In 2007, the National Immigration Project of the National Lawyers Guild and Deten- tion Watch Network began collaborating with IDP and FFF to create an expanded curriculum and to present additional trainings. Together, the Deportation 101 team has partnered with community-based groups to train directly affected peo- ple, organizers, and service providers in various parts of the country, including New York, New Jersey, Florida, Massachusetts, Georgia, Maryland, Virginia, District of Columbia, North Carolina, Arkansas, Louisiana, Missis- sippi, Alabama, Florida, Kentucky, Tennessee, South Carolina, Virginia, and West Virginia. About the Curriculum Deportation 101 is an intensive, one to two-day training, accompanied by comprehensive written materials, that offers basics on the detention and deportation system and provides guidance on how to organize com- munities directly impacted by deportation. Created by community organizers, legal experts, and advocates, this curriculum teaches immigrant families, loved ones, and communities how to understand and develop individual and community responses to this system – inside and outside the courts. The Deportation 101 curriculum provides: • overviews of the criminal justice and deportation systems and immigration enforcement programs, • practical tips and advocacy strategies for people facing or at risk of deportation, • local and national resources and referrals, • ideas for addressing the needs of immigrant families and communities, • discussions on current and future organizing strategies, and • analyses of current immigration reform proposals. *Disclaimer* This latest version of the Deportation 101 curriculum was published in May 2010. Later sections in this manual will go into greater detail about how this system works and how to navigate it. Here, we want to provide a general framework to help ground our understanding of some terminology, government actors, and history. We start off with some fundamentals. First, since the immigration system can seem inaccessible due to depor- tation-related jargon, we share a glos- sary of terms. We then take a look at the government systems and depart- ments that deal with detention and deportation. We include a diagram of the branches of federal government to help you understand the different institutions that play a role in deporta- tion. We also include a list of govern- ment actors that immigrants going through deportation often encounter – and their responsibilities. Lastly, we share a timeline to give some historical context for our current political landscape. This timeline gives a snapshot of policies, legislation, and case law that have shaped the current detention and deportation system since 1980. PREN THE YEAR 1965 is often cited as a turning point in the history of US immigra- tion, but what happened in the ensuing years is not well understood. Amend- ments to the Immigration and Nationality Act passed in that year repealed the national origins quotas, which had been enacted during the 1920s in a deliberate attempt to limit the entry of Southern and Eastern European immigrants—or more specifically Jews from the Russian Pale and Catholics from Poland and Italy, groups at the time deemed “unassimilable.” The quo- tas supplemented prohibitions already in place that effectively banned the entry of Asians and Africans. The 1965 amendments were intended to purge immigration law of its racist legacy by replacing the old quotas with a new system that allocated residence visas according to a neutral preference system based on family reunification and labor force needs.T he new system is widely credited with having sparked a shift in the composition of immigration away from Europe toward Asia and Latin America, along with a substantial increase in the number of immigrants. Indeed, after 1965 the number of immigrants entering the country did increase, and the flows did come to be dominated byA sians and Latin Ameri- cans. Although the amendments may have opened the door to greater im- migration from Asia, however, the surge in immigration from Latin America occurred in spite of rather than because of the new system. Countries in the Western Hemisphere had never been included in the national origins quotas, nor was the entry of their residents prohibited as that of Africans and Asians had been.

Illegal immigration is complicated, but it can be resolved. And it must be resolved in a way that upholds both our laws and our highest ideals.”1 – George W. Bush, State of the Union Address, January 28, 2008. Introduction: The Postville Raid It is impossible to overestimate the importance of Postville in contemporary American history and social policy. On May 12, 2008, this tiny Heartland farm town, secluded amid the rolling hills and cornfields of Northern Iowa, became the site of the largest immigration raid in U.S. history.2 Of the 389 people arrested, three quarters were Kaq’chikel ethnic Mayans from the hills of Chimaltenango, Guatemala.3 Only five (1.2%) had minor criminal records.4 Yet they were all arraigned on felony charges of identity theft, making this an unprecedented criminalization of migrant workers. Despite begging to be deported, these Agriprocessors employees were jailed for five to 12 months, while their families suffered severe hardship. A decision made in Washington, D.C. destroyed the livelihood and hopes of hundreds of working families and sank well over a thousand children, from Iowa to Guatemala, deeper into poverty and malnutrition, while serving to perpetuate the generational cycle of labor migration.5 The direct cost of this raid to taxpayers, including prosecution and detention, exceeded 10 million dollars.6 But government expense dwarfed in comparison to the economic impact on the 1 tri-state region.

At the same time, we caution that anecdotes are no substitute for hard data and that our laws and policies must be grounded in analysis of the facts, thoughtful discussion, and practical solutions. For too long, U.S. immigration laws and policies have been shaped by fear and stereotype rather than by empirical evidence. Empirical data shows that immigration is associated with lower crime rates and immigrants are less likely than the native-born to be serious criminals. Yet, we have spent billions of dollars deporting millions of people who have committed only immigration violations, and we have focused on quantity, not quality of deportations, while separating families. There is no doubt that our nation is safer when everyone is accounted for and fully documented.
