These efforts to hinder significantly or prevent the operator from providing this programming are not only prohibited by 47 U.S.C. 548(b), but are particularly egregious because they are taken against the only terrestrial competitor to Comcast’s cable systems in the areas served by the cable operator. It was only after the Comcast regional sports networks extracted a payment of approximately $2.4 million and a promise to pay even more on an ongoing basis – amounts far in excess of what would have been required by the distribution agreements, was the imminent threat to withhold the services withdrawn. -

SEPTEMBER 2019 KEY CONSUMER TECH TRENDS FOR ENTERTAINMENT INTRODUCTION The Consumer Technology Association (CTA)®, producers of CES®, recently updated its semi-annual U.S. Consumer Sales and Forecasts Report, projecting trends into 2020. Variety Intelligence Platform, a new division of Variety, has highlighted key areas within the report that we think are the most relevant for the entertainment industry as it gears up to enter the next decade. Entertainment finds itself in the midst of digital disruption, which will be amplified once 5G internet begins to hit the mainstream. The trends included here illustrate shifts that are not only changing the consumption of entertainment, but also creating new distribution channels and devices to engage with content. Older systems are being replaced by younger ones more suited to the new environment, but some previous generation systems are still surviving, even if on the decline. Others, like video games, have reinvented themselves and are generating more revenue than ever before. With many elements of the industry changing, one essential thing remains the same: people haven’t stopped wanting to be entertained. This report highlights the main ways this will continue. Sports over-the-top (OTT) provisions have seen to be a profitable area to be a player in with OTT media revenue expected to reach 158.84 billion dollars by 2024, more than double the $67.8 billion generated in 2018. OTT growth is second only to virtual reality in the media industry. However, it is not without its challenges - whilst there are many opportunities arising in this arena, especially due to the current pandemic and the increase in content consumption this has led to, there is the overhanging question of whether this market is a positive one to be part of or if it is the offering too broad with too many subscriptions for the consumer? Will this lead to a consolidation in the market much like the cable industry of yesteryear? OTT platforms have shown positive traits, Caelum Shove said as an example on Medium ‘NBC Sports Gold… focus on functional benefits relevant only to niche sports fans. Not only is this a messaging shift, but also an organizational one. In many cases, subscription sports streaming is the first time these networks have moved into the direct-to-consumer world, forcing the firms to shift priorities, hire new departments, and build new organizational muscles’. This suggests that OTT platforms are not only delivering that extra content for fans but are also providing a boost to the economy through new jobs and revenue streams. Track and Field Pass content that had previously required an NBC Sports Gold subscription is now available on Peacock. The Drake Relays, which were founded over 100 years ago, take place this Saturday in Des Moines, IA, open the coverage at 3 p.m. ET on NBCSN and Peacock, followed by the Oregon Relays from the University of Oregon’s recently renovated Hayward Field at 5 p.m. ET. NBC Sports’ track and field coverage features five U.S.-based events between April 24 and August 21 (schedule below). The track and field schedule for the U.S. Olympic Trials and Tokyo Olympics will be announced in the coming weeks. Kara Goucher, who competed in the 2008 and 2012 Olympics as a long-distance runner, will make her NBC Sports debut as an analyst at this weekend’s meets. Goucher joins host Paul Swangard and analysts four-time Olympic medalist Ato Boldon, and four-time Olympic gold medalist Sanya Richards-Ross.
