This research addresses this question and tests for the effects of institutional linkages between banks and states on the enforcement of these regulations. It is hypothesized here that a bank’s institutional link to its home state is necessary to block attempted enforcement. This research utilizes comparative studies of cases in which enforcement and penalization were attempted, and examines the role of institutional links between the bank and state in these outcomes. The case comparisons include five cases in all, with three comprising positive cases in which enforcement was blocked, and two in which penalty occurred. Combined, these cases control for rival variables such as rule of law, state capacity, iv authoritarianism, and membership of a country in a regulatory body while also testing for the impact of institutional linkage between a bank and its state in the country’s national political economy. -

INTRODUCTION The German statesman Otto von Bismarck once said that “[i]f you like laws and sausages, you should never watch either one being made.”1 The recent enactment of Bill C-32 — the government’s response to the Supreme Court’s February 2007 decision in Charkaoui v. Canada (Citizenship and Immigration)3 — can best be described as a “Bismarckian moment”. An effort to remedy the core defects of the prior immigration security certificate regime, the new law cobbles together a potentially half-hearted “special advocate” regime and converts immigration law into a de facto system of indefinite limits on liberty for foreigners. The new system will generate an inevitable series of new constitutional challenges, some of which may succeed at the Supreme Court unless the deficiencies of Bill C-3 are cured by careful innovation at the Federal Court level. -

Ave NW #341 Washington DC 20015 Email: [email protected] phone 202-363-8602 fax 202 966 5191 Introduction Terrorism depends upon the presence of three primary ingredients: Indoctrination, recruitment and financing. Take away any one of those three ingredients and the chances for success are geometrically reduced. In the nearly two years since the horrific attacks of 9/11, the war on terrorism has been assiduously fought by the US military, intelligence and law enforcement. Besides destroying the base that Al Qaeda used in Afghanistan, the United States has conducted a comprehensive campaign in the United States to arrest, prosecute, deport or jail those suspected of being connected to terrorist cells. The successful prosecution of terrorist cells in Detroit and Buffalo and the announcement of indictments against suspected terrorist cells in Portland, Seattle, northern Virginia, Chicago, Tampa, Brooklyn, and elsewhere have demonstrated the resolve of those on the front line in the battle against terrorism. Dozens of groups, financial conduits and financiers have seen their assets frozen or have been classified as terrorist by the US Government. One of the most sensitive areas of investigation remains the role played by financial entities and non-governmental organizations (ngo’s) connected to or operating under the aegis of the Kingdom of Saudi Arabia. Since the July 24 release of the “Report of the Joint Inquiry into the Terrorist Attacks of September 11, 2001,” the question of what role Saudi Arabia has played in supporting terrorism, particularly Al Qaeda and the 9/11 attacks, has come under increasing scrutiny. -

268 KENNETH R. TIMMERMAN +++ The fact the meeting took place at all was unusual. Somehow, the event had slipped beneath the radar screen of the “mainstream” organizations, who claimed to represent the U.S. Muslim population. These groups worked very hard to monitor U.S. government activities, and had a “war room” style operation to counter remarks about radical Islam wherever they appeared. They regularly smeared journalists and terrorism experts such as Steve Emerson as “anti-Muslim bigots” and “racists.” But Sheikh Mohammad Hisham Kabbani was a fellow Muslim, leader of the Islamic Supreme Council of America. Since 1992, just one year after he arrived in America from his native Lebanon, Sheikh Kabbani had crossed swords with these groups. Until now, however, the blows had fallen within the closeted confines of mosques and Arabic-language media. The State Department invited Sheikh Kabbani to the Jan. 9, 1999 open forum on Islamic extremism precisely because they had learned he did not fear exposing the Saudi-backed Wahhabi lobby and their ties to terrorist groups that were killing Americans and Jews around the world. In his energetic presentation, wearing a scholarly robes, the white turbaned Kabbani warned U.S. officials that an organized effort was underway to hijack the Muslim community in America. It had been launched by Islamic extremists whose goals were totally incompatible with American values, and whose methods in many instances violated American law. These Saudi-backed Muslim organizations “are declaring war against anyone who will not go with them,” and had taken over “more than 80% of the mosques that have been established in the U.S.,” he said. -
