Citizens for Responsibility and Ethics in Washington ("CREW"), Melanie Sloan, and Jessica Markley bring this complaint before the Federal Election Commission ("FEC") seeking an immediate investigation and enforcement action against Crossroads Grassroots Policy Strategies ("Crossroads GPS") for direct and serious violations of the Federal Election Campaign Act ("FECA"). Complainants 2. Complainant CREW is a non-profit corporation, organized under section 501 (c)(3) of i the Intemal Reyenue Code. CREW is committed to protecting the right of citizens to be informed about the activities of government officials and to ensuring' the integrity of government officials. 1 CREW is dedicated to empowering citizens to have an influential voice in government decisions and in the governmental decision-making process. CREW uses a combination of research, litigation, and advocacy to advance its mission. 3. In furtherance of its mission, CREW seeks to expose unethicaTand illegal conduct of those involved in government. One way CREW does this is by educating citizens regarding the integrity of the electoral process and our system of government. Toward this end, CREW monitors the'campaign finance activities of those who run for federal office and those who make expenditures to influence federal elections, and publicizes those who violate federal campaign finance laws through its website, press releases, and other methods of distribution. CREW also files complaints with the PEG when it discovers violations of the FECA. -

CITIZENS UNITED and Its Effect on Federal Campaign Finance Thomas Ritter Chancellor Honors Project Senior Thesis Faculty Advisor: Dr. John Scheb Spring 2012 1 INTRODUCTION On January 21, 2010, the Supreme Court overturned precedent that would send reverberations throughout the world of campaign finance. Since the early 20th century, Congress had taken great steps in regulating federal campaigns through a variety of methods: limiting contributions so that the wealthy and special interest groups could not create a stranglehold on the electoral process; directives to moderate campaign spending for federal offices; and finally the requirement of full public disclosure of any and all campaign finances in hopes of providing education and fairness to the electoral process.1 One of the biggest restrictive measures amidst the goals of legislative policy-making was the ban of corporate money in the involvement of federal elections. -

Regulatory Framework 1. This cycle has been different because of the Supreme Court’s Citizens United decision of January 2010.1 2. Citizens United struck down provisions of Bipartisan Campaign Reform Act (‘McCain-Fiengold’) of 2002 limiting corporate expenditures on so-called “electioneering communications”: • the Court did not strike down the prohibition against donations directly to candidate’s campaigns • however corporations (i.e. companies and trades unions) can now directly spend their own money on election advertising, which previously would have had to be undertaken by their associated PACs, financed by voluntary contributions2 3. A subsequent Court of Appeals ruling (SpeechNOW.org v FEC)3 held that “contributions to political action committees [so-called ‘Super PACs’] that make only independent expenditures cannot be limited.”4 • the decision did not affect the activities of “527” groups (unregulated by BCRA) which do not advocate the election or defeat of a candidate, but can run issue- advocacy media • reporting and disclosure requirements of FERA and BCRA remain intact5 4. -

Unregulated outside groups are defined for purposes of this report as those permitted to accept unlimited contributions. These include super PACs, which are required to report their donors, and 501(c) groups, which are not. Unregulated groups exclude conventional political action committees (PACs) and the official committees of the national political parties. Calculations of expenditures by outside groups include independent expenditures and electioneering communication expenditures reported to the Federal Election Commission. Calculations do not include communications costs, which represent expenditures by an organization to disseminate messages to its members.
