I Should Say, at the Outset of This Function on the Senate Side Of
I should say, at the outset of this function on the Senate side of Parliament House, that my subject today—former Tasmanian premier and Australian prime minister Joseph Lyons—was not all that enamoured with upper houses for much of his political career. As a Labor premier of Tasmania, he stood up to the Tasmanian Legislative Council in the 1920s over its financial powers. On a couple of occasions he even managed to by- pass the Council entirely. (How many prime ministers would like to be able to do that these days?) As well, during Lyons’ first two years as a federal minister in the Scullin Government, he faced strong opposition from the Nationalist Party dominated Senate. But then Joseph Lyons moved to stand with the conservatives in 1931. Thereafter, upper houses became more to his liking. Of course—that’s a long time ago and upper houses today cannot be relied upon so easily to reflect the conservative side of politics. As we know well … I am here to discuss one of Australia’s longest serving and most popular prime ministers. And, yet, it has taken some seventy years to get to a point of acknowledging this in the national record. As I discovered on researching his biography, Lyons has been shoved off to some remote region of forgetfulness— thought of as a prime minister who achieved little and was merely used by stronger forces to win elections. This legacy has stalked the memory of J. A. Lyons—as he was wont to sign on documents. Yet, nothing could be further from the truth. -

J The Last Man: The mutilation ofWilliam Lanne in 1869 and its aftermath Stefan Petrow Regarding the story of King Billy's Head, there are so many versions of it that it might be as well if you sent rhe correct details.! In 1869 William Lanne, the last 'full-blooded' Tasmanian Aboriginal male, died.2 Lying in the Hobart Town General Hospital, his dead body was mutilated by scientists com peting for the right to secure the skeleton. The first mutilation by Dr. William Lodewyk Crowther removed Lanne's head. The second mutilation by Dr. George Stokell and oth ers removed Lanne's hands and feet. After Lanne's burial, Stokell and his colleagues removed Lanne's body from his grave before Crowther and his party could do the same. Lanne's skull and body were never reunited. They were guarded jealously by the respective mutilators in the interests of science. By donating Lanne's skeleton, Crowther wanted to curry favour with the prestigious Royal College of Surgeons in London, while Stokell, anxious to retain his position as house-surgeon at the general hospital, wanted to cultivate good relations with the powerful men associated with the Royal Society of Tasmania. But, perhaps because of the scandal associated with the mutilation, no scientific study of Lanne's skull or skeleton was ever published or, as far as we know, even attempted. -

STATEMENT OF THESIS Few Tasmanians believed education was important in the early years of the twnntieth century, and poverty and conservatism were the most influential forces in society. There was no public pressure to compel politicians to assist the development of education in the State, or to support members of the profession who endeavoured to do so. As a result 7education in Tasmania has been more influenced by politics than by matters of professionL1 concern, and in turn the politicians have been more influenced'by the state of the economy than the needs of the children. Educational leadership was often unproductive because of the lack of political support, and political leadership was not fully productive because its aims were political rather than educational. Poverty and conservatism led to frustration that caused qualified and enthusiastic young teachers to seek higher salaries and a more congenial atmosphere elsewhere, and also created bitterness and resentment of those who were able to implement educational policies, with less dependence , on the state of the economy or the mood of Parliament. -

Fact Sheet 2 THE FIRST COMMONWEALTH PARLIAMENT 1901 FEDERATION AND ’S VOTE THE PEOPLE Overview 1897-1903 Once the Australian Constitution had been accepted by voters in the Australian colonies and enacted as law by British Parliament, the process of putting the new system of federal government into practice began. The Australian colonies were now States of the Commonwealth of Australia, and the office of Governor- General represented the reigning monarch of Britain as Head of the Commonwealth. The first Governor-General of Australia, Lord Hopetoun, proclaimed the Commonwealth of Australia at a special ceremony in Centennial Park, Sydney, 1 January 1901. It was also the Governor-General’s task to commission an interim or caretaker ministry until the Australian people were able to elect their representatives to the newly created Commonwealth Parliament. These interim ministers, with Edmund Barton as Prime Minister, were sworn in as part of the inaugural ceremony at Centennial Park. Over the next 1891 first Constitutional Convention to draft months they organised the first federal election and made a federal constitution arrangements for the opening of the first Commonwealth 1893 Parliament. first ‘people’s convention’ at Corowa 1897 The first federal election delegates elected to a representative Constitutional Convention On Friday 29 March and Saturday 30 (in Queensland and South Australia) voters took part in the first election of 1898-1900 referendums on the Constitution representatives to the Parliament of the Commonwealth of held in all colonies Australia. Chapter Four Dealing with Hung Parliaments The Honourable Michael Field My credentials to speak on this topic are that I was a member of the Tasmanian House of Assembly for more than twenty years, from 1976 until 1997, at various times serving as a minister, Leader of the Opposition and Premier of Tasmania. Especially relevant is that I was the Premier from 1989 to 1992 during the years of the “Labor Green Accord”. In 1989, in a 35-member House of Assembly, Labor won 13 seats, the Greens five seats and the Liberal Party 17 seats. Nearly three years later, under the threat of a No Confidence motion, the House of Assembly was dissolved and, in the subsequent election, Labor received just 28.9 per cent of the vote, the lowest vote Labor had received in Tasmania since 1910. Despite this thrashing, the remaining members of the Parliamentary Labor Party asked me to stay on as Leader of the Opposition. I saw my task as rebuilding our stocks, aiming to put us in a position to win majority government. In 1996, there was, indeed, a massive swing. Labor received more than 40 per cent of the vote. The Liberals continued to govern in a minority. This government was short-lived. In 1998, Labor won a majority under Jim Bacon’s leadership. I retired from the House of Assembly the following year. To put the context in which politics is conducted, I wish to describe some of the increasing pressures facing modern government. The biggest of these is coping with the speed of change. -

Journal of Australasian Mining History, Vol. 15, 2017 Development of Tasmanian water right legislation 1877-1885: a tortuous process By KEITH PRESTON rior to the Australian gold rushes of the 1850s, a right to water was governed by the riparian doctrine, a common law principle of entitlement that was established P in Great Britain during the 15th and 16th centuries.1 Water entitlements were tied to land ownership whereby the occupant could access a watercourse flowing through a landholding or along its boundary. This doctrine was introduced to New South Wales and Van Diemen’s Land in 1828 with the passing of the Australian Courts Act (9 Geo. No. 4) that transferred ‘all laws and statutes in force in the realm of England’.2 The riparian doctrine became part of New South Wales common law following a Supreme Court ruling in 1859.3 During the Californian and Victorian gold rushes, the principle of prior appropriation was established to protect the rights of mining leaseholders on crown land but riparian rights were retained for other users, particularly for irrigation of private land. The principle of prior appropriation was based on first possession, which established priority when later users obtained water from a common source, although these rights could be traded and were a valuable asset in the regulation of water supply to competing claims on mining fields.4 In Tasmania, disputes over water rights between 1881-85 challenged the application of these two doctrines, forcing repeated revision of legislation. The Tasmanian Parliament passed the first gold mining legislation in September 1859, eight years after the first gold rushes in Victoria and New South Wales, which marked the widespread introduction of alluvial mining in Australia. -

But after nearly one hundred years of experience there are some who believe that the most important question is whether our federal system is working and what changes if any should be made to it.
