7. New Business a) Alderman Seaborn: • The Library has many events happening, that can be viewed at www.grimsby.ca/library. The events include a film on April 6 at 7 p.m. Goodbye Christopher Robin. There is a meditation course on April 9 at 7 p.m. There is physical activity for older adults, Fireplace Lounge at 2 p.m. Please call the Grimsby library if you are interested.

Alderman Johnston • Attended Chair Caslin's State of the Region. The full message is on the Region's website.

Alderman DiFlavio: • Reminder of the West Niagara Second Stage Housing Gallivanting event at Casablanca Winery Inn on April 28. $100/ticket. The proceeds to help women and children dealing with abuse. Dancing, dinner and entertainment and helping a great cause. • This is the time of year when winter sports come to an end. Thanks to all coaches, volunteers and managers for their service to the community. This is a time when we should reflect on all the things the people do in the community to make it better.

Alderman Berry: • The Grimsby Fire Department had a Boot Drive on the weekend. Raised $14,000. Some of the funds will be donated to Canadian Tire Jump Start program for equipment for families that cannot afford to join sports teams.

Alderman Mullins: • Save the date for the Museum Dinner. November 3, 2018. More information will be provided closer to the date.

Mayor Bentley: • The State of the Region included Mayor Eisenberg of Hamilton, which is growing dramatically, as is Grimsby. He talked about the GO Train linking to Hamilton. Our two communities have many things in common. • Softball will be in Grimsby for the 2021 Commonwealth Games. • Les Colpitts, a volunteer in our community passed away today. He coached the Peach Kings for 18 years. Community members like Les make the community a wonderful place to live. He will be missed.

8. Next Meeting a) The next meeting is scheduled for April 16, 2018 at 7:00 p.m. in the Town Hall Council Chambers, 160 Livingston Avenue, Grimsby.

a) Site Plan Application - 10 Windward Drive Mr. F. Kloibhofer, A.J. Clarke & Associates & the principles from Rosebay Construction were in attendance in support of the application. Mr. Kloibhofer noted that the current application is for one tower which is 20 storeys in height. Mr. Kloibhofer stated that the building complies with the zoning height. He noted that the development is now comprised of mixed use, apartment condominiums and townhouses above the commercial component. There will be a total of 233 residential units, 866 sq.m. of commercial, with a total of 363 parking spaces. Committee members had questions about the engineering of the building and streetscape. PD-18-22 Moved by Ald. D. Wilson; Seconded by Ald. J. Johnston; Resolved that Report P.A. 18-10 regarding a revised application for site plan approval by Rosebay Construction Inc. at 10 Windward Drive be received and that the application be approved subject to the conditions outlined in Appendix "A" of this report. Further that a by- law be forwarded to Council for approval that authorizes the Mayor and Clerk to sign the agreement on the Town's behalf following the applicant meeting the conditions of approval to the satisfaction of the Planning Director. CARRIED

b) Facade Improvement Application - 12 Elizabeth Street J. Hogg gave an overview of the application. PD-18-23 Moved by Ald. J. Johnston; Seconded by Ald. D. Wilson; Resolved that Report P.A. 18-08 regarding the recommendation that the Town of Grimsby enter into a Downtown Facade Improvement Grant with Becca Lee Management Inc. at 12 Elizabeth Street, be received; And that the Facade Improvement Grant for 12 Elizabeth Street be approved subject to the following conditions:

a) Minutes of the Grimsby Heritage Advisory Committee Meeting April 3, 2018 PD-18-24 Moved by Member J.D. Finch; Seconded by Member J. Gillespie; Resolved that the properties identified in the memorandum “Heritage Register Update” dated April 3, 2018, and the property at 55 Main Street West be added to the Municipal Heritage Register.” CARRIED PD-18-25 Moved by Ald. J. Johnston; Seconded by Member K. Agnew Resolved that the Planning & Development Committee receive the resolution from the Grimsby Heritage Advisory Committee to the memorandum regarding Section 37, Benefits dated April 3, 2018, and recommend that clause 3c) in the Draft Official Plan Amendment related to Community Benefits be replaced with the following: c) to encourage and ensure the conservation of heritage landscapes and built heritage resources. a) 40 Mile Creek / Elm Street Bridge Gabion Wall Retaining Wall on the Forty Mile Creek south of the Elm Street Bridge The Director noted the 40-year-old stone retaining wall on the west bank of the Forty Mile Creek, south of the Elm Street Bridge has started to fail. Approximately 90% of this wall is located on and owned by the homeowner at 6 Elm Street. We are employing a consultant to propose a design solution to repair the Town's portion of the wall and will also pass this information to the landowner.

The Committee then considered Submission A-06/18 by Cannoleum Inc. to allow a medical marihuana facility with a southerly sideyard setback of 51.4 metres in a Specialty Crop (SC) Zone at 194 Woolverton Road Grimsby.

Correspondence was received from: Town Planning Department - Request conditions.

Mr. Jarod Marcus of IBI Group, Planner for the owner appeared before the Committee to support the application and outlined for the Committee that the operation is to reuse an existing building used as a printing plant. They propose to install a new septic system to service the building. The requested variance is based on setbacks from adjacent lot lines for properties used for residential purposes. The road allowance appears to belong to the adjacent southerly property and therefore they would request that the application be amended to a setback of 31 metres rather than the requested 51.4 metres. There will be no construction as they proposed to only occupy the existing 26000 square foot building.

Mr. Steven Verbeek of Cannoleum Inc. stated that they have to abide to very strict Health Canada criteria and will not grow plants to a flowering stage as this will be a genetic research lab. The plants will not flower and will not produce the odour associated with grow operations and as a result, the plants do not have any street value reducing the attraction for theft and crime.

Mr. Andrew Van Geest, speaking on behalf of the southerly property owners on Woolverton Road questioned whether this could be converted to a full scale growing operation as the industry is changing rapidly.

The Committee then consider Submissions B-01/18 for consent to convey 1923.7 square metres of land (Part 1) for proposed residential dwelling development. Part 2 being 1899.9 square metres of land is to be retained for proposed residential dwelling development.

Correspondence was received from: Town Planning Department - No objections. Town Public Works Department - No objections, request conditions. NPCA - No objections. Dan Costabile & Laureen Damignani Costabile - Objection.

Ms. Cheryl Selig of T. John Consulting Group appeared on behalf of the owner and stated that they agreed with the staff report as the lots will meet all of the zoning requirements. The slope stability report was submitted to the NPCA who have no objection to the consent.

Mr. Dan Costabile of Shoreline Crescent stated his objection as their view of the lake will be obscured due to the two homes on the lots and this will also devalue their home.

Mr. Jamie Vahdat of shoreline Crescent stated that he is not opposed to the severance providing the proposed homes to be built are in keeping with neighborhood and blend in.

On April 28th, the Niagara Regional Labour Council will observe the National Day of Mourning to remember those who have suffered and died on the job. As we remember those who have died in workplace catastrophes, those who have been exposed to toxic substances and those who have been injured due to dangerous work conditions, we rededicate ourselves to fight for safe workplaces.

Therefore, as we approach April 28th, we are requesting that City Council consider and issue a Proclamation with respect to the “National Day of Mourning”. Also, we also invite you, your council and staff to attend The Niagara Regional Day of Mourning Ceremony being held at the Niagara Region Headquarters, 1815 Sir Isacc Brock Way, at 5:15 p.m.

We are also requesting that all flags be flown at HALF-MAST at City Hall on the 28th. As we remember those who have been injured and killed, we must renew our fight for the living and we must organize and mobilize for safe jobs.

Please share this information widely since this is a public event.

Please be advised that, at its meeting of April 9,2018, the Council of The Corporation of the City of Port Colborne resolved as follows:

WHEREAS Port Colborne City Council is aware of concerns in the community that the Niagara Peninsula Conservation Authority (NPCA) has demonstrated an inability to operate as an effective, open and transparent Conservation Authority, that respects its mandate;

AND WHEREAS Port Colborne City Council has lost confidence in the current Board and management of the NPCA;

THEREFORE THE GOUNCIL OF THE CORPORATION OF THE CITY OF PORT COLBORNE RESOLVES AS FOLLOWS:

THAT the City of Port Colborne requests that the Region of Niagara immediately replace board members of the NPCA with members selected by the lower trer municipalities; and

THAT the City of Port Colborne requests that the Region of Niagara establish guidelines for the recruitment, selection, and appointment of individuals to be in place during the next selection of NPCA board members; and

THAT the guidelines be developed with criteria that is based on skillset and be carried out by the lower tier municipalities.

A By-law to authorize the execution of a Downtown Grimsby Façade Improvement Grant Agreement with Becca Lee Management Inc. at 12 Elizabeth Street

Whereas the Council of the Corporation of the Town of Grimsby deems it expedient to enter into a Downtown Grimsby Façade Grant Agreement with Becca Lee Management Inc. at 12Elizabeth Street;

And whereas Section 28(11) of the Planning lcl, R.S.O. 1990, c. P.13 provides that a municipality may enter into an agreement conceming a grant or loan;

And whereas the Council of the Town of Grimsby approved the recommendation of Report P.A. 18-08 at a Council meeting held on April, 16, 2018;

Now therefore the Council of the Corporation of the Town of Grimsby enacts as follows: 1. Entry by the Corporation of the Town of Grimsby into a Downtown Grimsby Façade Improvement Grant Agreement with Becca Lee Management Inc. substantially in the form annexed as Schedule 'A' to this By-Law be and the same is hereby approved and authorized.

2. The Mayor and the Town Clerk are hereby authorized to execute, under corporate seal, a Downtown Grimsby Façade Agreement substantially in the form of Schedule 'A' to this By-Law with Becca Lee Management Inc. and to effect registration of the same on title if such be required and to deliver the same.

3. That this By-Law shall have effect immediately upon final passing'
