KMPS KZOK KJAQ Money Maker 2012-FINAL KMPS-FM 94.1 / KZOK-FM 102.5 / KJAQ-FM 96.5 KMPS / KZOK / KJAQ- MONEY MAKER OFFICIAL RULES NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING. 1. HOW TO ENTER a. These rules govern the Money Maker promotion (the “Promotion”) being conducted by KMPS-FM, KZOK-FM, and KJAQ-FM (collectively the “Station”) beginning on July 14, 2012 at 10:00am Pacific Time (“PT”) and ending on Tuesday November 13, 2012 at 10:59pm PT. b. To participate in the Promotion, you must listen to either KMPS-FM, KZOK-FM, or KJAQ-FM each Monday beginning on July 14, 2012 and ending on Tuesday November 13, 2012 between the hours of 6:00am PT to 11:59pm PT each Monday for the announcement of the location of the “Money Maker” vehicle which displays the “key word of the week”. Upon finding the “Money Maker” vehicle, listeners must text the “key word of the week” to the KMPS short code, 54994. Upon texting in the “key word of the week” one (1) winner will be chosen on the following Tuesday to win a Qualifying Prize upon confirmation of eligibility. At the time of notification for qualifying, the potential prize winner will be required to provide all information requested including their full name, complete address (including zip code), day and evening phone numbers and date of birth in order to be eligible to win. In the event that the selected caller is disconnected or is found to be ineligible, the next eligible text will be a winner. There is no limit to the number of times a listener may attempt to text in to win, but a listener may be a winner only once. There will be up to a total of Fifteen (15) qualifying winners selected during the Promotion dates. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call. Due to delays in the KMPS-FM, KZOK-FM, and KJAQ- FM online streaming of its broadcast signal, listeners to the online stream may not be able to participate in or may be disadvantaged in participating in on-air contests. c. To participate in the Promotion, you may log onto either www.kmps.com, www.kzok.com, or www.jackseattle.com and follow the links and instructions to enter the Promotion and submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth and a valid email address in the online entry form. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the Promotion. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. All entries must be received by 11:59 PT on each Monday during the Promotion dates to be included in that weeks drawing. Entries will not be included in subsequent drawings in the Promotion. d. Participants can submit an unlimited number of entries. 2. ELIGIBILITY RESTRICTIONS a. The Promotion is open to all persons who are 21 years of age or older and who reside in the greater Seattle Metropolitan Area. Employees of the Station, its licensee, the licensee’s parent, subsidiary and affiliated entities, Station’s advertising and promotional agencies, its participating sponsors, other radio stations in the greater Seattle metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited. b. Listeners are eligible to win a prize from KMPS-FM, KZOK-FM, and KJAQ-FM only once every thirty (30) days, and listeners are eligible to win a prize in a Promotion conducted by the Station only once every sixty (60) days if the prize is valued over $600. Only one winner per household is permitted in any Station promotion. c. The winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize. If the winner is a minor, a parent or legal guardian must claim the prize on his or her behalf. d. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. 3. PRIZES PDF created with pdfFactory trial version www.pdffactory.com a. Twenty Five (25) Qualifying Prizes will be awarded in this Promotion. Each prize consists of the following: $1,000 & a “key” which is a raffle ticket. The Approximate Retail Value (“ARV”) of each Qualifying Prize is $1,000.00. b. One (1) Grand Prize will be awarded. The Grand Prize is a vehicle from Fiat of Tacoma: a 2012 Fiat 500 POP. The ARV of the Grand Prize is $17,000. The Station accepts no responsibility for repairing any real or supposed damage to any prize. Grand prize winner will be solely responsible for all car title, tax, tags, proof of insurance and license and registration fees, emissions inspection, freight, delivery, dealer prep, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, all other fees and expenses not specified herein associated with the receipt and use of this prize vehicle. Winner must provide proof of insurance and a valid driver’s license. All obligations must be met before contestant takes possession of the car. The winner will accept the chosen prize vehicle "as is." The Station accepts no responsibility for repairing any real or supposed damage to the prize car from this Promotion. If the Grand Prize is not available at the end of the Promotion, including vehicle color, a substitution of equal or greater value will be made at the Station’s choice. The Station has not made and is not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the Grand Prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle. Any additional car options (including the interior and exterior color of the prize) not specified herein are subject to availability and any costs associated with such options will be the responsibility of the winner. c. The Grand Prize winner is responsible for full maintenance of the vehicle according to owner's manual. The Grand Prize winner is responsible for full insurance coverage and must provide proof of insurance and a valid license at time of delivery. d. Grand Prize winner will be required to furnish legal proof of eligibility, including a valid driver’s license and valid Social Security card, at Muckleshoot Casino 2402 Auburn Way South, Auburn, WA 98002 on Tuesday November 13, 2012 after the Grand Prize Event. Additionally, Grand Prize winner will be required to provide proof that the minimum liability insurance required by vehicle lease has been purchased before vehicle will be released to winner. Unless prohibited by law, acceptance of the prize constitutes permission to use the name, photographs, voices and likenesses for publicity and promotional purposes without further compensation to the winners. The Grand Prize winner will be required to execute an affidavit of eligibility and release. e. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply. 4. WINNER SELECTION AND NOTIFICATION a. Decisions of the Station management with respect to the Promotion are final. b. Each Tuesday, Station will randomly draw one winner from the combined on-line and text entries received that week. A total of fifteen (15) Qualifying Prizes will be awarded from this manner of entry. c. Ten (10) additional Qualifying Prize winners will be selected on site as described in Section 4-d of these Official Rules. For a total of Twenty Five (25) Qualifying Prize winners. d. All Qualifying Prize winners will be invited to attend the Grand Prize Event on Tuesday November 13, 2012 at Muckleshoot Casino 2402 Auburn Way South, Auburn, WA 98002. One (1) Grand Prize winner will be selected from the eligible Qualifying Prize winners. All Qualifying Prize winners must be present to be eligible for the Grand Prize Event. Each Qualifying Prize winner must register and complete all paperwork within ten (10) days of winning. After completing all paperwork with the station, each Qualifying Prize winner must go to Muckleshoot Casino to claim their $1,000.00 Cash Card & raffle ticket within thirty (30) days.
