PNWA INFRASTRUCTURE PROJECTS PNWA supports the following infrastructure projects that enhance the region’s economy and environment NAVIGATION PROJECTS Mouth of the Columbia River Jetties major rehabilitation. Support funding to complete work at the South Jetty. Columbia & Lower Willamette River. Support robust funding to maintain the Lower Columbia River to -43’ and the Mouth of the Columbia River at -55’. Support development, implementation and funding of the 20-year plan to manage sediment on the Lower Columbia River. Columbia River pile dike system. Support rehabilitation of the pile dike system between the Mouth of the Columbia River and Bonneville dam to reduce dredging, increase channel stability, create/maintain beneficial fish habitat, and increase bank protection. Columbia River turning basins. Support federal funding for deepening and maintenance of turning basins, including deepening the Longview Turning Basin and establishment of a federally authorized turning basin at river mile 77. Columbia River anchorages. Support deepening and maintenance of designated federal anchorages. Work with Corps and Coast Guard to support designation of additional anchorage locations as needed. Columbia/Snake River inland locks. Support federal funding for the eight navigation locks on the Columbia Snake River System to fully maintain these projects for maximum efficiency. Snake River navigation. Maintain the navigation channel, river flows, and minimum operating pool as needed for safe and efficient navigation. Columbia/Snake dolphins. Support funding for refurbishment and/or replacement of dolphins located on the inland system. Specific location includes Ft. Rains just above Bonneville Dam. Abandoned and derelict vessels. Support federal funding to assess, remove and dispose of abandoned or derelict vessels that pose a threat to safe and efficient navigation.

IMPROVING FREIGHT CORRIDORS TO BENEFIT THE STATE’S ECONOMY & LOCAL COMMUNITIES FREIGHT MOBILITY STRATEGIC INVESTMENT BOARD 2014 ANNUAL REPORT DEAR FRIENDS OF FREIGHT: Freight Mobility Strategic Investment Board (FMSIB) members include representatives from ports, railroads, the marine sector, trucking, cities, counties, the state, and citizens at large. This representation is key to FMSIB’s success in facilitating partnerships to fund and to build complex projects. Freight movers, like other users of the system, benefit when the state invests in preserving and maintaining our state’s transportation system. For this reason, freight stakeholders are in strong support of a transportation package and can accept increases in fees and taxes if they are directly reinvested into the transportation network. Earlier this year, the Washington Freight Advisory Committee (WFAC), a FMSIB standing subcommittee, partnered with WSDOT in the development of the Washington State Freight Mobility Plan. Among other recommendations, the report urges the state to address the over $1 billion in identified at-grade rail crossing needs in a systematic way. Since its inception, FMSIB has participated in funding 22 grade separations at a total value of $353.5 million. But there remains a tremendous amount of work ahead. Washington State is at a transportation crossroads where new ways of doing business and new forms of partnership are needed. One example is the historic partnership announced by the Ports of Seattle and Tacoma in October 2014 to unify management of the two ports’ marine cargo terminals in a seaport alliance. By joining forces, Seattle and Tacoma will rank as the third-largest container gateway in North America.

NINTH AMENDMENT TO FMC AGREEMENT NO. 009335 THE MARINE TERMINAL DISCUSSION AGREEMENT AND COOPERATIVE WORKING AGREEMENT FOR THE NORTHWEST MARINE TERMINAL ASSOCIATION THIS NINTH AMENDMENT is made and entered into as of .~ ~ 7 , 2016, to FMC Agreement No. 009335, the Marine Terminal Discussion Agreement and Cooperative Working Agreement for the Northwest Marine Terminal Association ("Agreement"). WHEREAS, Article ?(a) of the Agreement states that "Any public or private terminal operator serving interstate and foreign commerce and located within the States of Oregon or Washington shall be eligible to become a Member of this Agreement, upon consent of the majority of the membership, by affixing its signature thereto; and WHEREAS, the Northwest Seaport Alliance ("Alliance") has applied for membership and the Northwest Marine Terminal Association ("NWMTA") fTl e~mbers voted and approved in accordance with the applicable procedures on 4 l£ ,2016, to have the Alliance join the NWMTA; and WHEREAS, Article ?(d) of the Agreement states that "Prompt notice of admission to membership shall be furnished to the Federal Maritime Commission and such admission shall be effective upon the filing of a modification with the Commission"; and WHEREAS, the Port ofTacoma, a member of the NWMT A, has transferred management of its cargo terminals to the Alliance and will have its interests represented adequately by the Alliance and therefore desires to relinquish its membership in the NWMTA; NOW THEREFORE, 1 . The Northwest Seaport Alliance is approved as a new member of NWMTA. A revised Page 20 and 21 is added to Agreement No. 009335-009 showing the Northwest Seaport Alliance as a member of the NWMTA.

INTERLOCAL AGREEMENT Federal Permit Review - Liaison/Staff Biologist THIS INTERLOCAL AGREEMENT ("This Agreement") is between the WASHINGTON PUBLIC PORTS ASSOCIATION, the PORT OF ANACORTES, PORT OF BELLINGHAM, PORT OF EVERETT, PORT OF KALAMA, PORT OF LONGVIEW, PORT OF OLYMPIA, PORT OF PORT ANGELES, PORT OF SEATTLE, PORT OF TACOMA, and PORT OF VANCOUVER USA (sometimes referred to herein individually as a "Party" and collectively as the "Parties"). I. RECITALS WHEREAS, the port districts named above(each a "Port"and collectively, "the Ports") are Washington public port districts created, existing and exercising authority pursuant to Title 53 ROW; and WHEREAS, the Washington Public Ports Association ("WPPA") is a coordinating agency created and existing pursuant to ROW 53.06.030 etseq, and WHEREAS, the Ports each engage in industrial development projects requiring permit review by, or consultations with, the National Marine Fisheries Service and/or the United States Fish and Wildlife Service (respectively, "NMFS" and "USFWS" and collectively "the Services"), each an agency of the United States of America; and WHEREAS, the Services are authorized by Federal law, and have agreed in a Memorandum of Agreement between the Ports and-each Service (the "MOAs", attached as Appendices A & B hereto), to host within their offices a WPPA employee ("Liaison") in the position of a staff biologist("Liaison/Staff Biologist") to assist the Ports to comply with the Endangered Species Act and other authorities or environmental regulations regarding listed species.

The meeting was held remotely in accordance with the Governor’s ‘Stay at Home’ order and Proclamation 20-28. Commissioners Bowman, Calkins, Cho, Felleman, and Steinbrueck were present 1. CALL to ORDER Pursuant to Article IV, Section 8, of the commission bylaws, the meeting convened at 11:00 a.m. to conduct an executive session. 2. EXECUTIVE SESSION pursuant to RCW 42.30.110 The public meeting was immediately recessed to an executive session to discuss three matters relating to litigation/potential litigation/legal risk (RCW 42.30.110(1)(i)) with the intention of reconvening the public session at 12:00 p.m. Following the executive session, which lasted approximately 60 minutes, the public meeting reconvened at 12:00 p.m. Commission President Steinbrueck led the flag salute. 3. APPROVAL of the AGENDA Without objection, the preliminary agenda was approved without revisions. 4. EXECUTIVE DIRECTOR’S REPORT Executive Director Steve Metruck previewed items on the day’s agenda and made announcements. 5. Welcome from your PNWA President Welcome to our 2019 Annual Convention. It’s fitting that we’re gathering and celebrating PNWA’s 85th anniversary here in Vancouver. Fort Vancouver was the Pacific Northwest’s original and foremost trading station, and the furs shipped from here often found their way across the Pacific Ocean to China. The Pacific Northwest is still one of North America’s key gateways to the Pacific Rim, and we still rely on our rivers and ocean to power our economy, in many different ways. It’s always a great pleasure to connect with representatives of so many industries and organizations who share that common bond. PNWA continues to be a respected voice for our diverse interests in our region and the nation’s capital, including the ten new members who joined us in 2019. Our funding and policy priorities remain at the forefront of agency and Congressional leaders’ deliberations. Industry analysts, the news media and– increasingly – the general public are also becoming more aware of the critical importance of our coastal, deepwater and upriver infrastructure, and of PNWA’s role in advocating for these projects. The number of reporters who sought PNWA’s perspective on the recent Bonneville navigation lock outage, for example, demonstrates our reputation. It’s been my great honor and pleasure to serve these past two years as your PNWA President. Thank you all for your support and guidance. Metruck, Executive Director FROM: Sandra Kilroy, Director Maritime Environment & Sustainability Jon Sloan, Sr. Manager, Maritime Environment & Sustainability Laura Wolfe, Environmental Program Manager, Maritime Env. & Sustainability SUBJECT: Interlocal Agreement with Washington Public Ports Association to hire permitting liaison for Endangered Species Act reviews Amount of this request: $0 Total estimated project cost: $300,000 ACTION REQUESTED Request Commission authorization for the Executive Director to execute a five-year Interlocal Agreement (ILA) with the Washington Public Ports Association, Port of Anacortes, Port of Bellingham, Port of Everett, Port of Kalama, Port of Longview, Port of Olympia, Port of Port Angeles, Port of Tacoma, and Port of Vancouver USA (each a “Port” and collectively, “the Ports”) in a form substantially similar to what is attached, with only minor changes approved by counsel for the Port of Seattle. The ILA will require a five-year commitment of up to a total of $300,000, funded annually through the Port’s capital program. No funding is being requested at this time. EXECUTIVE SUMMARY The ILA will cooperatively establish and fund a liaison position with the National Marine Fisheries Service (NMFS) and U.S. Fish and Wildlife Service (USFWS). The liaison will prioritize work on permit applications submitted by ten (10) port districts, including the Port of Seattle, promoting focused document review and project coordination. This will enhance the Ports’ ability to comply with the Endangered Species Act (ESA) and other authorities or environmental regulations regarding listed species in a timely manner.
