Cllr. Fahy expressed his sympathies on the death of Mr. John Morgan, a devoted former employee of Galway County Council. This was seconded by Cllr. Mc.Clearn, both acknowledging him as a sincere and dedicated public official.

The Chief Executive extended his condolences to John’s wife Noreen and the entire Morgan family on behalf of the Management and staff of Galway County Council. He commented on how John was a fine public servant and a gentleman who unfortunately did not get a long time to enjoy his retirement.

Cllr. Kinane made a proposal of sympathy to Breda Ryan of Anthony Ryan’s, acknowledging her contribution to the business community in Galway.

Confirmation of the Minutes of the Monthly Meeting Held on December 18th 2017 3162

Arising from the Minutes, Cllr. Cunniffe requested details of the timeframe for completion of the proposed bus corridor from Parkmore to Leader’s Shop on the Road. He stated that the operating bus companies and commuters along this route are frustrated with the traffic situation and a 15 minute increase in travel time from Tuam to Galway. Cllr. Cunniffe stated that while he is aware that this is a joint project between the City and County Council, he expressed the requirement of the County Council to push for sustainable transport for the County. He requested a full report on this matter, and expressed his disappointment that this issue was not on the Clár for the January Plenary Meeting.

Mr. J. Cullen responded and empathised with the public’s frustration on this matter. He advised that Galway City Council was taking the lead on the project and confirmed that Consultants have been engaged to come up with the preferred options. Galway City Council has submitted a preliminary design for approval to the National Transport Authority and once funding goes through it will go before both Local Authorities for Part 8 planning approval. He explained the complexity of the scheme at the approach to Bothar na dTreabh junction and agreed that he would follow up with the City Council on getting a report released in the meantime.

Cllr. Cunniffe queried if the project could be decoupled so that Galway County Council could proceed with works on the section that falls within its remit.

In his response, Mr. J. Cullen, Director of Services stated that the reality of same is complex and could revert the project back to square one. He confirmed that the Consultants are contracted to the City Council and that further approval would be required from Transport Infrastructure Ireland to separate out the project.

In reply to Cllr. Cuddy’s query regarding the need for Consultants, he advised that the design process which included consultant costs was contained within the overall cost of the scheme that was funded by the Department of Environment.

Ms.V. Loughnane advised the Elected Members that the Planning Unit is proposing to prepare a report to bring before the next Plenary Council meeting to discuss the deferral of Notice under Section 20 (3) (i) and (ii) of the Planning and Development Act 2000 as amended in respect of the Maigh Cuilinn Local Area Plan, for a period of not exceeding five years (i.e.) 5 years from 26th February 2018. She explained that the reason for requesting a deferral is due to the gap between the plan and the upcoming National Planning Framework and the Regional Spatial Economic Strategy.

Cllr. Thomas expressed his concerns regarding the deferral on Plan as there is a need to progress developments in the village and suggested that a Material Alteration be put in place in relation to the Relief Road. Cllr. N. Byrne queried if this deferral was due to a lack of resources. In reply, Ms. V. Loughnane explained that the reason was not resources but to achieve a more structured and co- ordination approach to the planning, so all Local Area Plans would be in line with the timelines of County Development Plan.

Cllr. Kinane raised concerns about the delay in the and Local Area Plans and considers it is a resource issue given the volume of work in making Plans and it could be a worrying trend. Cllr. Welby stated that it was a resource issue as other plans had been previously extended due to resources. He acknowledged however that if it was a matter of aligning to the County Development Plan then Local Area Plans (LAP’s) may then be reviewed every 6 years rather than 10 or more as has been occurring.

Cllr. J. Byrne referred to the Local Area Plan (LAP) that expired in 2011 and he feels that the village is being affected because of same. Cllr. Kinane suggested that if Town Plans are extended then they should be reviewed within 12- 18 months of the original deferral date.

Ms. V. Loughnane indicated that what was before the Members today was to seek their approval to prepare a report on the deferral of the Maigh Cuilinn Local

Area Plan, which will be brought before the next Council Plenary Meeting for their consideration. Ms. V. Loughnane added that the Kinvara LAP would be incorporated as part of the County Development Plan which would be reviewed in 2019.

To Consider the Motion on Illegal Parking (Caravans) 3170

Cllr. G. Finnerty expressed his concerns regarding people taking up residency along the M18. He stated that it is causing huge dissatisfaction amongst the public and there is also a health and safety risk involved from a fire hazard and security perspective. He stated that Transport Infrastructure Ireland (TII) and the Gardaí were invited to attend the January Plenary Meeting, however neither parties attended same. [Written replies noted under Correspondence] In his opinion there is no clear agreement between the TII, An Garda Siochána and Galway County Council as to whom is responsible for this issue. A Cork based company is the only company in Ireland to lift such Caravans and as these Caravans have no registered owner, they are put into storage from between four to six years.

Support on this matter was expressed by Cllr. J. Byrne, Cllr. Fahy and Cllr’s. Finnerty and Donohue who indicated that similar incidents of illegal parking was occurring in Ballinasloe. Cllr. Donohue alluded to the fact that barriers cannot be erected due to Health and Safety issues.

Comh. O Cualáin commented that similar issues arise in the area, albeit more on a seasonal basis. Comh. O’Tuairisg agreed, reiterating the health and safety and lack of sanitation.

Cllr. Roche [current Chair of the Joint Policing Committee (JPC)] concurred and considered that it is a matter of agency roles being determined nationally and that it could be a matter for the JPC to raise also. Cllr. Canning noted that one agency needs to be accountable overall.

Cllr. Welby commented that a policy document is required as there are a number of Local Authority Car Parks being used as Caravan Parks. Cllr. Mc Clearn suggested that surplus lands arising out of Transport Infrastructure Ireland (TII) projects should be sold similar to how the Local Authority approaches this.

Further to discussion it was PROPOSED by Cllr. Healy and SECONDED by Cllr. D. Connolly and AGREED that, the Transport Strategic Policy Committee (SPC) review the need for a Motor Tourism Policy for the County such that, overnight parking be regulated as well as setting out a vision for infrastructure that supports this form of tourism.

In reply to Member queries Mr. J. Cullen stated that there was two issues to hand. The first being the general issue of illegal parking and the second being specific issues regarding lands required for Motorways. The County Council he advised, is restricted under the Housing & Roads Acts and that the Gardai have certain powers. In relation to the issue regarding lands for motorways a Land Disposal Strategy is part of the Compulsory Purchase Order Process.

Cllr. Finnerty requested clarity in relation to the Housing Act and stated that these people residing in Caravans should have proper houses.

It was PROPOSED by Cllr. Finnerty and SECONDED by Cllr. J. Byrne and AGREED that, the following motion to be circulated to all other Local Authorities in Ireland. This Local Authority calls on the Minister for Transport and the Minister for Justice to provide each Local Authority with efficient Bye-laws to deal with illegal

Minutes of Monthly Council Meeting held on 29th January, 2018 NDA (National Disability Authority) Accessible Format parking of caravans and camper vans on public and private roads, right-aways, and non-designated camp sites. Sufficient powers to be given to each Authority to remove and impound illegally parked caravans. And sufficient powers be given to confiscate unclaimed caravans in a timely fashion similar to unclaimed motor vehicles. We request a reply from each Minister by July 1st 2018, so as this issue can become an item on the agenda for the July meeting off Local Authorities.

To consider the Management Report, January 2018 in accordance with Section 136 (2) of the Local Government Act 2001 (as amended). 3171

In response to the report, [SP4] Cllr. Cunniffe asked why the Council was continuing with purchasing new units including in a number of Estates in Tuam, despite a directive from Housing Minister, Mr. Eoghan Murphy, T.D. that Local Authorities should move towards constructing more housing. He requested clarification on the Council’s approach to renovating what they currently own and addressing derelict houses.

Cllr. Killilea commented on the figure of 179 social houses to be delivered in 2018 as presented in report as disappointing and suggested that Galway County Council intensify its social and affordable housing schemes between now and 2021 in order to achieve the 995 target set out in Rebuilding Ireland – Social Housing Targets.

Cllrs J. Byrne, Cllr. Mc Clearns, Cllr N. Byrne and Comh. O’Tuairisg expressed concern that the necessary resources would not be available to the Council to deliver on targets as its budget continues to be cut. Cllr. Healy considered the targets were low and enquired about social housing on the off- shore Islands. Cllr. McClearn and Cllr. Hoade queried the timeframe on reallocation of vacant properties. Cllr. Mc Hugh commented that the level of renovations were not satisfactory, citing Tirboy Tuam as an example.

The SP3 Tourism Promotion was welcomed by Cllr. Kearney and suggested that Galway County Council should seek funding for the recruitment of a designated Tourism Officer given the success from having a dedicated Heritage Officer.

Cllr. Fahy stated that the Diocese of Galway may be willing to donate lands to the Council for the purpose of building new homes. The new Bishop of Galway, Brendan Kelly, should be invited into the Council Chamber at the next monthly meeting. It was PROPOSED by Cllr. Fahy and SECONDED by Cllr. Killilea that Galway County Council invite the new Bishop of Galway Mont. Rev. Dr. Brendan Kelly address the Monthly Meeting of Galway Co. Council Feb/March. It was AGREED that this would be referred to the Corporate Policy Group for consideration.

In response the Chief Executive stated that a number of steps are being put in place to achieve the Social Housing targets as set out and with necessary capital resources being in place he considers targets will be met. The Chief Executive welcomed the suggestion that a Tourism Officer could further advance tourism but the Council has to work within its current resources.

In relation to the SP4 Planning Extension of Time (EOT), he advised that services is in response to issues raised by clients and is introduced in order to reduce reliance of EOT and refocus on seeking further information, in order to deliver improved efficiency in our planning services.

In reply to Councillors queries, Mr. M. Owens, Director of Housing confirmed that the National Social Housing Target 2017-2021 is 995 units which includes construction of houses, purchasing of units that come under new developments under the Part 5 Process and returning voids to occupation. In relation to the target of 179 for the County for 2018 he advised Members that the desire is to achieve 200 and additional resources are being put in place in the Capital Team to deliver this.

Mr. M. Owens acknowledged that the Directive towards construction over acquisition had been issued but, implementing same will take time and that acquisitions continue to play a role in meeting targets.

A total of 27 housing units he advised, will be delivered this year as part of legacy Part 5’s which are included in developments that are now being completed

There is also an application into the Department for funding of 25 derelict properties to be revamped as the turnaround of some rural voids are not economically viable within the Council’s own resources.

Mr. M. Owens in reply to Members’ queries referred to Council’s Strategic Management Plan in place for the delivery of social houses on Islands and that Galway County Council is currently seeking land for same. He further advised that detailed information on new Home Loan Schemes from Local Authorities will be available from the 1st February, 2018 and in respect of query on Garbally Drive, Ballinasloe, he confirmed that this was at Stage 3 approval and is going through the Tender process.

Chief Executive’s Business & Correspondence 3172

The following items of correspondence which were circulated at the meeting were noted: Correspondence from Galway City County dated 12th December 2017 in relation to a resolution calling on the Department of the Environment to prepare legislation regarding the disposal of paint under the Producer Responsibility Initiative similar to the WEE scheme where paint would be brought back to the suppliers and disposed of by the paint companies.

Correspondence from the Department of Transport, Tourism and Sport dated 18th January 2018 acknowledging receipt of Galway County Councils correspondence in relation to the need for improved safety measures to be put in place at Bawnmore.

Correspondence from Tipperary County Council dated 17th January 2018 in relation to the motion calling on the Minister for Environment to amend the legislation with regard to collection of waste as so to allow small operators to provide a service to those who live in remote areas, areas where large vehicles cannot access or were householders have very limited amount of waste and lack storage space for bins. Such small operators should be permitted to meet requirement in relation to pay by weight, by weighing their loads at the point of

disposal. This would facilitate householders, allow the small operators to continue in business and also reduce the likelihood of illegal dumping of waste.

Correspondence from Wexford County Council dated 15th January 2018 in relation to the motion that Wexford County Council would resolve that the guidance issued by the Data Protection Commissioners should not supersede the public interest role of Councillors both to oversee the allocation of housing and that a draft protocol to balance these competing interests be brought forward.

Cathaoirleach’s Business 3173

Cllr. J. Byrne expressed his concern regarding the severe flooding in the Gort area and the importance of the Office of Public Works (OPW) engaging with the County Council. He commented that the Loughrea Municipal District Meetings discussed the road and car damage but that he is today further requesting that Emergency Funding from the Department is sought to address flood damage.

The Cathaoirleach Cllr. Mannion noted the impact of severe weather conditions on the road network throughout the County and made specific reference to the N59 and concurred that Emergency funding be made available. Cllr. Healy agreed and further overlay on N59 was a priority.

Comh. O’Tuairisg made a proposal to set up an Island Committee and requested clarification on the progress.

Cllr. Maher expressed his concern about continued lack of funding to the Council for Roads. The Cathaoirleach advised Members that she was part of a meeting in Dublin in the previous week with Oireachtas Members seeking further funding for Galway County Council.

Cllr. Kinane commented on her first-hand experience of flood waters during Storm Eleanor and referred damage to businesses in . She proposed that resources be put in place to provide additional sandbags and consideration be given on ways to rapidly communicate with communities during flood events as not all had access to social media updates.

Cllr. Cronnelly criticised the amount of money that was given to the County Council by Central Government in the aftermath of Storm Ophelia [circa €200,000]

Cllr. Cuddy enquired as to costs of flood reports for Claregalway and lack of repair on roads in the area to take account of flood risks. Cllr. Finnerty concurred with Members on poor conditions of roads and further expressed concern regarding extensive flooding of farmlands and Church, seeking an update on what Emergency Plans and funding will be put in place.

It was PROPOSED by Cllr. Killilea and SECONDED by Cllr. Kinane that the toilet based in the “shambles” Car Park in Tuam, which is under utilised be moved to Rinville Park Oranmore. Rinville Park is in need of a super-loo that can facilitate a 24hrs a day access given the closure times of the current toilet facilities. The toilets in Tuam is a nearly new one costing in excess of €50,000 and is only used once a year, it also is self-cleaning.

The Cathaoirleach in response to Cllr. Killilea’s remarks, stated that the motion would not be debated and was a matter for discussion at the Tuam Municipal District.

Cllr. Fahy remarked that Galway County Council are not in receipt of adequate funding for roads from Central Government and proposed that the Head of Finance seek a €50m loan for improvement of roads.

Cllr. D. Connolly requested clarification on number of Dog Wardens employed and asked that in lambing season there is a need to ensure increased awareness among dog owners of their responsibilities.

Cllr. Thomas requested clarification on the onus of responsibility for the payment of Call out Charges to Emergency Services and commented on length of time for Irish Water to respond to logged requests for fixing of leaks.

Cllr. Hoade concurred with Cllr. Cuddy’s concerns regarding the flooding issue in Claregalway and requested Emergency Funding to be sought. She commented on the poor condition of the roads and made particular reference to the N84. Cllr. Hoade referenced the Meeting in Dublin with Oireachtas Members [as referred to by Cathaoirleach] underlying the difficulty in sustaining services with limited resources.

Comh. O’Cualáin, Comh. O’Curraoin, Cllr. Noone, Cllr. Healy and Cllr. Donohue concurred with the lack of funding being afforded to Galway County Council in general and specific to necessary road repair and he welcomed funding for Safety and Improvement Works at Nutfield Cross.

Cllr. J. Byrne stated that the OPW will provide pumps for individual houses if given notification.

Cllr. N. Byrne put on record that, the timeline for the variation to the County Development Plan should avoid any public consultation during the Christmas period.

Cllr. Canning suggested that due to the fact that the group from Ballinasloe are present at the meeting that the Ballinasloe Motion on the Agenda should be addressed.

In response to Members Mr. J Cullen, Director of Services stated that, the Islands Committee will be on the Agenda of the Connemara Municipal District Meeting in February. In respect of flooding throughout the County, a very wet winter has been experienced and storms have caused huge coastal damage. Protection of Councils assets was at the forefront of the response.

In relation to South Galway, he advised that there is a flooding plan in place in conjunction with the Office of Public Works (OPW). He acknowledged that recent weather conditions have taken their toll on the roads and Mr.J. Cullen made reference to the Leenane area being particularly affected and emergency funding is being sought for same.

Mr. J Cullen advised that when the public contact Irish Water, a work order is sent to the Local Authority from Irish Water. With regard to the payment of Fire

Service Fees, he stated that it was obligatory for them to attend calls once they are called out, therefore, the parties involved must pay for this service.

Cllr. Kinane, welcomed the Galway 2020 Small Towns Big Ideas schedule of meeting but expressed her disappointment that there was no information meeting being held in Oranmore and that organisers need to continually engage with communities in the County.

“That Galway County Council Under Section 4, City and Council Management Act 1955, Ballinasloe says No Campaign are requesting a resolution that the approved Planning Application for reference 16/1286 is revoked by the County Manger/Chief Executive following the required mandate of 30 Councillors to approve this”

Cllr. Killilea put on record a potential conflict of interest and excused himself from the meeting.

Cllr. Donohue stated that he raised this motion further to the request of the “Ballinasloe says No Campaign’ and welcomed the deputation from Ballinasloe in attendance in the public area at the meeting.

The Meetings Administrator Ms. E. Dolan advised the motion as set out could not be dealt with in the context of procedures at the Meeting and a written reply had been issued in line with Notice of Motion (NOM) procedures prior to the Meeting.

The current legislative provision in respect of the revocation or modification of a planning permission is Section 44 of the Planning and Development Act 2000 (as amended) This sets out the procedure to be followed including serving of notice , receiving submissions etc as well as an appeal provision to An Bord Pleanála

Of particular note is the provision that a planning authority shall neither revoke nor modify a permission under this section unless the development to which the permission relates no longer conforms with the provisions of the Development Plan. The exercising of this function requires careful consideration and can only be initiated in a circumstance where the provisions of the legislation have been met which does not appear to be the case in this instance.

Cllr. Donohue stated that it was in belief the planning decision allowed commercial activity on land that had been zoned agricultural.

Cllr. Burke, Cllr. D. Connolly, Cllr. Broderick. Cllr M. Connolly, and Cllr. M. Finnerty spoke in favour of the Local Action Group and the issues raised with regard to potential negative impact such activity on site could have for the local community, traffic, health and safety and environmental matters. These Members in their comments, concurred that no waste facility should be placed in Ballinasloe in the future, the community of Ballinasloe does not want any waste facility in this area.

Cllr. Broderick pointed out that the planning application was just below the threshold which would require an Environmental Impact Statement. He highlighted that there was concerns in the community as the same developer owns 70+ acres of land next to this site so people are concerned about any future phases. He stated that the public notice for this application was not visible and he has seen applications refused previously for this exact reason.

Cllr. Cunniffe stated that the public needs to be protected and welcomed the action by the Local residents.

In response, the Chief Executive (CE) clarified that there were three elements to the matters raised;

Firstly, Planning Permission: He stated that Galway County Council dealt with the planning application and approved same with conditions. He explained that a third party sought leave to appeal the decision, he assumed this raised concerns around the Environmental Impact Statement and the concern regarding

Secondly, the Waste Permit Application: The CE stated this application is currently before the council for decision, he pointed out that there has been a large number of submissions received in relation to same.

Thirdly, the High Court Order: He explained that the High Court Order regarding Poolboy Landfill did not relate to these lands in question. He stated that the lands in question are outside the Ballinasloe Local Area Plan. He explained that it was up to the Prescribed Body to make an application if they wanted to.

The Chief Executive advised that a revocation of a planning permission could be considered further to specific processes and in the context that it contravene the County Development Plan, and this was not the case in this instance.

Mr. M. Timmins confirmed in reply to Cllr. Burke that, Galway County Council deals with the waste permit application. He explained that there is currently an application with the Council for same and the closing date for submissions was last Thursday, several submissions had been received in relation to same. He advised he would reply directly to Cllr. Connolly on campaigns being undertaken by the Dog Wardens. .

“That Galway County Council would carry out an immediate review of the Housing Objectives in the County Development Plan and that they would be open to receiving submissions on same. The operation of the present objectives are deemed to be too restrictive for One Off Rural House Applications at a time when we have a severs shortage of houses and that clarification be given with regard to the 20 year rule and areas where Local Area Plans have expired and have not been renewed”

The review of the County Development Plan 2015-2021 will commence in the first quarter of next year (2019) with a requirement to having a new County Development Plan in place in the first quarter of 2021 in accordance the legislative timeframes. As part of that process the prescribe bodies, elected representatives and the general public will have an opportunity to put forward their views and comments with respect to all aspects of the Plan including objectives that relate to both urban and rural housing . As previously outlined the Department of Housing, Planning and Local Government have issued a circular with respect to Section 3.2.3 of the Sustainable Rural Housing Guidelines 2005 and Planning Authorities have been advised to await update with respect to this particular section of the guidelines. The current County Development Plan provides criteria that allows consideration for a wide and varied cross section of the existing rural residents for housing in their rural local areas and has been implemented to date with a measured approach taking on board all the environmental and planning considerations in place

Cllr. Cuddy requested clarification from the Planning Office on the 20 year rule. areas where Local Area Plans had expired and had not been renewed Ms. V. Loughnane, replied that the policy is in place and any individual is free to make a planning application and this will then be considered on its merits. If the application is refused, same can be appealed to An Bord Pleanála.

“That Galway County Council and Galway City Council provide this year the necessary financial provision so that the facilities of the Park are available to the many people especially at weekends who use this wonderful facility. I understand that the toilets at this facility are not open to the public between Halloween and Easter at weekends and that we are depending on a local CIS scheme to empty the overflown litter bins during the week. Last week end in particular there was a large number of people

visiting the facility and I have received complaints that the toilets were locked and that the litter bins were completely full”

The written reply is as follows;

Rinville Park is managed by Galway County Council on behalf of both City and County Council and is managed year round, within available resources. A caretaker is employed on a seasonal basis from the end of March to the end of September. The Council would like to acknowledge the continued support of the Community of Oranmore & Maree Employment Scheme (C.O.M.E.S) who operate a part-time presence in Rinville Park all year round. The Council also acknowledges the very positive relationship we have with the Oranmore Community Development Association, sponsors of the Employment Scheme. The support of the Employment Scheme has been very beneficial in relation to the upkeep of the Park for the enjoyment of all who avail of this amenity.

In addition to revenue investment in the day-to-day operation of Rinville Park, the Council has prioritised, under a range of capital schemes, recent upgrades to the toilets and pathways and put in place a Woodland Management Plan. Most recently, the Council has improved disability access in the Park and carried out improvements to the picnic facilities.

Cllr. Kinane expressed her support of the motion. Mr. A. Farrell, Director of Services in further reply to Cllr. Cuddy stated that a Caretaker is employed on a seasonal basis from March to September, however, the Community Employment Scheme employees in partnership with Oranmore Community Development Company, make a huge contribution to the upkeep of the Park. Mr. A. Farrell advised due to the limited budget approved for the maintenance of Renville Park, the resources are prioritised when the Park is most busy from Spring to the end of Summer. He confirmed that 50% of operating costs are recouped from Galway City Council as co-owners of the Park.
