and terminate on the date of acceptance or actual use.

4.3.3 The insured amount for construction and installation projects shall be determined as per the contract price of the projects or the actual value of the materials and equipment.

4.3.4 Participants shall take out insurance for construction and installation projects for all the construction and installation projects described in 4.3.1 of this Article under their control during the Expo.

The minimum requirement for each insurance type listed in this Article shall be decided by the Organizer, and the specific coverage for each insurance type shall be subject to the terms and conditions of the insurance contract or to the public announcement issued by the Organizer. The Organizer shall purchase for itself and all participants the comprehensive liability insurance. The participants shall be responsible for their pro-rata share of the cost, which is proportional to the exhibition area they occupy. Apart from Comprehensive Liability Insurance, participants must provide the Organizer with duplicate copies of the other required insurance contracts and documents proving payment of relevant insurance premiums.

5. Optional Insurance

The Organizer shall assist the participants in purchasing optional

insurance by providing the participants in due time with a list of optional insurance available and issuing insurance guidelines.

6. Waiver Clause and Other Regulations

6.1 Waiver

6.1.1 In the event of an accident, participants shall waive the right to claim compensation from the Organizer and its staff or other participants and their staff, unless the accident is intentional or caused by gross negligence.

6.1.2 In the event of an accident, the Organizer shall waive the right to claim compensation from the participants and their staff, unless the accident is intentional or caused by gross negligence.

6.1.3 For the types of insurance listed in Article 4, the participants and the Organizer shall waive the claims as specified in 6.1.1 and 6.1.2 of this Article, and ensure that the relevant insurance companies waive the right of subrogation arising therefrom.

6.1.4 The waivers specified in Paragraphs 1 to 3 of this Article shall be effective together with the Participation Contract, commercial contracts or any other contracts and agreements, and shall be included in every insurance contract in relation to the Expo signed by the participants.

6.2 Special provisions on personal accident insurance and medical insurance for non-Chinese employees:

Participants, who employ non-Chinese residents to work in the Expo Site, shall provide the Organizer with valid documents certifying that the said employees have been covered by the personal accident insurance and medical insurance. Otherwise, the Participants shall arrange the personal accident insurance and medical insurance for those employees in China and the Organizer shall provide necessary assistance in the respect.

6.3 Insurance policy term

Unless otherwise stipulated in this Participation Guide, insurance purchased by the participants for goods, plants and other materials shall have a policy term longer than the duration of the above objects being retained within the territory of China. Shall the participants purchase insurance for non-Chinese employees; the policy term shall be longer than the duration of these employees’ stay in China. Shall the participants purchase insurance for Chinese employees; the policy term shall be longer than the period in which these employees are under the employment of the participants.

6.4 Translation of the insurance contracts

The insurance contracts shall be concluded in or evidenced by Chinese. If an insurance contract is concluded in languages other than Chinese, the participants shall submit its Chinese translation to the Organizer upon its conclusion. In this case, the participant concerned shall guarantee the accuracy and consistence of the translation with its original version.

6.5 Signing contracts with insurers not on the recommended list

The Organizer shall provide the participants with a list of recommended insurance companies for insurance services. Any insurance contracts signed by the participants with insurance companies not on the recommended list shall satisfy the minimum requirements for the Expo required insurance and be legally valid within the territory of China.

6.6 Self-insurance

The governments of participating countries or similar institutions of other participants may, upon notifying the Commissioner General of the Expo in writing, act as their own insurers in respect to buildings, structures, facilities, equipment, merchandises, and articles for daily use, for which they are responsible.

6.7 Special clauses

Upon approval by the Organizer, the participants may add special clauses when signing insurance contracts for property, and construction

and installation projects with the insurers.

6.8 Assistance from the Organizer

6.8.1 The participants may apply to the Organizer for assistance when signing contracts for property insurance and insurance for construction and installation projects. The applications shall be submitted to the Organizer no later than 15 days prior to the signing of such contracts.

6.8.2 The Organizer may provide assistance when the participants need to add special clauses to the contracts mentioned in the above paragraph.

Section 17 IPR Protection

Pursuant to the Beijing Expo 2019 Special Regulation No.11 Concerning Intellectual Property Rights, this document provides official participants with information concerning IPR related issues and the services offered by the Organizer.

In order to specify how each type of intellectual achievements are effectively protected in China, the Organizer will also provide official participants with a copy of the Guide to IPR Protection in China.

Moreover, with the development of e-government, many Chinese government departments have set up their own websites, disclosing necessary information and offering access to services. In an attachment to this document, we have listed official websites of IPR related government departments for the participants’ reference.

Any service provided by the Organizer to help the participants protect and use IPR shall not be interpreted as the Organizer bearing any responsibility arising therefrom.

1. Music Copyright

According to the Copyright Law of the People’s Republic of China and the Regulations for the Implementation of the Copyright Law of the PRC, musical works refer to the works like songs and symphonies that can be sung or performed, with or without accompanying words. Musical works are protected by the Copyright Law. Unless otherwise stipulated by law, the users of musical works shall gain permission from and pay royalties to the copyright owners.

The use of musical works in this document refers to only the live performances and mechanical performances held within the Expo Site during the Expo period. Live performances are public performances of musical works for which no fees are charged to audience; whereas mechanical performances are broadcast of musical works by various public means. Beyond that, users of musical works in any other forms shall obtain permission from and pay royalties to the copyright owners by 155

themselves.

1.1 Use of musical works

Official participants who use musical works are defined users of musical works, and unless explicitly stipulated otherwise in this document, users of musical works shall pay royalties in accordance with regulations, which the Organizer will collect for copyright owners.

Official participants, who declare in written form at least one month prior to the Expo opening to the Organizer that they will use only musical works with copyrights or right of performance obtained by themselves or the Organizer, won’t need to pay royalties as stipulated in this document. Official participants making such declaration shall inform the Organizer of the musical works for which they have obtained copyrights or right of performance.

The Participant Service Center subordinate to the Organizer shall be responsible for collecting royalties for the use of musical works, for providing to official participants the list of musical works and sound materials for which the Organizer has obtained copyrights or right of performance, for receiving musical works from official participants and informing the legal affairs department for record keeping. Procedures for acquiring information on musical works and record filing will be released by the Organizer in due time.

1.2 Royalties

Official participants shall make royalty payments to the Participant Service Center prior to the Expo opening and have the names of musical works to be used registered at the Participant Service Center. Shall the official participants fail to make the payments on schedule due to special circumstances, they can give written notice to the Participant Service Center requesting for a deferment, which can be no later than up to three months after the opening of the Expo.

The above-mentioned royalties for musical works are collected by the Organizer for the Music Copyright Society of China (MCSC), which is the only organization for collective management of musical work

copyright and a member of the International Confederation of Societies of Authors and Composers (CISAC).

The MCSC’s standards for collecting royalties on the use of musical works in the Expo will be released by the Organizer in due time.

2.Exhibition Certificate

Exhibitors of official participants may file patent applications with the SIPO for works of invention-creation first exhibited at the Expo within six months of the exhibition, during which time the application will not lose its novelty. The exhibitor concerned may apply for and obtain exhibition certificates thereof from the Organizer.

If a trademark is used for the first time at the Expo, the exhibitor of official participant concerned may enjoy the right of priority in filing an application with the Trademark Office for registration of the same trademark for identical commodities in China within six months as from the date when the trademark is used. The exhibitor concerned may apply for and obtain an exhibition certificate thereof from the Organizer.

The application must be approved by the Commissioner General of Section with signature; whereas formats, other documents needed and relevant requirements will be released in due time. The application documents shall be true, accurate, complete and complying with the requirements of the Organizer. If everything checks out, the Organizer will issue Exhibition Certificate to the exhibitor within one month since the item in question has been put on exhibition.

The Organizer has the right to withdraw the Exhibition Certificate if the Certificate has been proven to be obtained through deception or other improper means, in which case relevant official participants shall cooperate.

3. Performance Certificate

The Organizer may provide a performance certificate for Official Participants performing at the Expo site during the Expo.

Official participants who organize performances in the Expo Site shall submit written application to the Organizer at least one month prior to the performance date and request issuance of performance certificates from the Organizer. The application shall be signed by the Commissioner General of Section or Chief of Pavilion. The specific format, documents needed and other requirements will be released later.

Organizer shall, after having the received documents and information verified, issue performance certificates to the applicants within five workdays after the performance.

4. Service Organizations

In order to help official participants to apply for patents, trademark registration, copyright registration (including the application for computer software registration), new varieties of plants, the registration of design map of integrated circuit, and the customs file of intellectual property right, the Organizer has produced a list of service providers for reference by sifting the qualified IPR service organizations. The list is in the relevant categories of The List of Recommended Service Providers.

5. On-Site Organizations and Complaint Hot Line

During the Expo, the relevant departments of Beijing Municipality will set up on-site offices in the Expo Site to provide free consultation for the official participants on IPR protection, guide the work on IPR related affairs, coordinate and resolve IPR disputes.

During the Expo, the hot line 12330 set up by the Beijing Municipal IPR Protection Service Center will deal with the complaints and reports about IPR infringement on official participants.

6. On-Site Measures

During the Expo, the Organizer will take measures to prevent the infringement on the IPR of official participants. Apart from the cases allowed by the Chinese laws and regulations, the Organizer shall prohibit anyone from recording and filming the exhibitions, forums and performances of the official participants without permission.

Section 18 Use of the Expo Logos

This document introduces how the official participants may use the Expo logos, the application procedure and matters to be noted. According to Article 26 of the General Regulations of the Beijing Expo 2019, the participants shall not use the name, emblem, flag, mascot and other identifying marks of the Expo in or outside the exhibition area of the participants, either in the forms of billboard, symbols, printed matter, photographs, pictures, electronic pictures or through the Internet, without the approval of the Organizer whether for commercial purposes or not.

At present, the Organizer has obtained registration for the “name”, “theme”, “organizations”, “emblem”, “mascot” and other special identifying marks and copyrights of the Expo.

The Organizer has completed the collection of the designs for the emblem and mascot of the Beijing Expo 2019, and has launched the licensed products designed based on the emblem and mascot.

The Organizer has the right to take all necessary measures to effectively prevent any behavior of using the Expo logos (including logos published and to be published) not compliant with the rules prescribed in this document.

1. Content of the Expo Logos

The Expo logos refer to the Expo name and abbreviations of the Expo name, key words, emblem, mascot, slogan and other identifying marks. For details please refer to the List of Beijing Expo 2019 Logos Available for Use by Application (see Attachment 1).

As the Expo preparation progresses, the Organizer will adjust and update the list timely and will publish the list on the official website of the Expo for reference (www.horti-expo2019.com).

The Organizer shall also timely publish the code of using the Expo logos to provide technical standards and guidance for the use of Expo logos by official participants.

2. The Use of the Expo Logos

The Legal Affairs Department of the Expo Coordination Bureau (hereinafter referred to as the Legal Department) is in charge of managing the application for using Expo logos and receiving reports on infringement.

The Organizer will not charge fees for non-commercial use of the Expo logos. Duration of the free use of this kind is subject to approval by the Organizer, but it shall not go beyond October 7th of 2019 in principle.

2.1 Application for use and the reply

Except for the cases listed in 2.2 of this section, official participants have to fill in the Application Form for the Use of Expo Logos by Official Participants (see Attachment 2) and submit it to the legal department. If the application materials are considered incomplete by the legal department, it will inform the applicants to submit the supplementary materials within the prescribed time limit.

The legal department will register and number the documents that meet the requirements and issue notice of acceptance to the applicants. Within seven workdays upon the issuing the notice of acceptance, the legal department shall reply to the applicants in written or oral forms. The replies may be as follows:

Application approved, and the use is permitted;

Application denied, with reasons explained;

The applicants shall submit supplementary materials.

The reply deadline may not be observed if the legal department fails to reply to the applicants due to false, unclear or incomplete information of the application documents.

The legal department will reply the applicants again within seven working days after receiving the supplement materials.

In case of applicants obtaining the approval through deception or other improper means, or failing to honor the commitments made for the application after obtaining the approval, the legal department has the right to revoke the approval and/or demand that the applicants take remedy measures. The Organizer may reserve the right to claim compensation from the applicants.

2.2 General approval for official participants

Official participants are not required to obtain prior approval from the Organizer for the use of Expo logos for non-commercial purposes, provided that they inform the legal department for record keeping and at the same time satisfy all the following conditions:

The use of logos for the official websites, posters, name cards of the staff, free brochures, conference reports, banners, flags and slogans of the official participants;

The use of logos shall not mislead other people into believing that other business organizations have obtained licensed use of the Expo logos from the Organizer of the Expo;

Comply with the code of use and other regulations prescribed in this document.

Commissioner General of Section of the official participant shall sign the Registration Form for the Use of Expo Logos by Official Participants (see Attachment 3). The participants have up to one week upon using the logos to inform the use to the legal department for record keeping.

2.3 Requirement for using the Expo logos

Official participants shall not use the Expo logos in the following circumstances:

Violating the principles and spirit of the Convention Relating to International Exhibitions or the Chinese laws and regulations and provisions;

Involving promotion of any specific political tendency, religion or ideology;

Involving promotion of specific organizations or individuals;

Involving improper profit-earning activities;

May impede the projects of the Organizer or the implementation and promotion of the projects authorized by the Organizer;

May impair the image of the Beijing Expo 2019, or be a hindrance to the correct understanding of the Expo;

Not in compliance with the code of using the Expo logos;

Other circumstances deemed inappropriate by the Organizer.

2.4 Report on infringement

Official participants, who have found any infringement on the Expo logos, may report to the legal department via contact information listed in this document.

In case of any infringement on the Expo logos, the Organizer shall hold the infringers legally accountable in accordance with relevant laws and regulations.

Section 19 Relevant Legal Documents

This document aims at providing information on Chinese laws and regulations that might involve the official participants during the Beijing Expo 2019.

Organizing the Expo in accordance with laws and regulations is a basic principle of the Chinese government. As the host country of the Beijing Expo 2019, the Chinese government shall abide by the Convention Relating to International Exhibitions and the rules of the Bureau International des Expositions (BIE) and International Association of Horticultural Producers (AIPH).

The Chinese government has compiled, submitted to and passed by the BIE the General Regulations, the Template of the Participation Contracts and No. 1-6 and No. 8-11 of the Special Regulations; and will compile and submit other Special Regulations in due course. In compiling the Special Regulations, the Chinese government strictly abides by the relevant regulations of the BIE and honors the commitments the Chinese government has made.
