The cure was achieved through the vigorous lifelong exercise of one’s Americanism.”1 He goes on to recount a childhood memory that took place in the early 1920s in New York City when a fellow playmate asked about his religion. Later, he confronted his parents with the question, “What’s my religion?” In response, Morgenthau III was taught the following: “If anyone ever asks you that again, just tell them you’re an American.”2 And that is what he did for much of his life. Had he asked his father, Henry Morgenthau Jr., this same question twenty years later, the answer would likely have been very different. By the end of World War II, Morgenthau Jr. was a leader in the American Jewish establishment, chairman of the United Jewish Appeal, and an aggressive actor in the struggle to save the remaining Jews of Europe. His son understood this change as having “sprung from something hidden deep within his conscience.”3 In reality, Morgenthau was one of many American Jews who underwent a turbulent change in experience of Jewishness in the 1930s and 1940s.

    Visiting Judges Marin K. Levy* Despite the fact that Article III judges hold particular seats on particular courts, the federal system rests on judicial interchangeability. Hundreds of judges “visit” other courts each year and collectively help decide thousands of appeals. Anyone from a retired Supreme Court Justice to a judge from the U.S. Court of International Trade to a district judge from out of circuit may come and hear cases on a given court of appeals. Although much has been written about the structure of the federal courts and the nature of Article III judgeships, little attention has been paid to the phenomenon of “sitting by designation”—how it came to be, how it functions today, and what it reveals about the judiciary more broadly. This Article offers an overdue account of visiting judges. It begins by providing an origin story, showing how the current practice stems from two radically different traditions. The first saw judges as fixed geographically, and allowed for visitors only as a stopgap measure when individual judges fell ill or courts fell into arrears with their cases. The second assumed greater fluidity within the courts, requiring Supreme Court Justices to ride circuit—to visit different regions and act as trial and appellate judges—for the first half of the Court’s history. Reiff, Co-chair This dissertation explores the unique, significant, and sometimes contentious relationship that existed between British Jewish author and activist Israel Zangwill and the Jewish community of the United States of America from 1892-1926 and beyond. Employing a broad definition of prophets and prophecy based on the works of prominent theologians, anthropologists, sociologists, and others, this dissertation argues that Zangwill’s vision of America as a new, diasporic cultural and religious center was so significant that we may reasonably characterize him as a prophet of American Judaism. This dissertation carefully studies Zangwill’s prophecy and the American Jewish reaction to Zangwillian thought to better understand both the nature of Zangwill’s thinking and the American Jewish community’s reception of that thought.
