Total building site coverage 3.53% of 12C 517 82.23% of portioned development site Required parking 39 Proposed parking 39 BACKGROUND April 24, 2019 (CPA/08/19; item 2.2) – an application for a fuel station and convenience store with associated works was refused for the following reasons: 1. Pursuant to Section 3.02 (b) of The Development Plan 1997, the applicant failed to demonstrate that the gas station in its present location would service the needs of the community. 2. Pursuant to Regulation 13(1)(b) of the Development and Planning Regulations (2018 Revision), the applicant failed to demonstrate that the gas station in its present location would cater principally for the needs of persons resident in, or in the vicinity of, the zone. The Central Planning Authority decision was appealed. On the 6th December 2019 the Planning Appeal Tribunal found CPA: “did not misdirect itself, did not err in law and did not act contrary to the rules of natural justice” The Tribunal further found: 5 1) Having regard to s.13(1)(b) of the Regulations the Appellant failed to meet the relevant tests set out for approval of a project in a Neighbourhood Commercial zone whereby the applicant failed to demonstrate that a gas station in the location of this project would serve the needs of the community. 2) CPA provided adequate reasons setting out how the decision of refusal was arrived at. 3) The National Energy Policy does not override development criteria provided in the Development and Planning Law. 4) The CPA did not act unreasonably in its determination of the matter in accordance with Wednesbury principles of reasonableness. Decision: It was resolved to grant planning permission, subject to the following conditions: Conditions (1-3) listed below shall be met before permit drawings can be submitted to the Department of Planning. 1) The applicant shall submit a Stormwater Management plan designed in accordance with the requirements of the National Roads Authority (NRA) and approved by the Central Planning Authority. The applicant should liaise directly with the NRA in submitting the stormwater management plan. 2) The applicant shall submit a landscape plan which shall be subject to review and approval by the Central Planning Authority. It is suggested that the landscape plan be prepared following the recommendations of the Draft Cayman Islands Landscape Guidelines, found on the Planning Department’s website (www.planning.ky) under Policy Development, Policy Drafts. 3) The applicant shall submit a construction operations plan to the satisfaction of the Director of Planning indicating in sufficient detail how the development will be constructed without interfering with or obstructing adjacent roads, properties and fire lanes. At a minimum, the plan shall indicate the location of material storage, workers parking, site offices, portable toilets, construction fencing and where applicable, the stockpiling of material excavated from the site and material brought to the site for fill purposes. In addition to Building Permit requirements, condition (4) listed below shall be met before a Building Permit can be issued. 4) The applicant shall
